JULY 8, 1980
The City Council met in session on this date at 6:30 p.m. in the Con-
ference ROOM at City Hall, Yakima, Washington. Council members present
were Mayor Betty L. Edtbndson, Henry Beauchamp, Lynn Buchanan, Lynn
Carmichael, Bruce Crest and Shirley Doty, and Don Hinman. - --
Reference was made to the notice of the National League of Cities Con-
ference to be held November 29 to December 3, 1980 at Atlanta, Georgia.
Mayor Edmondson reported that Bert Broad has informed him that
there will be Swim Across the week of August 4, 1980, to prOmyLe the
"Learn-to-Swim" class sponsored by the Red Cross, and would like Council
members to participate.
II/ Councilman Crest reported on the meeting of the Committee of the Council
on reorganization, stating that one of the things that they can up with
was an activity survey for Council members. He explained that it is an
opinion survey regarding the role of the Mayor, any ideas for reorgan-
ization. -- proposed changes in rules and roles -- possible Charter
changes. He asked that these be filled out by the 1st of August -- list
the meetings attended, hours spent, etc., especially outside of Council
meetings and stated that they will be doing this for July, August and
SepteMber.
City Manager Zais reported that there are two FEMA disaster teams -- one
is assigned to look at the City's cleanup work and the second is assign-
ed under EPA to work on the City Wastewater Treatment Plant. They will
go on site to prepare detailed information, sorting out the damage that
may be recoverable and the costs that are ineligible. He stated that
some items may be open to discussion and it is very time consuming since
the City is still working on the ash control and the cleanup effort. He
also reported that the City has just received its first interim fin-
ancing of $600,000.
Council member Doty noted that Council and staff will be meeting with
Don Swartz, Mbnday, July 14, 1980 at the Yakima Center Conference Rom.
Reference was also made to the meeting with City and government offic-
ials on Tuesday, July 15, 1980 from 10:00 a.m. to 12:00 Non.
It was the consensus of the Council to set the date for a special meet-
ing regarding Affirmative Action Plan for Tuesday, July 22, 1980 at
10:00 a.m. to 1:00 p.m. at the Sanctuary Restaurant.
Carol Darby, Director of Community Development, distributed a report
regarding the Community Development Block Grant Program and briefly
reviewed the highlights of the report and items that will be discussed
at the hearing on the regular agenda. She stated that there are a
couple of minor changes in the Housing Assistance Program and that this
is the third year of a three-year program. She referred to'the report
Which gives the different programs and how many dollars that have been
put into those programs, as related to how many dollars had been rec
II/ eived. One of the things reviewed is the draw down on the funds. We
have approximately $500,000 carry over Which we are using this year and
next year, she stated. Ms. Darby reported that Congress is considering
that any one that hasn't used their funds will loose them. She further
reported that the program is divided up into two sections -- (1) the
existing programs we are obligated to and (2) the new proposals. Ken
Crawford, CDBG Manager, reported on the Housing Rehab portion of the
project and Carole Folsom-Hill, Citizen Participation Coordinator,
reported on the Housing Counseling services portion of the program and
citizen participation meetings planned in 1981.
It was MOVED by Beauchamp, seconded by Carmichael to go into Executive
Session to discuss pending litigation: carried, Beauchamp, Buchanan,
Carmichael, Crest, Doty, BAncnOsen and _Hinman voting aye tyvoice vote.
Upon completion of the Executive Session, at 8:00 p.m., the Council
members moved into the Council Chambers for the balance of the meeting.

Carmichael, Doty and Crest and City Manager Zais and City Attorney
Andrews present on roll call. Mayor Edmondson absent.

The Invocation was given by City Attorney Andrews.
Assistant Mayor Hinman referred to the items placed on the Consent
Agenda questioning whether there were any additions or deletions from
either COuncil members or citizens present. Item NO. 13 was requested
to be removed from the Consent Agenda and Items No. 10 and 11 were
requested to be added to the Consent Agenda. It was the general con-
sensus a1 the Council that Item NO. 13 should be added and Items No. 10
and 11 should be deleted from the consent Agenda, as requested. The
City Clerk then read the Consent Agenda items including Resolutions and
an Ordinance by title. It was MOVED by Buchanan, seconded by Carmichael
that the Consent Agenda, as read, be passed: carried, Beauchamp, Buch-
anan, Carmichael, Crest, Doty and Hinman voting aye on roll call.
Edmondson absent. (SUbsequent paragraphs preceded by an asterisk (*)
indicate items on the Consent Agenda to be handled under one motion
without further discussion.)
This being the time fixed for the first hearing on the 1981 Commanity
Development Block Grant, Carol Darby, Community Development Director,
reviewed the procedure for applying for the Block Grant funds. She ex
plained that nine proposals for $114,000 were received which have to be
reviewed, input received from the public at two hearings, and then the
decisions are made after the second public hearing. The first person
speaking to the Council, Art Sclodall, P.O. Box 73, Everett, Washington,
was not requesting any Block Grant Funds. He explained he is repre-
senting a group that has bought the Commercial Hotel and are going to
submit an application to HUD under the Section 8 Program to convert the
Commercial Hotel into an apartment complex and needs the blessing of the
Council. He further explained that Bill Paddock, Yakima Architect, is
helping and they are trying to leave it intact to retain the character
cf the building. They will have 14 apartments per floor, four floors,
making 56 units. Since no funds are requested, no Council action was
taken. Those citizens present speaking in favor cf and giving infor-
mation on the request for funds for the Planned Parenthood Program were
Gwen Chaplin, Executive Director, 208 No. 3rd Avenue and Jerry Gibbons,
Board MeMber, 6501 Northridge. Citizens present speaking in favor of
and giving information on the Yakima Neighborhood Health Services appli-
cation were, Anita Mbnoian, 1 No. 4th Street, Executive Director cf
Yakima Neighborhood Health Services, Dr. Doug Corporon, 5510 Englewood,
Resident Family Medicine; Ellen Harder, Resident Physician at the Yakima
Neighborhood Health Services, Nicole Bocek, Family Physician, Dr. Dale
Brewer, 2311 West Chestnut, officer in the County Medical Society and
Dolores Heinen, President, Yakima Neighborhood Health Services, 2306
Barge. Those citizens present and speaking in favor of the Dust Abate-
ment Program for the Northeast Area were Mary Kirby, 305 No. Naches; Ida
K. Mann, 207 No. Naches Ave.; Loyola Siep, 610 No. 5th Street; Ruby M.
Anderson, 1105 So. "H" Street; Frank Kolb, 604 NO. 2nd St.; and Eddie
Sauve, 609 No. 2nd St. John Everhart, 1011 So. 8th Street spoke to the
matter of dust abatement program for the alleys and also would like to
have something done about the dust from the project across from where he
lives in the 1200 block of So. Rth Street. Terry Walker, 717 So. 7th
Ave., Registered Nurse with Central Washington Mental Care -- Group
Homes - Halfway House, requested $6,000 for a weatherization project aolE
the Mental Health Clinic at 202 No. 7th Street. Lucinda Getts asked
about providing emergency repairs for senior citizens. The public
portion cf the hearing was closed. Assistant Mayor Hinman explained
that the Council would not make a final decision on the proposals until
after the second hearing next week. Reference was made to the request
of John Everhart, 1012 So. Rth St., to have something done about the
dust caused by the City Housing Project across from his house, and it
was the consensus of the Council to refer this matter to staff to check
it out and report back. Carol Darby referred to the proposed dust
abatement program for the Northeast area and stated that there are many
other areas that also need this type of program, and that they are in
the process of looking into getting disaster relief funds or explore the
possibility of a three year comprehensive dust abatement program. It
was the consensus of the Council to have a report brought back regarding
possible solutions to this problem.
City Manager Zais referred to the updated report from the Director of
Public Works and Transit Manager re Proposed changes for City Transit
System and stated that basically the recommendation is that Council
direct staff to proceed with the proper legislation to refer the matter
of the 0.3% sales tax to the electorate and the elimination of the

Household Tax. He further stated that the staff reccomendation also is
to approve Capital Improvement Program A, which meets the absolute min-
imum requirements of 504 and maintain the current system. Further staff
recommendation listed in the report is to revise the Transit fare to a
flat rate of 25 (Handicapped 10) to be effective January 1, 1981,
subject to approval of the sales tax ballot. Councilman Hinman stated
that in upgrading the bus system, he does not feel the fare should be
reduced, but should be increased to 50. It was noted that there will
be a transit fare public hearing in a few weeks. After discussion, it
was MOVED by Beauchamp, seconded by Carmichael that the Council propose
a transit fare increase to 5() for persons 18 years of age and over; 25
for age 5-18 and honored senior citizens and change the monthly rate
for passes from $3.00 to $4.00: carried, Beauchamp, Buchanan, Car-
michael, Crest, Doty and Hinman voting aye by voice vote. Edmondson
II/ absent. There was discussion regarding the Capital Improvement Program
A, regarding bus shelters, the number of buses to be p the

procedure followed in the formation of a public transportation benefit
area (PPBA), and the matter of referring the 0.3% sales tax to the
electorate. Councilman Hinman asked if we go 0.1% or 0.2% would this
raise enough money. Public Works Director Willis White stated that the
0.1% would not raise enough and although the 0.2% would cover for a
While, it might not later on. He further explained the requested ballot
issue authorizes up to 0.3% and could later be lowered, if not needed.
Council member Doty stated that the downtown merchants are really
opposed to the 0.3% sales tax._
After further discussion, it was MOVED by Beauchamp,
seconded by Carmichael that staff be instructed to prepare the proper
legislation to refer the matter of the 0.3% sales tax to the electorate:
carried, Beaudhamp, Buchanan, Carmichael, Crest, and Hinman voting aye
by voice vote. Doty voting nay. Edmondson absent.
City Manager Zais explained that at the April 22, 1980 Council meeting,
staff presented its recommended Wastewater Resource Allocation Plan to
serve the City of Yakima, Union Gap, Terrace Heights Sewer District and
a portion of the unincorporated of Yakima county. He reviewed the fact
that the Council has also reviewed comments from the City of Union Gap
and Yakima County and pursuant to that review, directed that the alloc-
ation plan be adopted as proposed. He stated that we have subsequently
received a further reply of this matter from Terrace Heights, Which the
Council has seen and the staff position remains unchanged. Therefore,
they continue to recommend adoption of the Allocation Plan without
further amendment. Council members indicating that they concur with
staff recommendation, it was MOVED by Buchanan, seconded by Beauchamp
that Resolution No. D-4284 defining a "Yakima Wastewater Resource Alloc-
ation Plan", be passed: carried, Beauchamp, Buchanan, Carmichael,, Doty,
Crest and Hinman voting aye on roll call. Edmondson absent.

It was MOVED by Buchanan, seconded by Carmichael that Resolution No.
D-4285, Which establishes right-of-way acquisition procedures, be
II/ passed: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty and
Hinman voting aye on roll call. Edmondson absent.
RESOLUTION NO. D-4284, A RESOLUTION establishing administrative guide-
lines for the acquisition of street right-of-way with federal funds.
It was MOVED by Buchanan, seconded by Carmichael that the report of
Fire Chief Carroll regarding the replacement of tone encoder equipment
be accepted and authorization be given to purchase said encoders at the
cost of $1,300: carried, Beauchamp, Buchanan, Carmichael, Doty, Crest
and Hinman voting aye by voice vote. Edmondson absent.
It was MOVED by Buchanan, seconded by Carmichael that the report of the
Department of Cdmmunity Development dated July 1, 1980, with respect to
the completion of the work on the contract performed by Knobel Electric,
1980 Fire Lane Signalization, be approved, the work be accepted and the
payment of the final estimate as therein set forth is hereby authorized:
carried, Beaudhamp, Buchanan, Carmichael, Crest, Doty and Hinman voting
aye by voice vote. Edmondson Absent.
The Ordinance amending the classification and compensation plan having
been taken off the Consent Agenda, Fire Chief Ed Carroll referred to the

mmofrom the Personnel Officer which explained that the only change in
the Ordinance is a raise in salary range for the Secretary II classif i-
cation. He reviewed the explanation cf why this position is reclassif- .
ied pointing out that she had been reclassified from Secretary I Step 5
to Secretary II, Step 2 and _stated that he feels this should have been
Secretary II, Step 5, as she was in Step 5 in the previous classif i-
cation. It was MOVED by Beauchamp that the -request of ChieE Carroll to
have this change to Secretary II Step 5, be passed. The motion died for
lack of a second. In discussion, Council members indicated that they
feel that the matter cf personnel step changes should be handled adminr
istratively. It was then MOVED by Beauchamp, seconded by Buchanan that
Ordinance . No. 2428, amending the Classification and Compensation Plan,
be passed: carried, Beauchamp, Buchanan, Carmichael, Crest, Doty and
Hinman voting aye on roll call. Edmondson absent. .
ORDINANCE NO. 2428, AN ORDINANCE relating to City personnel; amending

the Compensation Plan relating to Fire Civil Service employees; changing
the effective date therecf, and amending Section 2.20.110 cf the City cf
Yakima Municipal Code.
*An Ordinance amending the 1980 Budget and appropriating, transferring
and reappropriating monies among various accounts for promoting tourism
having been read by title only at this meeting, it was MOVED by Buch-
anan, seconded by Carmichael that this item be laid on the table for one
week, or until Tuesday, July_ 15, 1980: carried, Beauchamp, Buchanan,
Carmichael, Crest, Doty and Hinman voting aye on roll call. Edmondson
absent.
