STUDY SESSION
The City Council met in session on this date at 1:00 P.M. in the Council
Chambers of City Hall, Yakima, Washington. Council members present were
Mayor Betty L.' Edmondson, Henry Beauchamp, Lynn Buchanan, Lynn Carmi-
chael, Bruce Crest, Shirley Doty and Don Hinman.
1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Edmondson gave some information on meetings that will
take place in the next couple of weeks which Council members
might like to attend.
2. STATUS REPORT ON WASTEWATER TREATMENT PLANT FINANCES
Don Horan, Director of Finance and Budget, reviewed the report
explaining the figures on the attachments. He commented that

Municipal money is not as attractive in the money market as it
was in the past. He stated that he will try to negotiate a
contract with a bank to purchase the revenue warrants issued
through March, 1981. He commented that the fund will continue
to operate in a deficit position until new bond funds become
available. He explained that the pending items are expenses
that could be grant eligible if approved, however, the Federal
government won't put anything in writing when asked. Dennis
Bertek, Supervising Sanitary Engineer, explained the items
listed on Attachment IV. Discussion followed on the R. W.
Beck contract and the impact the time extension had on the
financing. City Manager Zais commented that it may take years
to resolve court cases and in the meantime we have to pay our
bills. Council member Hinman stated that he needs more infor-
mation on the breakdown for the $2 million. Mr. Horan stated
that he can bring that information. Mr. Horan stated that he
would like Council's authorization to start working in the
bond market in order to bring back more accurate figures. It
was MOVED by Carmichael, seconded by Crest to authorize the
staff to do the preliminary work necessary in the bond market
for this particular proposed bond issue. Unanimously carried
by voice vote. City Manager Zais stated that he hopes it is
clear that we are in a situation where we have to have this
additional funding to complete this project, and that pro-
jected additional revenue requested does not address the
outstanding claims with the contractor. Discussion followed,
during which Don Horan explained the teems of the bond and the
payments on a twenty year bond. City. Manager Zais stated that
staff will be back with the information requested and a recom-
mendation to engage a firm for a sewer rate study. Mr. Horan
commented that in order to obtain a rating for a bond at this
point, it is going to require a professional point of view as
to the adequacy of our rate structure to support the bond
issue.
3. STATUS REPORT ON COMPREHENSIVE UTILITIES PLANNING PROGRAM

Carol Darby, Director of Community Development, commented that
this is an in-house study performed by Public Works and Com-
munity Development. The schedule for this project is January,
1981, to April, 1983. This will be a part of the Urban Area
Plan. She stated that this is background work for the joint
sewer plan. She stated that she anticipates having to bring
in some extra help when it comes time to do some sewer moni-
toring. Don Skone, Project Manager, stated that the collec-
tion system needs to be improved on a yearly basis on a short
term capital improvement project. Mayor Edmondson inquired if
any of this would be recoupable. Mr. Skone stated that it
would be recoupable through the sewer rates and reimbursable
contracts. Willis White, Director of Public Works, commented
that in our present sewer rates we built in money to maintain
our sewer system, but not the capital improvements.
Mayor Edmondson gave a brief report on the proceedings of the
Capital Theatre litigation.

BUSINESS MEETING
4. .ROLL CALL
At 3:00 P.M., the Council members commenced the regular meet-
ing, Mayor Edmondson residing, Council members Beauchamp,
Buchanan, Carmichael, Crest, .Doty and Hinman and City Manager
Zais and City Attorney Andrews present on roll call.
5. INVOCATION
The Invocation was given by Council member Beauchamp.
6. CONSENT AGENDA
Mayor Edmondson referred to the items placed on the Consent
Agenda questioning whether there,were any additions or dele-
tions from either Council members or citizens present. Coun-
cil member Doty requested that Item No. 13 be removed. It was
the general consensus of the Council that the deletion of Item
No. 13, as requested, be made. .The City Clerk then read the
Consent Agenda items, including Resolutions and Ordinances, by
title. , It was MOVED by Carmichael, seconded by Buchanan that
the Consent Agenda, as read, be passed. Unanimously carried
by roll call vote. (Subsequent paragraphs. preceded by an
asterisk (*) indicate items on the Consent Agenda handled
under one motion without further discussion.)
7. AUDIENCE PARTICIPATION ,
Mayor Edmondson announced the following proclamations: the
week of May 3 through 9, 1981, is proclaimed to.be "Week of
the Parents and.the Young Child". The week of May 9 through
17, 1981, is "Bicycle Week", and May 13th is "Bike. to Work" or
"Bike. to School, Day". The week of May 10 through 16 is
"Nursing Home Week" and also "Small Business Week".
Mary Hersey, AFSCME Representative, complimented the Parks
Department Director on his budget looking healthy and the
innovative changes to alleviate some of the personnel problems
that had existed, which has raised morale in the Department.
Magnolia Rentz, 1001 South 6th Street, complained about the
dogs running loose in her neighborhood and in her garden.
APPEARANCE BY VISITORS AND CONVENTION BUREAU MANAGER RE VOLCANO
SUNDAY
Les McNary, Director, gave information onithe events that will
take place on Sunday, May 17th,-in commemoration of. the com-
munity spirit that existed following the May 18th Mount St.
II/ Helens eruption. It will begin with a "Jog For Fun" event at
12:45 P.M., and end at 6:00 P.M. Events throughout the day
will be a parade at 1:00 P.M., live music at 2:00 P.M. at the
Yakima Center until 5:30 P.M., and in the east lobby at 2:30
P.M. there will be video tape copies available for viewing of
the media's film coverage from May 18th through the Memorial
weekend, 1980.
8. AGREEMENT REGARDING TRANSIT MARKETING PROGRAM . .

Willis White, Director of Public Works, stated that in the
1981 budget, $30,000 was budgeted for a marketing program. He
stated that he requested proposals based on a $15,000 adver-
tising program. He stated that the panel selected WINS and
Company to enter into a contract from now until the end of the
year, for $21,000, of which their profit is about 10%. Coun-
- 'ciL member Hinman expressed concern about the proposed adver-
tising program for the population of the City. Ken Toney,
WINS and Company, _ explained his advertising program, using
displays for the ad and read the script for radio ads. He

also explained a flyer which would go into the Yakima Herald -
Republic Newspaper which would entitle a person to a free ride
on the bus, and explained the contest to win a free pass for
riding the bus for one month. Council member Doty expressed
her concern that the proposal came in at $21,000 when propos-
als were requested for a $15,000 program. Mr. Toney stated
that this was a revised proposal, and that the original pro-
posal was for $15,000. Council member Crest expressed concern
that the free rides might be considered a gift of public
funds. Council member Carmichael expressed her concern with
the wording in the contract which calls for a 12 month con-
tract with a renewal option. She stated she thought this
contract was for the time between May and December. Mr. Toney
stated that they base their contracts on a 12 month period.
Council member Carmichael also expressed her displeasure with
the wording in the proposal describing the advertising target
area. Council member Hinman expressed his concern that there
is not a good understanding of the market and the people who
would ride the bus. He suggested that the program be centered
around a like an employer urging his employees to ride
the bus, or senior citizens riding the bus to the medical
center. Council member Crest expressed his concern about the
large expenditure on one project, and stated that alternatives
need to be looked at. Following discussion, the Resolution
authorizing the execution of the contract was read. It was
MOVED by Beauchamp that the Resolution be adopted. The Motion
died for lack of a second. It was MOVED by Crest, seconded by
Doty to send this back to staff and have them come back with a
little different program with a lower dollar amount. It was
MOVED by Hinman, seconded by Carmichael; to ask staff to
negotiate this proposal with WINS and Company and not put it
out for bids. Carried by 6 -1 voice vote. Beauchamp voting
nay. The question was called for the vote on the Motion as
amended. Carried by 6 -1 voice vote. Edmondson voting nay.
Council member Hinman suggested that staff work with the
Transit Committee to come up with some ideas. It was MOVED by
Hinman, seconded by Carmichael to ask staff to work with the
Transit Committee and come up with an alternative. Carried by
5 -2 voice vote. Beauchamp and Edmondson voting nay.
9. REPORT ON EAST NOB HILL OUTSIDE UTILITY AGREEMENT
It was the general consensus of the Council that the report be
accepted.
*10. SALE OF SURPLUS CITY PROPERTY ON NOB HILL BOULEVARD BETWEEN 32ND
AND 34TH AVENUES
RESOLUTION NO. D -4475, A RESOLUTION authorizing the sale of
surplus real property owned by the City situated on Nob Hill
Boulevard between 32nd and 34th Avenues, Yakima, Washington.
*11. AMENDMENT TO THE CITY /COUNTY JAIL AGREEMENT
RESOLUTION NO. D -4476, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to
execute an Addendum To City /County Jail Agreement.
*12. REIMBURSABLE CONTRACT WITH WILLIAM EDENS FOR SEWER LINE
RESOLUTION NO. D -4477, A _RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement with William Edens for the partial reimbursement
construction costs for a sewer line on Castlevale Road.
13. RIGHT -OF -WAY USE PERMIT REQUESTED BY RICHARD FLATHERS, 5 SOUTH 2ND
STREET
Council member Doty questioned if staff felt that granting
this,would set a dangerous precedent. Larry Wright, Planning
Manager, stated that this is a relatively permanent installa-
tion, and that he could get other requests. It was MOVED by

Hinman, seconded by Doty to accept the staff recommendation
and deny the application for a right-of-way use permit.
Unanimously carried by voice vote.
*14. ORDINANCE APPROPRIATING MONEY WITHIN VARIOUS FUNDS AND ACCOUNTS
An ordinance appropriating money within various funds and
accounts, having! been read by title only at this meeting, was
laid on the table for one week or until May 12, 1981.

16. OTHER
Council member Hinman inquired about the status of the Council
Committee on City finances. City Manager Zais stated that Mel
Wagoner withdreW his name because he had accepted another
commitment. He stated that staff was in the process of set-
-- Ifignp an initial meeting to establish a meeting time and
chairman. He stated that he will come back with a request to
appoint another individual.
Council member Doty asked if they could discuss the meeting
coming up this Thursday.

17. ADJOURNMENT
It was MOVED by Buchanan, seconded by Doty that this meeting
be adjourned at the hour of 4:35 P.M., to then meet at 4:40
P.M., May 5, 1981, to discuss the strategy for the meeting on
May 7, 1981, on the Urban Area Plan. Unanimously carried by
voice vote. -
