For Meeting of: December 10, 2019 ITEM TITLE: Resolution approving Amendment No. 1 to an Interlocal Agreement between the City of Yakima and Yakima County for the provision of jail services SUBMITTED BY: Matthew Murray, Chief of Police SUMMARY EXPLANATION: This is a resolution requesting the City Manager to execute an agreement with Yakima County Department of Corrections for the housing of City prisoners who cannot be housed at the Yakima City Jail in 2020 due to felony charges, serious medical or mental health needs, or being female inmates. The agreement will renew annually through December 31, 2023. It calls for the County to house prisoners at a tiered daily rate between $61.50 and $67.50, dependent on the number of prisoners housed. Inmates with special housing and/or medical needs will be billed at a daily rate of$105.25. Medical costs are in addition to the daily rate. R-2019- A RESOLUTION approving Amendment No. 1 to the Interlocal Agreement between the City of Yakima and Yakima County for the provision of jail services. WHEREAS, the City of Yakima (hereafter the "City"), through the Yakima Police Department, requires additional space for the detention of some City prisoners held on misdemeanor or gross misdemeanor charges; and WHEREAS, Yakima County, through its Department of Corrections, is willing to provide jail services and facilities for the detention of some City prisoners; and WHEREAS, Yakima County and the City of Yakima have an interlocal agreement for such purposes, the "Interlocal Corrections/Detention Agreement Between Yakima County and the City of Yakima"for jail services and facilities (City Contract No. 2018-226, adopted by City Resolution No. R-2018-140 on December 11, 2018; BOCC339-2018 adopted by the Board of Yakima County Commissioners on December 18, 2018, hereafter "Interlocal Agreement), which term began on January 1, 2019; and WHEREAS, the Interlocal Agreement includes Attachment A which lists prisoner housing fees in accordance with Section 4 of the Interlocal Agreement; and WHEREAS, the parties have reached an agreement on prisoner housing fees for the period of January 1, 2020 through midnight December 31, 2020, in accordance with Section 3 of the Interlocal Agreement, and the fees for 2020 are reflected as Attachment A to Amendment No. 1; and WHEREAS, the City Council of the City of Yakima deems it to be in the best interest of the City of Yakima to enter into Amendment No. 1 to the interlocal agreement with Yakima County for the provision of jail services; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Amendment No. 1 with Attachment A regarding the 2020 fees to the Interlocal Corrections/Detention Agreement between Yakima County and the City of Yakima is hereby approved, and the City Manager of the City of Yakima is directed to execute Amendment No. 1 with Attachment A regarding the 2020 fees. Kathy Coffey, Mayor ATTEST: City Clerk 3 4 Amendment No. 1 to Interlocal Corrections/Detention Agreement Between Yakima County and the City of Yakima Regarding Fees for 2020 This Amendment No. 1 to the "Interlocal Corrections/Detention Agreement Between Yakima County and the City of Yakima"for jail services and facilities (City Contract No. 2018-226, adopted by City Resolution No. R-2018-140 on December 11, 2018; BOCC339-2018 adopted by the Board of Yakima County Commissioners on December 18, 2018, hereafter "Interlocal Agreement), is made and entered into by and between the City of Yakima (hereafter the "City") and Yakima County (hereafter the "County"). Whereas, the City has entered into the Interlocal Agreement with Yakima County for the purpose of receiving jail services and facilities for the detention of some City of Yakima prisoners held on misdemeanor or gross misdemeanor charges; and Whereas, the term of the Interlocal Agreement which began on January 1, 2019, renews annually for up to five years to December 31, 2023, unless otherwise terminated in accordance with Section 14 of the Interlocal Agreement; and Whereas, the Interlocal Agreement includes Attachment A which lists prisoner housing fees in accordance with Section 4 of the Interlocal Agreement; and Whereas, the parties have agreed upon prisoner housing fees for the period of January 1, 2020 through midnight December 31, 2020, in accordance with Section 3 of the Interlocal Agreement; Now, therefore, the City of Yakima and Yakima County agree to the fees for 2020 as set forth in Attachment A to this Amendment. Except as expressly modified in this Amendment No. 1 and in Attachment A regarding 2020 fees, all other terms and conditions of the "Interlocal Corrections/Detention Agreement Between Yakima County and the City of Yakima" between the City of Yakima and Yakima County remain in full force and effect. Intensive Management Inmates (IMI) who have serious medical, mental health or behavioral conditions and require special housing or treatment, as determined by the County will be housed at a rate of$105.25. The IMI population will be used in the(MADP)rate calculation listed below for all other inmate: Monthly Average Daily Population(MADP) Daily Rate Per Inmate 151-above $61.50 126-150 $62.50 101-125 $63.50 76-100 $64.50 51-75 $65.50 26-50 $66.50 0-25 $67.50 Billing Detail: Fractionalized Billing per current practice.
