Mayor Micah Cawley, presiding, Assistant Mayor Kathy Coffey (after 5:34), Council Members Maureen Adkison, Dave Edler, Rick Ensey, Dave Etti (after 5.36) and Bill Lover Staff City Manager Zais, City Attorney Cutter, and Sr Assistant Attorney Harvey 2. Invocation /Pledge of Allegiance Council Member Dave Edler gave an invocation and led the Pledge of Allegiance 3 Open Discussion for the Good of the Order A. Proclamations • National American Indian Heritage Month Mayor Cawley read a proclamation designating November as National American Indian Heritage month Cary Campbell accepted the proclamation on behalf of the Daughters of the American Revolution. Ms. Campbell gave Council a copy of the book The Powers of Four B Presentations /recognitions /introductions • Recognition of retiring Fire Department Lt. Ron Johnson Chief Hines and Deputy Chief Willson introduced Lt. Ron Johnson (RJ) who is retiring after 32 years with the Department. He was given his Lieutenant pin as well as a City watch. • Recognition of Boy Scout Troop 200 Assistant Scout Master Ken Zontek brought Troop 200 to the City Council meeting as part of their Community merit badge Each scout came forward and stated their name and rank. C Status reports on prior meeting's citizen service requests - None D Appointments to Boards, Commissions and Council Committees - None 4 Consent Agenda Items No 10 and 11 were added to the consent agenda ACTION Motion carried to approve the consent agenda as read. VOTE Unanimous *A. Consideration of approval of City Council Meeting Minutes • Business Meeting — October 19, 2010 ACTION Council meeting minutes were approved. *B Consideration of approval of Council Committee Meeting Minutes 1 North First Street Committee — October 14, 2010 2. Gang Free Initiative Committee — October 20, 2010 3 Transit - Transportation Committee — October 21, 2010 ACTION Council committee meeting minutes were approved 5 Audience Participation • Candy Turner commented on the quantity of campaign signs throughout the city and asked if there was a way of limiting them in the future City Attorney Cutter explained there is a constitutional right for individuals to campaign and put up signage and our ordinance allows for the signs to be in the public right -of -ways • Mike Hunnel submitted pictures that he felt displayed businesses discriminating against seniors and the disabled. His concerns will be sent through the normal code compliance complaint process 7.00 P M — PUBLIC HEARINGS 6 Closed record public hearing to consider the Hearing Examiner's recommendation on the preliminary plat of Cameo Court at Apple Tree Joseph Calhoun, Assistant Planner, described the preliminary plat. The public hearing was held. No one came forward to speak. ACTION Motion carried to accept the Hearing Examiner's recommendation and direct Legal to prepare the appropriate legislation. VOTE Unanimous 7 Closed record public hearing to consider the Hearing Examiner's recommendation on the preliminary plat of Malibu subdivision Supervising Planner Bruce Benson described the preliminary plat. The closed record public hearing was held with no one coming forward to speak. ACTION Motion carried to accept the Hearing Examiner's recommendation and direct Legal to prepare the appropriate legislation. VOTE; Unanimous 8 Public hearing on the 2010 Rezone and Comprehensive Plan Map Amendment Applications Supervising Planner Bruce Benson listed the seven applications submitted The public hearing was held with no one coming forward to speak. ACTION Motion carried to pass the ordinance VOTE: Unanimous ORDINANCE NO. 2010 -44 2 9 Public hearing on the City of Yakima's 2010 text amendment to the 2025 Comprehensive Plan Associate Planner Jeff Peters introduced a text amendment for the Comprehensive Plan The public hearing was held with no one coming forward to speak. ACTION. Motion carried to pass the ordinance VOTE. Unanimous ORDINANCE NO. 2010 -45 CITY MANAGER'S REPORTS *10 Consideration of the Yakima Police Department 2009 Annual Report ACTION Report approved *11 Consideration of a Resolution authorizing execution of an amended Letter of Understanding with Yakima Air Terminal, Yakima County and the City of Union Gap for improvements of 16 Avenue and Washington Avenue intersection and the property exchange between the City of Yakima and the Yakima Air Terminal ACTON Resolution adopted. RESOLUTION NO. R -2010 -120 *12 Consideration of a Resolution authorizing execution of an agreement with Hultz/BHU Engineers, Inc. to assess existing heating and air conditioning units at three City facilities ACTON. Resolution adopted. RESOLUTION NO R- 2010 -121 *13 Consideration of a Resolution authorizing annual renewal of the City Manager's authority to resolve and settle any claims against or by the City of Yakima in an amount of $100,000 or Tess ACTON Resolution adopted RESOLUTION NO. R- 2010 -122 *14 Consideration of a Resolution authorizing execution of an Interlocal Jail Agreement with the City of Sunnyside ACTON. Resolution adopted RESOLUTION NO R- 2010 -123 *15 Consideration of a Resolution authorizing execution of an agreement with Huibregtse Louman and Associates for North First Street corridor revitalization project ACTON Resolution adopted. RESOLUTION NO. R- 2010 -124 *16 Consideration of a Resolution ratifying a contract amendment (Addendum One) to the initial agreement with Gillihan Law office for public defender representation of indigent defendants ACTON Resolution adopted RESOLUTION NO R- 2010 -125 *17 Set date of Closed Record public hearing for December 7, 2010 on the preliminary plat of Washington Heights Phases 2 through 11 ACTON. Hearing date was set for December 7, 2010 ORDINANCES *18 Consideration of an Ordinance amending Chapter 7 90 of the City of Yakima Municipal Code by adding a new section 7 90 040 entitled "Unlawful Transit Conduct" and adopting the Revised Code of Washington Statute 9 91 025 by reference ACTON. Ordinance passed ORDINANCE NO. 2010 -46 3 19 Other Business • Strong Mayor Format - City Manager Zais advised that the City Attorney expects to have formal resolution ready for Council action at the December 7 business meeting in time for approval and submittal to the County Auditor to be on the ballot for a February 8 special election He clarified that the ballot proposition concerns only the form of government and does not elect the mayor If the ballot is successful, it would initiate the next phase and invoke a municipal election in the August primary from which the two top candidates would advance to the November election Until that point in time, the current form of government remains stable until a new mayor is elected and certified by the auditor • Tom McCormick expressed a concern about people putting motors on bicycles and yet not following the rules for motorcycles He also expressed a desire for Amtrak service to Seattle 20 Adjournment — 7 16 p m ACTION Motion carried to adjourn to November 9, 2010 at 9 a.m in the Council Chambers for City Council Budget Review VOTE° Unanimous 4
