HomeMy WebLinkAbout09/25/1980 Adjourned Meeting ADJOURNED MEETING SEPTEMBER 25, 1980 The City Council met in session on this date at 2:00 P.M. in the Council Chambers of City Hall, Yakima, Washington; Mayor Edmondson presiding, Council members Lynn Buchanan, Lynn Carmichael, Bruce Crest, Shirley Doty and Don Hinman present on roll call. Council member Henry Beau- champ absent. Mayor Edmondson stated that this meeting was called for the purpose of discussing the City's Outside Utility Agreements. Carol Darby, Director of Community Development, referred to her memo dated 9/25/80 and stated that the history of the Outside Utility Agree- ment was traced back through 24 years. She spoke about the increased number of outside utilities being requested and referred to a map which II/ indicates properties with outside utilities. She reviewed the alterna- tives given in the report. Council members discussed these alterna- tives, outlining the advantages and disadvantages of each alternative. She reported that staff has two recommendations: 1) Actively pursue compliance to the conditions and commitments made to the City by the current Outside Utility Agreement holders -- including legal action where necessary; and 2) Prepare a resolution to place a suspension on Outside Utility Agreements as proposed in Alternative No. 3. Council member Hinman stated there could be a sixth alternative to have an Outside Utility Agreement with nothing in it about planning. The citi- zen would agree to annex, but nothing would be in the agreement about going to City standards. Following Council deliberation, it was MOVED by Buchanan, seconded by Carmichael to direct staff to prepare proper legislation to implement Alternative No. 3 to suspend Outside Utility Agreements until the Regional Planning Program is in place and operat- ing. Seeking clarification, Mayor Edmondson inquired if the Motion is passed would it suspend all utilities with the exception of those al- ready started and would it mean that utilities could be extended through annexation? Carol Darby confirmed that to be correct. She also stated that there are bound to be a few requests Council would have to consider on a case by case basis. City Attorney Andrews commented that the City would have to honor the agreements made when the rights-of-way were extended for the sewer line. Carol Darby suggested that the suspension would apply to all outside utility requests with the exception of those already in process, those utilities where the City has prior commitment for wastewater project and those utilities which may be determined necessary because of health, welfare and safety. City Attorney Andrews questioned who would be determining that; will staff have the authority to reject them or do they all have to come to Council? He stated that if Council desires to vest the authority of discretion to decide on which applications to accept, Council must set forth some sort of stan- dards and criteria for the staff to follow. Mayor Edmondson suggested that it could be a decision of the Health District. Carol Darby stated that staff could bring back some suggestions for the criteria. The question wascalled_tor the vote on the Motion. Carried by 5/2 voice vote. Hinman voting nay. Beauchamp absent. Council member Crest absent after 3:40 P.M. Council members briefly discussed the proposed annexation brochure. Council member Doty stated she does not like the word "actively" pur- suing annexations. Carol Darby stated that that can be deleted, how- ever, Council member Carmichael said she is not sure that she wants it deleted. Mayor Edmondson questioned the statement that the City gives a discount when the utility payment is paid within a certain period of time. Carol Darby stated that staff would check on that. Discussion followed on the problems encountered in pursuing annexation of the Madison House. It was MOVED by Carmichael, seconded by Buchanan to actively pursue compliance to the conditions and commitments made to the City by the current Outside Utility Agreement holders -- including legal action where necessary. Unanimously carried by voice vote.
