The City Council net in session on. this date at 7:00 P.M. in the Council
Chambers of City Hall, Yakima, Washington, Mayor Betty L. Edmondson
presiding, Council mambers Lynn Buchanani-tOn Hinman,
Nadine Lee and Gordon Wonder and City Manager Zais and City Attorney
Andreas present on roll call. Councilman Jack Sparling absent.
The Invocation was given by Mayor Edmondson.
Mayor Edmondson referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from either
Council members or citizens present. The City Clerk then read the
Consent Agenda items, including resolutions by title. It was MOVED by
Hinman, seconded by Lee that the Consent Agenda, as read, be passed:
carried, - Budhanan, Edmondson, Hinman, Lee, Wonder and Beauchamp voting
aye on roll call. (Subsequent paragraphs preceded by an asterisk (*)
indicate items on the Consent Agenda to be handled under one motion
without further discussion.)
It was MOVED by Hinman, seconded by Lee that the minutes of the June 19

and 26, 1979 meetings, having been duly certified accurate by two Coun-
cil nembers and no one present wishing to have said minutes read pub-
licly, be approved: carried, Buchanan, Edmondson, Hinman, Lee, Wonder
and Beauchcimp voting aye on roll call. Sparling absent.
This being the time fixed for the hearing on Petition No. 949, filed by
Cox Cable of Yakima, Inc., requesting annexation of property located at
North 16th Avenue and Hathaway, and no one present wishing to speak to
this matter, it was MOVED by Hinman, seconded by Buchanan that Ordinance
No. 2312, annexing said property, be passed: carried, Edmondson, Hin-
man, Lee, Wonder, Beauchamp and 'Buchanan votingraye.lon roll cal 1.

ORDINANCE NO. 2312, AN ORDINANCE annexing property to the City of Yakima
and zoning said property.
This being the time fixed for the hearing on the appeal to the Planning
Commission's decision to deny the rezone application filed by Hobart
Weaver for property located at 62 and 64 West Mead Avenue, Councilman
Beauchamp inquired if this was the same property that came to the Coun-
cil last year for a rezone. Larry Wright, Principal Planner, reported
that this property has been before the Council previously. The owner
accepts Planning Commission has said it would look more favorable if it
cane as a Planned Development. Mr. Wright reviewed the surrounding
zones and named sane of the businesses in the vicinity. There being no
citizen present wishing to speak to this matter, it was MOVED by Wonder,
seconded by Lee that Resolution No. D-4114, affirming the action of the
Planning Commission in denying the said rezone, be passed: carried,
Hinman, Lee, Wonder, Beauchamp, Buchanan and Edmondson voting aye on
roll call. Sparling absent.
RESOLUTION NO. D-4114, A RESOLUTION affirming the action of the Planning
Commission in denying the rezone of property situated at 62 and 64 West
Mead Avenue in the City of Yakima, Washington, from R-2, ¶o Family
Zone, to B-3, General Business Zone.
This being the time fixed for the hearing on Petition No. 950, filed by
Robert and Elizabeth Lynch and R. J. and Mary Gustafson, requesting

vacation of a portion of Ramona Road right-ofway, Councilman Wonder
inquired about the width of the right-of-way. Larry Wright, Principal
Planner, reported that it is 42 feet wide. councilman Hinman inquired
if the City awns the property. Mr. Wright reported that the City has
easements for the purpose of installing a road or for using it for
utilities or for use of right-of-way. He stated that the City does not
receive a title for that land. Mr. Wright explained the formula used
for establishing the amount the applicant would compensate the City for
the vacation of the right-of-way. Council members discussed the formula
used for establishing the amount of compensation and City Attorney
Andreas reported that that formula can be changed, but in time for this
vacation. It was MOVED by Hinman, seconded by Wonder that Ordinance No.
2313, providing for the vacation of said right-of-way, requested by
Robert Lynch and R. J. Gustafson, be passed: carried, Lee, Wonder,
Beauchamp, Buchanan and Hinman voting aye on roll call. Edmondson
voting nay. Sparling absent.
ORDINANCE NO. 2313, AN ORDINANCE providing for the vacation of a portion
of street right-of-way within the City of Yakima, Washington.

City Manager Zais, giving a status report on the Larson Garage neg-
otiations, reported that the City Attorney has advised him that the
negotiations are at the point where it must be discussed in public, and
not in Executive Session. He reported that Benny Kwong would now like
to purchase the Larson Garage outright. Previously, we were discussing
a trade of property for the Garage. It was discovered that at that
time, however, that Mr. Kwong did not own the amount of property he had
in mind for the exchange. Mr. Kwong has submitted an alternative pro-
posal -- trade with the City three downtown parking lots, which City
Manager Zais outlined on a map. He proposed to pay the difference in
cash if there is a difference in value of property. He would also agree
to maintain the Garage during business hours for public parking for 19
years. He requested that the City would then cease the practice of
selling monthly parking in the City-owned downtown parking lots.
Councilman Wonder expressed concern about giving up the option of being
able to sell monthly parking in the City-owned lots in the future. City
Attorney Andreas reported that Mr. Wong is bringing this proposal to
Council to see if Council is receptive to this type of proposition. If
Council thinks it may have merit for the City, then we would have the
property appraised and if those values are such that either party
doesn't want to enter into an agreement, then it would not be binding.
Several Council members expressed concern that this discussion is not
taking place in an Executive Session. City Attorney Andrews reported
that although the Open Meeting Law provides exceptions to allow land
acquisition to be discussed in Executive Session to keep the price from
being inflated, the City is at the point now in its negotiations that it
doesn't have to be discussed in Executive Session. He stated that if
people could buy property to speculate to drive up prices, then it could
be discussed in Executive Session. City Manager Zais reported that each
party would pay the cost of their an appraisal,. Concern was again
expressed that this is a topic for Executive Session. City Attorney
Andregs stated that since this property is being paid for by the pro-
perty owners of L.I.D. No. 1001, then full disclosure must be made by
the City of their intention to trade or sell it. He stated that he
would review the Executive Session statute again and Council could delay
action until after his report. It was MOVED by Wonder, seconded by
Beauchamp that City Management proceed with negotiations with Mr. Kwong
with the stipulation that the approach be the same as that in the past.
City Manager Zais questioned if this motion included authorization to
obtain the appraisals. It was the general consensus of the Council that
it does. The question was called for the vote on the motion: carried,
Beauchamp, Buchanan, Edmondson, Hinman, Lee and Wonder 'voting aye by
voice Sparling absent.
Carol Darby, Director of community Development, introduced Carole
FolsoM-Hill as the Citizen Participation Coordinator at the Housing
Services Center. Miss Darby explained that the Housing Authority had
been offered 35 units of existing Section 8 Housing by HUD and for
various reasons the Housing Authority turned down the offer. The City
of Yakima was not aware of that offer. Then HUD offered the Housing
Authority 50 units of moderate rehabilitation housing which offer was
also declined, which the City has recently learned about. We found out
that because those units were turned down, it might effect our Community
Development Block Grant. We approach ed the Housing Authority and asked
them to reconsider their decision. They told us they felt they did not
have the staff or knowledge to put that type of grant together. Since
the City of Yakima. has experience in rehabilitation work, we offered our
staff to put together the application and bring it to the point of
actual operation work. We are still waiting for the draft regulations,
but it is important to submit this now. Council member Lee inquired
about the location of these units. Darrell Griek, Housing Services
Center, reported that the rental units can be located anywhere within
the target area. They can be single or family units, however, they have
to be non-owner occupied. He stated that an apartment owner would go to
the bank and secure his own loan and HUD would guarantee that loan to
120% of fair market rent. Council member Lee inquired if this program
would be turned aver to the Housing Authority after they have been
rehabilitated. , Mr. Griek reported that we will be doing the rehab-
ilitation work and then turn it over to the Housing Authority. The
rehabilitation work will be let out to contact. It was MOVED by Lee,
Seconded by Hinman that Resolution No. D-4116, authorizing a contract
for the Yakima Housing Authority whereby the City will administer a
residential rental unit_rehabilitation program, be passed: carried,
Wonder, Beauchamp, Buchanan, Edmondson, Hinman, and Lee voting aye on
roll call. Sparling absent.

RESOLUTION NO. D-4115,_ A RESOLUTION authorizing the City of Yakima to
enter into a contract with the Yakima Housing Authority whereby the City
will administer a residential rental unit rehabilitation program.
It was MOVED by Hinman, Seconded by Lee that Resolution No. 0-4116,
authorizing the disposal of City surplus personal property, be passed:
carried, Buchanan, Edmondson, Hinman, Lee, Wonder and Beauchamp voting
aye on roll call. Sperling absent.

personal property owned by the City.

authorizing the purchase of a bookmobile van for the On Guard Program,
without calling for bids, be passed: carried, Buchanan, EdMondson,
Hinman, Lee, Wander and Beauchamp voting aye on roll call. Sparling
absent.
RESOLUTION NO. D-4117, A RESOLUTION authorizing the purchase of a bodk-
mobile van for the On Guard Program of the Yakima Police Department
without calling for bids.

permit for 109-111 North 2nd Avenue, as requested by O.E. Hollingbery,
be approved: carried, Buchanan, Edmondson, Hinman, Lee, Wonder and
Beauchamp voting aye on roll call. Sparling absent.
It was MOVED by Hinman, seconded by Lee that Resolution No. D-4118,
fixing a date of hearing for July 24, 1979 on the Six Year Trans-
portation Improvement Program, be passed: carried, Buchanan, Edmondson,
Hinman, Lee, Wonder and Beauchamp voting aye on roll cali. Sparling
absent.
RESOLUTION NO. D-4118, A RESOLUTION fixing the time and place for hear-
ing on a Six Year Transportation Improvement Program for the period of
1980 through 1986.
It was 'MOVED by Hinman, seconded by Lee that July 24, 1979 be fixed as
the date of hearing on the fallowing: Petition No. 946, 'filed by Lee
Stratton, requesting annexation of property located at 1820 South 3rd
Avenue; Petition No. 934, filed by Richard Abhold and H.S. Robinson
representing Arctic Circle, Inc., requesting annexation of property
located at 3912 West Nob Hill Boulevard; and modifications to pre-
liminary plat for Tancara Subdivision: carried, Buchanan, Edmondson,
Hinman, Lee, Wonder and Beauchamp voting aye on roll call. Sparling
absent.
It was MOVED by Hinman, seconded by Lee that Resolution D-4119,
ordering segregation of an assessment in L.I.D. No. 1009, Freeway Pro-
parties, Inc„ Water District, be passed: carried, Buchanan, Edmondson,
Hinman, Lee, Wonder and Beauchamp voting aye on roll call. Sparling
absent.
RESOLUTION NO. D-4119, A RESOLUTION ordering segregation of an assess-
ment in Local Improvement District No. 1009.
City Manager Zais reported the hearing on the Community Garden project
cannot be heard tonight because public notice was inadvertently over-
looked. He suggested that the first hearing be scheduled for the 24th
of July and the second hearing be scheduled at a special meeting on the
7th of August. It was MOVED by Lee, seconded by Hinman to reaffirm the
hearing dates for Community Garden Project for July 24 and August 7 be
set for the second hearing: carried, Beauchamp, 'Buchanan, Edmondson,
Hinman, Lee and Wonder voting aye by voice vote. Sparling absent.
City Manager Zais referred to the article in the Herald-Republic News-
paper which reported on a Civil Service CcMmission meeting which the
City Manager requested the Commission to change one of their rules. He
stated that he does not want to wait until the City is in non-compliance
in their Affirmative Action Program to change the Rule One regulation,
which requires that the top person on the register be offered the posi-
tion. He stated that with only four or five vacancies a year in the
Police or Fire Departmnts, we are not going to reach dawn that register
very far with the Rule of One. He told the Commission that he wants the
authority to reach down the register to any one who had passed the
examination, particularly in the Police Department. He reported that

Mr. Flower, one of the Commissioners was out-of-town and the Commission
will reconsider this at their next meeting It was MOVED by Lee, sec-
onded by Hinman to support the action of the City Manager in his request
to the Civil Service Commission in doing away with the Rule of One:
carried, Beauchamp, Buchanan, Edmondson, Hinman, Lee and Wonder voting
aye by voice vote. Sparling absent.
It was MOVED by Hinman, seconded by Lee to move into Executive Session
for the purpose of discussing pending litigation and then adjourn the
meeting: carried, Beauchamp, Buchanan, Edmondson, Hinman, Lee and
Wander voting aye by voice vote. Sparling absent.
Items of information supplied to the Council were: memo from Director
of Community Development re Urban Area Plan - Review Process for Adop-
tion. 6/25/79; Minutes of June 26, 1979 Board of Adjustment meeting;
monthly report from Yakima Air Terminal for May, 1979; and monthly
report of Code Administration Office activities for June, 1979.
The Executive Session being completed, the meeting was adjourned at the
hour of 9:30 P.M.
