DECEMBER 23, 1980 231
STUDY SESSION
The City Council net in session on this date at 1:00 p.m. in the Council
Chambers Of City Hall, Yakima, Washington. Council members present were
Mayor Betty L. Edmondson, Lynn Budhanan, Lynn Carmichael, Shirley Doty
and Don Hinman. Council member Henry Beauchamp present after 1:10 p.m.
Council member Crest absent.
1. OPEN DISCUSSION FOR THE GOOD CF THE ORDER
It was MOVED by Buchanan, seconded by Hinman that Council
instruct staff to revise the management compensation package
and change it to 10.5 percent - with a maximum of 11.5 percent
l and a minimum of 7 percent. Unanimously carried by voice

vote. Beauchamp and Crest absent. It was noted that the
staff will try to have the ordinance ready by the end of the
meeting, to make that change.

MAYOR REPORTS
Mayor Edmondson reported that Charles Lee was appointed to the

Police and Fire Civil Service Commission to fill an unexpired
term, Which term will expire December 31, 1980. At the time
he was appointed to fill this unexpired term, he was also
appointed for the following six-year term, but not formally
appointed by the Council. It was MOVED by Buchanan, seconded
by Beauchamp that the Council reaffirm the appointment by the
City Manager of Charles Lee for a six term to the Police
and Fire Civil Service Commission, said term to begin January
1, 1981. In discussion, Council member Doty indicated that
she will probably vote against the motion as she is not
entirely comfortable with the process of the appointment. She
was concerned that they didn't know more about the people Who
applied in the first place. Council member Hinman asked if
this matter of reappointment for the new six-year term had
been discussed with Mr. Lee. City Manager Zais replied that
it had and Mr. Lee indicated that he still desires to serve.
Mayor Edmondson called for the vote on the nution and it
carried by 5-1 voice vote. Doty voting nay. Crest Absent.
City Manager Zais asked if there is something the Council
would like to have done regarding these appointments such as
having, two Council members review the applications with him
during the evaluation. Council member Beauchamp stated that
the City Manager brings the recommended appointments to
Council at Which time they-do have the right to question and
disagree. Council member Doty indicated that if she is the
only person that feels this way, that the matter should be
left like it is presently. No further action was taken on
this matter.
II/ . 2. DISCUSSION CP DRAFT URBAN AREA PLAN AND RESULTS FROM NEIGHBORHOOD
FORUM
Larry Wright, Planning Manager, reviewed the Comprehensive
Plan adopted in 1960 and explained that seven years ago an
update was started and the draft material reflects the changes
made. Ken Coffin of the Community Development Department,
reviewed the proposed Plan stating that the document was sent
to the Regional Planning Commission who mad R a recommendation
and forwarded the Plan back to the jurisdictions for adoption,
with seven minor changes, Which he listed. council member
Hinman stated that the indications from the citizens at the
neighborhood forums were that they were in favor of the Plan.
After discussion, it was MOVED by Hinman, seconded by
Carmidiael that the appropriate legislation be prepared to
adopt the Urban Area Plan as presented and amended by the
Regional Planning Commission and use it as the City's
Comprehensive Plan. Unanimously carried by voice vote. Crest
Absent. Jean Allard, former Council member, stated he is in
favor of this Plan. Council member Carmichael complimented
the staff on their efforts in preparing this Plan. Council

member Hinman suggested that the Mayor be instructed to send a
letter lack to the Urban Area Board telling them of the
Council action. The Mayor stated that this will be done.
3. REPORT ON CONSULTANT STUDY OF CITY-WIDE DRAINAGE SYSTEM
Denny Covell, City Engineer, reviewed the consultant study of
the City-wide Drainage System explaining that the primary
purpose of this study was to provide an up-to-date description
and maps of the storm drainage system. This gives an
inventory of that we have Which includes manhole and catch
basin locations, and pipe locations, sizes, elevations, slopes

• and materials. He further explained that next they will
develop the overall master drainage plan - vat has to be done
and what it will cost. Mayor Edmondson asked if there is a
time table and Mr. Covell stated that next year the Master
Plan should be in place. Council member Doty asked if the
County will be with the City on this. Mt. Covell stated that

there is indication that the County will be ready to go with
the City. Council member Beauchamp asked if the Holiday Inn
area was included. Mr. Covell stated that either there was no
data around that area or they left it out. He plans to
research with CH2MrHill on Why they did not include some
areas Asked that is needed from the Council at this time,
Mr. Covell explained that basically What we have now was that
we paid $25,000 for and $30,000 has been budgeted to work with
the County to get the Master Plan. After discussion, it was -
MOVED by Carmichael, seconded by Buchanan that the report that
has been prepared so far, be accepted and continue the plans
as outlined today toward the Master Plan with the County.
Unanimously carried by voice vote. Crest absent.
4. EXECUTIVE SESSION
It was MOVED by Hinman, seconded by Doty to move into
Executive Session to discuss property acquisition and
personnel. Unanimously carried by voice vote. Crest absent.
BUSINESS MEETING
5. ROLL CALL
At 3:00 P.M., the Council members commenced the regular
meeting, Mayor Edmondson presiding, Council members Beauchamp,
Buchanan, Carmichael, Doty and Hinman and City Manager Zais
and Assistant City Attorney Vanek present on roll call. Crest
absent.
6. INVOCATION
The Invocation was given by Council member Carmichael.
Mayor Edmondson announced that Council met in Executive
Session to discuss personnel. She commented that there wasn't
time to do an evaluation on the City Manager at this time,
however, it will be scheduled to be done in January. She

reported that the Management's salary will be increased by
10.5% and the City Manager will also receive a 10.5% raise.
She stated staff is directed to prepare the proper legislation
to accomplish this.
7. CONSENT AGENDA
Mayor Edmondson referred to the items placed on the Consent
Agenda questioning Whether there were any additions or
deletions from either Council members or citizens present.
Mayor Edmondson reported that there is additional information
to come on Item NO. 23 and it will be continued for two weeks.
She also stated that there is a citizen present wishing to
speak to Item No. 27. Council member Hinman requested that
Item NO. 28 be removed. Council member Doty requested that
Item No. 15 be removed. Council member Carmichael requested
that Item No. 16 be added, however, Council member Doty stated

that she has a question on that item. Mayor Edmondson
announced that there are Some off-agenda items Which she
listed as Item No. 29, a Cooperative Purchasing Agreement with
Wnatcom County and Item NO. 30, an Agreement for City
Sponsorship of a pre-application grant request to the
Washington State Energy Office and suggested that these items
be put on the Consent Agenda. It was the' general consensus of
the Council that the addition of Items NO. 29 and 30 and the
deletion of Items No. 15, 27 and 28, as requested, be made.
The City Clerk then read the Consent Agenda items including
resolutions and ordinances by title. It was MOVED by
Carmichael, seconded by Hinman that the Consent Agenda, as
read, be passed. Unanimously carried by roll call vote.

9. HEARING ON IHN DEVELOPMENT COMPANY, INC. REZONE REQUEST FOR
PROPERTY LOCATED AT 1705 SOUTH 24TH AVENUE
There being no citizen present wishing to speak to this item,
the public portion of the hearing was closed. Following
Council discussion, it was MOVED by Hinman, seconded by Doty
to direct staff to prepare the legislation to approve the
rezone and to use the justification in the staff report and
Planning Commission minutes. Unanimously carried by voice
vote. Crest absent.
10. AUDIENCE PARTICIPATION
No citizens. were present wishing to speak at this time.
*11. REPORT ON OFFICE SUPPLY PROCUREMENT COMPARISON -
The December - 18,. 1980 Office Supply Procurement Comparison
Report was accepted and staff directed to continue existing
office supply purchasing procedures.

directing the City Manager and City Clerk of the City of
Yakima to execute an agricultural lease agreement with
Bob Decoto for real . property at the Yakima Air Terminal.

*14. AGREEMENT FOR PARK RENTAL PROPERTY - KIWANIS PARK RESIDENCE
RESOLUTION NO. D-4394, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to
execute a lease agreement with Robert and Shirley Ritenour.
15. ADOPT 1981 SCHEDULE OF FEES FOR RECREATIONAL ACTIVITIES
Council member Doty expressed concern about the 50 swim fee.
She questioned if the fee could be adjusted during the year if
the number of people attending increases. Mayor Edmondson
stated that Council can amend the budget and amend any fees on
the schedule at any time during the year. Council member

Carmichael suggested that the Parks and Recreation Commission
and the Council Committee on Parks review this during the
year. It was MOVED by Hinman, seconded by Carmichael that
Resolution No. D-4395, as read, be passed. Unanimously
carried by roll call vote. Crest absent.
RESOLUTION NO. D-4395, A RESOLUTION adopting a schedule of
fees for recreational activities of the City of Yakima
Department of Parks & Recreation.
16. AMENDMENT NO. 11 TO THE AGREEMENT WITH R. W. BECK & ASSOCIATES RE
WASTEWATER TREATMENT PLANT CONSTRUCTION - PHASE II
Council members expressed their concern regarding the request
for an amendment to the R. W. Beck & Associates contract.
Council member Doty questioned the contractor's schedule on
the project. Jon Weise, Sanitary Engineer, explained the
completion date of the project and how the awarding of
Schedule B changed that completion date to May. He also
reported that there was a time extension granted for 16 days.
He stated that there is sufficient money to review the
contract until June. Council member Carmichael expressed her
concern that staff is not in agreement with What R. W. Beck is
saying in the letter. Council members requested more in-depth
information. Mr. Wiese commented that two weeks ago Council
authorized them $15,000 to carry them through December and DOE
and EPA will only authorize funding for prior authorized work.
He stated that the upper limit of the contract will have to be
reviewed if this is continued to January. Following this
discussion, it was MOVED by Hinman, seconded by Carmichael to
authorize the Amendment No. 11 with the figures to be brought
back to Council after the first of the year. City Manager
Zais stated that a resolution had been prepared and that an
alternative is to raise the ceiling. Following discussion,
Council member Hinman withdrew his motion and Council member
Carmichael withdrew her second to the motion. It was MOVED by
4 Hinman, seconded by Carmichael to raise the previous amount of
$15,000 to $30,000 until the 20th of January and staff to come
back at that time with a staff report. Unanimously carried by
voice vote. Crest absent.
*17. VOLCANO EMERGENCY CHANGE ORDER NO. 19 - WASTEWATER TREATMENT PLANT
'CONSTRUCTION
Change Order No. 19 to Contract No. 3, for volcanic
ash-related emergency work performed by Mullen & Associates,
was approved.
*18. FINAL CONTRACT CONSTRUCTION PAYMENT ON BRISTOL-GLENMOOR STORM DRAIN
PROJECT
The report from the Director of Community Development dated
December 16, 1980 with respect to the completion of the work
on Bristol-Gaenmoor storm drain project, performed by Ken
Leingang was approved, the work was accepted and payment of
the final estimate as therein set forth is hereby authorized.

*19. INVESTMENT REPORT FOR NOVEMBER, 1980
The report of the City. Treasurer dated November 30, 1980,
7' regarding the investments of the City of Yakima, was accepted
and approved.
*20. DATES CF HEARINGS SCHEDULED
The following hearings were sdheduled:
(a) Fixed time of hearing for an amendment to the Six Year
Transportation Improvement Program for January 6, 1981;
(b) Hearing on Water Rate Study set for January 13, 1981; and

(c) Hearing on L.I.D. NO. 1029, Moose Lodge Water Final
Assessment Roll set for January 20, 1981.

An Ordinance amending the 1980 Budget, having been read by
title only previously, was pasSed.
ORDINANCE NO. 2478, AN ORDINANCE amending the 1980 Budget for
the City of Yakima; apprOpriating the amount of $213, 395 from
unappropriated money in 613EMployees' Health Benefit Reserve
Fund to account 6.13.645.519.80.31 therein, as a 1980
appropriation for 613-EMployees' Health Benefit Reserves.

*26. ORDINANCE RELATING TO GARBAGE COLTECTION AND DISPOSAL
ORDINANCE NO. 2480, AN ORDINANCE relating to garbage
collection and disposal; establishing refuse collection
service rates; providing for yard service and a "yard service
surcharge", and adopting rules and regulations applicable
thereto; amending Subsection 4.16.040c of the City of Yakima
Municipal Code; and declaring an emergency.

27. ORDINANCE AUTHORIZING AND REGULATING THE ADOPTION OF CIVIL SERVICE
RULES AND REGULATIONS FOR POLICE & FIRE
Tony Sloan, representing Local 469 Firefighters, spoke in
apposition to the passage of this ordinance. He stated that
Civil Service Rules have been in existence since 1935 without
any problems. Don Loveland, representing Yakima Police
Patrolmen's Association, stated that the Association is
opposed to this ordinance. He reported on the effect the
ordinance would have on a Police Officer's ability to appeal a
letter of reprimand Which affects his promotion in the
Department for two years. There was some confusion about the
ordinance and City Manager Zais clarified that this Ordinance
will maintain the existing rules of the Civil Service
Commission. He stated that the Civil Service Commission
attempted to change the rules deleting the impact of a

reprimand having any effect on promotional status. Council
member Hinman commented that we got a court ruling which
states that letters of reprimand are not reviewable by the
Civil Service Commission. Mr. Sloan stated that the Civil
Service Commission does not view the letter of reprimand as a
disciplinary action. They want that determination made, since
it is not specifically in the Civil Service Rules. He
contended that a letter of reprimand' should not prevent a
person from taking a promotional exam. The ordinance was
read by title and it was MOVED by peaudlapp, seconded by
Hinman that the Ordinance be passed. Council member Hinman
stated that Council has some strong feelings about this issue
and perhaps should make the Civil Service Commission aware of
the Council's philosophy on this issue. Council member Doty
stated that the employee's have a grievance process and
believes that this issue is management's prerogative. The
question was called for the vote on the motion. Unanimously
carried by roll call vote. Crest absent. Doug Cordner, Vice
President of Local Firefighters 469 stated ,this Ordinance is
not fair and that the letter of 'reprimand should not -
effect the promotion of a firefighter. City Manager Zais
replied that there is a grievance procedure in the collective
bargaining agreement that can be exercised.
ORDINANCE NO. 2481, AN ORDINANCE relating to City gove/nment
administration; authorizing and directing the adoption of
Civil Service Rules and Regulations pertaining to the
discipline and promotion of employees; and amending Section
1.46.010 and Section 1.54.010 of the City of Yakima Municipal
Code.
28. ORDINANCE ADOPTING THE 1981 BUDGET
Council member Hinman stated he does not have any questions,
but complimented the staff on their efforts on this budget,
citing other cities that had to make drastic personnel cuts
and imposed B & 0 taxes. He stated that the management team
has earned their pay increases. It was MOVED by Beauchamp,
seconded by Carmichael that Ordinance NO. 2482, as read, be

passed. Unanimously carried by roll call vote. Crest absent.
ORDINANCE NO. 2482, AN ORDINANCE adopting a budget for the
City of Yakima, Washington for the year 1981; and
appropriating funds for estimated expenditures.
*29. COOPERATIVE PURCHASING AGREEMENT WITH WHATCOM COUNTY
RESOLUTION NO. D-4396, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to
execute a cooperative purchasing agreement with Whatcom
County.
*30. AGREEMENT FOR CITY SPONSORSHIP CF A PRE-APPLICATION GRANT REQUEST
TO THE WASHINGTON STATE ENERGY OFFICE
The staff reccomendation to enter into an agreement with the
State of Washington Energy Office for the purpose of preparing

an application to HUD for a Feasibility Study cf the potential
use of a geothermal district heating/cooling system in the
City of Yakima, was approved and accepted.
31. ORDINANCE RELATING TO CITY PERSONNEL, ADOPTING A CLASSIFICATION AND
COMPENSATION PLAN
City Manager Zais explained that this Ordinance relates to
management pay, rich includes the changes Council requested
at the beginning cf the meeting. It was MOVED by Beauchamp,
seconded by Buchanan that this ordinance, as read, be passed.
Unanimously carried by roll call vote. Crest absent.
ORDINANCE NO. 2483, AN ORDINANCE relating to City personnel;
adopting a classification and compensation plan for City
employees to be effective January 1, 1981; amending Sections
2.20.100 and 2.20.110 of the City of Yakima Municipal Code;
and declaring an emergency.
32. OTHER BUSINESS
ODUNCILMIFORMATION
Items of information supplied to Council were: copy of Yakima
County Resolution No. 674-1980 re transfer of Fairview-Sumac
sanitary sewer collection system to the City of Yakima.
11/18/80; copy of correspondence to KMWX re "MIX Free Fare
Day" from the Transit Manager. 12/15/80; letter from U.S.
Bureau of the Census re Change in Political Limits of the City
of Yakima jurisdiction for 1980 Census; letter to Chairman,
Police & Fire Civil Service Commission in response to his
inquiry on appointment procedure to Boards and Commissions
vacancies. 12/11/80; report from Chief of Police for November
1980; and memo from Assistant City Manager re Information
_Systems Users Committee. 12/18/80.
33. ADJOURNMENT
Mayor Edmondson announced that there will not be a Council
meeting held until January 6, 1981, unless there is an
emergency. There being no further business to come before the
Council, the meeting was adjourned at the hour of 4:16 P.M.
