For Meeting of: December 4, 2018 Ordinance amending Chapter 7.68 Yakima Municipal Code regarding Water rates Scott Schafer, Public Works Director David Brown, Interim Assistant Public Works Director, 509-575- 6204 SUMMARY EXPLANATION: To keep up with the cost of inflation, to maintain appropriate reserve fund levels, as well as to properly plan for significant infrastructure projects such as the Water Treatment Plant Intake Improvements and the Aquifer Storage and Recovery Project, Water rates must periodically be adjusted to cover the cost of service. Having a sound infrastructure ensures that the Water Division treats and delivers potable water of sufficient quantity and quality to meet the domestic, commercial, industrial, irrigation and fire suppression needs within the system's retail service area. The City contracted with HDR Engineering to conduct a rate study of the Water Division. This effort corresponded with the City Council adopted 2017 Water System Plan. HDR Engineering recommended a rate increase of 5% per year for four years (2019-2022). The last rate adjustment for the Water Division was conducted in 2018. The revenue received is collected into the Water Operating Fund 474 and Water Capital Fund 477. Attached for review is the revised Yakima Municipal Code Chapter 7.68 based on the recommendations from HDR Engineering and as directed by the City Council at the October 18, 2018 Budget Session. This rate increase provides the Water Division with proper funding levels for the next four years. Future fee increases will be presented to Council in an annual fee schedule rather than individually throughout the year on a case-by-case basis. WHEREAS, RCW 35.92.010 authorizes cities to own and operate water utilities, and to regulate and control the use, distribution, and price for water utility service; and WHEREAS, Article IX, Section 1 of the City Charter of the City of Yakima authorizes the City Council to provide by ordinance rules and regulations for the control, management and operation of all public utilities owned and operated by the City; and WHEREAS, the City Council has established rates and charges for domestic water connection and service through the enactment of Yakima Municipal Code (YMC) chapters 7.68 and 7.75; and WHEREAS, the City Council finds and determines that the rates, charges, terms and conditions for domestic water utility service set forth in this ordinance are fair, just and reasonable; and WHEREAS, the City Council finds and determines that adoption of this ordinance is in the public interest; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The ready -to -serve charge may be computed on a daily basis by dividing the two-month charge by sixty days. C. All charges for water supplied outside the city shall be computed by multiplying the applicable rates set forth in subsections A and B of this section by one and one-half. D. Home Kidney Dialysis. A residential customer who undergoes kidney dialysis at his or her home, or whose home is also the home of a different person who undergoes home kidney dialysis, shall not be required to pay utility charges for domestic water service or sewer service for the quantity of water that is necessary for the home dialysis. In order to be excused from utility charges under this subsection, the residential customer must present to the director of finance and budget or their designee written documentation annually from a recognized kidney dialysis center certifying that the person requires dialysis and the quantity of water needed for that person's dialysis. Section 2. Section 7.68.251 of the City of Yakima Municipal Code is hereby amended to read as follows: 7.68.251 Bulk Rate The charge for water supplied through fire hydrants, when the water is used by either the city or a private person for any use authorized by the water/irrigation division, shall be the same as the highest UOC charge set forth in YMC 7.88.250. No charge shall be made for water supplied through fire hydrants when the water is used for fire suppression or for maintenance and operation purposes by the city. 5 B. All water served through a fire hydrant shall comply with YMC 768.300. C. Charges for fire services outside the city limits shall be computed by multiplying the applicable rate above by one and one-half. D. The inside diameter of the pipe leading to a fire hydrant shall determine the service charge. Any fire hydrant installed and maintained by the city outside of city limits will be billed as a fire 6 service, which charge shall be terminated at such time as the responsible consumer's property is annexed to the city. Section 4. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional, unlawful or invalid by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. Section 5. Effective Date. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
