R-2019-050 A RESOLUTION authorizing a contract with Selland Construction for the widening, reconstruction and other related roadway and utility work on River Road from 34th to 40th Avenues. WHEREAS, community and private involvement in the cooperative effort to bring the Aquatics Center to the area has been strongly supported in the City Council Strategic Plan and the Park Element of the Yakima Urban Area Comprehensive Plan 2040, and the Aquatics Center has been recognized by the City Council as an enhancement to the pool facilities offered to Yakima residents; and WHEREAS, on October 27, 2015 the Yakima City Council entered into agreements with the Yakima Family YMCA, a Washington nonprofit corporation, for a public -private partnership to create the Aquatics Center; and WHEREAS, improvements to the existing public streets in the vicinity of the proposed YMCA/Aquatics Center will improve public safety and facilitate access to the development and are required as part of the development of the site by the YMCA, and WHEREAS, because the Aquatics Center is projected to create economic development opportunities in Yakima, Supporting Investment in Economic Development ("SIED") funds were secured for the project in July of 2018 and are projected to cover approximately 61 % of the cost to upgrade River Road to current City standards, and WHEREAS, the remaining cost to upgrade River Road will be paid with $648,710 in Transportation Benefit District (TBD) funds and $106,620 in Wastewater funds, and WHEREAS, early this year, city staff used the state bidding process to advertise for bids Five (5) contractors submitted bids with Selland Construction of Wenatchee submitting the lowest bid of $855,652 14 WHEREAS, The City Council has determined that it is in the best interests of the City to assist with improvements on River Road in support of the Aquatic Center project, and WHEREAS, the City Council finds that it is in the best interest of the City and its residents to enter into a contract with Selland Construction to complete the improvements to River Road from 34th Avenue to 40th Avenue; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute the attached contract with Selland Construction in the amount of $855,652 14 for the widening, reconstruction and other related roadway and utility work on River Road from 34th to 40th Avenues, City Project No 2479 A ADOPTED BY THE CITY COUNCIL this 7th day of May, 2019 TEST Sonya ClaarQe, City Clerk athy Co CONTRACT THIS AGREEMENT, made and entered into in triplicate, this 7 day of /`ICA , 2019, by and between the City of Yakima, hereinafter called the Owner, and Selland Construction, Inc a Washington Corporation, hereinafter called the Contractor WITNESSETH: That in consideration of the terms and conditions contained herein and attached and made a part of this agreement, the parties hereto covenant and agree as follows. I The Contractor shall do all work and furnish all tools, materials, labor and equipment for THE BID AMOUNT OF $855,652.14 for River Road Improvements, 34th Avenue to 40th Avenue, City Project No. 2479, all in accordance with, and as described in the attached plans and specifications and the 2014 Standard Specifications for Road, Bridge, and Municipal Construction which are by this reference incorporated herein and made a part hereof, and shall perform any alterations in or additions to the work provided under this contract and every part thereof. Work shall start within ten (10) days after the Notice to Proceed and shall be completed in Sixty-five (65) working days. If work has not commenced within the ten (10) days after the Notice to Proceed, the first chargeable working day shall be the 11 th day after the date on which the City issues the Notice to Proceed. If said work is not completed within the time specified, the Contractor agrees to pay to the Owner the sum specified in the Standard Specifications for each and every day said work remains uncompleted after expiration of the specified time, as liquidated damages. The Contractors shall provide and bear the expense of all equipment, work and labor of any sort whatsoever that may be required for the transfer of materials and for constructing and completing the work provided for in this contract and every part thereof, except such as are mentioned in the specifications to be furnished by the City of Yakima. II The City of Yakima hereby promises and agrees with the Contractor to employ, and does employ the Contractor to provide the materials and to do and cause to be done the above described work and to complete and finish the same according to the attached plans and specifications and the terms and conditions herein contained and hereby contracts to pay for the same according to the attached specifications and the schedule of unit or itemized prices hereto attached, at the time and in the manner and upon the conditions provided for in this contract. III INDEMNIFICATION The Contractor shall defend, indemnify, and hold harmless the City, its officers, elected officials, employees and agents from and against any and all claims, causes of action, damages, losses, and expenses of any kind or nature whatsoever, including but not limited to, attorney's fees and court costs, arising out of, relating to, or resulting from the Contractor's performance or non-performance of the services, duties and obligations required of it under this Agreement. IV The Contractor for himself, and for his heirs, executors, administrators, successors, and assigns, does hereby agree to the full performance of all the covenants herein contained upon the part of the Contractor V It is further provided that no liability shall attach to the City of Yakima by reason of entering into this contract, except as expressly provided herein. For Meeting of: May 7, 2019 Resolution authorizing a contract with Selland Construction for the widening, reconstruction and other related road work on River Road from 34th to 40th Avenues Scott Schafer, Public Works Director Bob Desgrosellier, Acting Chief Engineer - 575-6228 SUMMARY EXPLANATION: The River Road Improvement Project will extend from 40th Avenue to 34th Avenue consisting of widening the roadway to three lanes to add a turn -lane, the addition of curb, gutter, sidewalk and bike path to accommodate the safety of pedestrians and bicyclists, and the addition of storm drainage, sanitary sewer, and street lighting. In addition, Pacific Power will be relocating power transmission and distribution poles and lines to the backside of the new sidewalks, while communication companies will be relocating some of the overhead facilities to underground conduits; improvement the surrounding esthetics. City staff utilized the state bidding process to advertise for bids. Five (5) contractors submitted bids with Selland Construction of Wenatchee submitting the lowest bid of $855,652.14. See attached contract. The project is primarily funded by a $1,000,000 Yakima County S I E D Board grant/loan. Transportation Benefit District (TBD) funds will be used to finance the loan payments of the SIED Loan. In addition, the Wastewater/Stormwater Division is contributing $106,620 towards the project for infrastructure improvements. Any remaining funds from this phase of the River Road project will be applied to phase 2, the Roundabout Construction Project at 34th Avenue and Fruitvale Blvd., which connects River Road to 34th Avenue. The River Road Improvement Project is scheduled to be completed by mid - September 2019 in coordination with the completion of the new YMCA Aquatics/Fitness Center at Chesterley Park.
