ITEM TITLE: Resolution setting a public hearing on February 19, 2019, at 6:30
p.m. for the surplus of property that formerly was a portion of the
PPL Canal, located in the vicinity of West Lincoln Avenue between
North 24th Avenue and North 22nd Avenue

SUMMARY EXPLANATION:
A resolution for the purpose of setting the time and place for a public hearing to hear from the
public on the proposed surplus of City property, formerly where the Pacific Power and Light canal
was located, south of West Lincoln Avenue between North 23rd Avenue and approximately North
20th Avenue.

RESOLUTION NO. R-2019-
A RESOLUTION setting the time and place for a public hearing on February 19, 2019, at
6:30 p.m. in the City of Yakima City Council Chambers to hear from the
public on the proposed surplus of real property owned by the City and
acquired for utility purposes.
WHEREAS, the City of Yakima owns real property that was formerly the Pacific Power
and Light canal; and
WHEREAS, a portion of the former canal runs adjacent to residential properties south of
West Lincoln Avenue between North 23' Avenue and approximately North 20'h Avenue; and
WHEREAS, the City of Yakima Water Division has determined it has no need for the
property and the property is not needed to provide continued public utility service; and
WHEREAS, pursuant to RCW 35.94.040, because the property was originally obtained
for utility purposes, a public hearing must be held prior to surplussing the property, regardless of
the property's value; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The proposed surplus of City property, formerly where the Pacific Power and Light canal
was located, south of West Lincoln Avenue between North 23'Avenue and approximately North
20'h Avenue shall be presented for a public hearing and determination by the City Council at the
hour of 6:30 p.m. on February 19, 2019, in the City Council Chambers of the City of Yakima at
Yakima City Hall, 129 North 2' Street, Yakima, Washington, or as soon thereafter as the same
so that all persons interested may appear and be heard, and that notice of such hearing be given
as required by law.
ADOPTED BY THE CITY COUNCIL this 15'h day of January, 2019.
