Background: The Council Economic Development Committee received updates regarding these properties during the fall of 2009. Minutes from those meetings are attached, along with a history of the project including maps, correspondence, photos, code compliance complaints/resolutions, and a corresponding landscape contract. The City Codes Division continues to monitor the situation on a weekly basis: Animal Control is responding to calls for dogs (mainly at 4409 Alpine Way); excessive vegetation has been cited numerous times; debris and junk vehicles have been addressed with abatement; and YPD is monitoring this area for criminal activity under their enforcement efforts. Every effort is underway to strictly enforce the codes in this area. Community and Economic Development continues to explore the potential for reconstruction of some of the properties in the area. Yakima City Council Committee Meeting Counci(Economic Deve(opment Committee Wednesday, December 2, 2009 4:00 p.m. Council Members present: Micah Cawley, Maureen Adkison, Kathy Adkison, Bill Lover Staff: Bill Cook, Michael Morales, Doug Mayo Guests:. Jim Evans, Mike Murphy, Elba Richards Update on 45th Avenue / Alpine Way properties Bill Cook reported that staff is trying to stimulate private interest on five lots that are relatively clear of liens. Ken Harperis working with .one of the private lien holders. If it makes sense financially, many of the City's liens can be removed (there is a fee to remove liens that have been paid). The City is working to establish an automatic notice process to avoid the lengthy review board process on things such as weedy lots. Joe Caruso continues to work on the code compliance issue of vehicle repair in the area. It is hoped that this process can also become more efficient in the near future. Bill Cook reminded the Committee that there is still an option of contacting the irrigation company about allowing property owners additional use of the right of way. There was discussion about the bonding process. Bill Cook said that staff is looking at changing the bond language to include demolition in certain circumstances and updating the language in general. Mike Murphy asked if the. City is working with Memorial Hospital. The committee agreed that would be a good idea and suggested a meeting with Rick Linneweh. The committee thanked the neighbors that were in attendance and emphasized the need to keep moving forward on the issue. Legislative Priorities Michael Morales briefly described the draft list of 2010 Legislative Priorities. These will be presented to the full Council on December 10, and they will have an opportunity to provide additional input. Kathy Coffey said she hopes the City will make North First Street a City priority and would adding it to the legislative priority list be a good first step. It was determined that the best first step would be a study that would help create a plan. Michael Morales will work on. securing a SIED planning grant for the study. Old City Jail Kathy Coffey presented an idea about preserving some of the old jail space on the third and fourth floors of City Hall. It might be possible to recreate a jail cell in the Yakima Valley Museum or maybe even preserve some of the space as a .museum. A bid to have most of the old equipment removed is set to go out in January, so there isn't a lot of time to spare. The next regularly scheduled meeting of the Council Economic Development Committee will be Wednesday, January 6, 2010, at 4:00 p.m. The agenda will include updates on the 45th Avenue / Alpine Way project and legislative priorities, further discussion about the old City jail, information about new residential sprinkler regulations and discussion regarding pending stormwater construction ordinances. Micah Cawley, Chair Date Yakima C ty£Council Committee l Ieeting,: Council -Economic Development Committee Wednesday, November 4, 2009 4:00 p.m. ' Members present: Micah Cawley, Maureen Adkison Staff: Bill Cook, Michael Morales, Joe Caruso, Bruce Benson Status of Renewal Community Tax Break Program (CRD) Michael Morales reported that recommendations for the annual allocations are scheduled to go to Council on November 17. The applications thus far total slightly less than $12 million. We are still waiting to see if the program will be extended into 2010 or beyond. Update on 45th Avenue / Alpine Way properties Bill Cook reported that litigation reports have been received on every parcel in the subdivision. The reports affirm that there are many liens still in place. Staff is trying to stimulate private interest on the six lots that are relatively clear. He noted that some of the City Hens have actually been paid off. However a lien will continue to show against a property until the holder of the lien removes it, and the cost of removing a lien has increased dramatically in recent years. It is possible that some of the liens placed by other individuals and organizations have also been paid, but the lien has not been removed from the record. The City will complete the. procedures necessary to remove the City liens that have been paid. Mr. Opfer commented about an untended poplar tree at the previous meeting. Bill Cook said that the City's arborist examined the tree and said it is healthy; leaving the City without ' a basis to remove it at this time. Joe Caruso reported on the status of various code compliance complaints. He said there ' may be an action coming before Council to consider a change to the bond language to allow demolition in some circumstances. 1 Councilmember Cawley said that he appreciates the work and noted that everyone is doing what they can in this complicated situation. 1 Requested Annexation Bruce Benson reported that the City has received a request to tie some additional property, known as the Ziegler: property, into the current Foursquare Church / Hochrein annexation request. The Committee approved the request to go forward to the full Council and recommended approval. The next regularly scheduled meeting of the Council Economic Development Committee will be Wednesday, December 2, 2009, at 4:00 p.m. The agenda will include an update on the 45th Avenue / Alpine Way project. Micah Cawley, Chair Date Yakima CityrCouncil` CommitteemMeeting Council -Economic Development Committee Wednesday, October 7, 2009 4:00 p.m. Members present: Micah Cawley, Maureen Adkison, Rick Ensey Staff: Bill Cook, Michael Morales, Jeff Cutter Status of Renewal Community Tax Break Program (CRD) Michael Morales reported that the status of the annual allocations is delayed while we wait for the outcome on the question of the extension of benefits. Some projects have also been delayed by economic circumstances. We hope to know if there will be an extension by early November and will update the Committee at that time. Applications will be accepted through the end of October. Update on 45th Avenue / Alpine Way properties Bill Cook presented an assortment of options: 1. If the City were to purchase the four properties that are in question, the worst case price scenario for the entire project would be $650,000. 2. Condemnation requirements are clearly spelled out by state law and the conditions of the vacant house do not meet those requirements at this time. 3. It may be possible to obtain a standing weedy lot clean up order next year. The weedy lot season is April 1 to October 1. 4. The city could act as an intermediary to help negotiate or propose solutions with various parties to the lawsuits and liens. 5. The city could act as an intermediary to help private developers purchase the nine buildable lots. 6. The city could negotiate a license agreement with Yakima Valley Canal Company. 7. The city could remove the landscaping improvements if they are bothersome. Councilmember Cawley asked about the process of title searches for the parcels. Jeff Cutter said that a litigation report will identify the claims against the property, and additional research can be done to try to obtain all the details. Jeanne Crawford commented on the boarded up house, the canal and the general appearance of the area. She hopes that some of the options will be used to improve the situation. Bill Cook reported that the boarded up house has not been deemed dangerous, so the city cannot demolish it. However, it is not currently habitable. He also said that Yakima County records show no property tax delinquencies of more than one year on the Tots in question. Art Opfer commented on pet waste, site screening, and an untended poplar tree, and said there are Targe amounts of concrete buried on one or more of the lots. Councilmember Cawley asked Bill Cook to find out who owns the lot in question to see if the poplar tree can be removed. Jim Evans asked about bonds, the permitting process, compaction reports and blamed the situation on the failure of code enforcement and building inspectors. He does not think the city should purchase the homes or lots. Michael Morales furnished a Public Disclosure Request form to Mr. Evans to facilitate his request for documents. Councilmember Cawley thanked staff for their work and ideas. He requested that staff begin work on the title search process. He would like to consider condemnation only as a last resort. Councilmember Ensey supported the concept of working with private developers and working to negotiate the liens and lawsuits. He also stated that we need to enforce code compliance on all lots. He does not approve of the city purchasing any of the properties. Councilmember Adkison assured the neighbors that Council shares their concerns and will continue to pursue improvements. In summation, Councilmember Cawley said the Committee is not in favor of property acquisition or condemnation. Sawmill Site Two citizens presented information to the Committee in regard to proposed future development at the old Boise Cascade site. They would like to see a working sawmill museum as part of a Targe center that could also include retail, restaurants, an aquatic center and nature paths that would connect to the Yakima Greenway. They see this project as a great opportunity for a public/private partnership. The next regularly scheduled meeting of the Council Economic Development Committee will be Wednesday, November 4, 2009, at 4:00 p.m. The agenda will include an update on the 45th Avenue / Alpine Way project and an update on the CRD. Micah Cawley, Chair Date MEMORANDUM DATE: _ . August 27, 2009 TO: Honorable Mayor and Councilmembers Dick Zais, City Manager FROM'. William Cook, Director of Community and Economic Development SUBJECT: Response to citizen complaints regarding code issues at the "Doty" property BACKGROUND Beginning in August 2002, the City of Yakima received three adjacent short plats of five, five and nine lots for a total of nineteen parcels (Attachment 1). The significance of this development being submitted as three short plats is that under state law; a short plat is approved administratively and is not subject to a Hearing Examiner public review and comment process. Also, the City's interpretation of state law at that time was that a short plat was categorically exempt from review under the State Environmental Policy Act (SEPA), and therefore no public "environmental" process was required. Only long plats of morethan nine lots triggered a SEPA review and a public hearing before the Hearing Examiner. Throughout the period 2003 through 2006, the City issued permits for thirteen structures that were relocated to the site from the neighborhood adjacent to Memorial Hospital. By March 2006, nine of these structures were occupied, had passed all building inspections and secured a certificate of occupancy. Three of the four unoccupied structures were eventually. demolished under orders from the City's Building Official with the approval of Yakima County Superior Court. One house, 4408 Alpine Way, has never been occupied at its current location. However, it has not reached a condition of deterioration to support a demolition action by the City. We have, on at least two occasions, requested an engineer's review of 4408 Alpine Way to determine if its condition has changed to such a degree that it has become a dangerous building. As of two weeks ago, no such significant change had occurred. From time to time, beginning in 2003, my office has sent out correspondence to neighbors on the status of work (during construction) and reports to Council on project status and code enforcement activities. A sample of these letters and reports to Council are attached for your information (Attachment 2). RESPONSE TO CITIZEN'S COMPLAINTS OF AUGUST 18, 2009 Summary of complaints taken from 8/18/09 Council meeting minutes: "Bill Bosch, 116 N. 45th Avenue, gave a Power Point presentation on the property located between 44th and 45th Avenues. The presentation showed the deterioration of the property over the years. Elba Richards, 4308 Marylin Drive, complained about drainage and refuse problems related to the subject property_ Jim Evans, 4405 Summitview, also complained about the problems with the property, claiming the responsibility for the failure of the 1 project belongs to both the City of Yakima and Memorial Hospital. Jean Crawford, Ed Cunnington, and Art Opfer also expressed their frustration with the condition of the property and the impact on their neighborhood_ It was requested that a status report be given on property liens and what is being done to rectify the problem. A commitment was made to provide a report at the September 1, 2009, City Council meeting." 1. Drainage problems: It isnot entirely clear where the drainage issue is, and we will contact Elba Richards to discuss the problem further. However, we have attached a photo of the property line (Attachment 3) between the Doty project (on the right in the photo) and the Richards' yard and fence. The photo suggests an elevation difference between the two lots, with the Doty property higher in elevation. It is quite possible that fill was added to the lot on the right which could have altered the natural drainage pattern. Unfortunately if this was done, it was probably done six or seven years ago and we have no record of a permit to add the fill. We were unaware of a complaint until now that the natural drainage pattern of the area had been altered. If and when a building permit is applied for on that lot, it is possible we could request some regrading of the area. Sod or planting would also help absorb runoff. 2. Refuse: All occupied properties in this subdivision have refuse service with the exception of 4405 Alpine Way. Please refer to the attached memo from Pete Hobbs, Utility Services Manager (Attachment 4). 3. Condition of property: Our records indicate a long and varied history of complaints and violation notices for properties in the subdivision (Attachments 5-12). To date, the City has filed liens to recover costs on code compliance actions totaling $39,469.47. To be fair, many of these liens were before and during construction work and do not reflect the current condition of many of the occupied homes in the subdivision. However, the City has demolished three structures to date. The main problem area today seems to be Alpine Way, and other than the boarded -up house at 4808 Alpine Way, as noted previously, the issues seem to be the condition of yards, trash and vehicles being repaired in the right-of- way. The occupied structures on the north side of Alpine Way have a unique problem in that they have no private back yard, no garage, and an irrigation canal easement across the back of the property that does not allow storage shed or other structures. One property has solved this problem with a fence close to the house, but this seems to leave the remainder of the yard north of the fence untended. Next door to the east, lawn furniture, outdoor children's toys, tires and other items that would generally be inside a garage or hidden behind a back yard fence are visible to the public. It was in an effort to screen this area that, the Office of Neighborhood Development Services (ONDS) contracted with Colonial Lawn and Garden in 2006 to plant arborvitae on the City's right of way, install sprinklers and plant grass on the north side of the Congdon irrigation canal. This was done under an agreement (Attachment 13) that required the property owners to maintain the lawn and take over full responsibility for the irrigation system and all plantings by June 1, 2011. The source of funds was non-federal. These funds come from the repayment of state funded low-income housing mortgages made within the City of Yakima in the 1990's. These dollars are not federal CDBG or HOME funds and they are not general fund (tax) revenues. 4. Status of property liens and lawsuits: It is important to note that there is no one place to go to find a recording of all liens and lawsuits against this property. The parties of record who have interest in the potential sale of lots in the subdivision numbers at least eight for the boarded -up house at 4408 Alpine Way, as recorded in the Yakima County Assessor's office (Attachment 14). We do know that the City at one time held performance bonds for the completion of the public improvements (streets, sidewalks, paving and street lights) in this subdivision totaling $75,296.84. The public infrastructure was completed to City standards, and the cash bond was deposited with the courts on August 20, 2004, pursuant to an order by Superior Court Judge James P. Hutton. The City also held $30,000 in cash bonds as security to assure the finalization of improvements to structures moved onto the site from Memorial Hospital. In December 2008, the City released these funds to Superior Court, as well, and Judge Blaine G. Gibson granted an order discharging the City from any further responsibility to any of the bond claimants. During the period of November 2002 through July 2007, the City also recorded liens against the property totaling $39,469.47 for the cost of cleanup, temporary fencing and demolition of three structures. In June 2008, the City received a partial repayment on these liens from Yakima County_ The repayment represented surplus funds for the sale of 4401 Alpine Way. See attached spreadsheet and correspondence from Senior Assistant City Attorney Helen Harvey dated June 12, 2008, for additional details (Attachment 15). The City's liens have been cleared on all but three parcels: 4400 Alpine Way 4404 Alpine Way 4408 Alpine Way $ 8,474.87 $ 8,390.92 $ 324.57 Total $17,190.36 In the absence of updated title reports, the amount of private liens recorded on these properties is unknown. The cost of a title report is approximately $200 per parcel and may not be conclusive. It is likely, however, that the bigger financial and legal uncertainties for many of the lots within this subdivision come as a result of a lawsuit filed by John Naiden, M.D., against Jude Doty. The State of Washington Department of Labor and Industries and others have joined in this lawsuit. The damages that may be awarded in this lawsuit are not capable of accurate determination at this time and will ultimately be established by the court. Any market interest in the properties will likely be thwarted by the cloud of this lawsuit and recorded liens which must be resolved before marketable title can be realized. Yet market forces to acquire and build new homes on the vacant lots is precisely what is missing to resolve neighborhood concerns and to finish this subdivision in the way it should have been built from the beginning. The surrounding neighborhood fabric is healthy. Similar lots. in this neighborhood with utilities and urban infrastructure appraise at approximately $45,000 each. With nine vacant buildable lots still available, and one vacant house, the value of the developable property should be close to $450,000. Current Status 1. Subdivisions were designed and approved to City standards. 2. Subdivision streets and public utilities were approved and built to City standards. 3. Nine homes that were moved are occupied. All were permitted, inspected and approved pursuant to City building code. 4. Four structures were moved with City permits but were never completed to City code standards. Three have been demolished by the City and liens were recorded. One structure remains boarded -up, but in compliance with the City's code. 5. Nine buildable lots remain vacant. 6. A lawsuit by John Naiden demanding judgment "in an amount to be proven at trial" was filed in June 2003. 7. A counter lawsuit filed by Jude Doty for $400,000 plus an unspecified amount of damages was filed in October 2004. 8. As of June 18, 2004,.the Department of Labor and Industries made demand against Mr. Doty for $110,445.76. 9.. The City's outstanding liens for code enforcement total $17,190.36. 10. Dear Neighbors: Since the last neighbor mailing on July 25, 2003, the City of Yakima is aware of only minimal activity on the Jude Doty construction site. In particular, Nob Hill Water has started to install water main lines starting at 45th & Summitview and down 45th to Barge. Nob Hill Water contacted the City of Yakima today to advise us that they will be starting work again on this site possibly tomorrow and should complete their work at the end of next week. As you likely recall, Mr. Doty stated at the July 9, 2003, meeting at the Allied Arts building, that the infrastructure would be completed in 60 days and some structures would be ready for sale in 90 days. To this date, 48 days have passed since that meeting. The City of Yakima has initiated another Superior Court hearing date on September 2, 2003, at 9:00 A.M. before the Honorable Michael E. Schwab to address the status of the project. Dear Neighbors: Since the last neighborhood mailing on August 26, 2003, there has been a substantial amount of progress. Nob Hill Water notified the City of Yakima that they completed the water mains and fire hydrants at this location on October 9, 2003. Notified by the City of Yakima Engineering department, that Ken Leingang Construction was 95% completed with all sewer work and retention tanks. On October 16, 2003, the City of Yakima scheduled to have a structural engineer meet city staff on site to evaluate a structure that sustained structural damages during the house move process with a report to follow on stability and the rebuilding process. The structure that was on steel on the northwest comer of the property is currently being placed on a foundation. According to Mr. Doty today, he stated that the electric for lighting is next and then the grading of the property and finishing up with sidewalks, gutters and paving of the roadways. The paving of N. 45th Avenue and both cul-de-sacs have been completed. The sidewalks along N. 45th Avenue has been scheduled a few times but inclement weather has held that up. The sidewalk areas have been graded and hopefully the weather will have a few more days acceptable to complete this. A Notice of Illegal Conditions was sent out to all owners of 4400 and 4404 Alpine Way to remove all household garbage, wood debris and cement. Also, one of the structures had a porch roof that was pulling away from the structure, along with severe deteriorating floor decking. A Hearing for the Community Review Board was held on March 15, 2006 with the Board's Summary of Decision to "immediately remove" the porch roof and decking due to the "imminent danger" The debris was also ordered to be removed, but had a 30 day appeal process according to the ordinance. The City of Yakima sent three contractors to evaluate and give estimates to complete this work. The owners of 4400 and 4404 Alpine Way hired the contractor, who was awarded the job, and the City of Yakima did not have to be involved in this cleanup Both sites were completely cleaned of all cement and construction debris and the dangerous porch roof and deck were removed. All fencing panels were taken down and removed from the site. We have been advised that there are still legal issues being held with ownership and this is what is holding up on further progress. Hopefully, the meeting was an informational tool for the residents and the City of Yakima. An abundance of information was exchanged and the direction of the project was discussed at length. It was also mentioned by a neighbor that the intersection of 45th & Summitview Avenue was a dangerous intersection because of many accidents. The City of Yakima has checked with the records bureau and there have been six accidents at this location between the time span of 01-01-98 and 01-31-03. Project owner, Jude Doty, explained where the project was and what direction the project would move to. Mr. Doty stated that he has retained Columbia Asphalt & Gravel to oversee the project and to act as a general contractor. Hestated that the project has been surveyed and staked for road alignment and the road grading process has started. Mr. Doty also stated that Ken Leingang Excavating has been awarded the contract to install sewers and the necessary connections. Leingang Excavating has at this time installed multiple lengths of sewer piping and side sewers connections. The sewer work has stopped temporarily due to power poles on site that are in the area of the new sewers. Mr. Doty stated that the power company was scheduled to remove the poles in a few days. The City of Yakima independently contacted the power company and inquired about the power poles that were holding up the progressive sewer work. The City of Yakima was advised that Mr. Doty has prepaid for this work to be completed and it was scheduled for approximately 07-26-03. Once the electric pole is removed, the sewer work can continue. Mr. Doty also stated that he would not personally direct in the renovations of the inside and outsides of the structures. He has hired out two groups to complete these phases. Upon being asked for a timeline, Mr. Doty stated that the infrastructure would be completed by sixty days and houses would be ready for sale in ninety days, but not all the houses. The City of Yakima has also independently contacted Nob Hill Water and they stated that they were also prepaid and they were waiting for Columbia Gravel to contact them to start installing water mains on the site. Responded with Labor & Industry's electrical inspector to have illegal electric disconnected and to advise Mr. Doty that these structures were unsafe for occupancy at this gime. • JAN. 27, 2003 Received numerous neighbor complaints due to excessive mud track out onto streets and water runoff from this project due to excessive rains and snow. Dept. of Ecology responded with the City of Yakima to advise contractor that excessive mud track out and runoff must be addressed before any other structures could be moved to this site. • FEB. 26, 2003 Scheduled meeting between Jude Doty, partner Dr. John Naiden, city assigned attorney Ken Harper, Doug Maples and Joe Caruso. Meeting necessary due to numerous neighborhood complaints of trespassing and activities in the opened structures. Responsibles were advised to have the site and structures secured and blocked off from unauthorized illegal entry. • APR. 7, 2003 Site inspection conducted by City of Yakima and found structures open and numerous dangerous conditions. Notice of Non Compliance served to owner with several days to comply. • APR 16, 2003 City of Yakima authorized city contractor to install fencing securing site from dangerous conditions that were not addressed by owner by the abatement date on the Notice ofNon-Compliance. • JULY 9, 2003 The City of Yakima held a neighborhood open meeting at the Allied Arts building to discuss the direction of the project due to non activity for a several months. Mr. Doty spoke at the meeting and stated that he would have the infrastructure completed in 60 days and houses for sale in 90 days. The project has basically been at a standstill, other than the several structures that have been currently occupied. Currently, there are 19 parcels on this project. Nine (9) structures are occupied, all of which have passed inspections for their Certificate of Occupancy. There were four (4) structures that were not occupied and did not get to an inspection level due to those structures needing additional work. On February 9, 2006, the structures located at 4401- 440 and 4404 Alpine Way were placarded as "Dangerous Buildings'' . by the City of Yakima due to the structures having broken windows and damages that would allow unauthorized illegal entry. As these buildings were declared Dangerous, the owners of these properties were notified to have these structures boarded up according to the City of Yakima's "Vacant Building Ordinance", and they were. Recently, the City of Yakima had a second inspection conducted by a certified structural engineer, due to the rapid deterioration of this structure located at 4401 Alpine Way. It was the opinion of the structural engineer, that the house had sustained an extreme amount of damages. Also, the report stated that this house is extremely unsafe in this condition. On February 24, 2006, the City of Yakima petitioned the Yakima County Superior Court for an " Order to Demolish". After the order was obtained, on Saturday February 25, 2006, a certified contractor removed a ceiling in one room that contained asbestos. On February 27, 2006, a demolition contractor razed the structure and that parcel was totally cleared of all debris. Also, the structures located at 4400 and 4404 Alpine Way had a structural engineer inspect these and they were found not to be compromised to meet the criteria to have them demolished due to structural instability. It is the intention of the City of Yakima to have the fencing panels. taken down and the immediate area surrounding the structures cleared of any construction debris.
