The City Council met in session on this date at 7:00 P.M. in the Council
Chambers of City Hall, Yakima, Washington; Mayor Betty L. Edmondson pre-
siding, Council members Henry Beauchamp, Lynn Buchanan, Lynn Carmichael,
Shirley Doty, ,Don Hinman and Frank Roberts, and City Manager Zais and
City Attorney Andrews present on roll call.
The Invocation was given by City Attorney Andrews.
Mayor Edmondson referred to the items placed on the Consent Agenda,

Item No. 19 be removed, and Councilman Roberts requested that Item No.
14 be removed from the Consent Agenda. City Manager Zais requested that
Item No. 10 be removed from the agenda, stating that it will be brought
the Council that the deletions of Item Nos. 10, 14, and 19, as reques-
ted, be made. The City Clerk then read the Consent Agenda items, inclu-
ding resolutions and ordinances by title. It was MOVED by Beauchamp,
seconded by Buchanan that the Consent Agenda, as read, be passed:

It was MOVED by Roberts, seconded by Hinman that the established order
of the agenda be suspended and that Item No. 19 be considered at this
time: carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson, Hinman
and Roberts voting aye by voice vote. It MOVED by Hinman, seconded
by Beauchamp that Ordinance No. 2368, amending compensation plan for
City employees, be passed. Norm Steuart, 217 .North 16th Avenue, ad-
dressed this proposed increase of the City Manager's increase in salary,
expressing concern about a possible withholding of federal funds for the
City for the violation of federal guidelines for wage increases. He
suggested a more gradual approach to this end by granting a wage of
$36,000 plus the vehicle allowance, and if conditions and personnel
remain the same, to grant the $39,000 for 1981. John 'Klingele, 1312
West Walnut, requested the Council to substantiate in three Ways the
increase that the City Manager has done a good job for our City. Mayor
Edmondson stated that Council stated several ways at the last meeting
that the City Manager has been beneficial to the City of Yakima. She
stated that she would be happy to review it with Mr. Klingele at a later
time. She did the City Manager has followed the direction
and guidelines and communication dictates of the Council. She stated
that the City Manager has kept. the Council informed on ongoing matters.
Councilman Roberts stated that this was not a unanimous decision in
Executive Session. He stated that he voted against it and suggested
following the Presidential Guideline of a 7% increase. Councilman
Hinman stated that when the,City Manager was first appointed he was not
paid the going market rate at that time, but was told that if he did a
good job during the first year, then his salary would be raised substan-
tially at that time. Council member ,Carmichael stated she was opposed
to such a high increase in salary at this time. Councilman Beauchamp
spoke in support of the proposed salary increase. Councilman Buchanan
also spoke in favor of the salary increase- stating that if the City
Manager had been paid the market rate when he was hired, then this
Increase would be small. Mayor Edmondson spoke in support of the salary
- I ll increase, stating, that this ordinance would not :be effective- until
February so the annual salary this year would be $38,5,00. Yellowing
discussion, the question was called for the vote on the motion: car-
ried, Beauchamp, Buchanan, Doty, Edmondson and Hinman voting aye on roll
call. Carmichael and Roberts voting nay.
ORDINANCE NO. 2368, AN ORDINANCE relating to City personnel; adopting a
compensation plan for City employees, and amending Section 2.20.110 of
the City of Yakima Municipal Code. .
Councilman Roberts stated that he .did not receive the minutes of Novem-
ber 27, 1979, or December 4 and 5, 1979, in his Council packet. It was
the general consensus of the Council to continue this item for one week.

This being the time fixed for the hearing on the Assessment Roll for
L.I.D. No. 1020, Pierce Street Paving District, and there being no
citizen present wishing to speak to this matter, it was MOVED by Beau-
champ, seconded by Doty that Ordinance No. 2365, confirming the Assess-
ment Roll on L.I.D. No. 1020, be passed: Beauchamp, Buchanan, Carmi-
chael, Doty, Edmondson, Hinman and Roberts voting aye on roll call.
ORDINANCE NO. 2365, AN ORDINANCE confirming the Assessment Roll covering
Local Improvement District No. 1020 as created and established by Or-
dinance No. 2208, as amended by Ordinance No. 2213 of the ordinances of
the City of Yakima.
This being the time fixed for the hearing on the rezone request filed by
IT-IN Development Company, Larry Wright, Principal Planner, outlined the
area involved in this rezone. Council member Doty inquired about how
the residents feel about this rezone. Mr. Wright stated that the resi-
dents have expressed interest in hooking up to the sewer, which will be
expensive. He stated that it will take a business such as this to help Ilir
pay for the sewer services. Following discussion on the type of busi-
ness this land is being rezoned to accommodate, it was MOVED by Hinman,
seconded by Buchanan to follow staff recommendation and findings and
request that legislation be prepared in accordance with them: Beau-
champ, Buchanan, Carmichael, Doty, Edmondson, Hinman and Roberts voting
aye by voice vote.
Mayor Edmondson stated that a letter of resignation has been received
from Miguel Rodriguez, resigning from the Human Relations Commission.
She stated that she has also received a request from the Human Relations
Commission for the termination of Abe Gonzales as a Commission member,
stating that he has done an excellent job, but he has missed more than
three consecutive meetings. Stating that he believed Mr. Gonzales was
going to resign anyway, it was MOVED by Hinman, seconded by Roberts to
accept the Human Relations Commission's recommendation and remove Abe
Gonzales for the reason that he missed three meetings in a row without
being excused: carried Beauchamp, Buchanan, Carmichael, Doty, Edmon-
dson, Hinman and Roberts voting aye by voice vote. ,
Mayor Edmondson stated that the 95th Congress honored Justice Douglas by
naming the Federal Building after him and proclaimed January 21 through
26 as Justice William O. Douglas Week.
Ines Rice, 4409 Arlingon, asked how many houses the City owns. Mayor
Edmondson stated that Council had requested a report on the rental fee,
location and condition-of the houses the City owns. City Manager Zais
stated that that is a comprehensive report and won't be available for
several months. He stated that the property involved relates primarily
to Parks properties. He stated that the City owns a residence at the
Arborteum, Randall and Kiwanis Parks and one other location. He stated
that there are two houses at the Oak Flats property. City Attorney
Andrews stated that the City Charter prohibits an employee or officer of
theCity from benefiting from any contract. He stated that a lease of
City property to a City employee is prohibited unless the occupancy of
that land is a condition of employment for the benefit of the City.
Mrs. Rice also requested a list of heavy equipment and vehicles of the -
Public Works Department. John Klingele, 1312 West Walnut, questioned if
Council is planning on seeking public input before the water rates are
increased. Mayor Edmondson stated that the citizens have always been II/

D-4192, accepting the Community Development Block Grant No.
B-80-MC-53-0008, be passed: carried Beauchamp, Buchanan, Carmichael,
Doty, Edmondson, Hinman and Roberts voting aye on roll call.
RESOLUTION NO. D-4192, A RESOLUTION authorizing the City Manager and
City Clerk of the City of Yakima to execute an agreement accepting Com-
munity Development Block Grant No. B-80-MC-53-0008 from the United
States of America, Department of Housing and Urban Development.
It was MOVED by Buchanan, seconded by Hinman that Resolution No. D-4193,
amending and readopting the "Rules of Procedures of Yakima City Coun-

ci1", be passed. Councilman Roberts stated that he had some concerns on
this but would bring them up to the Committee of the Council working on
the Rules of Procedures. The question was called for the vote on the
Motion: carried' Beauchamp,' Buchanan, Carmichael, .Doty, Edmondson,
Hinman and Roberts voting aye on roll call.
RESOLUTION NO. D -4193, A- RESOLUTION amending and readopting "Rules of
Procedure of Yakima City Council ".
*It was MOVED by Beauchamp, seconded by Buchanan that the report from
the Department of Community Development dated January 10, 19.80, with
respect. to the completion of the work on Washington Park Tennis Courts
performed by Superior Asphalt, be approved, the work be accepted and
payment of'the final estimates as therein set forth is hereby author-
ized: - carried Beauchamp, Buchanan, Carmichael, Doty, Edmondson, Hinman
and Roberts voting aye on roll call.

the Director of Community Development dated January 22, 1980, with
respect to the completion of the work bn Prospect Park Paving L :I.D. No.
1022, performed by Superior Asphalt, be approved, the work.be accepted

D -4194, authorizing payment of $145.14 to Gary Pue in settlement of a
claim for damages when gravel from a gravel =spr -eader damaged his ve-

and Roberts voting aye on roll call.
RESOLUTION NO. D- 4194, A - RESOLUTION authorizing payment of $145.14 to
Gary Pue in settlement of a . claim for damages filed with the City of
Yakima.

D = 4195, authorizing payment of Kenneth Meade in settlement of
a claim for-- damages when a City sewer line backed up into his basement,
be passed: carried - Beauchamp Carmichael, Doty, Edmondson,
Hinman and Roberts 'voting aye on roll call.
RESOLUTION NO. D- 4195, A RESOLUTION authorizing payment of $.170'.84 to
Kenneth R. Mead in settlement of, a claim for damages filed with the City
of Yakima.

John 'Klingele, 1312.Walnut, expressed concern about the method of snow
removal and the fact that money -was not budgeted this in the 1980
budget. Willis White, Director of Public Works, stated that the City
practices snow control• :and not snow removal. He stated that there has
been 37.4 inches of snowfall in the last two months. The stated that
last 'year - additional assistance ;had to be hired. . He stated that this
year $14,500 has been spent for outside assistance to date.. He des-
cribed the control program, stating that he called in. additional
staff to ^help with the snow control program. Councilman Roberts.ques-
tioned the policy of waiting until four inches of snow has .fallen before
the snow plow goes out. Del Kary, Street and Refuse Manager, stated
that-it does not take any more effort to remove four inches of snow than
two inches. He stated he plans onianalyzing the program at the end of
the season. He stated that staff tries to intiate action to do the best
with what equipment is available. , It was MOVED by Hinman, seconded by
Beauchamp that Resolution No. D- 4196, authorizing. the hiring of snow
removal services, be passed: carried Buchanan, Carmichael, Doty, Ed-

RESOLUTION NO. D-4197, A RESOLUTION extending the date for repayment of
various interfund loans.
Willis White, Director of Public Works, reviewed his memo in the Council
packet regarding the Wastewater Facilities Project. He stated that back
in 1976 the City of Yakima, Yakima County, Terrace Heights and Union Gap
signed a Wastewater Facilities Contract which says that the City of
Yakima will own, operate and develop the regional sewer treatment facil-
ity and then develop rates to recover the cost for the service provided.
Those people connecting to the sewer would sign an Outside Utility
Agreement, which provides for, annexation to, the City. The City would
recoup.their expense through a.Capital Recovery Charge. , Councilman
Hinman expressed concern about there not being a mechanism in: the con-
tract with R. W. Beck that.requires some of guide-in accounting for
their service. Mr. White stated there is a reference in the contract
that says Beck must maintain standard accounting practices. They must
also demonstrate to DOE and EPA how they plan to spend these funds. Mr.

White reviewed the services provided by the engineer. Dennis Bertek,
Supervising Sanitary Engineer, reviewed the proposed Change-Order No. 8
which would result in an increase in the contract in the amount of
$4,069.72. It was. MOVED by Hinman, seconded by Carmichael to approve
and authorize Change Order No. 8 to the R. W. Beck contract, as outlined
by the Project Engineer: carried Beauchamp, Buchanan, Carmichael, Doty,
Edmondson, Hinman and Roberts voting aye by voice vote. Dennis Bertek
reviewed the bids received for Phase II of the project and recommended
awarding the contract to Peter, Kiewit and Sons, as low bidder. He
stated their low bid came in at $8,692,000 but was 33% higher than the
engineer's estimate. He stated that the bids have been reviewed and
staff has met with DOE and EPA and they report they don't have enough
funds to fund the entire Phase II project. He recommended awarding
Schedule A of the contract and delay Schedule B. Councilman Beauchamp
inquired if Schedule B is not funded, will Schedule A be usable, and Mr.
Bertek reported that they would not. Mayor Edmondson stated that there
have been several statements made by people in Congress that they are
committed to this. Mr. Roster and Mr. Thomas, DOE, stated that Washing-
ton State was allocated $59-billion this year and the State was con-
sidering a bill of $360 million for State funding on a. 50/50 match. Mr.
Bertek recommended the awarding of Schedule A with Alternate No. 5. He
stated that Schedule'B was included in the contract with the option of
doing it contingent on funding. - The cost to the City would be $205,495
for ineligible items, $855,223 for the City's 10% share, totaling
$1,060,178. He recommended that this be funded with the Water/Sewer
Funds. Councilman Beauchamp inquired if there were any funding, alterna-
tives other than • an increase of sewer rates. Mr. White stated that
staff doesn't know of any alternatives. City Manager Zais stated that
this will accelerate the need for an additional increase in sewer rates.
It was MOVED by Hinman, seconded by Buchanan to accept the staff's
recommendation and award the contract for Phase II, Schedule A to the
low bidder, Peter Kiewit and Sons, and authorize the City Manager to
direct the negotiation of Schedule B: carried Beauchamp, Buchanan,
Carmichael; Doty, Edmondson, Hinman and Roberts ,voting aye by voice
vote. It was MOVED by Roberts, seconded by Beauchamp that Resolution
No. D-4198, approving the grant increase for Wastewater Project
C-530557-05, be , passed: carried, Carmichael, Doty, Edmondson, Hinman,

RESOLUTION NO. D-4198, A RESOLUTION authorizing the application by the
City of Yakima for a grant increase for the Yakima Wastewater Project.

It was. MOVED by Hinman, seconded by Carmichael that Resolution No.
D-4199, approving the grant .increase for Wastewater Project C-530557-04,
be passed: carried, Doty, Edmondson, Hinman', Roberts, Beauchamp, Bu-
chanan and Carmichael voting aye :on roll call.
RESOLUTION NO. D-4199, A RESOLUTION authorizing the. application by the
City of Yakima for a grant increase for the Yakima Wastewater Project.
It was MOVED. by Hinman, seconded by Carmichael that Resolution No.
D-4200, authorizing the execution of Change Order No. 7 to the agreement
with R. W. Beck and Associates, be passed. Mr. Bertek stated that the
engineering agreement has been adjusted-and distributed a revised Exhi-

bit. B where the engineering fees have been reduced. He stated they
proposed that the profit be split 50% to help the City in the situation.
It was MOVED by Hinman, seconded by Doty to incorporate Exhibit B Re-
vised, regarding the, splitting of the profit of R. W. Beck by 50%, as
,part ,of Resolution No. D-4200: carried Beauchamp, Buchanan, Carmichael,
Doty, Edmondson, Hinman, and ,Roberts voting aye by voice vote. The
question was called for the vote on the Motion as amended: carried
Edmondson, Hinman, Roberts, Beauchamp, Buchanan! Carmichael-and Doty
voting on roll call. City Manager Zais stated that R. W. Beck was
allowed a 13% profit; Beck's original proposal was 10%, and they are now
taking a 5% profit.
RESOLUTION NO. D-4200, A RESOLUTION authorizing the, City Manager and
City Clerk of the City of Yakima to execute an amendment to the agree-
ment with R. W. Beck and Associates to prepare wastewater facilities
design.

reappropriating monies for the restoration of the position of Street
Inspector, and a DA II to the Police Department and the purchase of
filing cabinets for the Police Records Department, having been read by
title only previously, it was MOVED by Beauchamp, seconded by ,Buchanan
that Ordinance No. 2366, amending the 1980 budget and appropriating,
transferring, and reappropriating money within and among various funds,
be passed: carried Beauchamp, Buchanan, Carmichael, Doty, ,Edmondson,
Hinman and Roberts voting aye on roll call.
ORDINANCE NO. 2366, AN ORDINANCE amending the 1980 budget for the City
of Yakima; and appropriating', transferring and reappropriating within
and among various funds and accounts, all as appropriations for the 1980
City of Yakima budget.

orizing a major modification to a planned development zone for property
at the northwest corner of the intersection of 31st Avenue and Tieton
Drive, as requested by Yakima Valley Memorial Hospital, be passed:

ORDINANCE NO. 2367, AN ORDINANCE accepting the recommendation of the
Planning Commission and authorizing a major modification to a planned
development zone, applicable to property at the northwest corner of the
intersection of 31st Avenue and Tieton Drive in the City of Yakima.
It was MOVED by Hinman, seconded by Doty that Ordinance No. 2369, amend-
ing the Equipment Rental and Replacement Fund, be passed: carried,
Hinman, Edmondson, Roberts, Beauchamp, Buchanan, Carmichael and Doty
voting aye on roll call.
ORDINANCE NO. 2369, AN ORDINANCE relating to City funds and accounts;
specifying formulas for deriving rental charges to be charged by the
Equipment Rental and Replacement Fund; defining terms; and amending
Subsection 3.15.030 B and Section 3.15.040 of the City of Yakima Munici-
pal Code.

An Ordinance amending the 1980 budget and appropriating money within the
Federal Shared Revenue Fund and transferring to the Capitol Theatre
Fund, having been read by title only at this meeting, was laid on the
table for three weeks or until Tuesday, February 13, 1980.

Mayor Edmondson reminded Council that this Thursday, January 24th, is
the date set for the luncheon with the County Commissioners at the
Holiday Inn at Noon. She also stated that the tour of the V & C was
scheduled for Friday at 4:00 P.M. Council member Doty requested that
that be delayed. City Manager Zais stated that that can be delayed for
a few weeks.

Following discussion, it was the general consensus of the Council to
meet with the County Commissioners on January 30, 1980, at 2:00 P.M. to
discuss the Joint Law Facility.

It was MOVED by Hinman, seconded by Doty to move into Executive Session
for the purpose of discussing collective bargaining and pending litiga-
tion and then adjourn the meeting: carried ,Beauchamp, Buchanan, Car-
michael, Doty, Edmondson, Hinman and Roberts voting aye by voice vote.
Upon completion of Executive Session, and there being no further busi-
ness to come before the Council, the meeting was adjourned at
