Executive Session • Pending and prospective litigation • Collective Bargaining Executive Session was held and adjourned at 5 43 p m 6 P M. — BUSINESS MEETING 1 Roll Call Present: Council. Mayor Micah Cawley, presiding, Assistant Mayor Kathy Coffey, Council Members Maureen Adkison, Dave Edler, Rick Ensey, Dave Ettl and Bill Lover Staff Assistant City Manager Zabel!, City Attorney Cutter and City Clerk Kloster 2. Invocation /Pledge of Allegiance Mayor Cawley gave an invocation and led the Pledge of Allegiance 3 Open Discussion for the Good of the Order A. Proclamations • National Hospice Month Council Member Adkison read a proclamation declaring November 2010 as National Hospice Month Raynalee Willsey accepted the proclamation. • Veterans Day Council Member Lover read a proclamation declaring November 11 as Veterans Day and the month of November as Veterans Awareness Month. Dave Brown, Veterans coordinator for Yakima County, accepted the proclamation B Presentations /recognitions /introductions • Recognition of Yakima Police Department employee Kristen Drury for completing the ATF National Firearms Examiner Academy Interim Deputy Police Chief Copeland gave background on Kristen's training in Washington DC Rick Wyant, Brian Smelser and Captain Barry from the Washington State Patrol also provided information on the services Kristen will be able to provide Yakima by having completed the academy program C Status reports on prior meeting's .citizen service requests — None D Appointments to Boards, Commissions and Council Committees • Tourism Promotion Area Penny Baker and Connie Webb were recommended for appointment to the Tourism Promotion Area (TPA) board Wanda Riel was recommended for reappointment to her existing seat on the board ACTION' Motion carried to accept the Committee's recommendations VOTE Unanimous 4 Consent Agenda Items 7, 8 and 9 were added to the consent agenda ACTION Motion carried to approve the consent agenda as read VOTE Unanimous *A. Consideration of approval of City Council Meeting Minutes • Business Meeting — October 5, 2010 ACTION Council meeting minutes were approved *B Consideration of approval of Council Committee Meeting Minutes 1 Public Safety Committee _ September 15, 2010 2. City /County Intergovernmental Committee — September 28, 2010 3 Budget Committee — September 29, 2010 4 Gang Free Initiative Committee — October 6, 2010 5 Neighborhood Development Committee — October 6, 2010 ACTION Council committee meeting minutes were approved 5 Audience Participation • Consideration of a Citizens Petition No 10 -08 regarding parking in the North Front Street Historic District area Dwight Lewis spoke about the petition he submitted and the parking issues at the Cascade and Senator Apartments ACTION Motion carried to refer the petition to the Parking Commission for review of options. VOTE: Unanimous Candy Turner commented on her family experience with hospice She thinks hiring the gang coordinator was an unnecessary use of funds and offered other suggestions to the gang problem She also was not in favor of spending money for a study on the possibility of building a new Bears stadium Chris Johnson asked if he needed a permit to read the Bible on City sidewalks The City Attorney advised him a permit was not required and reading was allowed as long he did not disturb the peace. Lawrence Breer reminded the Council and citizens that a "no background check" gun show is coming to Yakima and the Yakima Valley Peace Advocates network will be protesting it. He feels it is incumbent upon the City to support the state and national law concerning background checks for purchase of guns 2 7 P M — PUBLIC HEARINGS 6 Public hearing and consideration of a Resolution adopting the 2011 CDBG and HOME Annual Action Plan Michael Morales reviewed the process leading up to the public hearing and adoption of the Plan He expects the funding to remain the same in 2011 The public hearing was held with no one coming forward to speak. ACTION Motion carried to adopt the Resolution VOTE Unanimous RESOLUTION NO R -2010 -116 CITY MANAGER'S REPORTS *7 Consideration of a Resolution authorizing a Temporary Emergency Cold Weather Shelter Program in the City of Yakima ACTION Resolution adopted. RESOLUTION NO R- 2010 -117 *8 Consideration of the 2010 Third Quarter Capital Improvement Projects Report ACTION Report accepted. *9 Consideration of a Resolution authorizing execution of a loan application to the Yakima County Supporting Investments in Economic Diversification (SIED) fund for infrastructure design of the Yakima Sawmill Redevelopment Area ACTION Resolution adopted. RESOLUTION NO R- 2010 -118 *10 Consideration of the State Auditor's Report — City's 2009 Financial Statements ACTION Report accepted *11 Consideration of final contract payment for Granite Northwest, Inc — Kiwanis Upper Park Phase 1 Maple Street Parking (Standard Motion V -B — accept the project and approve the final payment) ACTION Project was accepted and final payment was approved. *12. Consideration of a Resolution approving the preliminary plat of Mountain View Estates ACTION. Resolution adopted RESOLUTION NO R -2010 -119 *13 Set date of closed record public hearing for November 2, 2010 to consider the preliminary plat of Cameo Court at Apple Tree and an open record public hearing on a proposed development agreement for a Master Planned Development ACTION Hearing date was set for November 2, 2010 *14 Set date of closed record public hearing for November 2, 2010 to consider the preliminary plat of Malibu subdivision ACTION- Hearing date was set for November 2, 2010 15 Other Business Mayor Cawley gave an update on the recent Gang Commission meeting he had attended. 3 Council Member Edler initiated a discussion on the forms of government. The Council decided to hold a study session on November 1 (time to be determined) to continue discussing this issue and consider a proposal to initiate a ballot proposition to adopt a Mayor - Council government format. 16 Adjournment — 7 34 p m ACTION Motion carried to adjourn to October 26, 2010 at 9 a m in the Council Chambers for City Council Budget Review 4
