ADJOURNED MEETING -- URBAN AREA PLAN
The City Council met in session on this date at 11:30 A.M. in Room B-32
at the Yakima County Health District. Council members present were
Mayor Betty L. Edmondson, Lynn Buchanan, Lynn Carmichael and Don Hinman.
Council member Bruce Crest present after 11:57 A.M. Council member
Shirley Doty-present after 12:06 P.M. Corincll member Henry Bearichamp
absent. County Commissioners present were Chuck Klarich and Jim White-
side. Union Gap Mayor John Hodkinson was also present.
Council member Hinman distributed a copy of the City's response to the
County Commissioners as follows:
"Council proposes (1) boundary designated as 'the Urban Area Boun-
dary'.
REGIONAL PLANNING COMMISSION
Council proposes the RPC -make-up be a seven (7)- member Plan-
ning Commission with: three (3) members appointed by the
County Commissioners, three (3) members appointed by the
Yakima 'City Council, and one (1) member appointed by Union Gap
City Council. The only residency requirement would be that
the members live in the Urban Area."
Council member Hinman stated that the City agrees that there should be
one boundary, not both a Planning Boundary and a Service Boundary. He
stated that after touring the entire area, the Council) feels that the
entire area is susceptible to urban development. He stated that if it
is an urban development, then urban level standards should apply, how-
ever, if it is a rural development, then rural development ,standards
should apply. He stated that Council is concerned about the Airport
Area. Mayor Hodkinson stated that Union Gap would like to see the line
in that area extended. Council member Hinman stated that the City would
like to meet to discuss that. Referring to the Regional Planning Com-
mission, he stated that it would be considered one body, however, mem-
bers could' be •appOinted on a Urban Area-wide basis. Commissioner
Whiteside asked- why the Council decreased the membership of the Com-
mittee to seven. Mayor Edmondson stated that it is easier to work with
a seven member committee. Seeking clarification, Commissioner Klarich
asked if this means that when addressing an issue in that area which is
considered to be rural, then the rural land use would apply and if it is
considered urban, then the urban land use would.apply. .Council member
Hinman stated that that is correct. He stated that if it is a dual
development, then the hearing examiner would apply the standards.
Referring to that area which lies between the Planning Boundary and the
Service Boundary, Commissioner Whiteside asked if this were to be under
one boundary, then those people will be provided with sewer service.
Council member Carmichael indicated that that is incorrect. She stated
that it is called an Urban Boundary, not an Urban Service Boundary.
Commissioner Whiteside stated that is differentiating between the people
in the boundary, and you are saying that we won't be serving everybody
in the present Service Boundary. He asked who will make the selection
II/ of who receives service. Council member Carmichael stated that depends
on the property as there are geographical problems and not all areas can
be served with sewer. Mayor Edmondson stated that will also depend on
the County Commissioners on who they will allow to develop. Commis-
sioner Klarich stated that the area between the City limits and the
Urban Boundary will be addressed consistently as it was in the past on a
first-come/first-serve basis. (Council member Crest present after 11:57
A.M.) Mayor Hodkinson stated that money for the development would also
be a determining factor on who gets service. Commissioner Klarich
stated that he would like to think about this for one week. Mayor
Edmondson stated that it will be two weeks before the next meeting
because Council members will be involved with the AWC Convention. Dick
Anderwald, Yakima County Planning Director, asked if he understood
correctly that under this proposal in the area outside the existing
Urban Service Boundary and between the Urban Boundary, those people
could get service where feasible, which would be determinated by a
comprehensive sewer plan. Mayor Edmondson stated that is correct. •
The next issue discussed was a comparison of the City and County Zoning
Ordinances. Carol Darby, City of Yakima Director of Community Develop-
ment, stated that rather than try to prepare an intensity type ordin-

ance, staff thought it was better to combine traditional zoning concepts
with some intensity type zoning concepts. She stated that staff did
this and distributed copies of the "example zoning" to the County Com-
missioners and Mayor Hodkinson. She stated that this is an approach and
if it is acceptable, then a Zoning Ordinance will be put together based
on this approach. Judd Black, Yakima City Planning staff member, stated
that the existing City/County staff can do the things they are doing now
regarding the zoning processes. "(Council member Doty-present after
12:06 P.M.) Mr. Black also explained the district standard numbers and
intent standards which would eliminate the need for a planned develop-
ment zone. Don Skone, City of Yakima Planning staff member, explained
the development review process. He stated that there are three levels
of review: (1) those permitted outright, (2) those proces adminis-
tratively; and (3) those processed through the hearing examiner. If it
is permitted outright, it would be reviewed by the Building Inspector
and is required to meet standards. Under administrative, it would be
reviewed by the Department Head/Planning Director, and must meet the
intent of standards. There will be a specific list of uses for this
category. There will be a list of uses under the hearing examiner that
he could permit. He would review the project for intent-of the district
and standards. Rezone reviews would be done by the hearing examiner.
The process would involve a staff review; their recommendation and
report would be forwarded to the hearing examiner who would hold a
public hearing and who would then give a recommendation to the legis-
lative body. It would be presented to the City Council or County Com-
missioner for determination and that decision be appealed-and'that
decision would be final. Larry Wright, City of Yakima Planning Manager,
stated that staff wanted to facilitate development and the only way to
do that is to allow staff to'Make'&pecific interpretation& of some
things that were done by the Planning Commission. He stated that if any
decision would be questioned, staff could provide the legislative body
with a set of the standards. He reviewed three planned developments and
explained how the process could have been expedited for the developer.
He stated that the real question is whether the use is applicable in
that area and then it would go through a development review and all the
standards would be known by the developer. Dick Anderwald, Yakima
County Planning Director, distributed a handout which gives a comparison
between traditional and performance zoning. He commented that with the
new mapping there would be fewer requests for- rezones. These standards
for rezones would be incorporated in the ordinance and the permitted
uses listed. Commissioner Whiteside commented that this would
more flexibility and could be called Flexibility Zoning. Commissioner
Klarich expressed his concern that this might delay the lifting of the
moratorium. He stated that if we could get this done more quickly, he
would be more favorable towards it. Referring back to the map,' Commis-
sioner Whiteside asked the City to consider extending the lines to Wide
Hollow Creek because it now bisects the County Rural Zone. It_was the
general consensus to request the staff to continue working on the
example zoning presented today.
