HomeMy WebLinkAbout11/18/1980 Adjourned Meeting (2) 180 NOVEMBER 18, 1980 STUDY SESSION The City Council met in session on this date at 1:00 P.M. in the Council Chambers of City Hall, Yakima, Washington. Council members present were Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Buchanan, Lynn Car- michael, Bruce Crest, Shirley Doty and Don Hinran. 1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER , - Mayor Reports Mayor Edmondson reported that she had received a letter from Mr. Wright Hawkes asking how the City handles the collection of the 1/2% tax fran outside or transient merchants, if they do collect it, and how the City handles the licensing and bonding of these people. After discussion, it was the general consensus of the Council to refer this matter to staff to bring back a report. Mayor Edmondson reported that the Dia- mond Parking people had asked if the City was interested in going to the bid procedure for parking lot checking, marking of cars, etc. It was the general consensus of the Council to refer this matter to staff to report back regarding in-staff operation vs. contracting out to Diamond Parking, going to bid, or any other recommendation. Mayor Edmondson referred to the response from Hank Hein, Supervising Traffic Engineer, to the request regarding strip- ing of the intersection at Fruitvale Boulevard and North 9th Avenue, Which stated that this is part in the County and part in the City and there is nothing we can do about it. There was discussion regarding the painting of crosswalks and the safety factor involved on whether crosswalks should he paint- ed. The suggestion was made to contact the County regarding this particular crosswalk to see if something could be worked out with them. It was MOVED by Doty, seconded by Crest that staff be directed to explore the possibility of working with the County regarding the striping of the intersection of Fruitvale Boulevard and North 9th Avenue, and future coopera- tion on other intersections. Motion failed by 4-3 show of hand vote. Beauchamp, Buchanan, Carmichael and Hinman voting nay. Council member Hinman indicated he feels the matter of the safety factor regarding painting of crosswalks should be settled first, before painting them. Mayor Edmondson reported that she has heard fran only one of the individuals regarding an answer to her letter to the four members of the Planning Commission who have been absent for the last three meetings. She will have a report for the Council at the next meeting. The Council Committee of Doty, Crest and Hinman reported they are ready to recommend persons to fill vacancies when this report is made. 2. DISCUSSION RE SPECIAL COUNSELING PROGRAMS FOR HOUSING SERVICES Ken Coffin, CDBG Manager, introduced Diane Henderson, Housing Information Aide, who explained the Housing Counseling Program for the past year in detail. She outlined the types of coun- seling the program covers, such as landlord/tenant informa- tion, default/delinquency information, pre-purchasing coun- seling, rental counseling, consumer education, have improve- ment workshop, and fair housing information. Ms. Henderson explained that the tremendous workload handled is basically on a referral basis, stating that in this past year they handled 993 landlord/tenant requests, 104 default/delinquencies, 27 pre-purchasing counseling sessions, 11 consumer education, and 19 counseling related to the 312 loan program. She stated that in addition, they would like to discuss a housing grants proposal to support the program in Yakima, stating that the Yakima Office is the only housing counseling service in East- ern Washington. She further stated they would like Council consideration to make application for the grant, which is a supplemental program which would provide additional funds this next year for an additional staff person. After discussion in NOVEMBER 18, 1980 191 STUDY SESSION which more information was given on what the proposed grant would cover, it was MOVED by Beauchamp, seconded by Buchanan that the staff be directed to apply for this additional grant for counseling services as outlined. Unanimously carried by voice vote. 3. REPORT FROM PERSONNEL DEPARTMENT RE OPEN PROMOTIONAL EXAMS City Manager Zais reported that this is a follow -up report to the previous report the Council received in September regard- ing Police and Fire Civil Service promotions. At that time the Council asked for additional information about the appli- cation of open competition in other cities. Bob Weaver, Personnel Officer, and Larry Wittenberg, Assistant City Man- ager, answered questions regarding the report distributed. Mr. Weaver explained that Washington, California and Oregon cities have been surveyed. They found no incidents in Wash- ington cities where there is open competition except for chiefs. There was further discussion regarding the report, and the previous recommendation of the Committee of the Coun- cil, after which the Council had instructed staff to prepare legislation. It was the general consensus of the Council that there was no immediate necessity to do it now. It was MOVED by Beauchamp, seconded by Crest, to continue this discussion until after the budget, or until the first of the year. Unanimously carried by voice vote. 4. EXECUTIVE SESSION RE PENDING AND PROSPECTIVE LITIGATION AND COL- LECTIVE BARGAINING It was MOVED by Hinman, seconded by Carmichael to move into Executive Session for the purpose of discussing pending and prospective litigation and collective bargaining. Unanimously carried by voice vote. 1 NOVEMBER 18, 1980 BUSINESS MEETING 5. ROLL CALL At 3:00 P.M. the Council members commenced their regular meeting, Mayor Edmondson presiding, Council members Beauchamp, Buchanan, Carmichael, Crest, Doty and Hinman and City Manager Zais and City Attorney Andrews present on roll call. 6. INVOCATION The Invocation was given by City Attorney Andrews. Mayor Edmondson announced that Council met in Executive Ses- sion and made a decision not to appeal the Southeast Area Rezone ruling by the Superior Court. 7. CONSENT AGENDA II/ Mayor Edmondson referred to the its placed on the Consent Agenda questioning whether there were any additions or dele- tions from either Council members or citizens present. Mayor Edmondson announced that there is an off-agenda item to be numbered 20-A regarding an agreement with Ken Leingang Exca- vating, Inc. Council member Carmichael requested that Item No. 28 be added to the Consent Agenda. Council member Buchanan requested that Item No. 12 be added. Mayor Edmondson requested that Item No. 8 be removed from the Consent Agenda. It was the general consensus of the Council that the addition of Items No. 12 and 28 and the deletion of Item No. 8, as requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and an ordinance by title. It was MOVED by Carmichael, seconded by Hinman that the Con- sent Agenda, as read, be passed. Unanimously carried by roll call vote. (Subsequent paragraphs preceded by an asterisk (*) indicate items on the Consent Agenda handled under one motion without further discussion.) 8. MINUTES Mayor Edmondson referred to an cuor in the November 4, 1980, Council minutes on page 173, and stated that letters were mailed to four Planning Commission members. She also stated that on page 178 of the November 4, 1980, minutes, she stated that the amendment is "not" palatable. It was MOVED by Crest, seconded by Carmichael that the minutes of November 4, 1980, as corrected, were approved. Unanimously carried by voice vote. It was MOVED by Crest, seconded by Buchanan that the minutes of November 12, 1980, were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. Unanimously carried by voice vote. 9. AUDIENCE PARTICIPATION 1981 CONFERENCE OF GOVERNMENTS PRESENTATION II/ Mayor Edmondson stated that she is a member of the COG Execu- tive Board and stated that the 1981 budget will be presented to the COG general membership on December 10, 1980. She gave an overview of the COG budget, stating that the City of Yak- ima's assessment will be assessed at 23.380 per capita. Debra Prins, COG, commented that the budget material previously provided to Council outlines the goals and specific programs that have involved COG. The City of Yakima's assessment will be $11,692. She stated she needs a formal letter from the City Manager stating the City of Yakima will participate in COG. It was MOVED by Hinman, seconded by Doty to approve our assessment to COG in the amount of $11,692 and instruct the City Manager to send them a letter so stating, before the 1st of December. Unanimously carried by voice vote. 1 ,3 NOVEMBER 18, 1980 APPEARANCE BY LARRY WITTENBERG Larry Wittenberg, Assistant City Manager, announced that City Manager Dick Zais has been elected as Vice-President of the Washington City Managers Association at their business meeting last week. PROCLAMATION Mayor Edmondson proclaimed the week of November 15-22, 1980, as American Education Week. She also proclaimed Thursday, November 20, 1980, as the "Great American Smoke-Out" Day, and urged all citizens to accept this challenge to not smoke on this day. She proclaimed November 23-28, 1980, as Family Week II/ and urged citizens to join with the General Federation of Women Clubs to become involved in family activities. 10. PRESENTATION OF 1981 BUDGET City Manager Zais stated that this is the official filing of the 1981 budget for the City. The budget is in balance, however, it is an extremely tight budget. He commented about the critical need for the Federal Revenue Sharing funds, which has not passed completely through Congress, and the reper- cussions to the budget should it not pass. Following the City Manager's comments on the 1981 budget, it was MOVED by Crest, seconded by Doty to set the date of hearing for the 1981 budget and Federal Revenue Sharing hearing for December 2, 1980, at 3:00 P.M. in the Council Chambers. Unanimously carried by voice vote. 11. REPORT ON AIRPORT RESTAURANT VALIDATION PROGRAM This item has been continued one week to allow time for the restaurant attorney to meet with the Airport Advisory Commis- sion. *12. REPORT ON SCHOOL SAFETY COMMITTEE WORK PROGRAM The staff report dated 11/6/80 on the School Safety Committee was accepted. 13. TANCARA SUBDIVISION ROAD CLOSURE REQUEST Hank Hein, Supervising Traffic Engineer, reviewed his memo dated 11/14/80 regarding the application for the street clo- sure within the Tancara Subdivision. He suggested that if the street closure is granted, that some sort of liability policy be enforced to cover the City's equipment in the subdivision. Discussion followed regarding the Council's concern about damage and liability, costs incurred for Police work if neces- sary, spectator safety and clean-up following the event. City Attorney Andrews explained the procedure to follow to grant this request. Charles Moore, 5604 Scenic Drive, and Daryl Schilperoort, President of the Yakima Valley Sportscar Club, addressed Council's concerns and stated that they could at- tempt to increase their $300,000 liability 'insurance. Mr. Schilperoort described the autocross event which the club is wishing to hold. He also stated that the club would suggest that the event be scheduled for November 30th rather than November 22nd to give them additional time to advertise the event. He stated that this event is really for the partici- pants and not the spectators. Following this discussion, it was MOVED by Hinman, seconded by Crest to instruct staff to prepare the appropriate legislature and change the date to November 30, 1980, and if possible, the club should see about raising their liability insurance to $500,000 and the event be held at no expense to the City of Yakima for clean-up and hold the City harmless for any possible liability. Carried, by 6-1 voice vote. Beauchamp voting nay. 1 8 NOVEMBER 18, 1980 *14. REPORT ON REHABILITATION ASSISTANCE FROM OFFICE OF HOUSING AND NEIGHBORHOOD CONSERVATION The 11/7/80 memo from the Director of Community Development regarding the rescinding of the denial of Dolores Helmer for rehabilitation assistance on 9/23/80, was accepted. *15. TRAFFIC SIGNAL REPAIR AGREEMENT WITH THE CITY OF WAPATO RESOLUTION NO. D-4359, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Traffic Signal Repair Agreement with the City of Wapato. *16. AMENDMENT NO. 9 TO THE AGREEMENT WITH R. W. BECK AND ASSOCIATES FOR VOLCANO EMERGENCY SERVICES RESOLUTION NO. D-4360, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute an amendment to the agreement with R. W. Beck and Associates to prepare a Wastewater Facilities Design. *17. SURPLUS PROPERTY AT 102 NORTH 9TH STREET RESOLUTION NO. D-4361, A RESOLUTION authorizing the sale of surplus property owned by the City. *18. LEASE AGREEMENTS COVERING CITY-OWNED HOUSES AT OAK FLATS RESOLUTION NO. D-4362, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute rental agreements with Harry and Helen Orr, and Jeaneen Watkins and Carol Gleeson for houses B and A respectively at the Oak Flats Property. *19. DAMAGE CLAIM FOR LOSS OF PROPERTY AT LIONS POOL RESOLUTION NO. D-4363, A RESOLUTION denying the claim of Guadalupe Juarez filed with the City of Yakima 10/29/80. *20. FINAL CONTRACT CONSTRUCTION PAYMENT ON 1980 SEWER PROJECT -- SCHE- DULE 1 A report from the Director of Community Development dated 10/29/80 with respect to the completion of the 1980 Sewer Project -- Schedule 1 -- 61st Avenue Sewer, performed by Low's Crane and Excavating, was approved, the work was accepted and payment of the final estimates as therein set forth was auth- orized. ** 20-B. PURCHASE REPAIR PARTS AND SERVICES FOR REFUSE TRUCKS It was MOVED by Crest, seconded by Hinman that Resolution No. D-4365, be passed. Carried by 6-1 roll call vote. Doty II/ temporarily absent. RESOLUTION NO. D-4365, A RESOLUTION authorizing the purchase of truck repair parts and services without calling for bids. *21. ORDINANCE IMPLEMENTING SALES AND USE TAX ORDINANCE NO. 2469, AN ORDINANCE relating to City funds and accounts; fixing and imposing a local sales and use tax and providing for the administration of that tax; designating the source of funds for the City Transit Fund; enacting Chapter 3.89, "Transit Sales and Use Tax", as a new chapter, amending Section 3.68.020, and repealing Sections 3.68.040, 3.68.050, 3.68.060, 3.68.070, and 3.68.080, Chapter 3.88, "Housing Unit Transit Tax", and each and every section thereof, and Chapter 3.92, "Multiple Dwelling Housing Unit Transit Tax", and each and every section thereof all of the Yakima Municipal Code. ** See page 195 195 NOVEMBER 18, 1980 *22. ORDINANCE AMENDING THE 1980 BUDGET TO PAY COSTS FOR RETROACTIVE APPLICATION OF RECLASSIFICATION RESULTS An Ordinance amending the 1980 budget, appropriating, trans- ferring and reappropriating money, having been read by title . only at this meeting was laid on the table for one week or until Tuesday, November 25, 1980. 23. OTHER BUSINESS CHANCE ORDER NO. 18 FOR OONTRACT NO. 3, WASTEWATER TREATMENT FACIL- ITIES ' Dennis Bertek, Supervising Sanitary Engineer, explained the II/ Change Order which is a $31,972 credit to the City. It was MOVED by Hinman, seconded by Crest to approve Change Order No. 18 to Contract No. 3, Wastewater Treatment Facilities. Unani- mously carried by voice vote.
