HomeMy WebLinkAbout05/13/1980 Adjourned Meeting MAY 13, 1980 The City Council met in session on this date at 6:30 P.M. in classroom AB at KYVE -TV Studio, 1105 South 15th Avenue, Yakima, Washington. Council members present were Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Carmichael, Bruce Crest, Shirley Doty, and Don Hinman. Councilman Lynn Buchanan present after 7:15 P.M. - Mayor Edmondson reported that there will be a hearing on elderly and handicapped transportation on Wednesday, May 14, at 7:30 P.M., at City Hall. She also stated there will be another hearing on 'Thursday night at the Library. She reported that YMATS has received the Bike and Path Plan at their last meeting but did not have time to review it and give a recommendation. It was the general consensus of the Council to continue the discussion on this item until after a report has been received on it from YMATS. Council members discussed the AWC Conference which takes place in Olym- pia on June 17th, which is a regular Council meeting date. Following discussion, it was MOVED by Beauchamp, seconded by Doty to cancel the _ Council meeting on June 17th provided that unexpected business doesn't come up that requires Council to meet and other regular business can be taken care of: carried, Beauchamp, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by voice vote. Buchanan absent. Mayor Edmondson reported on the conversation she had with Representative Mike McCormack regarding the requirements for accessibility of the handicapped under Section 504. She reported that there is a Cleveland amendment that has been introduced and is in the sub - committee. That amendment would give each municipality the option of transportation for the handicapped and elderly. She also reported that representative McCormack reported that he does not believe that any action will be taken on the Wastewater Grant until September. _ ,. Mayor Edmondson requested direction for setting up the commi£ tee on the Task Force for Hazardous Material. She asked if Council wants her to set up a meeting for the Task Force to form a group, or does Council want to see the 21 names and then choose citizen representatives. Following discussion about the need for some guidelines for the Task Force, it was the general consensus.of the Council to set up a date for the representatives to meet and form a group. Mayor Edmondson reported that she has received a request from the Repub- lic of China to establish another sister city relationship. She gave some background information on the importing of apples to Taiwan, which will not compromise our relationship with Itayanagi. She stated that Mr. Yang, Director, Coordination Council for North American Affairs, and his aide, Mr. Hsiac, were in Yakima to arrange the sister city agreement for the city and the Port of Keelung. She reported that Mayor Chen of Keelung has adopted a resolution requesting a sister city relationship with Yakima. Mayor Edmondson inquired if Council would like -to enter into this relationship. It was MOVED by Hinman, seconded by Beauchamp to instruct the Mayor to establish a sister city relationship with the Port of Keelung in the Republic of China: carried, Beauchamp, Carmi- chael,- Crest, Doty, Edmondson and Hinman voting aye by voice vote. ,Buchanan absent. Council member Doty reported that she had a call from Verna Beggs. The 'Fairview -Sumac Commit -tee is working on the groundwork for the utility hook -ups. She told of the concerns voiced by the committee re the City's policy towards the mobile homes that will have to be hooked up to the sewer. She contacted Larry Wright, Principal Planner, and discussed this matter with him. She requested Council to voice a consensus that Council follow the present policy to annex that area with the under- standing that the mobile homes would be a non- conforming use. City Manager -Zais stated that he has been in contact with Verna Beggs and the Planning Department, and there will be a report available next week. It was the general consensus of the Council to have Council member Doty contact Verna Beggs and advise her that Council will be receiving some data on this next week. , Council members discussed the proposed changes in the Civil Service Commission for Police and Fire and the reports prepared by the Affirma- tive Action Specialist and the City Attorney. Council member Carmichael 030 MAY 13, 1980 gave a brief report on the trip to Seattle, and told of her visit to the Fire Station Training Center. She spoke about Seattle's Affirmative Action Program for Police and Fire, stating that the Police and Fire Department hire from a list of names submitted to them. Councilman Beauchamp reported that Seattle has a ratio layoff procedure, should layoffs be necessary. It was the general consensus of the Council to wait until after Council meets with the Police and Fire Commission before giving any direction on this. It was MOVED by Crest, seconded by Hinman to move into Executive Session for the purpose of discussing potential litigation: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by voice vote. At 8:00 P.M. the Council members moved into the Studio of the KYVE-TV station for the balance of the meeting, Mayor Edmondson presiding, Council members Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman and City Manager Zais and City Attorney Andrews present on roll call. The Invocation was given by Councilman Beauchamp. Mayor Edmondson gave some background information on the student chosen to receive the Outstanding Youth Award. She introduced Mark Pouley to present the award to Susie Johnson. Mark Pouley presented the Out- standing Youth Award to Susie Johnson on behalf of the City Council and the Yakima Youth Task Commission. Mayor Edmondson referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Councilman Beauchamp requested that Items No. 16 and 17 be added to the Consent Agenda, and Councilman Buchanan.requested that Item No. 8 be removed. Councilman Crest re- quested that Item No. 18 be added to the Consent Agenda. It was the general consensus of the Council that the addition of Items No. 16, 17, and 18, and the deletion of Item No. 8, as requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Hinman, seconded by Buchanan that the Consent Agenda, as read, be passed: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye on roll call. (Subsequent paragraphs preceded by an asterisk (*) indicated items on the Consent Agenda to be handled under one motion without further dis- cussion.) Councilman Buchanan reported an error in the motions of the top three items on page 493. It was MOVED by Hinman, seconded by Buchanan that the minutes of the April 8, 1980, meeting, having been corrected and no one present wishing to have said minutes read publicly, be approved: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by voice vote. This being the time fixed for the hearing on the proposed exchange of Oak Flats property with the State Department of Transportation, Willis White, Public Works Director, gave a brief overview of the proposed trade of the Oak Flats property. He stated that the intent of the City was to keep the property in public ownership. He reported that Oak Flats consists of 350 acres, and is appfaised at $237,000. The Depart- ment of Transportation desires 62 acres for a maintenance site which is in the heart of the property. There are 234 acres south of the river, which could be purchased by the Department of Game for a reservation for wildlife. There will be 16 acres remaining, which would remain for public use. The City would acquire from the State some property in the vicinity of the Wastewater Treatment Plant which is appraised at a value of $112,000. The property the Department of Transportation is wanting is also valued at $112,000. The area involved is about 118 acres of which the City is already leasing 36 acres. He stated he would like to acquire that property as part of the sludge disposal plant. It is the only land available for future expansion of the Treatment Plant. Jim Wilson, Department of Transportation, was present to answer questions. Mayor Edmondson expressed concern about the need for possible future development of water rights in the Cougar Lake Area. Mr. Wilson stated that the City would be granted a 20 foot easement by the river and along 031 MAY 13, 1980 the road. Ines Rice, 4409 West Arlington, spoke against the proposed trade, stating that it would jeopardize the City's future water. Mr. Wilson stated that the City will retain ownership of the diversion. point, about 1/4 of an acre. Mrs. Rice stated that she does not think that a 20 foot easement is wide enough. John Klingele, 1312 West Wal- nut, stated that in 1974 when there was a flood that facility was used as a filtering system. He stated he would like to see the City retain this as a source of major diversion to feed the City water. Mr. •lin- gele questioned where the material would be coming from for the rock crusher. He also stated that the crusher would be causing dust pollu- tion. Mr. Wilson stated that the gravel will come from the pond. The crusher operation pollutes noise, dirt and dust and that is why the State wants 62 acres as a buffer. The public portion of the hearing was declared closed by the Mayor.. Councilman Hinman stated that the City II/ needs to protect its water rights, and it would be a mistake to get rid of that property. Councilman Buchanan stated that if the highway is widened, it would delete the 20 foot easement. Glen Perkins, Water Superintendent, reported that the City wells will produce 9 to 11 mil- lion'gallons of water per day and in the summer we may run, 19 million gallons through the plant. He stated that this system is useless to us the way it is, however, and the only way we could use it would be to lay a new main to our water treatment plant. The State Health Board told us to shut it down. We are using a portion of that wooden stave to get water to the Gleed area and we are losing 1 million gallons of .water a day.- He stated that the City could use another well. He stated that he would like to see the City retain the intake structure and easement. Mayor Edmondson stated she could not see the advantage for the trade. The City can't use the land it will get)in trade, and the .City won't receive any money. It was MOVED-by Hinman, seconded by Crest to not trade the Oak Flats property with the Department of Transportation and State •Department of Game:- carried, carried,. Beauchamp, Buchanan; Carmi- chael, •Crest, Doty, Edmondson and Hinman voting aye by voice vote. Jim Lewis, Director of Communications for Comprehensive Mental, Health, stated that this is Mental Health Week and they are trying to do away with the stigma that is attached to mental health. Gary Henna, Director of Yakima Services, reported that one out of four Americans will seek services.from a Mental Health Service in their lifetime. Mayor Edmondson proclaimed this week as Nursing Home Week in the City and stated that their theme is "Love is Ageless". She encouraged the citizens to-take time to visit the people in the nursing homes. She reported that this is the first world-wide Kiwanis Prayer Week, and urged the citizens tajoin with them in spiritual fellowship. This is also Salvation Army Week, celebrating the 100th Anniversary of the Salvation Army in the United States. Victoria Wooten, 1208 Brown, representing the senior citizens, stated that the bus system is really needed. Gabriel Jackson, a citizen, stated that. a friend of his wanted to know the status of the Hazardous Waste Task Force. Mayor Edmondson reported II/ that Council will be sending letters to solicit names for membership on the Committee. Council members discussed the City/County Storm Drainage Study, con- tinued from last week's Council meeting. City Manager Zais stated that he understands that Council members Doty and Hinman, and the City En- gineer Dennis Covell met with the County Commissioners about the sub- ject. Councilman Hinman reported on that meeting', stating that the County's feelings were that the City,and the County were not on,the,same level to approach this study. The City does not have an adequate inven- tory of the-system. Dennis Covell,,City Engineer, recommended that the City do a study.of its storm drainage system in two phases. The first phase is for the City to get an inventory of the system. He reported that the consultant gave a cost of $25,000 to do this. He then stated that after the storm 'drainage inventory is prepared, then the City can get together with the County to develop a Master Storm Drainage System. Council member Carmichael asked what the advantage would be to do a joint study with the County, if the City hires a consultant to do the inventory. Mr. Covell stated that the County can tell us about their system, and there is a concern about working with the DID's. Following 1 MAY 13, 1980 further discussion, it was MOVED by Buchanan, seconded by Hinman to go ahead with the first part of the survey at an estimated cost of $25,000: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by voice vote. City Attorney Andrews reported that he should be able to bring an analy- sis in a couple of weeks of the request of Gabriel Jackson to operation a concession stand on Yakima Avenue and 2nd Street. He stated he could tentatively schedule to bring that information to Council on May 27, 1980. Mayor Edmondson distributed a letter from Mr. Jackson with addi- tional information on the request, giving additional businessmen in support of it. Speaking about the Yakima Metropolitan Area Path Plan, Mayor Edmondson stated that she was contacted by Council representatives on YMATS (Janet Snodgrass and Jim Kurbitz) and was informed that they have received a copy of the Path Plan but did not have the opportunity to review it and give a recommendation. Mayor Edmondson suggested that Council may want to delay action on this item until this recommendation is received. Janet Snodgrass, Council's representative to YMATS, reported that at the last meeting there were several interested citizens who wanted to review the plan and then give their input. She stated that there will be another meeting of YMATS this Thursday evening at 7:30 P.M. at the Library. Larry Lehman, Transportation Planner, stated that this is a total and complete document that took two years combined effort between staff and citizen committees to prepare., He reported that there is very little funding available, however, this plan will be a guide for improve- ments to arterial streets. Councilman Buchanan questioned the designa- tion of 64th Avenue and 72nd Avenue. Mr. Lehman stated he would take this under consideration and the maps will have to be revised several times before the funding is available. Following further discussion, it was MOVED by Buchanan, seconded by Crest to put this on the next week's agenda for consideration: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by voice vote. Les McNary, General Manager of the Yakima Center, reviewed the 1980 Yakima Center First Quarter Summary Report. He stated that he had budgeted for a $40,000 loss for the year, and in the first quarter the Center had only lost $3,500. He reported that there are 131 dates booked so far this year compared to the 134 total bookings for 1979. Councilman Hinman inquired about the attendance figures in the report, stating that March seems to be incorrect. Mr. McNary stated that he would check those figures. Mr. McNary stated that the ridership has doubled on the trolleys. The fare has been cut for senior citizens and children, and the routes have been extended. *It was, MOVED by Hinman, seconded by Buchanan that Resolution No. D-4241, authorizing the execution of a Modification Agreement with the Capitol Theatre Committee for management and operation of the Capitol ' Theatre during the year of 1980, be passed: carried, Beauchamp, Bu- chanan, CaLmichael, Crest, Doty, Edmondson and Hinman voting aye on roll call. RESOLUTION NO. D-4241, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Modification Agreement with the Capitol Theatre Committee, Inc. *It was MOVED by Hinman, seconded by Buchanan that Resolution No. D-4242, authorizing the purchase of materials for bus shelter window replacements, be passed: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye on roll call. RESOLUTION NO. ORDINANCE NO. 2415, AN ORDINANCE creating a Local Improvement District; amending Section 1 of City of Yakima Ordinance No. 2394, enacted April 8, 1980, and entitled "An Ordinance providing for the improvement of certain properties by constructing the necessary mains,.fire hydrants, valves, and appurtenances for supplying water for domestic use and fire protection, establishing a Local Improvement District, providing for the method of thereof, and creating a special:fund". II/ Council members discussed the proposed Ordinance regulating the adoption of rules and regulations by the Police and Fire _Civil Service Commis- sion. Bill Almon, attorney representing the Civil Service Commission, reported -he is representing the , Civil Service Commission .on•a matter that is now before the Appellant Court. He urged Council to delay action on this Ordinance until after they have met with the Civil Service Commission. He stated that if the Appellant Court determines that the Commission has jurisdiction in the matter involved, then this Ordinance would have no power. Mike-Welton, Police Officer representing the Police Department, spoke against the proposed Ordinance and outlined the current procedure to-air inter-departmental matters. He stated that disciplinary action can effect the Police Officers'. evaluations -- it means no promotion for two years. He stated that everything has been handled within the Department in the past, before the Tony Sloan inci- dent. Tom Fieldstead, representing the Firefighters, stated that they appreciate Council's decision to meet with the Civil Service Commission before taking any action on this Ordinance. Bill Dizmang, Executive Board, Yakima Police Association, stated that he doesn't have any com- ments now. Mayor Edmondson announced that Council-On-The-Air was going n MAY 13, 1980 off the air, however, the Council meeting would continue. City Manager Zais spoke about the Tony Sloan case, stating that the Superior Court ruled in favor of the City, saying it was outside the jurisdiction of the Civil Service Commission to hear the appeal. The Commission then presented a proposal to change the rules and then forwarded it to the City Attorneys Office for comment. The Commission is seeking to do something that is already in the court, and would be resolved in court. It is premature for them to make this, amendment until the litigation is resolved. He reported that the Commission has requested legal counsel, which would be a conflict of interest. He stated that the employees have an option available to them and that is to go through the grievance procedures through the PERC Commission. Following further discussion, it was MOVED by Hinman, seconded by Crest to continue this matter until after the meeting with the Civil Service Commission on the 20th: car- ried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and Hinman voting aye by voice vote. *It was MOVED by Hinman, seconded by Buchanan that Ordinance No. 2416, accepting the recommendation of the Planning Commission and rezoning property in the vicinity of 416 South 46th Avenue, be passed: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty, Edmondson and . 1 - Unman voting aye on roll call.
