August 17, 1981
The City Council met in session on this date at 4:00 P.M. in the Council
Chambers of City Hall, Yakima, Washington for the purpose of discussing
the proposal submitted by the County for the resolution of issues one,
two and three. Council members present were Mayor Betty L. Edmondson,
Lynn Budhanan, Lynn Carmichael, Bruce Crest, and Shirley Doty. Council
member Henry Beauchamp present at 4:15 P.M. Council member Don Hinman
absent.
ISSUE THREE: Whether Annexation Policies Should Be Included In The
Yakima Urban Area Plan
Larry Wright, Planning Manager, stated that staff believes that is a
cumbersome way to deal with it, but the appendix could be amended by the
City Council.
ISSUE TKO: Whether Already Developed Areas, Where Potential Health

Hazards, From Well Contamination Exist, Must Annex Immediately For
Sewer Service From The City
Larry Wright stated that staff has sane minor problems with this
position. The Council needs to address the policy issues as to whether
cammercial and industrial areas should be in the same category as sane
of the residential areas. Also, should Fruitvale and some of the other
Northeast areas be the only areas for Community Development programs or
any area that has an active neighborhood participation program?
(Council member Beauchamp present after 4:15 P.M.) He stated that staff
felt it should be a three - five year time period for delaying
annexation, dependent upon how active the neighborhood participation is
and the amount of improvements. Mayor Edmondson commented that there is
nothing here that refers to "outside utility agreement". Discussion
followed on the time limit proposed for delaying annexation.
Alternative language was suggested to substitute "may" for "shall" and
"Outside Utility Agreement" for "agreement". Discussion for alternative
language for the "5 year period" was discussed and Mt. Wright commented
that staff had problems with that position because it would eliminate
any annexations except in the West Valley area. It was the general
consensus of the Council to substitute "for a time period mutually
agreeable to both entities" for the "five year period". City Manager
Zais stated that a definition of provision of sewer service is needed.
Mayor Edmondson suggested that the sentence be ended before it comes to
that part. City Manager Zais stated that past policy has interpreted it
to mean the sewer line is available and the resident has access to the
line. Larry Wright also suggested that Council might wish to consider
adding water service also. Mayor Edmondson suggested that it should be
a recognized active neighborhood participation group. Mayor Edmondson
suggested that staff outline the City's limitations for annexing if
there is a 5 year delay period stipulated. She Asked if Council wanted
to substitute "outside utility agreement" for "agreement" and it was the
general consensus of the Council that that would not be necessary.
Speaking about the County's proposal regarding the capital cost recovery
dharge, Mr. Wright recommended that staff does not believe this should
be included in the Urban Area Plan as it would be difficult to modify
it. City Manager Zais suggested that the ordinance could be added as an
appendix. It was the general consensus of the Council to add a small
paragraph about the capital cost recovery charge, with a footnote that
the ordinance is attached as an appendix. Following discussion, it was
the general consensus of the Council to add the words "sewer service" to
the statement on Page UT-11.
ISSUE ONE: Whether New Developments Receiving Sewer Service Fran The
City Should Annex For That Service
Larry Wright stated that it would be sensible to work with the County
Assessor to develop a system to make this information more readily
available. He stated that when a citizen comes in for an annexation,
staff tries to give then information on the cost and savings factors.
He expressed his concern that this proposition would require staff to
research this type of information for any citizen who is just curious.
He commented that it would take approximately two hours of staff time to
research this type of information. Council member Buchanan suggested
charging a fee for this request of information. City Manager Zais
expressed his concern about charging a fee for this information because
the first impression the citizen would receive would be a negative one.
Tarry Wright suggested that a map be prepared which would indicate the

various taxing districts that could he handed out to the citizens.
Mayor Edmondson suggested that the Joint Board should be the one to
furnish this information.
PRORJSED TIME TABLE
The time schedule was discussed and it was the general consensus of the
Council that this is a fine goal and staff will attempt to keep it and
if not, the Council will be advised. (Council member Buchanan absent
after 5:15 p.m.)
HEARING EXAMINER
Larry Wright stated he agrees that the Hearing Examiner should be hired
by March 1st in order to give him time to work with this in order to get
the intent of the law besides the letter of the lad. He stated that the
Board of Adjustment will he eliminated. Council member Doty stated that
she is not prepared to discuss this item at this time because she did
not think it would be discussed. She suggested that this be discussed
at the meeting tcmorrow and a caucus could be called if needed.
It was MOVED by Doty, seconded by Carmichael that this meeting be
adjourned at the hour of 5:25 P.M., to then meet on Tuesday,
August 18, 1981 at 11:30 A.M. in Rocm 104 of the Yakima County
Courthouse. Unanimously carried by voice vote. 'Budianan and Hinman
absent.
