HomeMy WebLinkAbout09/19/1977 Business Meeting ��� wm� � SEPTEMBER 19, 1977 The City Council met in session on this date at 6:30 PM in the Conference Room at City Ho||, Yakima, Washington. Council members present were Mayor Betty L. Edmondson, Ralph Holbrook, W. K. "Pefe' Moore, Nadine Walker and Gordon Wonder. Councilmen Jean Al |ord and Dr. "Bill Simmons absent. Mayor Edmondson inquired who would be attending the A.W.C. meeting in Ellensburg on October 20 1977. Mayor Edmondson will make reservations for Councilmen Moore and Wonder, and dinner reservations for Councilman Walker. Mayor Edmondson announced that there will be a COG meeting on Wednesday, October 19 1977, to discuss what COG does for your community and what it is. COG will be sending a letter of invitation to this dinner meeting to each Councilman. Councilman Wonder requested copies of the minutes of the COG meetings for the last few months, and Mayor Edmondson said she would get them for him. Council members discussed the reservations for the meeting in San Francisco in December for the Congress of Cities Convention. ^* Those indicating they would Council then discussed revenues from the sale of the old fire station and the fire training center. Councilman Moore suggested that Chief Carroll should review the amount left in the General Obligation Fund from the sale of the Fire Training Center, to possibly be used to build a fire training tower at Fire Station #5. Mayor Edmondson announced that Governor Ray has appointed her to serve on the Governor's Commission for Law and Justice, and she has accepted. Kennith Crawford, Chief of Housing and Neighborhood Conservation, informed Council that HUD has offered the City a grant of $12,000 for a housing counselor for three months, ending December 31, 1977. There are currently two housing counselors at the Housing Services Center. There will be more funds available after the first of the year if this program is successful. It was MOVED by Holbrook, seconded by Walker that the City pursue the HUD counseling grant in the amount of $12,000 and authorize the City Manager to sign such grant: carried, Edmondson, Holbrook, Moore, Walker and Wonder voting aye by voice vofe. Allard and Simmons absent. City Manager Eastman reported that the City UAB Grant Application of $65,000 for the improvements of 18fh Avenue and Summitview, was declined because the improvements to that intersection had been cut to just raslQna|izaflon. Dick Zais, Assistant City Manager, gave a report on the financial advisory services available in Yakima in connection with the Wastewater Facilities Bonds. Harper and Sons, Hornblower and Weeks, and Merrill Lynch have sales representatives in Yakima and have expressed interest in submitting a proposal. The City has not yet asked for a specific proposal for the Wastewater Facilities Bond financial advisory services as yet. Mr. Eastman stated that staff will meet with the four firms. It was MOVED by Walker, seconded by Holbrook to move into Executive Session to discuss a legal matter: carried, Edmondson, Holbrook, Moore, Walker and Wonder voting aye by voice vote. Allard and Simmons absent. At 7:45 PM, the Council members then assembled in the Council Chambers for the balance of the Study Session meeting to discuss the transfer of the liquor license of the Corral. Mayor Edmondson reported that she had received numerous phone calls and letters (which she circulated for the Council's perusal) in _opposition to the relocation Of the Cdrra|. City Manager Eastman stated that the City should recommend denial because of the number of unresolved suspensions for activities that have taken place at the Corral. It is unusual for the Liquor � Con.ro| E�a�d�fo overturn the City's decision. However, there is recourse if that happens; the City can request a hearing before the transfer license is issued. It was MOVED by Wonder, seconded by Holbrook to accept the City Manager's recommendation to advise the Liquor Control Board that the City is in opposition to the change of location for the Corral and the transfer of the liquor license: carried, Edmondson, Holbrook, Moore, Walker and Wonder votin aye by voice vote. Allard and Simmons absent. Mayor Edmondson advised the citizens to write the Washington State Liquor Control Board, License Division, Olympia, WA 98504, to state their opposition to the relocation of the Corral and the transfer of their liquor license. At 8:00 PM, the Council members commenced the regular agenda items, Mayor Edmondson presiding, Holbrook, Moore, Walker and Wonder, City Manager Eastman and City Attorney Andrews present on roll call. Mayor Edmondson referred to the items placed on•fhe Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Mayor Edmondson announced that the Evergreen Transit Association has Transit, ven fhe ��� City of Yakima Transit, Division their "KEY" Safety Award. . Mayor Edmondson proclaimed the week of September 18 -, 24, 1977 as Square Dance Week. In celebration of this 326th year, there will be exhibitions of square dancing in the Mall, as there was in the Lobby of City Hall this morning. Mayor Edmondson reported that the information requested last week in connection with the Housing Authority Cooperation Agreement is not available as yet. . Allard and Simmons absent. . . � This being the time fixed for the hearing on the appeal from Planning Commission's decision to deny the outside utility request, filed by Fred Hommersfod, for water and sewer 'for a new eight-p|ax located at 1716 So. 10th Avenue, Mayor Edmondson stated that a letter has been received from Ronald Whitaker, Attorney for Mr. Hammerstad, withdrawing his appeal. . . • . . . Reverend Joe T. Denman, President of the Southeast Coalition, spoke to the Council regarding their concerns with certain activities in the City. Reverend Denman reported incidents where the police were late in arriving after being called about a crime. Reverend Denman stated that in visiting with Poiica Chief Jack LaRue about the situation that exists on So. 6th Street, he was advised to have people of the community unite and "put their foot down" to stop that type of activity, by being willing to sign complaints and testify against those persons responsible for.commiffing the violations; or have the area residents petition the City Attorney to take abatement action against the residence. Reverend Denman submitted a copy of a petition containing approximately 300 names, (copies of which were also submitted to the City /C|erk" Chief of Police, City Attorney, and the Prosecuting Attorney), wherein the petitioners were opposed to the action created at 1014 So. 6th Street, i.e., .gambling, murder, and other crimes. Reverend Denman stated he wants the Council to write the Coalition to let them know what action they have taken on this matter. If this matter is referred to a staff member, then he wants a letter from that Department advising them of . their action taken to alleviate this problem. Reverend Denman presented the following five proposals which were accepted by the Southeast Coalition: 11/ |. Our Yakima Southeast Coalition request to be on the agenda of one of the Council evan|ng.meeflngs once a quarter of a year, or more, if . necessary. ^^ ' Kathy Gallegos, 6 East "A" Street, questioned why these people at 1014 So. 6th Street couldn't be. shut down for disturbing the peace, Councilman Wonder expressed concern about the response to calls in.fhaf area after a crime has been committed, and also stated he would Like a report on the legality of abatement of the house located at 1014 So. 6th Street. It was the general consensus of the Council that the proposals be referred to the City Manager and staff for a report and also asked Chief LaRue for a report on the response in answering calls in the. Southeast area when a crime has been reported: carried, Edmondson, Ho|brook, Moore, Walker and Wonder voting aye by voice vote. ,Allard and Simmons absent. This being the time fixed for the hearing on Petition No. 911 filed by A. R. and Barbara V. Rankin and Phil E. and Kathleen M. Souder, requesting annexation of property in the vicinity of East Nob Hill Boulevard and So. 6th Street, if was MOVED by Moore, seconded by Walker that Ordinance No. 2107 annexing said property, be passed: carried, Edmondson, Holbrook, Moore, Walker and Wonder voting aye on ro|.| call. Allard and Simmons absent. . . . ORDINANCE NO. 2107, AN ORDINANCE annexing property to the City of Yakima and zoning said property. This being the time fixed for a hearing on the proposed dog licensing ordinance amendments, Assistant City Manager Zais explained that this ordinance contains the amendments requested by Council at their July ||, 1977 meeting. The proposed amendments would increase the cost of dog licenses from $0.00 to $6,00 for dogs who have been sterilized, and $12,00 for dogs who are still ."Intact". 8|s.o the impound tee would be increased from $10.00 to $15.00 for the first two impounds during any 12 month period, and $35.00 for each subsequent impoundment of that same dog during that 12 month poriod,. The proposed amendment would also increase the late penalty for obtaining a dog license from $4,{}0 to $|O.00. There was discussion on the amount the increased fees would bring, and the cost to administer the Animal Control Program. Councilman Holbrook stated that he was in favor of increasing the impound fees, b would like the. license fees, to remain the same. Agnes and Allen Ross, All So. 17fh Avenue, submitted a letter .to Council explaining their experience of the impounding of their dog. They stated that their child is in a wheel chair and they would like to have the dog with him when he is outside. Mr. Ross stated that he objects to the raising of the impound fee. William Stroll, 104 N. 55th Avenue, spoke in behalf of the senior citizens, requesting that an exemption from an increase of .the dog License fee. He also suggested that a copy of the 8nlmoi Control Ordinance be included with every dog license sold. Bob Craner, 211 No, 7+h Street, reported that people let their dogs run loose during the night when there is no way to control them. Others speaking on this matter were Jdhn K|inga\e, h013 West Walnut and Larry Robinson, 501 So. 6th Avenue. It was MOVED by Holbrook, seconded by Moore to adopt the proposed ordinance, except the dog license fees should remain $6.00 for all dogs. After discussion, Councilman Holbrook withdrew the motion and Councilman Moore withdrew the second. Assistant City Manager Zais stated that if Council did not like the increase in fees for unsterile dogs, in order to control overpopulation of dogs, then another possibility would be to not charge a .\ioensa fee for .those who are sterile. Mayor Edmondson asked how this would effect the budget of Animal Control. Mr. Zais said that the animal. control program costs about $77,000 to $80,000. We would save some money on Humona Shelter costs. Allard and Simmons absent. Councilman Holbrook stated he would like to see 'if some deviation of this law could be made for ' - problems like the Ross's have. Councilman Wonder stated he would like facts of success or failure on the sferY|e/uns+er|ie dog license program. This being the time fixed for the hearing on the 1978 Community Development Budget, Kennith Crawford, Chief of Housing and Neighborhood Conservation, briefly outlined the proposed budget of $923 Those spoehing.in favor of spending money to construct tennis courts at Washington Junior High were Chris `^ ' Chandler, 602 So. 8th Street, Brian Berglund, Student Body President at Washington Junior High (submitted petition signed by students of Washington Junior High), Don Breitenfeldt, 203 Belair Drive, Board Member of School District #7, Don Hunt, Principal of Washington Junior High, Johnnie Rance, Director of the Southeast Community Center, Gilbert Chandler, 602 So. 8th Street, and Reverend Denman, 814 Central Avenue. Mr. Beauchamp asked what the outlay of $43,700 covered under Housing .Services Adm|'nisfrnfion, Mr. Crawford explained that it covered the salaries of two housing counselors and one clerk-typist, plus all the supplies and equipment needed. He stated total administrative . costs are 23%, and 1200 people were counseled last year. Dr. Marjorie Wilson, Yakima Neighborhood Health Services, explained their services and requested funds. Evelyn Pleasant, 1202 Fair Avenue, asked about the rehabilitation grant. Ken Crawford explained that certain people who qualify for these grants, according to their income, can receive up to $5,000 to repair their homes. Also, there is the Craftsman Corps which has been designed to aid senior citizens in critical home repairs up to $1500 for supplies and the labor is performed by volunteers. Mrs. Pleasant requested the addresses of the homes that hove.been repaired so they can be inspected. City Attorney Andrews stated that he wuu|d.have to check i on the legality of this to make sure that it doesn't fall under the privacy laws. Caroline Smith, 1210 So. 7th Street, stated that her home had been worked on in July under the rehabilitation grant, and still the work hasn't been completed. Henry Beauchamp stated that there is not one person from the Southeast area who • had been hired for this proQram. Kathy Gallegos, 6 East "Ax Street asked what the use was in rehabilitating these homes, if certain | | |ega| activities are allowed to continue in the neighborhood. Mrs. Stewart, 1106 No. 4th Street, stated that her home had been rehabilitated on the 312 Loan Program. She said a contract had been drawn up for electrical and plumbing repair and when that work was completed, three inspectors inspected the work. Councilman Wonder stated he was concerned about the administrative costs, and would like to see a detailed breakdown of these costs. .Councilman Holbrook stated he.would like a report ' regarding the hiring of people from the Southeast area to work on the rehabilitation repair program. Mayor Edmondson announced that this hearing will be continued to Monday, September 26 at 3:00 PM.
