The City Council met in session on this date at 7:00 P.M. in the Council
Chambers of City Hall, Yakima, Washington; Mayor Betty L. Edmondson pre-
siding, Council members Henry Beauchamp, Lynn Buchanan, Lynn Carmichael,
Shirley Doty and Don Hinman and City Manager Zais and City Attorney
Andrews present on roll call.
The Invocation was given by Council member Carmichael.
Councilman Frank E. Roberts, having submitted his resignation effective
February 15, 1980, and Council having authorized legislation be prepared
to appoint A. Bruce Crest to serve the balance of his term, it was MOVED
by Hinman, seconded by Beauchamp that Resolution No. D-4229, appointing
A. Bruce Crest as a member of the Yakima City Council, be passed:
carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson and Hinman
voting aye on roll call.
RESOLUTION NO. D-4229, A RESOLUTION appointing A. Bruce Crest as a
member of the Yakima City Council.
Councilman A. Bruce Crest was then sworn into office by the City At-
torney, Fred Andrews.
Mayor Edmondson referred to the items placed on the Consent Agenda,
questioning whether there were, any additions or deletions from either
Council members or citizens presents. Councilman Hinman requested that
Items No. 13 and 16 be added to the Consent Agenda. Councilman Beau-
champ objected to Item No. 13 being added to the Consent Agenda, and
Council member Doty objected to Item No. 16 being added to the Consent
Agenda. The Deputy City Clerk then read the Consent Agenda items,
including resolutions and ordinances by title. It was MOVED by Beau-
champ, seconded by Einmanithat the Consent Agenda, as read, beipassed:
carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and

accurate by two Council members and no one present wishing to have_said

It was the general consensus of the Council to allow a presentation by
Joel Heinzen and Janet Johnstone, at this time, out of sequence on the
agenda. Janet Johnstone, Amnesty International, distributed copies of
the objectives of Amnesty International, which has been organized for 20
years and has over 100 countries:enrolled in its membership. She stated
that they are organizing a chapter in Yakima and urged support from the
Community.
This being the time fixed for the hearing on the Final Assessment Roll
for L.I.D. No. 1026, 18th,and-Greenway WaterlDistrict, Councilman Beau-
/ champ inquired why J the Water-Sewer Fund is paying for 340 feet of the
assessment. Carol Darby, Director of Community Development, reported
that there is City right-of-way and it finished out the grid for that
area: Mayor Edmondson then asked if the City would.recover this outlay
when other people hook up, and Ms. Darby answered in the'affirmative.
Constant Hinkle, 131,17South 18th Avenue, asked various questions about
the project which staff answered. Kenneth Harper, 1903 Greenway, ques-
tioned when they are going to get hooked up. Ms. Darby stated that as
soon as the residents come in -and make their request, staff will begin
hooking them up. Mr. Harper also expressed concern about the'. duplex
being allowed to be ,. hooked up to the water line In that area. The
public pOrtion of the hearing being closed, it was MOVED by Buchanan,
seconded by Hinman that Ordinance No.'2393, confirming the Assessment
Roll for Na. 1026, 18th Avenue and Greenway Water District, be
passed: carried, Carmichael, Crest, Doty, Edmondson, Hinman, Beauchamp
and Buchanan voting aye on roll call.
ORDINANCE NO. 2393, AN ORDINANCE confirming the Assessment Roll covering
Local Improvement District No. 1026 as created and established by Or-
dinance No. 2281 of the ordinances of the City of Yakima.

This being the time fixed for the hearing on the Resolution of Intention
to create a Local Improvement District for the purpose of constructing a
water main to Moose Lodge, Council member Doty inquired where this
property is located. Dennis Covell, City Engineer, stated that the
property is off of North 16th Avenue before you get to the freeway
interchange on the right hand side of the road. There being no citizen
present wishing to speak to this item, the public portion of the hearing
was closed. It was MOVED by,Doty, seconded by Buchanan that Ordinance
No. 2394, creating L.I.D. No. 1029, Moose Lodge Water District, be
passed: carried, Crest, Doty, Edmondson, Hinman, Beauchamp, Buchanan
and Carmichael voting aye on roll call.
ORDINANCE NO. 2394, AN ORDINANCE providing for the improvement of cer-
tain property by constructing the necessary mains, fire hydrants,
valves, and appurtenances for the purpose of supplying water for domes-
tic use and fire protection; establishing a Local Improvement District,
providing for the method of payment thereof, and creating a special
fund.
John Klingele, 1312 West Walnut, stated that last week a resolution was
passed to amend the Rules of Procedure of the Council, which he believes
needs to be reenacted because it requires that all members of the Coun-
cil need to be present and Councilman Buchanan was absent. City At-
torney Andrews stated that it requires a two- thirds vote of the Council,
and therefore the action taken last week is valid.
Mayor Edmondson proclaimed April 9, 1980, as Arbor Day and stated there
will be a special planting at Randall Park at 3:30 P.M. She also pro-
claimed April 13 through 19 as Days of Rememberances and reported'there
was a resolution adopted by the U. S. Congress as Days of Rememberances
of the victims of the holocaust in the Nazi concentration camps.
Council members discussed the report from the Community Development
Department on Garfield area neighborhood group request for signalization
of Lincoln /Custer intersection. Council member Doty stated that she
understands that gradeschool students cross at this intersection, how-
ever, the School District will change its boundary to avoid this prob-
lem. She stated she also noticed that disabled youngsters try to cross
there, and inquired if that was taken into consideration. Carol Darby,
Director of Community Development, stated that the School Safety Com-
mittee was consulted. She stated that this intersection does not meet
the criteria to require a traffic signal, and, in fact, by adding a stop
light there, it could increase these problems. Toney Deccio, 1312
Cherry Avenue, distributed an invitation for Council members to meet at
that intersection on April 9, 1980, at 4:30 P.M. He stated that the
service station at that intersection is the greatest hazard on Lincoln
Avenue. Following discussion, it was MOVED by Carmichael, seconded by
Buchanan to accept the staff report and recommendation: carried, Bu-
chanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by
voice vote. Beauchamp voting nay.
At the request of the City Manager, it was the general consensus of the
Council that the report on fuel flowage fee increase be continued for
one or two weeks.
Carol Darby, Director of Community Development, reported that the City
will be on a 90/10 match basis for ADAP funding instead of 80/20. She
reported that the City is eligible for $175,000 through ADAP funding
this year. She reported that the $5,000 allocated for the fencing at
the Airport was leveraged for $50,000 of additional funds to add to this
project. She stated that FAA has told the City that the next project
would be the purchase of a snow blower. The State has tentatively told
us that they would give us 5% of our 10% match, however, staff is re-
questing appropriation of the full 10% match for the 06 project, which
is for the fencing and acquisition of a snowblower. It was MOVED by
Hinman, seconded by Buchanan to accept the recommendation of the Airport
Advisory Commission and staff and ask for appropriate legislation to be
prepared to appropriate the additional $12,000 match for the proposed
project: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmond-
son and Hinman voting aye by voice vote.

Larry Wittenberg, Assistant City Manager, spoke about the gasoline
allocation, specifically for emergency services, which remained at 100%.
If we had to reallocate internally, most of the non-emergency services
would have to be shut down. He also stated that the cost advantage of
buying large quantities is diminishing. He stated that the only source
the City has 100% guarantee for diesel fuel, is for the Transit System.
He stated that it is price, right now, rather than availability that is
controlling our consumption. Mr. Wittenberg advised the Council about
some of the conservation measures taking place by the departments. He
stated that we are exploring a few things in the area of energy audits,
i.e. proposal for energy audit consultant and energy grants. He stated
that the City has storage capacity for about one month's usage -- 15,400
gallons for gas, and 27,600 gallons for diesel. It was MOVED by Bu-
chanan, seconded by Beauchamp to accept the report: carried, Beauchamp,
Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by
voice vote.
It was MOVED by Beauchamp, seconded by Buchanan to accept the report on
the withdrawal of the Fire Department from the Equipment Rental Pool and
direct staff to prepare the proper legislation for the withdrawal of the
Fire Department from the Equipment Rental Pool: carried, Beauchamp,
Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by
voice vote.
It was MOVED by Hinman, seconded by Carmichael to accept the report on
the processing of outside utility requests. Mayor Edmondson stated that
a sentence on page 1 needs to be clarified so that it states that the
Planning Commission recommends to the City Council, not approves the
annexation. Ms. Darby reported that in the first three months of 1980,
there have only been eleven outside utility requests, which is about 50%
less than what was anticipated. Following discussion, the question was
called for the vote on the Motion: carried, carried, Beauchamp, Bu-
chanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by
voice vote.
Carol Darby, Director of Community Development, reported that she had
met with Dick Anderwald and County Commissioner Chuck Klarich regarding
the Fairview-Sumac Sewer. She stated she had requested a letter from
the Council regarding the status of this project. She reported that
this letter has not been prepared, but we should get it within the next
week. She gave a brief status report, stating that an inspector visited
the site as construction has been going on. There is one area that had
to go deeper than anticipated and there is an area for which the sewer
line will have to go down the side of the road, which requires purchase
of rights-of-way. She stated that tees are being installed, however
there cannot be any hook-ups until the line has been tested. She stated
that when the letter from the County is received, she will bring it to
the Council.
It was MOVED by Beauchamp, seconded by Hinman that Resolution No.
D-4230, authorizing execution of a CETA Special Project Contract to
conduct a Beautification Program in the Central Business District, be
passed. Following discussion about the trees in the CBD area, the
question was called for the vote on the Motion: carried, Doty, Edmond-
son, Hinman, Beauchamp, Buchanan, Carmichael and Crest voting aye on
roll call.
RESOLUTION NO. D-4230, A RESOLUTION authorizing and directing the City
Manager and City Clerk of the City of Yakima to execute an agreement
with the County of Yakima for a CETA special project.
Councilman Beauchamp questioned why additional money is being requested
for the Northeast Section Ditch Fencing Project. He stated the original
estimate was $35,000 and now an additional $39,000 is being requested.
Carol Darby, Director of Community Development, stated that the en-
gineering estimate was derived after contacting some of the local con-
tractors. She stated there will be some removal of shrubs, bushes,
clotheslines, etc. She reported the neighbors have said they will
assist some people in moving and replanting the shrubs. Mayor Edmondson
stated that she thought if a citizen used the right-of-way, they did it
at their own risk. Ms. Darby stated that this is true, however, the
City is trying to build some credibility and good will in that area.

They know that the City is not going to put all of the things back for
them. She stated that the original estimate was a poor estimate. The
costs have gone up substantially. She reported a problem is that staff
is not sure if some of that fence is cemented to the canal, which would
mean repairing some of the walls. She stated that there is only $12,000
left in the Community Development Block Grant Contingency Fund. City
Manager Zais stated that another element that was taken into considera-
tion was the fact that there was not that clear a determination of City
right-of-way and that would take a tremendous amount of time to clarify.
Betty Gaudette, 701 North 6th Street, expressed concern that staff is
still discussing this while the water will be coming into the ditch
soon. Patty Huff, 713 North 3rd Street, stated that the fence is old
and needs repairs. She reported that there is already water in the
ditch. James Gaudette, 707 North 6th Street, stated that Council is
talking about dollars and referred to the City's liability under the

Attractive Nuisance Law. It was MOVED by Hinman, seconded by Buchanan
to direct staff to make the necessary changes which would cover the
whole cost of fencing the ditch, and come back with the appropriate
changes in Community Development Block Grant Funds: carried, Beauchamp,
Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by
voice vote.

Office of Environmental Planning on the new fee system, be accepted:

D-4231, authorizing payment of $148.55 to Glenda Hamlin in settlement of
a claim for damages incurred to the windshield of her vehicle when the
tire of a City Transit Bus threw off a piece of asphalt from the road,
be passed: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty,
Edmondson and Hinman voting aye on roll call.
RESOLUTION NO. D-4231, A RESOLUTION authorizing payment of $148.55 to
Glenda Hamlin in settlement of a claim for damages filed with the City
of Yakima.
*It was MOVED by Beauchamp, seconded by Hinman that Resolution No.
D-4232, authorizing payment of $237.30 to Bill K. Monahan in settlement
of a claim for damages incurred to his vehicle when the City Refuse
truck slid into the side of his pick-up truck, be passed: carried,
Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman
voting aye on roll call.
RESOLUTION NO. D-4232, A RESOLUTION authorizing payment of $237.30 to
Bill K. Monahan in settlement of a claim for damages filed with the City
of Yakima.
*It was MOVED by Beauchamp, seconded by Hinman that Resolution No.
D-4233, denying the claim filed by William McGriff alleging the City
sewer line was clogged causing damage to his residence, be passed:

travel request for Kenneth Groth, Fire Department, to attend the Na-
tional Fire Academy Course at Emmitsburg, Maryland, at a cost of
$200.00, be approved: carried, Beauchamp, Buchanan, Carmichael, Crest,
Doty, Edmondson and Hinman voting aye on roll call.
*It was MOVED by Beauchamp, seconded by Hinman that April 22, 1980, be
set as the date of hearing for the rezone request filed by Stan Coffin
for property at 416 South 45th Avenue, and the rezone of property on
North Front Street, initiated by the Yakima City Planning Commission
carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and
Hinman voting aye on roll call.

ORDINANCE NO. 2395, AN ORDINANCE amending the 1980 Budget for the City
of Yakima; and appropriating, transferring and reappropriating money for
payment of Yakima Police Patrolmen's Association arbitration expenses,
as an appropriation for the 1980 City of Yakima Budget.

ORDINANCE NO. 2398, AN ORDINANCE accepting the recommendation of the
Planning Commission and rezoning property at 809 North Front Street in
the City of Yakima, Washington, from R-3, Multiple Family Zone, to M-1,
Light Industrial Zone.
Council members discussed the proposed Council retreat. Council member
Carmichael stated that Council member Doty will be attending a confer-
ence in Seattle this Thursday, and she will make some inquiries on
facilitators and cost factors. She inquired if any other Council member
would like to work on this with her. Mayor Edmondson stated she has a
file of information on other Council retreats. Council members Hinman
and Doty volunteered their help. Larry Wittenberg, Assistant City
Manager, stated he would like to meet with Council member Carmichael and
report on the information he received on this subject at a recent semin-
ar he attended in Oregon. Council goal setting was a subject discussed
at that conference. He stated that it is generally agreed that to use a
facilitator is one of the better ways to conduct a meeting.
Mayor Edmondson announced that Indian Culture Awareness Week is next
week and there will be special events on the campus.
Mayor Edmondson reported that an application from Tom C. Bostic for the
Housing Authority Board and a recommendation from the Board recommending
Mr. Bostic's reappointment has been received. She also reported that
applications have been received from Carol Martin, Mike Parsons, Nick
Hughes, Patricia Bacal, Rod Sanchez and Jerry Wilson. She reported that
the Committee of the Council recommends the reappointment of Tom Bostic.
It was MOVED by Beauchamp, seconded by Doty to reappoint Tom Bostic for
another term on the Housing Authority Board. Councilman Hinman inquired

about Mr. Bostic's health and Mayor Edmondson reported that Mr. Bostic
has only missed one meeting of the Board because he was in the hospital.
She stated that Mr. Bostic has stated that he will resign from the Board
should his health deteriorate to the point where he could not actively
participate on the Board. Following discussion, the question was called
for the vote on the Motion: carried, Beauchamp, Doty, Edmondson and
Hinman voting aye on roll call. Buchanan, Carmichael and Crest voting
nay.
Councilman Beauchamp reported that he had received a call from a citizen
concerned about the street sweeping program. City Manager Zais stated
staff could talk with her and explain the program.

It was MOVED by Beauchamp, seconded by Carmichael to move into Executive
Session for the purpose of discussing collective bargaining and then
immediately adjourn the meeting to then meet on Thursday, April 10,
1980, at 7:00 P.M. at the Warehouse Theatre: carried, Beauchamp, Bu-
chanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by
voice vote.
Upon completion of the Executive Session, and there being no further
