For Meeting of: June 4, 2019 ITEM TITLE: Ordinance amending Yakima Municipal Code 7.68.250 correcting the 2020 rate for two-inch ready to serve charge that was established in error SUBMITTED BY: Scott Schafer, Public Works Director David Brown, Water/Irrigation Division Manager, 509-575-6204 SUMMARY EXPLANATION: On December 4, 2018, City Council passed on ordinance establishing water rates and charges for a five-year period from 2019 - 2023. When reviewing those charges it was discovered the 2020 rate for two-inch ready to serve charge was placed at a higher rate that it was intended. This ordinance amends the 2020 rate for a 2-inch ready to serve; reducing the rate from $67.08 to the correct rate of$63.89. WHEREAS, RCW 35.92.010 authorizes cities to own and operate water utilities, and to regulate and control the use, distribution, and price for water utility service; and WHEREAS, Article IX, Section 1 of the City Charter of the City of Yakima authorizes the City Council to provide by ordinance rules and regulations for the control, management and operation of all public utilities owned and operated by the City; and WHEREAS, the City Council has established recently established new rates and charges for domestic water connection and service through the enactment of Yakima Municipal Code (YMC) chapters 7.68 and 7.75; and WHEREAS, when reviewing the code it became clear that the rate for two inch lines starting on January 1, 2020, was incorrect and should be reduced to reflect the correct ready-to- serve charge starting January 1, 2020 of $63.89; and WHEREAS, the City Council finds and determines that adoption of this ordinance correcting the ready-to-serve charge for two inch lines starting January 1, 2020 is in the public interest; now,therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 7.68.250 of the City of Yakima Municipal Code is hereby amended to read as follows: 7.68.250 Water services charges. A. The charge for domestic water supplied within the city of Yakima shall consist of a ready-to- serve charge and a charge for water consumed. The ready-to-serve charge may be computed on a daily basis by dividing the two-month charge by sixty days. C. All charges for water supplied outside the city shall be computed by multiplying the applicable rates set forth in subsections A and B of this section by one and one-half. D. Home Kidney Dialysis. A residential customer who undergoes kidney dialysis at his or her home, or whose home is also the home of a different person who undergoes home kidney dialysis, shall not be required to pay utility charges for domestic water service or sewer service for the quantity of water that is necessary for the home dialysis. In order to be excused from utility charges under this subsection, the residential customer must present to the director of finance and budget or their designee written documentation annually from a recognized kidney dialysis center certifying that the person requires dialysis and the quantity of water needed for that person's dialysis. Section 2. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional, unlawful or invalid by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. 4 Section 3. Effective Date. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
