HomeMy WebLinkAbout05/31/1977 Business Meeting 517 MAY 31, 1977 At 3:00 p.m., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Edmondson presiding, Council members Allard, Holbrook, Moore, Simmons and Walker, City Manager Eastman and City Attorney Andrews present on roll call. Councilman Wonder absent. The Invocation was given by Councilman Holbrook. The Mayor announced that the entire Council meeting is being taped for the first time. Mayor Edmondson referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Councilman Allard requested that Item #7 be deleted from the Consent Agenda and Mayor Edmondson requested that the minutes of the previous meeting be deleted from the Consent Agenda. It was the consensus of the Council that the deletion of Item #7 and the minutes of the previous meeting, as requested, be made. The City Clerk then read the Consent Agenda items, including Resolutions by Title. II/ It was MOVED by Allard, seconded by Holbrook that the Consent Agenda, as read, be passed: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. (Subsequent paragraphs preceded by an asterisk (*) indicate items on the Consent Agenda to be handled under one motion without further discussion.) It was MOVED by Allard, seconded by Holbrook that the Minutes,of the previous meeting, as corrected, having been certified accurate by two Councilmen, and no one present wishing to have said Minutes read aloud, be approved: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. Mr. McElroy, 803 So. 27th Avenue, speaking unofficially for the'Veteran's of Foreign Wars, commented on the Memorial Day Parade. He said that Council members would be invited to participate in the Veteran's Day Parade, November 11, 1977, and a car would be provided for them. Councilman Allard reported that there were about 4,000 people in attendance at the State A Track Meet held at Eisenhower Stadium, for which that convention committee deserves a special commendation. It was MOVED by Allard, seconded by WOkei^ consideration of awarding bids on Capitol Theatre project be discussed at Noon, Friday, June 3, 1977, at City Hall: carried,. Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. It was MOVED by Holbrook, seconded by Moore that Council authorize Preston L. Shepherd & Associates to proceed with L.I.D. No. 1011, River Road Sewer District: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. City Attorney Andrews analyzed the cooperation agreement between the City of Yakima and the Housing Authority. In substance, the contract calls for the City to help with rezones, put in City utilities, accept dedication of public rights-of-way and I/I to vacate public rights-of-way, if necessary. The City would do these things at no cost to the Housing Authority. The real estate taxes would be waived and in lieu of these taxes, a fee would be paid to the City in the amount of 10% of the shelter rent. This fee would then be dispursed to the County and State and any other people who would normally have received funds from the property tax. Mr. Tom Hargis, Chairman of the Housing Authority, spoke to the Council on this matter. He stated that following procedures of HUD, the agreement is necessary to reserve the funds granted to the Housing Authority, prior to having specific properties. Mayor Edmondson- asked if the Housing Authority could decide on projects, project location, and acquisition of property without consulting the Council. Ken Crawford, Chief of Housing and Neighborhood Conservation, stated that the Housing Authority has applied to HUD for funds for this project, and therefore, any decisions regarding the project would have to have HUD's approval. Councilman Allard asked what legal liability the City would have in connection with the Housing Authority's project and full faith and credit on any bonds that may be issued. Mr. Crawford stated that the full faith and credit of the U. S. Government is pledged on any obligations set forth by the Housing Authority. Tom Hargis stated that the Housing Authority will come back and present their plans to keep Council informed, although it is not required by law. It was MOVED by Allard, seconded by Moore that Resolution No. D-3698, authorizing execution of a cooperative agreement with the Housing Authority and the City of 518 MAY 31, 1977 Yakima, be passed: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. RESOLUTION NO. D-3698, A RESOLUTION authorizing the City Manager and the City Clerk of the City of Yakima to execute a cooperative agreement with the Housing Authority of the City of Yakima. It was MOVED by Allard, seconded by Holbrook that Resolution No. D-3699, authorizing execution of an agreement with Oregon-Washington Railroad and Navigation Company and Union Pacific Railroad Company for construction of a 30-inch sewer crossing beneath its track on Mead Avenue, be passed: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. RESOLUTION NO. D-3699, A RESOLUTION authorizing the Mayor and City Clerk of the City of Yakima to execute an agreement with Oregon-Washington Railroad and Navigation Company and Union Pacific Railroad Company for a sewer pipeline II/ installation across railroad right-of-way. It was MOVED by Allard, seconded by Holbrook that the application for Right- of-Way Use Permit, to allow construction of structures in connection with the rebuilding of the Capitol Theatre, be approved: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. *It was MOVED by Allard, seconded by Holbrook that Resolution No. D-3700, denying payment of damage claim filed by Richard R. Voytilla for wrongful impoundment of his car, be passed: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. RESOLUTION NO. D-3700, A RESOLUTION denying payment of the claim of Richard R. Voytilla in the amount of $29.43 filed with the City of Yakima. *It was MOVED by Allard, seconded by Holbrook to approve the outside utility request for domestic water and sewer service for Sentinel Land Company, for property located at King Street and South 13th Avenue; for•Dr. Frank LeCocq for property located at the northeast corner of Lincoln and 18th Avenue; and for Don Gimlin for property located in the 1700 block of So. llth Avenue: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. *It was MOVED by Allard, seconded by Holbrook to approve the out-of-state travel request for Dave Vargas, Project Manager, and Sandy Rogers, Traffic Engineer, to attend a June 2, 1977, conference in Portland, Oregon on "Railroad-Highway Grade Crossing Warning Systems and Crossing Surfaces" sponsored by the Washington-Oregon Public Utility and Transportation Commission: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. It was MOVED by Moore, seconded by Walker to approve the out-of-state travel request4..}for Bruce Belfield, Alarm Supervisor, to travel to Portland, Oregon from June 1-3, 1977 to analyze specifications and design criteria of available communications equipment: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting aye on roll call. Wonder absent. II/ It was the consensus of the Council to meet Thursday evening, rather than Friday afternoon, so more Council members may attend, as the information requested from Bill Paddock on the Capitol Theatre would be available by Thursday afternoon. There being no further business to come before the Council, it was MOVED by Moore, seconded by Allard that this meeting be adjourned at the hour of 3:30 P.M. to then meet on Thursday, June 2, 1977, at the hour of 8:00 p.m. in the Council Chambers at City Hall: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Walker voting • aye by voice vote.
