FEBRUARY 23, 1976
The City Council met in session on this date at 1:30 P.M. in
the Conference Room at Yakima City Hall.

! Councilmen present at the meeting were Jean Allard, Mayor
Betty L. Edmondson, Ralph Holbrook, W. K. "Pete" Moore, Dr.
Bill Simmons, Nadine Walker and Gordon Wonder.
Mayor Betty Edmondson opened discussion on the recommenda-
tion by the Visitor's and Convention Bureau that Mike Mercy
be designated as a member and Chairman of the Bicentennial
Pavilion Advisory Board. In considering this matter, Council-
man Wonder indicated he believed that the Council should
"choose someone other than Mr. Mercy for this appointment and
that there were other individuals in the community that
!could serve better in that capacity. Other members of the
Council indicated that Visitor's and Convention Bureau were
!applying pressure tactics to insure that Mr. Mercy was
Appointed. After further discussion, it was MOVED by Pete
Moore and seconded by Jean Allard that the Visitor's and
Convention Bureau be asked to submit additional names for
the appointment, hopefully from outside the Visitor's and
1 Convention Bureau organization. Motion carried by majority
vote.
The Mayor next asked that three appointments be made to the
!Human Relations Commission, those of Frank Frederick, De-
lores Goodman, and Naomi Shephard commencing April 1, 1976.
It was subsequently moved by Pete Moore, seconded by Ralph
Holbrook that the reappointment of these members be auth-
orized from April 1, 1976, motion carried by a vote. Coun-
lcilman tinimons also indicated that the Council should con-
sider the Human Relations Commission's interest in main-
taining its present size or whether or not membership should
"remain at nine or be returned to eleven. Finally, the Mayor
"indicated that an appointment was needed for the Council
Manpower Advisory Council; and Council member Nadine Walker
!agreed to assume this duty.
Motion by Gordon Wonder, seconded by Pete Moore to enter
into an Executive Session to discuss the status of property
acquisition for the 16th Avenue and Tieton Drive project.
Upon concluding the Executive Session on 16th and Tieton at
1 1 2:45 P.M., Council members began a supplemental review of
the project. It was thereupon moved by Jean Allard and
seconded by Gordon Wonder that the 16th Avenue and Tieton
Drive project be cancelled. Motion carried by a majority
Note 5-2.
A t 3:00 P.M., the Council members moved into the Council
Chambers for the balance of the meeting, Mayor Edmondson
presiding, Councilmen Allard, Holbrook, Moore, Simmons,
Walker and Wonder, City Manager McMicken and City Attorney
Andrews present on roll call.
The Invocation was given by Councilman Allard.
The Minutes of the previous meeting of February 17, having
been read by two Councilmen, and no one present wishing to
have said minutes read publicly, Mayor Edmondson declared
said minutes approved with two corrections.
This being the time set for the Hearing on Petition No. 870,
filed by United Builders of Washington, Inc., requesting
"annexation of property located west of 32nd Avenue between
'Logan and Plath, Associate Planner Glenn Rice reviewed the
Staff Report and Planning Commission Minutes on this request

;dated January 19, and February 3, 1976, respectively. He
!explained that Mr. Fred Hammerstad of United Builders re-
quests annexation of approximately 7.01 acres on the west
side of 32nd Avenue to gain a full range of City services.
At the present time the area is mostly undeveloped, and
'plans include future single-family construction. Surrounding
County and City zoning is Residential. Residential development
!concurs with the County Comprehensive Plan and the Yakima
!General Plan. The area is currently served by unpaved
!streets. He indicated that a replatting request will soon
be submitted in order to allow for City sewer service. The
:Planning Staff and Planning Commission recommend approval
'for the following reasons:
1. Desire of the property owner to join the City.
2. The logical service area represented by this proposal.
3. The need for and availability of full urban services.
4. It is recommended that this area be zoned R-1, Single
Family Residential.
Present and speaking in favor of the proposed annexation was
Mr. Fred Hammerstad. It was MOVED by Holbrook, seconded by
Simmons that Ordinance No. 1913, providing for the annex-
lation of said property, be passed: carried, Allard, Edmond-
son, Holbrook, Moore, Simmons, Walker and Wonder voting aye
on roll call.
ORDINANCE NO. 1913, AN ORDINANCE annexing property to the
'City of Yakima, and zoning said property.
This being the time set for the Hearing on the Assessment
"Roll for L.I.D. No. 1005, 1975 Street Paving L.I.D., and
!there being no protests received to date, it was MOVED by
Wonder, seconded by Moore that Ordinance No. 1914, confir-

ming said Assessment Roll, be passed: carried, Allard,
,Edmondson, Holbrook, Moore, Simmons, Walker and Wonder
voting aye on roll call.
ORDINANCE NO. 1914, AN ORDINANCE confirming the assessment
Toll covering Local Improvement District No. 1005 as created
and established by Ordinance No. 1787 of the Ordinances of
the City of Yakima.

the following one-way streets:
1. "A" Street from North Front Street to North 6th Street
westbound

: Traffic Engineer Bill Stark referred to these designations
: in reference to Downtown Redevelopment to include these one-
way streets. He indicated that extension of these one-way
I Istreets would reduce turning conflicts between cars and
'pedestrians and increase car capacity through the inter-
sections. He explained it is expected that more traffic
Will use Chestnut to bypass Yakima Avenue. He explained
that on Chestnut the proposed angle parking on the south
Side and parallel on the north side all the way to 4th
!Street. Thirteen stalls=now exist on the south side and 19 stalls on
the north side, which would be reduced by approximately 10 spaces with
Parallel on the douth.councilman Allard expressed a concern
that all the angle parking kept on the same side along "A"
. Street. The extension involves restriping and removal of
' eters. Councilman Moore expressed a concern that the City
may be losing parking spaces by these extensions, since
;their objective has been to increase parking in the downtown
'prea. At the suggestion of Councilman Allard for changing

:these to single lane one-way street, Director of Public
!Works Dave Vargas indicated this would not be feasible,
since it would cause traffic congestion should a car have
;trouble backing and would not allow access for emergency
!vehicles. After due discussion, it was MOVED by Wonder that
the Council instruct staff to realign diagonal parking on A"
Street between First and Front Streets to conform to that now exist-
ing east of First Street, to provide for all parallel parking on
the south side and all angle parking on the north side:

and Wonder voting aye by voice vote4Present and speaking
to the Council was Mrs. Verleen Proudfoot of Victor Shoes
;stating their establishment has been condemned in connection
with the acquisition of 22 parking spaces asking whether any

'location, or sources of funding are being made available for
relocation. City Manager McMicken indicated that the staff
will give a complete review of the proposed acquisition of
this property next Monday.

!No. 1915, designating portions of these two streets as one-
!way, be passed: carried, Allard, Edmondson, Holbrook,

,ORDINANCE NO. 1915, AN ORDINANCE relating to traffic control;
!designating a portion of "A" Street and a portion of Chest-
! nut Avenue as one way streets; and amending Subsections
9.50.120(1) and 9.50.120(2) of the City of Yakima Municipal
!Code.
!Mrs. Jean Rich, being present, presented a petition to the
;Council from persons gepi4ing along Naches Avenue, who are
;very concerned about the traffic along East Walnut Street
and explained that no speed limit signs are posted from 10th
,Avenue past 10th Street and from 3rd to 6th Streets. She
;indicated that there are many elderly people and small
'children living in the area who are concerned with those
:breaking the speed limit along East Walnut. Police Chief
Jack LaRue, being present, indicated that they can coordin-
ate their enforcement efforts with the Traffic Engineer's
!Department and it was the consensus of the Council that a re-
;port be obtained from staff regarding this petition and request
of Mrs. Rich.
Police Chief Jack LaRue reviewed the annual report of the
; Yakima Police Department for 1975, which was made available
to Councilmen. He noted that while the national increase in
;crime is 11 percent the City of Yakima has experienced a
Islight decrease. He briefly commented that the shift changes
implemented in October seem to be working well and the
, addition of 18 CETA personnel has been valuable to the
department. Regarding questions on areas of special concern,
the Chief indicated that the Department has concentrated efforts
'on Part 1 Offenses.
The Council next discussed Agenda Item No. 16 re the bids re-
ceived for the City's legal advertising and City Manager McMicken
!reported that as a result of the bids opened on this date, the
!bid of the Herald Republic was $2.20 per first insertion and
$1.65 for each subsequent insertion, while the Sun Publica-
tion was 98' for the first insertion and 98 for each subsequent
! insertion. He pointed out that the City's Code stipulates by
; Ordinance that the paper shall be printed and published in
the City of Yakima and that the bid call specified the same.
'City Attorney Andrews indicated that the Purchasing Agent
:reports that although the weekly newspaper (Sun) was the
;lowest bid, it is not actually printed in the City of Yakima.
In order for both papers to qualify for consideration, the
language of the Ordinance would have to be changed to delete
!requirements for local printing. Mr. Gary Jackson, Sun Publi-
cations, being present, reported that their paper is in fact
printed in Seattle, though it is distributed through a local

office. It was MOVED by Allard, seconded by Wonder, that the Council
reject the bids for legal advertising received on this date: carried,
Allard, Holbrook, Simmons, Walker and Wonder voting aye by voice vote.
Edmondson and Moore voting nay by voice vote. Mr. Rod Ross, Advertis-
ing Director for the Herald-Republic, being present, briefly reviewed
the background materials provided to Councilmen. Mr. Gary Jackson ,
stated that 96% of their circulation is within the City Limits of
Yakima and the newspaper is readily available at approximately 50
locations throughout the City. He felt that the price should be
the basis for the award and indicated that their office could re-
ceive publications up to the hour of 5:00 P.M. on Tuesday for
Thursday publication. After further discussion, it was MOVED by
Allard, seconded by Wonder that the Ordinance be brought up to date
and that the reference to requiring printing and publishing
of the paper in the City of Yakima be stricken: carried,
Allard, Holbrook, Moore, Simmons, Walker and Wonder voting aye by
voice vote, Edmondson voting nay by voice vote.
Agenda item No. 11 was next brought on for consideration. City
Manager McMicken explained the proposed Resolution authorizing a
lease agreement with Mix' Productions, who plan to expand their film
and radio operations and lease space on the 3rd Floor of the
Terminal Building. Remodeling would be done at the City's expense.
The area involves 360 square feet and the new agreement is for a
period of three years with a 3 year option for renewal. It was
MOVED by Moore, seconded by Simmons that Resolution No. D-3479,
authorizing the execution of said lease agreement, be passed:
carried, Allard, Edmondson, Holbrook, Moore, Simmons, Walker and
Wonder voting aye on roll call.
RESOLUTION NO. D-3479, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
a lease agreement with Rod Mick and Steve Scott, doing business
as Mix' ProductionsfOr office and studio space in the air terminal
building at the Yakima Air Terminal.
The Council next considered Agenda Item No. 21. Director of Parks
& Recreation Bill Hutsinpiller related the recommendation by the
Parks & Recreation Commission that approval be made to relamp
Dunbar Field at Larson Park with one-half of the cost paid by the
City and one-half of the cost paid by the Yakima Softball Associa-
tion. He explained that this would involve relamping of the main
field at Larson Park and sited as possible sources of funding the .
I otherwise proposed Gilbert Park picnic facilities in the amount
; I of $5,643.49 and the Miller Park Pool filter at $20,000. The cost
; I for the project will be approximately $27,000. The City will be
required to purchase the materials by bid and the Yakima Softball
Association will be responsible for installation with volunteer
labor and paying for other additional expenses incurred. Mr.
I ! Hutsinpiller further explained :that the concession monies obligated
! to the City by the Yakima Softball Association will be reimburse-

, ball Association, being present, asked support for the lighting
program. After due discussion, it was MOVED by Walker, seconded
by Moore that the Council agree to the recommendation by the Parks
, 1 and Recreation Commission to relamp Dunbar Field at Larson Park
with one-half the costpaid by the City and one-half by the Soft-
ball Association and that the administration be within the Parks
, Department, to be worked out by staff. It was subsequently MOVED
! ; by Wonder, seconded by Simmons that the motion be amended to state
that the amount spent by the Council will not exceed $32,000:
carried, Allard, Edmondson, Moore, Simmons, Walker and Wonder
' voting aye by voice vote. Holbrook voting nay by voice vote.
The Motion, as amended, then carried with Allard, Edmondson,
Holbrook, Moore, Simmons, Walker and Wonder voting aye by voice
vote.
Director of Parks & Recreation Bill Hutsinpiller reviewed the
final design of the landscape improvements to Washington Avenue
adjacent to the Airport, explaining that it will involve land-

scaping the planter strip in the middle of Washington Avenue
planting trees along the side at a cost of approximately $5,000.

The work will be done by City forces. City Manager McMicken
commented that should the Council agree, bidding for material
'will take place and will include the installation of materials.
Bill Hutsinpiller explained the trees will be Crab Trees and
;Juniper Trees. It was MOVED by Simmons, seconded by Walker
that the Council approve the final design for the landscaping
of Washington Avenue adjacent to the airport: carried, Allard,
Edmondson, Holbrook, Moore, Simmons, Walker and Wonder voting
aye by voice vote. Mr. Hutsinpiller also reviewed the City of
!Yakima Parks Capital Fund update as of January 31, 1976.

It was MOVED by Wonder, seconded by Simmons that Resolution
Mo. D-3478, authorizing a loan of $100,000 from the Water-Sewer Fund
to the Parks and Recreation Fund for cash flow purposes, be
passed: carried, Edmondson, Holbrook, Simmons, Walker and
Wonder voting aye on roll call. Allard and Moore absent.
!RESOLUTION NO. D-3478, A RESOLUTION authorizing a temporary loan
!of $100,000 from 473-Water-Sewer Fund to 131-Parks and Recrea-
tion Fund, and providing for repayment.
It was MOVED by Wonder, seconded by Holbrook that Resolution
1No. D-3480, designating the City of Yakima as a recipient
of Federal Urban Mass Transportation Funds for the Regional
! Transportation Project, be passed: carried, Edmondson, Holbrook,
Simmons, Walker and Wonder voting aye on roll call. Allard and
Moore absent. City Manager McMicken explained the requirements
of the Urban Mass Transportation Act require that the City declare
their eligibility to receive funds.
;RESOLUTION NO. D-3480, A RESOLUTION affirming the intent of
the City of Yakima, Washington, to be named as a designated
recipient of the Federal Urban Mass Transit Fund.
IA Report having been received from the City Engineer on the
completion of L.I.D. No. 1004, North 63rd Avenue Sanitary
Sewer District, it was MOVED by Wonder, seconded by Holbrook
that March 22, 1976, be the date set for Hearing on this matter:

City Manager McMicken reported that bids were received and
considered on December 23, 1975, for the South 1st Street and
Nob Hill Intersection Resignalization, as follows:

Knobel's Electric, Inc. 17,122.40
The City Engineer recommending that the bid be awarded to Knobel's
glectric, Inc., who submitted the lowest and best bid, it was
MOVED by Holbrook, seconded by Simmons that the bid be awarded
to Knobel's Electric in the amount of $17,122.40 and that the
City Manager be authorized to enter in contract with said con-
tractor upon the filing of the proper bond and insurance:

The City Treasurer having submitted a report of Balances on Hand as
of January 31, 1976, it was MOVED by Wonder, seconded by Simmons
that the Report of the City Treasurer dated January 31, 1976, with
the respect to the investments of the City of Yakima be accepted '
l and approved: carried, Edmondson, Holbrook, Simmons, Walker and
Wonder voting aye by voice vote. Allard and Moore absent.
ICity Manager McMicken explained the proposed ordinance prohibiting
iparking on a portion of Knobel Avenue, explaining that it is re-
quested that parking be allowed on the north side of the street only
due to narrowness. It was MOVED by Simmons, seconded by Holbrook
that Ordinance No. 1916, providing for said traffic control, be
!passed: carried, Edmondson, Holbrook, Simmons, Walker and Wonder
voting aye on roll call. Allard and Moore absent.
ORDINANCE NO. 1916, AN ORDINANCE relating to traffic control; pro-
hibiting parking along a portion of Knobel Avenue, and amending
I Section 9.50.500 of the City of Yakima Municipal Code.
!Mr. Bill Huibregtse, Public Works Department, explained a proposed
Ordinance authorizing the condemnation of avigation easements for
I the Yakima Air Terminal enlargement project, explaining that the
1 total project includes acquisition of 24 parcels all of which have
been acquired or are being netotiated statifig7that three avigation
, !easements are under negotiation with 11 parcels that have
been unsuccessfully acquired, explaining that negotiations
with the Attorney for the property owners have been unsuccessful.
He further explained that the City is attempting to purchase
' two buildings on the site of the Fish Hatchery. Of the
: $950,000 cost, the 77.3 percent is from the Federal Aviation
:Association while $216,000 is the local share. Also
!brought to the Council's attention was the Environmental Review
Document and Negative Environmental Impact Sstatement (Attachment
16), which accompanied the Ordinance. It was MOVED by Holbrook,
!seconded by Walker that Ordinance No. 1917, authorizing said
!condemnation of avigation easements for the Yakima Air
;Terminal enlargement project, be passed: carried, Edmondson,
Holbrook, Simmons, Walker and Wonder voting aye on roll

!ORDINANCE NO. 1917, AN ORDINANCE of the City Council of the
!City of Yakima, Washington, providing for the acquisition of
'certain property and property rights for the improvement,

and damaging of property and other property rights necessary
therefor, and directing attorneys for the City to prosecute
the appropriate action and proceeding in the manner provided

'Mayor Edmondson explained that Yakima School District No. 7
has adopted as its Bicentennial Theme "Parents, Community
and Educators as Partners". It was MOVED by Wonder, seconded
by Holbrook that Resolution No. D-3481, endorsing the theme
of Yakima School District No. 7, be passed: carried, Edmond-
son, Holbrook, Simmons, Walker and Wonder voting aye on roll
'call. Allard and Moore absent.
RESOLUTION NO. D-3481, A RESOLUTION endorsing "Parents, Com-
munity and Educators as Partners" as the Bicentennial Theme
of Yakima School District,No. 7.
!City Manager McMicken requesting authorization for out-of-
state travel for James Veary, Refuse, to travel to Los
Angeles, California, to attend the annual Public Works
'Association meeting, March 8-11, 1976, it was MOVED by
:Simmons, seconded by Holbrook that said travel be approved
and expenses paid: carried, Edmondson, Holbrook, Simmons,
Walker and Wonder voting aye by voice vote. Allard and
;Moore absent.
;There being no further business to come before the Council
it was MOVED by Walker, seconded by Simmons that this meet-
ling be adjourned at 6:30 P.M. to Thursday, February 26,
