The City Council met in session on this date at 11:30 A.M. in Roam 104
at the Yakima County Courthouse, Yakima, Washington. Council members
present were Mayor Betty L. Edmondson, Henry Beauchamp, Carmichael,
Shirley Doty, and Don Hinman. Council member Lynn Buchanan absent.
County Commissioners present were Chuck Klarich, Graham Tollefson and
Jim Whiteside. Union Gap Mayor John Hodkinson was also present.
Commissioner Klarich opened the meeting stating that the previous week
he brought up the point that the existing developments, the individual
residences -- weren't really addressed in the proposed document. He
explained they had gone over the outside utility agreement and modified
the language a little to try to explain to the resident exactly the
procedure that is involved when a resident requests hookup to the sewer
system, stating that is the first portion of the paragraph in the
County's proposal on Issue No. 2. After that (after the asterisk) is
the paragraph that was agreed to previously - that was brought up to us
by the staffs. And then, just to clarify again to the people which is
in the document elsewhere, those people that live in the City, would
address their developments with the City, those people that live in the
County, would do it with the County, and those people that live in Union
Gap, would do it through the planning process at Union Gap, and that is
What the second paragraph is. The third paragraph adds a third item for
inclusion in the Urban Area Plan appendix, which adds... "A narrative
description of the Boundary Review. Board objectives and factors
considered in review of annexation proposals (RCW 36.93.170 and 180)."
Mayor Edmondson stated that the Council met this morning to discuss the
County's proposal for resolution of Issue No. 2 and that Council member
Hinman stated that the Council was trying to understand what the County
was trying to accomplish. He reported that the Council had reviewed
this proposal and is requesting that the first paragraph be changed to
read "(Existing development including individual residences), shall,
prior to receiving sewer service from the City, be required to
immediately annex, if feasible to do so, or to signing an outside
utility agreement" leaving out the rest of that sentence to the effect
that a petition to annex to the City of Yakima will be approved subject
to the annexation meeting the criteria of the Boundary Review Board; and
leave in the rest of the paragraph after the asterisk. He explained
that the City feels the part about the Boundary Review Board is
unnecessary as that is addressed by law. The County Commissioners
withdrew from the meeting to caucus.
While the County Commissioners were out of the roan, Mayor Edmondson
asked Mayor Hodkinson to bring back a written statement regarding
various items giving Union Gap's position or comments requesting this on
Items 1, 2, 5, 9, 11 and 12.
The County Commissioners returned fran caucus. Commissioner Klarich
stated that they feel it is necessary to include in the wastewater
agreement, under Section IV, the section regarding annexation by the
City of Yakima, in place of the first paragraph, which starts with
"Existing" down to the word "Except" that we include in that area of
the document, the statement which says that ..."any property owner
seeking sewer service, located in the urban boundary", etc, etc.,
exactly as has been agreed to in the signed document in 1976 between the
City and the County - Wastewater Agreement for 1977, and that we need
the middle paragraph as explanation as to who the person would address
in looking at development. There was some further discussion on the
interpretation of the second paragraph regarding outside utility service
and agreement. It was then the general consensus of the Council and the
Commissioners that since the matter of outside utility agreement has
been taken care of in other parts of the document - that the second
paragraph shall read ..."All existing and new development within the
unincorporated Urban Area, including any site or structural
improvements, shall be subject only to issuance of appropriate
development permits fran the County and shall occur in accordance with
adopted Urban Area standards." With this agreement by the County and
City on these issues, Mayor Edmondson asked if there were any questions
on the other issues. She asked if on Item #6, that roads and streets
can be designated and it was agreed that a border description will be
made.

The County Commissioners read a letter, which they stated had previously
been written in June, asking the Council to lift the suspension of
outside utility services, with the agreement of all issues on the Urban
Area Plan. Mayor Edmondson stated that this will be done by requesting
staff to prepare the proper legislation at the next Council meeting.
It was not that there will be a joint neeting of the Regional Planning
Commission, the County, City and Union Gap at the Convention Center on
Monday, September 14, 1981 at 11:00 A.M. It was also noted that Union
Gap will have written statements regarding their position on various
issues, which will be kept separate from the joint meeting.
