HomeMy WebLinkAbout11/17/1975 Business Meeting 15 NOVEMBER 17, 1975 The City Council met in session on this date at 6:30 P.M. in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Betty L. Edmondson, Dick Jams, W. K. "Pete" Moore, Don Schussler and Dr. Bill Simmons. City Manager McMicken discussed the reports from the State Auditor for fiscal 1974, on the Airport, Water-Sewer Utility and General Government and discussed the City's response toward meeting recommenda- tions of the Auditor. Council members and Staff held general:discussion re the Rodriquez shooting incident by members of the Chicano community and a report from Jay Spearman, Chairman, Human Relations Commission. It was MOVED by Simmons and seconded by Edmondson that since Wray Brown has beeen a competent and dependable member of the Yakima City Council for 11 years, and for most of his lifetime has been an active member of the community, and so can speak as a knowledgeable representative of the Yakima area, and since he has given good service to the State as a member of the E.A.A., the Yakima City Council respectfully requests that he be continued as a member of the E.A.A. after the expiration of his term on the Council December 31, 1975: tarried, Broad, Edmondson, Jarms, Moore, Schussler and Simmons voting aye by voice vote. At 8:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Edmondson, Jarms, Moore, Schussler and Simmons, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by Councilman Moore. The minutes of the previous meeting of November 10, 1975, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. This being the time set for the Hearing on the Assessment Roll for L.I.D. No, 998, Voelker Addition No. 1 Sanitary Sewer District, City Manager McMicken reported that no protests had been received. There being no one present speaking for or against this project, it was MOVED by Schussler, seconded by Jarms that Ordinance No. 1859, confirming said Assessment Roll, be passed: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting ayeon roll call. ORDINANCE NO. 1859, AN ORDINANCE confirming the Assessment Roll covering Local Improvement District No. 998 as created and established by Ordinance No. 1885 of the Ordinances of the City of Yakima. This being the time set for the Hearing on an Application filed by Don Williams for a private heliport at 4508 Carriage Hill Drive, Assistant Planner John Haddix reviewed the Planning Staff Report on this request, explaining that the proposed heliport is located at 910 Coach Court near Mr. Williams residence. The heliport is only to be used during daylight hours and the flight pattern is directed over land owned by Mr. Williams. Surrounding land use and zoning is R-1, Single-Family Residential. The proposal is to be situated on a vacant loft yet fully improved subdivision. The City's General Plan indicates this area suitable for low density residential development. Mr. Williams has completed required forms and the FAA has approved his proposal. Mr. Haddix indicated that complaints have been received from neighbors after prior landings. Mr. Williams currently lands at the airport at the direction of City Staff, after learning of his activities through complaints. The Planning Staff recommends denial of this request. Mr. Haddix explained that new homes are developing within approximately 300 feet of this area. Mr. Williams controls the land to the west and some to the south of the subdivision development. Councilman Schussler asked questions regarding the City's ordinance prohibiting aircraft below 3,000 feet flying over residential areas. AA NOVEMBER 17, 1975 City Attorney Andrews reviewed that Ordinance which prohibits flight over residences at an altitude belOw 3,000 feet; however, it allows for application for a landing place to be issued by Special Permit. Mr. Bob Rash, 4402 Scenic Drive, indicated he is within 300 feet north of this property and objected to the noise. Mr. Mark McWhorter, 904 Carriage Hill Drive, indicated the Covenants do not specify restrictions and since all the homes in this area are not completed, future home owners will have had no opportunity to express their opinions regarding this request. He asked that this area be maintained as a quiet residential neighborhood and if approved, suggested the Council should state at which times the helicopter may take off and land and that take off and landing be made from a minimum of 800 feet, directly above the heliport. He also objected to the noise. Terry Purdy, 910 Conestoga Boulevard, indicated that the helicopter creates alot of dust. cMrs. Gore voiced concern, since her home will be completed in December, explaining that this lot will be situated on two sides of her home. She explained that the fence surrounding the site is not very high and provides inadequate protection for children. Also present and objecting were Mr.. Quincy Gates and George McCullough, 4408 Fechter Road. Those present and speaking in favor of the proposal and/or voicing objections were Mr. Dan Demick, 911 Carriage Hill Drive; Bill Barton, 915 Carriage Hill Drive; Stan Hillwick and Dan Craig, 4508 Fechter Road. Also present and speaking to this matter, was Mr. Dick Morrow, 4706 Fechter Road. Speaking to this matter, Mr. Don Williams pointed out that the heliport has been approved by the FAA and has been determined to be safe. He again emphasized he would be flying in over his own land. He explained there would be no night flying, since his flights are to his work in Ellensburg. He indicated that it only takes approximately one minute to land and three minutes to take off, so that noise is not prolonged. However, he stated he would not be able to land straight down from 800 feet. Mr. Williams indicated he had contacted 27 neighbors, finding four in objection and the rest in agreement. He again reviewed his flight pattern with the use of a map for those present and stated that he lands in a grassy area. After due discussion, it was MOVED by Simmons, seconded by Edmondson that the request for Special Permit for a heliport landing by Mr. Williams be denied: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting aye by voice vote. Councilman Brown voiced objection to the noise problem cited. Councilman Edmondson voiced objection due to the newly developed residential area and the close proximity of the airport. The Council next heard a presentation by Dr. Robert Atwood and County Commissioner Lenore Lambert regarding Yakima Health District services, as outlined-in the materials passed to Councilmen. Commissioner Lenore Lambert explained that the District is concerned about public relations and feels a need to share with various cities what kind of services are being provided. Dr. Atwood reviewed the various health services as detailed in the report, reviewing the total number of services and costs in 1975 for the County and City. He pointed out the number of services provided to Yakima City compared with the total services for the Health District. Dr. Atwood explained the summary chart of contributions from cities in Yakima County as calculated in 1975 by formula, explaining that the City experienced no increase in their assessment last year, but will request one for 1976, since the total Health District budget is up ten percent for 1976. Councilman Simmons asked whether the District could operate at the same level without an increase. Dr. Atwood indicated they are not sure they can even operate at the same level and explained that they are cutting 10 positions, but are hoping not to reduce services. He briefly spoke to the matter of the Southeast Community Center clinic and reviewed the action whereby the Health District took over the Clinic's operation as of September 1, 1975. Since that time, available services have increased and the reports are good. As a result, the Health District will submit a request for a contribution reduced to $30,000. No further action was taken. NOVEMBER 17, 1975 ICity Manager McMicken requested authorization to engage special legal counsel for the acquisition of Avigation Easements for the Yakima Air Terminal Expansion Project, explaining that the City Attorney and City Manager recommend that the firm of Preston, Thorgrimson, et.al. be engaged on an hourly basis to be funded from FAA monies. It was MOVED by Schussler, !seconded by Brown that the City engage the legal Counsel of ;Preston, Thorgrimson, for acquisition services: carried, !Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons ;voting aye by voice vote. ;There was discussion by the Council regarding approval for the City to have preliminary responsibilities for transit planning in the Yakima Urban Area. City Manager McMicken explained that in the Transportation Planning for the urban !area, the State and Federal agencies need to have a contact source with whom to work. Yakima has been selected for this purpose. Assistant Planner John Haddix explained that it is felt that i Yakima has the best background. One of the requirements is !that the City agree to do this so that funding may be received for streets and sidewalks, highways and transportation,planning. It was indicated that should the City not agree to this, FAM !Funds may be discontinued. It was MOVED by Jarms, seconded by Brown that this request for the City to have preliminary ;responsibility for transit planning in the Yakima Urban Area, be approved: carried,'Broad, Brown, Edmondson, Jarms and !Moore voting aye by voice vote; Schussler ancLSimmons voting ;nay by voice vote. ;City Manager McMicken referred to City Manager Report No. 1253 entitled Public Hearing Notification Procedure, and suggested !that as time permits, the Council may want to review this !report and discuss appropriate action. It was MOVED by Brown, seconded by Simmons that Resolution 1 No. D-3410, authorizing the payment of $66.61 to Michael A. ;Parker for damages from a City sewer backup, be passed: carried, !Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons I voting aye on roll call. ; RESOLUTION NO. D-3410, A RESOLUTION authorizing payment 'Of $66.61 to Michael A. Parker in settlement of a Claim for Damages filed with the City of Yakima. City Manager McMicken reported that bids were received and iconsidered by a Bid Board on November 6, 1975, for the Naches ;Avenue Sidewalk Lighting, as follows: Knobel's Electric $ 59,870 Smith Electric $ 76,425 West Coast Electric Wilson Electric $146,306 $ 45,442 It was MOVED by Schussler, seconded by Moore that the Bid be awarded to Wilson Electric who submitted the lowest and !best bid and that the City Manager be authorized to enter into !Contract with said Contractor upon filing of the proper bond and insurance: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting aye by voice vote. City Manager McMicken reported that bids were received and considered on November 13, 1975 for the Bicentennial Pavilion !Utility Relocation and Others Project, Schedule II, as follows: Larry DeBlasio Construction $ 7,910.70 Cook-Lewis Company, Inc. $ 9,310.96 Jobeca Construction $11,445.00 Valley Cement Construction $12,159.00 i It was MOVED by Schussler, seconded by Brown that the bid for Schedule II be awarded to Larry DeBlasio Construction NOVEMBER 17, 1975 who submitted the lowest and best bid in the amount of $7,910.70 and that the City Manager be authorized to enter into contract with said contractor upon the filing of the proper bond and ' insurance: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting aye by voice vote. City Manager McMicken explained that the award for Schedule I would be made j next week. The City Treasurer having submitted the Investment Report for the month of October, 1975, it was MOVED by Schussler, seconded by Brown that the Report of the City Treasurer dated October 31, 1975 regarding the investments of the City of Yakima, be accepted and approved: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting aye by voice vote. A Damage Claim having been filed with the City Clerk on November 12, 1975 by Leslie Pfaff, 1010 So. 27th Avenue in the amount ' of $25.73 for reimbursement of Roto Rooter Services in connection with a City sewer backup, it was MOVED by Schussler, seconded by Jarms that said Damage Claim be referred to the City Manager and staff for study and recommendation: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting aye by voice vote. i1 There being no futher business to come before the Council, it was MOVED by Schussler, seconded by Simmons that this meeting ' be adjourned at 9:20 P.M., to Wednesday, November 19, 1975 at the hour of 12:00 Noon, to then meet in the Holiday Inn Restaurant: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting aye by voice vote.
