Councilmember Mendez had stated that it was previously agreed that their rates would be the same as City pools for City residents. In addition, Councilmember Hill asked for a report on the contract commitments that were made for the YMCA project. Current pool fees are listed below comparing the City to the YMCA. However, it is reasonable to expect that the fees of the YMCA would be slightly higher than that of the City's due to it being a new facility offering more amenities to its customers. It should be noted, that it was never agreed upon that the fees of the new YMCA Aquatic Center equal that of the City's fee schedule. The higher fee for the YMCA is acceptable in accordance to the Operating Agreement between the City and YMCA. Section 6.1 of the Operating Agreement - Use of Aquatic Center During the Term of this Agreement, the Aquatic Center during all times of operation and for all programs conducted herein will be made available for use and participation by the public on a fee-per-use basis in accordance with the same rules, policies, and hours of use of the Aquatic Center and its programs are made available by the YMCA for the YMCA's members. The fees charged by the YMCA for public (i.e, non-YMCA member) use of the Aquatic Center and participation in the Aquatic Center's programs will be set by the YMCA after consultation with the City and must be commercially reasonable in amount and generally consistent with the fees for public use charged by facilities of similar size and scope to the Aquatic Center that are located elsewhere in Washington state for the corresponding use and program participation. The following obligations have been provided in order to address Councilmember Hill's request for contract commitments of the YMCA: • The aquatic center will be managed, operated and maintained by the YMCA in accordance with operating standards consistent with industry and mutually agreed upon standards. • Minimal operating hours: Monday through Friday 6:00 am to 9:00 pm Saturday 7:00 am to 7:00 pm Sunday 12:00 pm to 6:00 pm 4 • Programming at the Aquatic Center shall include water aerobics classes, swim lessons, masters swim instruction, private swim lessons, senior water aerobics classes, arthritis and therapy group classes, birthday parties, lifeguard training certification, swim meets, open lap swimming, aqua dance, water walking classes and other group fitness with the use of a lap pool, therapy pool and family/children's pool. By all counts, it appears that the YMCA is meeting its obligations in accordance with the Operating Agreement with the City that went into effect on October 27, 2015. 5 Informational Memorandum Date: January 23, 2020 To Honorable Mayor, Members of City Council, and Interim City anager From: Scott Schafer, Public Works Director Alvie Maxey, Yakima Transit Division Manager Subject: Special Route to YMCA Aquatics Center and SOZO Sports Complex Yakima City Council recently requested that Yakima Transit investigate the possibility of creating a direct bus route that transports residents who live in the east side of our community to and from the YMCA Aquatics Center and the SOZO Sports Complex. City Council also requested that Yakima Transit investigate the creation of a bus service or program that specifically accommodates children/youth who want to travel directly to and from the YMCA Aquatics Center at no cost, or with a voucher. The Federal Transit Association (FTA) Region 10 Office has indicated to Yakima Transit that the creation of a bus route which exclusively transports east side residents directly to and from the YMCA Aquatics Center and the SOZO Sports Complex risks violation of Federal Title VI regulations. Officials from the FTA Region 10 Office warned that providing an exclusive service to a specific demographic such as this, would violate Federal Title VI regulations which prohibits discrimination based on Race, Color or National Origin in regard to public transportation. FTA officials also added that utilizing federal assets to provide transportation for only one group would be a violation of Title VI. To summarize, Yakima Transit is prohibited from providing special or preferential services to select members of our community, while excluding or severely limiting the availability of such a service to others. Yakima Transit is obligated to operate our public transportation system in a manner that is fair and equitable for all passengers. In order to avoid violating Title VI regulations, Charter Rules, and/or repercussions relating to discriminatory practices, we are proposing that the newly opened YMCA Aquatics Center be included in our free summer"Bus to Pools" program to satisfy City Council's request. This successful program has been available for the past few years to all Transit passengers for approximately two and a half months during the summer. As children/youth are generally out of school during the summer months, this program is highly utilized and does not exclusively serve select members of our community or exclude others. However, for the YMCA Aquatics Center to be included in the Bus to Pools program, this would require the YMCA to actively partner with Yakima Transit just as the Parks and Recreation staff currently do. Yakima Transit will reach out to YMCA officials to coordinate efforts. 6 To summarize, Yakima Transit fixed route service must utilize established bus stops and operate on established bus routes which are advertised and available for the use of all passengers within our system. Yakima Transit is not to provide exclusive or special trips to select individuals or groups, or endeavor to create routes which intentionally or unintentionally, exclude access to some of the riding public while providing preferential services to others as this may jeopardize federal funding and place the City out of compliance with FTA. The Court Adjudicates all traffic infractions, misdemeanors, and gross misdemeanors cited in the City. The Court operates with two full time Judges, one of whom provides over the Courts activities, and a part time Court Commissioner. The City Council adopts the Courts budget annually; the Court is otherwise independent from City Administration. Following, please find summary statistical reports for Municipal Court's 4th Quarter activity through December 31, 2019. Detailed reports are available from the Office of the Municipal Court. Collection Statistics -- Municipal Court Outstanding Time-Pay Contracts As of 12/31/2019 Outstanding Municipal Court Time-Pay Agreements' 1,747,361 **After judgment the offender makes arrangements with the court to pay their outstanding fines. If the offender does not make a payment in 30 days and does not make an effort with the court to make other arrangements to pay,the account is considered in arrears. A final notice is mailed to the person in arrears. If ignored the account is then turned over to collection The collection agency is mandated by the state of Washington to write off accounts still owing ten years after the judgment date due to the statute of limitations.
