AUGUST 15, 1977
The City Council met in session on this date at 7:30 PM in the Conference Room at City
Hall, Yakima, Washington. Council members present at the meeting were Mayor
Betty L. Edmondson, Jean Allard, Ralph Holbrook, W. K. "Pete" Moore, Dr. Bill
Simmons, Nadine Walker and Gordon Wonder.
Mayor Edmondson referred to the matter of providing names of Council members that
would like to serve on the County Law and Justice Committee. Councilman Allard
had previously indicated that he would like to serve on the Committee, as well
as Mayor Edmondson. After discussion, and no one else indicating they desire to
serve on this Committee, Mayor Edmondson stated she will submit Jean A||ard's name
as well as let them know she will serve if more than one person is desired.
The Mayor reported that Bernie Kline, Police Department, has asked for a Council
representative to serve on the County-wide Crime Prevention Board. Council member
Walker stated that she would like to serve on that Board. The Mayor will submit
her name to this Board.
II Mayor Edmondson roferred fo a |affer rauoived from C. F. Hough, Dinscfor,
Legislative Board of United Transportation Union regarding proposed legislation to
remove some runs from Seattle to Chicogo. He asked that Council members write to
their Congressmen to oppose this proposed legislation. After discussion, it
was the consensus of the Council members to refer this matter to City Manager
Eastman to get more information.
Mayor Edmondson reported that Don Schussler has been recommended to be the
Chairman of the Yakima Center Advisory Board by the Visitors and _
Convention Bureau. She asked when are to confirm or reject
the need for this Advisory Board. It was noted that Council has been waiting
for recommendations from staff on some proposed changes regarding the Yakima Center
Advisory Board. Councilman Wonder stated that they are running fine as they are now.
The Mayor reported that the Advisory Board is anxious to continue meeting and would
like Don Schussler appointed as Chairman. After discussion, it was MOVED by Simmons,
seconded by Walker that Don Schussler be appointed as Chairman of the Yakima Center
Advisory Board: carried, 8||ard Edmondson, Holbrook, Moore, Simmons and Walker
voting aye by voice vote. Wonder not voting. The Mayor stated that the Board
would be advised that the recommendation has been confirmed by City Council and that
Don Schussler has been appointed as Chairman of the Yakima Center Advisory Board.
Councilman Holbrook stated that the Airport Advisory Committee is awaiting some
guidelines from the Council. City Manager Eastman reported that he will set up
a meeting soon with the Advisory Committee.
It was MOVED by Moore, seconded by Walker to move into Executive Session for
the purpose of discussion of legal aspects of claims against the City on
public improvement project: carried, 8||ord Edmondson, Ho|bruoh, Moore, Simmons,
Walker and Wonder voting aye by voice vote.
At 8:00 PM, the Council members moved into the Council Chambers for the balance
of the meeting, Mayor Edmondson presiding, Council members A||ard Ho|brcmh Moore,
Simmons, Walker and Wonder, City Manager Eastman and City Attorney Andrews present
on roll call.
The Invocation was given by Councilman Walker.
Mayor Edmondson referred to the items placed on the Consent Agenda, questioning
II/ xhefher there were any additions or deletions from either Council member or
citizen present. Councilman Holbrook requested that item #7 be removed and
Councilman Wonder requested that item #9 be removed from the Consent Agenda.
The Mayor announced that a Resolution has been substituted for the Ordinance in
item #||; and in item #|5 the hearing date has been changed to September 6,
1077. It was the general consensus of the Council that items #7 and #9 be deleted
from the Consent Agenda, as requested. The City Clerk then read the Consent
Agenda items, as amended. It was MOVED by A||ard seconded by Holbrook that
the Consent Agenda, as read, be passed: carried, Allard, Edmondson, Holbrook,
Moore, Simmons, Walker and Wonder voting aye on roll call. (Subsequent paragraphs

one motion without further discussion.)

This being the time fixed for the hearing on the rezone application filed by •
James Elliott (Va-Alta, Inc.,-Holiday Inn) for property on the east side • '
of the intersection of 10th and o8o Streets, continued from August 8, 1977,
City Attorney Andrews informed Council that the recommendations made . •
last week are acceptable to Mr. Elliott. Mr. Elliott has agreed:
I. That chain link fencing be errected along the north and east
property lines of the rezoned area, and that the fencing be
provided with redwood colored aluminum slats so as fo'provide
site screening.
2. That no barb wire be installed on the chain link fence to be
installed in accordance with condition #|, above.
3. Along the easterly boundary, the property within the rezone
area shall be away from the property line at a grade no
more than a 45* angle.
Mr. James Smith, 12 No. ||fh Street, who had requested these changes,
thanked the Council for their and stated that fhe‘ogreemenf ls'
satisfactory to him. It was MOVED by Wonder, sqconded by Simmons that
Ordinance No. 2093, accepting the recommendations of the Planning Commission
and rezoning the property located on the east side of the intersection
of 10th and "A" Streets, be passed: carried, Allard, Edmondson, Holbrook,
Moore, Simmons, Walker and Wonder vof<ng.aye on roll call.
ORDINANCE NO. 2093, AN ORDINANCE accepting the recommendations of the Planning
Commission and rezoning property at 10th and "Kn Streets from R-3, Multiple
Family Zone, to B-3, General Business Zone,
Mr. Robert J. Edwards, West Coast Coordinator of "Enough Is Enough" Committee,
distributed copies to the Council on their beliefs on the hiring of homosexuals as
teachers, judges and enforcement officers, pornography, and prostitution. Mr.
Edwards urged the Council members to write to their Senators and Congressmen to
get the Bill HR 6747, which would make it a federal felony to use children in
sex movies and photographs, out of the committee and onto the floor for hearing and
passage. Mr. Edwards also suggested creating and appointing the Office
of "Special Assistant Chief of Po|loe whose duties would be:
a. take second of command of the Yakima City Police; •
b. examine and evaluate the efficiency of the Police Department;
c. establish and/or combine a vice/narcotics squad of the
Yakima Police Department; •
d. within 00 days of appointment, to have completed the total
analysis of the efficiency, credibility of the management and
operations of the Police Department to the City Council;
e, make recommendations relative to the reorganization if such
reorganization is needed and be acted on within 10 days
of the filing of the report by the Council;
f. be empowered to probe inferha| affairs of the Police Department
and have access to any and all records within its f||os'or
scope of operations.

The salary of the Special Assistant Chief of Police will be set at $71 per diem and
the tenure of office will not exceed 70 days, except at the pleasure of the City
Council. An official police car will be at the disposal of the Special Assistant
Chief of Police during his tenure of offlce.• Mr. Chuck Rich, County Commissioner,-
204 So. Naches Avenue, spoke to the Council of existing conditions in his neighborhood,
namely, prostitution. Mr. Rich suggested that prostitution be legalized, but
restricted to one certain area, and not be allowed in a residential neighborhood.

Mr. Rich informed Council that his life has been threatened because he is trying
to get prostitution out of his neighborhood. . Mr. Ed Blanchard, 110 No. 5th Avenue,
stated that Yakima is able to take care of itself and is against the prqposad
program outlined by Mr. Edwards. Mr. Blanchard stated that he believes .
prostitution in Yakima is protected by the Mafio. Jerry Gipson, 205 So.
Naches Avenue, stated that the City needs a Chief of Police-who will demand what he
needs in order to get . prostitution out of the residential neighborhoods in Yakima.
Mr, Glen Loveland, 802 No. 20th Avenue, stated that the law should be stricter with
prostitutes. He stated that they.should be.fined $1500 for the first offense,
$5,000 for the second offense, and if there should be a third offense, they should
be run out of the City. If they are caught here again, with a fourth offense,
they should be thrown in prison. Brenda Moody, 209.Easf "0" Street, spoke against
prostitution and stated they should be prosecuted to the full extent of the law.
B i l l Stroll, 104 N. .55fh Avenue, stated that it is more important to deal with
vicious crimes, than those committed by two consenting adults. However, he agrees
that they shouldn't be allowed to conduct their business in residential areas,
but in a restricted area set aside for this purpose. Mr. Stroll also stated that

City property. Colleen Buckley questioned Council about a meeting to be held
at fhe_E| Cid Restaurant regarding gambling. Mayor Edmondson stated that the State
i. ho|ding. -.~ a public hearing about casino-type gambling at El Cid on Friday,
August 19, 1977 at 10:00 AM. Mrs. Buckley suggested that the City have
a day of praymr.for the good of the City. Pastor Gary Me(|ick" 36 West
Washington Avenue, stated that he is against the legalization of prostitution
and any other vice. Pastor Me||iuh challenged the Church people of
Yakima to let the City officials know how they feel. Clarence Marshall,
4902 Cosf|eview Drive, President of the Yakima Motel Association,
stated that the motel owners.do not condone prostitution, but it is not .
top priority. Mayor Edmondson read a letter from the Yakima Motel `
Association which states they do not andorce Mr. Edwards or his proposed
program. It is their belief that funds should be found to provide
additional officers to the Police Department. Dennis Brown, Pastor of
Yakima Bible Baptist Church, stated he believes the people of Yakima
will stand behind more rigid prosecution of prostitutes, and.fhat will
drive these people out of our City. Bob Hooper, spoke against Mr.

Edward's proposed program. Ines Rice, 4409 Arlington, spoke against the
program proposed by Mr. Edwards. She stated that the Police Department
needs more money and more facilities. Mrs. Rice read an article from .
the Herald Republic Newspaper dated August 3, 1978. Mrs. Jean Rich, 204
So, Naches Avenue, stated that they had received threatening phone calls
and wanted to thank the Police Department for their cooperation. She
stated that the problem still exists across the street. Mr. Clyde
Keltner, a former Yakima fireman, agrees with Pastor Me||ick/ s statement,
and feels that the Police Department should get tougher on prostitutes.
Harry Arthur, 210 No. 8th Street, believes that the Police Department .
should concentrate on other orlmes. He stated that he believes that . .
prostitution should be legalized. Dan Wais, 1005 So. 42nd Street, . . .
stated that prostitution is between two consenting adults, and doesn't
feel that anyone can stop it. Norma Scheffner, 1405 Hathaway, stated
she would like to see prostitution legalized in a restricted area. She
thinks that's another way to get tax revenues for the City. ,Also she
feels that homosexual teachers should not be allowed to teach in our '
schools. Larry Robinson, 501 So. 6th Avenue, stated that the prostitution
law should be enforced by the Police Department by closing down these
"firms" and padlocking the doors. Mr. Robinson stated he felt the

a place to go. Mr. Thomas Edwards, "Enough Is Enough" Committee stated
that nothing has been done in this City about prostitution and demands
that the City do something about this si,fuafion. Councilman Al |ard stated that the
Council has passed ordinances in fha past year dealing with prosf|fuf|on. Mr. Allard
stated he would like to see a meeting with the City Manager, City Attorney and the
Chief of Police to discuss this subject. It was the general consensus of the Council
to reject the recommendation of. "Enough Is Enough" Committee and to have the
City Manager, City Attorney and Chief of Police meet .together to discuss this
situation as soon as possible and report back to the Council.' Councilman Moore, '
speaking to Mr. Robinson's suggestion in making the Police Department directly
responsible to the Council, stated that it is set up in the Charter that the
Police Department report to the City Manager, and the only way to change that
is by putting it on the ballot and having the people vote for it.

3737, authorizing the execution of a Sewer Line Installation Agreement

City Manager Eastman informed Council that EDA requires that each load
of concrete be tested that is being used for the "Uptown" project. The .
City does not have the proper equipment to do these tests, therefore,
the City Manager recommends that the City contract with the Washington
State Department of Highways to perform these tests. It was MOVED by
Allard, seconded by Moore that Resolution No. D-3738, authorizing execution
of a letter of agreement with the Washington State Department of Highways
for service in connection with various City paving projects, be passed:

RESOLUTION NO. D-3738, A RESOLUTION authorizing the Mayor and City Clerk

Councilman Wonder questioned the benefits received by the City by having
employees offend conventions. City Manager Eastman explained that an
employee has to be an officer of the Association before the City will
pay expenses of attending the convention. Willis White is an Executive Officer of
the American Public Works Association, and Hope Gomez had already committed
herself to attend Region X Equal Employment Opportunity Committee meeting,
which is relevant to Affirmative Action. Assistant City Manager Zais
informed Council that a statement of what benefits are gained is required
by the employee after attending a convention or meeting. It was MOVED
by Moore, seconded by Wonder to approve the out-of-state travel for Hope
Gomez, to Juneau, Alaska to attend a Region X Equal Employment Opportunity
Committee meeting, at a cost of $240; and for Willis White to attend the
American Public Norhs'8ssoc|oflon National.Convention to be held in
Chicago, Illinois at a cost of $678.44: carried, Allard, Edmondson,
Holbrook, Moore, Simmons, Walker and Wonder voting aye by voice vote.

Travel Expense Fund.
An Ordinance amending the 1977 budget and appropriating, transferring
and reopproprioflng money within and among the various funds and accounts
having been read by title at this meeting was laid on the table for one
week, or until August 22, 1977. City Manager Eastman and Assistant City
Manager Zais explained the reopproprlof|ons of money to certain funds,
emphasizing the transfer of funds to pay the salary of the new attorney
in the Legal Department and salaries for the Police Department for
overtime and for a narcotics investigation.

1977 be set as the date for public hearing by the City Council on this
