Calhoun introduced a document entitled "City of Yakima Department of Community Development Affordable Housing White Paper" from the City Council study session on March 12, 2019. He pointed the Commission to the action steps described therein related to zoning and regulatory innovation which City Council referred to the Planning Commission for review and recommendation. The action steps will be discussed at future Planning Commission meetings. Audience Participation - None noted. Approval of Meeting Minutes of February 27, 2019 — It was motioned by Commissioner Cook and seconded by Vice -Chair Liddicoat to approve the meeting minutes of February 27, 2019. The motion carried unanimously. Discussion on Potential Text Amendments: Small Cell Wireless Facilities — Calhoun introduced proposed changes to Yakima Municipal Code (YMC) Chapter 15.29 Wireless Communication Facilities for the inclusion of language on small cell wireless facilities. Discussion took place on the levels of review proposed for small cell wireless facilities and design standards imposed in YMC 15.29.070. The Commission requested that staff seek a possible alternative to requiring Hearing Examiner review for new small cell wireless facilities on new utility poles within 300 feet of a protected area (as defined by Ch. 15.29) to help reduce cost and processing time. Suggested changes to Ch. 15.29 received in writing from industry representatives were distributed. Gregory Bush of Wireless Policy Group and Jason Verduzco of Verizon Wireless summarized their proposed changes to the chapter. Verduzco distributed copies of a Verizon Wireless pamphlet containing information on small cell facilities. The Commission requested the following from staff: photos of small cell wireless facilities, time to review the industry representatives' suggested changes to the code, and for staff to review and provide feedback at a future meeting on the industry representatives' suggestions. The Commission invited the industry representatives to return for future study sessions and requested staff to invite the representatives to the public hearing that will be scheduled at a later -1- time. The possibility of holding separate text amendment public hearings for separate topics/areas of the code was discussed and will be determined down the line. Senior Assistant City Attorney Sara Watkins stated that she will review the Federal Communications Commission (FCC) order so it can be clarified what bearing the shot clocks established therein will have on the city's permitting and appeal procedures. Background On March 12, 2019, the City Council held a study session where it was moved and seconded to send the following items to the Planning Commission for further review and discussion: a. Review options for zoning of additional land for multi -family construction b. Analyze the Zoning Ordinance (YMC 15) & Subdivision Ordinance (YMC 14) for regulatory strategies c. Analyze the R-1 Zoning District to determine if more density should be allowed in the R-1 zone d. Review techniques used in other cities, especially in the state of Washington, to encourage new housing of all types e. Review the concept of Inclusionary Housing Ordinances that require set -asides for affordable housing or payment into a fund for affordable housing. Seattle and Portland have similar ordinances with mixed results f. Review short term rental zoning and licensing regulations (AirBNB or VRBO) 2. Multiple -family and detached single-family dwellings that are clustering around a common amenity such as open space, recreation facilities or common community building, and have a common driveway access on a single lot of record are also considered multiple -family development. Low Density Residential: A. Purpose: This designation provides for low density residential development. B. Locational criteria: Within established low density residential communities and in other parts of the City that are inappropriate for more intensive urban development due to topography or other land suitability challenges and/or the desire to create a lower intensity transitional area between the city and the surrounding unincorporated rural pasture, foothills, and agricultural land. C. Principal uses & density: Single-family detached dwellings are the predominant dwelling type. Other dwelling types may be allowed under certain circumstances, such as accessory dwellings and cottage housing. The permitted density is up to seven net dwelling units per acre for infill development. On larger sites (over two acres), more flexibility in lot sizes and layout are envisioned, provided overall density standards are met. Permitted maximum densities on large sites is up to seven gross dwelling units per acre. Density bonuses allowing up to six gross dwelling units may be allowed subject to conformance with traditional neighborhood design concepts. D. Implementing zoning districts: SR & R-1. 15.03.020(B) — R-1 District Intent Statement B. Single -Family Residential District (R-1). The single-family residential district is intended to: 1. Establish new residential neighborhoods for detached single-family dwellings free from other uses except those which are compatible with, and serve the residents of, this district, which may include duplexes and zero lot lines if established during the subdivision process; 2. Preserve existing residential neighborhoods for detached single-family dwellings free from other uses to ensure the preservation of the existing residential character, and serve the residents of this district; and 3. Locate moderate -density residential development, up to seven dwelling units per net residential acre, in areas served by public water and sewer system. Detached single-family dwellings are the primary use in this district. The district is characterized by up to sixty percent lot coverage; access to individual lots by local access streets; required front, rear and side yard setbacks; and one- and two-story structures. The density in the district is generally seven dwelling units per net residential acre or less. This zone is intended to afford single-family neighborhoods the highest level of protection from encroachment by potentially incompatible nonresidential land uses or impacts. Nonresidential uses within these zones are not allowed; except for public or quasi -public uses, which will be required to undergo extensive public review and will have all necessary performance or design standards assigned to them as necessary to mitigate potential impacts to adjacent residences.
