The City Council met in session on this date at 3:00 P.M. in the Council
Chambers of City Hall, Yakima, Washington. Council members present were
Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Buchanan, Lynn
Carmichael, Shirley Doty, Don Hinman and Frank Roberts.
Mayor Edmondson stated that Council sat in Executive Session prior to
this meeting to evaluate the performance of the City Manager. She
reported that the former Council members were also asked to participate
in the evaluation process. She reported that it was an excellent
evaluation and the Council directed that legislation be prepared to
commend the City Manager and raise his salary to $39,000 per year.
Mayor Edmondson proclaimed that next week is Alcoholism Awareness Week
and she stated that there will be a lunch and program on January 23,
1980, at the Yakima Convention Center.

Mayor Edmondson inquired if Council wished to discuss the letter sent
from Yakima Association of Churches regarding the transportation of
dangerous chemicals. Following discussion, it was the general consensus
of the Council to refer this to staff.
Referring to the memo from the Director of Public Works, re Vergil Carl,
former Street Inspector, dated January 10, 1980, City Manager Zais
reported that it is recommended by staff to fund this position from the
Contingency Fund, as it cannot be funded in the Public Works budget
without disturbing the other funds. An Ordinance amending the 1980
budget, appropriating, transferring and reappropriating money within and
among various funds and accounts, having been read by title only at this
meeting, was laid on the table for one week or until Tuesday, January
22, 1980.
It was MOVED by Hinman, seconded by Buchanan that Ordinance No. 2362,
repealing the Admission Tax, be carried: Beauchamp, Buchanan,
Carmichael, Doty, Edmondson, Hinman and Roberts voting aye on roll call.
Mayor Edmondson stated she voted yes, however, she feels that tax should
be on all of that type of business and not just theatres.
ORDINANCE NO. 2362, AN ORDINANCE relating to licenses and business
regulations; and repealing Chapter 5.04, "Admission Tax", and Sections
5.04.010, 5.04.020, 5.04.060, 5.04.070, 5.04.080, 5.04.090, 5.04.100 and
5.04.110, thereof, of the City of Yakima Municipal Code.
Council members discussed the 1/10/80 memo from the Director of Finance
and Budget regarding interfund loans. It was MOVED by Roberts, seconded
by Doty to direct staff to prepare appropriate legislation regarding
staff's recommendation on Items for 8% loans and for retiring other
items, as recommended in their report: carried, Beauchamp, Buchanan,
Carmichael, Doty, Edmondson, Hinman and Roberts voting aye by voice
vote.
Mayor Edmondson announced that the County Commissioners have appointed
Charles Countryman to the Yakima Valley Regional Library Board of
Trustees, which requires confiLmation by the City Council. It was MOVED , 7
by Carmichael, seconded by Roberts to reaffirm the appointment of
Charles Countryman to the Library Board: carried, Beauchamp, Buchanan,
Carmichael, Doty, Edmondson, Hinman and Roberts voting aye by voice
vote. Council members discussed the election procedure to boards and
commissions. Councilman Roberts expressed concern about having a member
serve on a board too long. Councilman Hinman stated that some of the
ordinances provide for a time limitation for serving on the board.
Mayor Edmondson questioned if Council wants staff to prepare an
ordinance to stipulate a two term limitation for serving on each
commission or board. It was the general consensus of the Council not to
request that type of legislation because the length of the terms to be
served on the different boards and commissions aren't the same. It was
the general consensus of the Council to get information on which
commissions and boards have a limitation for serving. Council members
discussed the need for a mechanism in the ordinance to provide for
removal of a board or commission member. City Attorney Andrews stated
that based on past court rulings, there must be just cause for removal
of the member, and that procedure must be outlined in the ordinance. It

was the general consensus of the Council to direct staff to come back
with a mechanism regarding removal of a commissioner or board member.
Mayor Edmondson inquired if Council would like to advertise for the
openings on a board or commission while simultaneously asking if the
current member would like to continue serving on the board or
commission. It was the general consensus of the Council to do it
simultaneously. Council members expressed concern about possibly losing
a good candidate because the candidate would not want to fill out the
application form. Following discussion, it was the general consensus of
the Council to make it a mandate that all candidates must complete an
application form. Following discussion, it was the general consensus of
the Council to add a statement to the application form informing the
applicants that the candidate may be called for an interview by the
Council. City Manager Zais reported that when the reorganization of the
parks was done, the duties of the Parks Commission was not defined.
City Attorney Andrews reviewed the transition of the parks from the
Metropolitan Park District to the City and stated that there was an
ordinance drafted but upon which no action was taken. He stated that
when he brings back legislation on the other items Council has
requested, he will also bring this back. It was the general consensus
of the Council to request staff to bring to their attention the
expiration of a term on a board or commission three months in advance of
the expiration date. Councilman Hinman requested some background
information--on the Employee's Civil Service Commission issues and if
this upcoming vacancy is appointed by the Council. It was the general
consensus of the Council to find out what method is to be used for this
appointment.
Council members discussed the nomination of a Council representative to
the Association of Washington Cities. It was MOVED •by Doty, seconded by
Carmichael to recommend for filling the at large vacancy with Councilman
Hinman: carried, Beauchamp, Buchanan, .Carmichael, 'Doty, Edmondson,
Hinman Roberts voting aye by voice vote.. .
Referring to the amendments to. the rules of procedures of the Council,
City) Attorney Andrews stated that this is the formal notification
required, and that next week Council will take action on the -resolution
amending the rules of procedure. He stated that if Council wishes to
make further changes; later, it would be helpful to adopt the proposed
rules of procedures as they are -now and then start from scratch later.
It was the general consensus of the Council to discuss this next week.
It was MOVED by Beauchamp, seconded by Doty that Resolution No. D-4191,
authorizing the execution of.an agreement with Yakima County specifying
the amount of filing fees for criminal ordinance violations, be passed:
carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson, Hinman and
Roberts voting aye on roll call.
RESOLUTION NO. D-4191, A RESOLUTION authorizing and directing the City
Manager and City Clerk of the City of Yakima to execute an agreement
with Yakima County relating to Yakima County District Justice Court
costs.

amending the Municipal Code relating to vacation accumulation for
managment employees, be passed: carried, Beauchamp, Buchanan,
Carmichael, Doty, Edmondson, Hinman and Roberts voting aye on roll call.
ORDINANCE NO. 2363, AN ORDINANCE relating to personnel; designating the
rate of accrual of vacation leave and limiting the accumulating of
vacation leave for certain City employees; amending Subsections 2.40.020
A(2) and 2.40.020 B of the City of Yakima Municipal Code, and declaring
an emergency.
It was MOVED by Buchanan, seconded by Carmichael that Ordinance No.
2364, authorizing a vehicle allowance for the City Manager, be passed:
carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson, Hinman and
Roberts voting aye on roll call.
ORDINANCE NO. 2364, AN ORDINANCE relating to personnel; authorizing a
vehicle allowance for the City Manager, and enacting Section 2.20.097 as
a new section of the City of Yakima Municipal Code.

It was the general consensus of the Council to continue Item No. 12,
briefing by the Director of Public Works regarding Yakima Wastewater
Facilities Project.
Council members discussed the report on the street lighting on 24th
Avenue. City Manager Zais reported that no funds have been budgeted for
this, as in the past it had been identified as.a Pacific Power and Light
Problem. He stated the City could absoib; of replacing the
light in the maintenance account. It.was MOVED by Hinman, seconded by
Roberts to direct staff to proceed with the method necessary for getting
the light at 23rd and Lincoln: carried, Beauchamp, Buchanan,
Carmichael, Doty, Edmondson, , Hinman and Roberts voting aye by voice
vote. It was the general consensus of the Council to let staff
determine the number of poles.
It was MOVED by Hinman, seconded by Carmichael to set February 13, 1980,
as the hearing date on L.I.D. No. 1023, 43rd and Aller Sewer District
II/
for final assessment roll: carried, Beauchamp, Buchanan, Carmichael,
Doty, Edmondson, Hinman and Roberts voting aye by voice vote.
It was MOVED by Roberts, seconded by Catiaichael to move into Executive
Session for the purpose of discussing collective bargaining and
personnel matters and then adjourn the meeting: carried, Beauchamp,
Buchanan, Carmichael, Doty, Edmondson, Hinman and Roberts voting aye by
voice vote.
Items of information supplied to Council were: memo from Director of
Parks and Recreation re Sr. Citizen Center staff reorganization, 1/9/80;
Annual Report from Legal Department for 1979; notice and registration
form re National League of Cities Congressional/City Conference -- March
16 through 18, 1980, Washington D.C.; memo from City Attorney re damage
claims referred to insurance carriers, 1/7/80; Monthly Report of Code
Administration Office activities for December, 1979; minutes of the
December 18, 1979 meeting of the Airport Advisory Commission; letter
from Jack H. Watson, Jr, the Whitehouse, re general revenue sharing
funds, 1/7/80; and Council assignments on boards and commissions,
1/11/80.
Upon completion of Executive Session, and there being no further
business to come before the Council, the meeting was adjourned at the
hour of 6:25 P.M.
