HomeMy WebLinkAbout03/15/1983 Study Session MARCH 15, 1983 1 5 STUDY SESSION The City Council met in session on this date at 2:00 P.M. in the Council Chambers of City Hall, Yakima, Washington. Council members present were Assistant Mayor Lynn Buchanan, Clarence Barnett, Henry Beauchamp, Shirley Doty, W. K. "Pete" Moore and Jack Sparling. Mayor Carmichael absent. 1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Council member Doty encouraged City Council members to attend the Open House tour of the Housing Services Center on Saturday morning, March 19, 1983. She indicated the tour would be a good experience and opportunity to meet the Housing Services Center advisory group members. Council member Sparling referred to a recent newspaper article addressing the status on the various City pools. City Manager Zais informed Council of two public hearings scheduled by the Parks Commission regarding City Aquatic needs. He stated the meetings will be held on March 21 and 22, 1983, after which the Parks Commission will respond back to Council with a preliminary report. 2. EXECUTIVE SESSION REGARDING PROSPECTIVE LITIGATION It was MOVED by Beauchamp, seconded by Doty to move into Executive Session for the purpose of discussing prospective litigation. Unanimously carried by voice vote. Carmichael absent. BUSINESS MEETING 3. ROLL CALL At 3:00 P.M., the Council members commenced the regular meeting, Assistant Mayor Buchanan presiding, Council members Barnett, Beauchamp, Doty, Moore and Sparling present. Mayor Carmichael absent and excused. 4. INVOCATION The Invocation was given by Council member Doty. 5. CONSENT AGENDA Assistant Mayor Buchanan referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. City Manager Zais requested Item No. 15 be postponed for one II/ week. Council member Barnett indicated he was not present for the January 25, 1983 hearing for Item No. 13 and, therefore, would abstain from voting on that item. It was the general consensus of the Council that the deletion of Item No. 15, as requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Beauchamp, seconded by Doty that the Consent Agenda, as read, be passed. Carried by a 5-1 roll call vote. Barnett abstaining from voting on Item No. 1.3 due to his absence at the January 25, 1983 hearing on the item. Mayor Carmichael absent. (Subsequent paragraphs preceded by an asterisk (*) indicate items on the Consent Agenda handled under one motion without further discussion.) 6. CURRENT STUDY SESSION ITEMS None *7. MINUTES The Council minutes of February 1, 1983, were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 1: 1 3 MARCH 15, 1983 8. AUDIENCE PARTICIPATION None 9. HEARING ON 1983 IRRIGATION MAINTENANCE ASSESSMENT ROLL This being the time fixed for the hearing on the 1983 Irrigation Maintenance Assessment Roll, Dennis Covell, Director of Engineering and Utilities, introduced Frank Mabry, Superintendent, Water Division. Frank Mabry began discussion, informing Council that 60% of the districts comprising the 1983 Irrigation Maintenance Assessment Roll did not receive a rate adjustment. He addressed District No. 688 which received a 71% increase. He informed Council that the 71% increase was primarily attributed to the replacement of a badly worn pump at a cost of $3,000. He addressed other districts which 11/ incurred significant increases and informed Council of the criteria for the increases; District No. 857 incurred a 36% rate increase due to 1983 expenditures including $1,000 pump and the establishment of a cash reserve, District No. 837 received a recommended 36% rate increase due to compensation for 1983 expenditures and establishment of a cash reserve, and District No. 308, or the General Irrigation System, received a recommended 25% rate increase, to compensate for the 1983 expenditures including a $2,000 pump replacement. Mr. Mabry informed Council this pump-operated system was constructed in 1919 using wood stave pipe which has deteriorated significantly. He commented on the appropriation of Community Development Block Grant funds which have been earmarked for this area. Mr. Mabry responded to- Council's questions. Council member Barnett expressed his concerns regarding the lack of 1982 actual data and the necessary costs information from the private canal and power companies. He expressed his concerns regarding districts that are incurring a rate increase which is higher than the estimated expenditure percentage. He referred to District No. 308, wherein that district has estimated expenditures for 1983 of approximately 15.9% however, the proposed rate increase is 25%. Council member Barnett reiterated his concern regarding a proposed ' rate increase higher than estimated expenditures for a district, that has an- adequate cash balance. Council member Beauchamp stated he had similar concerns regarding the use of estimated figures versus 1982 actual data as a basis for the proposed rate increases. Assistant Mayor Buchanan requested citizens wishing to speak, do so by District number. Those citizens speaking in opposition to the irrigation assessment roll were: District No. 308: Monroe Rentz, 803 S. Naches Avenue; Magnolia Rentz, 1001 S. 6th Street; Marge Grove, 103 S. 6th Street, who requested an improvement in water pressure for her district; Albert Lantrip, 808 Pioneer Lane, owns two parcels at '215 S. 8th Street, informed Council of his inability to locate a water outlet on one of the parcels; Rev. John Adams, 915 S. Naches Avenue, informed Council he received an assessment, but does not receive irrigation water; C. H. Himms, Granger, Lot 6, Block 82, Naches Avenue, stated a water outlet is not available on his property; District No. 378: Rube Riley, 424 S. 18th Avenue; District No. 508: Joe Leingang, 918 S. llth Avenue, requested improved water pressure; District No. 534: George Corbett, 2702 W. Chestnut, representing himself and his neighbors, requested information regarding the current assessment for his district; District No. 556: Al Owens, 620 S. 23rd Avenue; District No. 664: Wilma DePue,.1405 S. 1st Avenue and Maxine Saylor, 1407 S. 7th Avenue, commented on low:water pressure in their areas; District No. 688: Allison Pike, 408 N. 23rd Avenue, questioned if the $3,000 pump, necessary for their district, could be prorated; and District No. 837: Sis Patnode, 511 W. Pierce, spoke in opposition to paying an irrigation assessment for water they do not use. Council members and staff responded to these citizens, regarding their concerns, informing them of substantial Community Development Block Grant funds which have been allocated for irrigation MARCH 15, 1983 417 needs. Frank Mabry responded to those citizens who reported problems with their irrigation needs, informing them staff would research and help solve these problems. Mr. Mabry also clarified the policies and procedures pertaining to irrigation assessment by the square foot of property owned by individuals. There being no other citizens wishing to speak to this issue, the public portion of the hearing was closed. Council member Barnett proposed a point of consideration by the Council, wherein, those districts whose percent increase in costs is less than the proposed 1983 percent rate increase, and where there is a beginning estimated cash balance sufficient to meet four months operating needs, he proposed the rate increase for those districts not exceed the estimated 1983 costs. He stated that those districts that meet the criteria, as outlined, should be changed in the ordinance. Discussion followed regarding the types of data and problems incurred in compiling the 1983 Irrigation Assessment Roll. The Ordinance confirming the irrigation maintenance assessment roll for the City of Yakima for the calendar year 1983, having been read by title, it was MOVED by Doty, seconded by Moore that the Ordinance as read, be passed. Council member Beauchamp suggested staff research Council member Barnett's proposal. Discussion followed regarding the consolidation of some of the districts during which City Attorney Andrews elaborated on the legal aspects and constraints pertaining to the consolidation of water districts. Council member Beauchamp reiterated his desire to request staff to research Council member Barnett's proposal, before taking any formal action on the issue. The question was called for a vote on the motion. Motion failed 3 -3 by roll call vote. Barnett, Beauchamp and Sparling voting nay. Carmichael absent. It was the consensus of the Council to request staff to research Council member Barnett's proposal and return in one week. *10. RESOLUTION AUTHORIZING THE EXECUTION OF A PERSONAL SERVICES CONTRACT WITH BRUCE BELFIELD FOR ADMINISTRATIVE SUPPORT IN THE FIRE DEPARTMENT RESOLUTION NO. D -4785, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute a personal services agreement with Bruce Belfield. *11. RESOLUTION AUTHORIZING THE EXECUTION OF A PERSONAL SERVICES CONTRACT WITH ALICE BACHISON, FOR ADMINISTRATIVE SUPPORT IN THE POLICE DEPARTMENT RESOLUTION NO. D -4786, A RESOLUTION authorizing and directing the City Manager and the City Clerk to execute a personal services contract with Alice Bachison. *12. RESOLUTION AUTHORIZING A TEMPORARY LOAN FOR THE PURCHASE OF STREET LIGHTS RESOLUTION NO. D -4787, A RESOLUTION authorizing a temporary loan from 199 - Federal Shared Revenue Fund to 000 - General Fund, and providing for repayment. *13. RESOLUTION DENYING THE APPLICATION FOR A MAJOR MODIFICATION TO A PLANNED DEVELOPMENT LOCATED AT 3502 TIETON DRIVE, AS REQUESTED BY D. A. HABECK RESOLUTION NO. D -4788, A RESOLUTION denying an application by D. A. Habeck for a major modification to a Planned Development zone at 3502 Tieton Drive, Yakima, Washington. *14. APPROVAL OF OUT -OF -STATE TRAVEL FOR PERSONNEL DIVISION The out -of -state travel for Julie Lande, Buyer, Purchasing Division, to attend the semi- annual PNPPA Conference in Eugene, Oregon, March 16 -18, 1983, at a cost of $297, was approved. !i8 MARCH 15, 1983 *15. ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION PLAN AN ORDINANCE relating to City government personnel; authorizing special assignment pay, was postponed for one week. *16. ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION PLAN ORDINANCE NO. 2678, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective April 16, 1983; amending Sections 2.20.100 and 2.20.110 of the City of Yakima Municipal Code. *17. ORDINANCE GRANTING A MAJOR MODIFICATION/REZONE OF PROPERTY LOCATED AT 54 WEST NOB HILL BOULEVARD, AS REQUESTED FOR - BAMBOO TERRACE II/ ORDINANCE NO. 2679, AN ORDINANCE affirming the recommendation of the Planning Commission and granting a majdr modification to a Planned Development Zone, and rezoning proerty from R-2, Two-Family Zone to Planned Development Zone, at 54 West Nob Hill Boulevard in the City of Yakima, Washington. *18. ORDINANCE GRANTING A REZONE OF PROPERTY LOCATED IN THE VICINITY OF THE 300 BLOCK.OF SOUTH 10TH AVENUE, AS REQUESTED BY D. MILLER AND J. SAHR ORDINANCE NO. 2680, AN ORDINANCE affirming the recommendation of the Planning Commission and rezoning property in the 300 block of South 10th Avenue from R-3, Multiple-Family Zone to B-1, Modified Business Zone. *19. ORDINANCE APPROPRIATING FUNDS FOR SALES TAX PAYMENTS (VOLCANO CLEANUP) (SECOND READING) An Ordinance appropriating funds for sales :tax payments (volcano clean-up), having been read by title only at a previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 2681, AN ORDINANCE amending the 1983 Budget for the City of Yakima and appropriating money within 197-Volcano Emergency Fund for expenditure during the year 1983. *20. ORDINANCE APPROPRIATING FUNDS FOR OUTSTANDING 1982 ENCUMBRANCES (SECOND READING) An Ordinance appropriating funds for outstanding 1982 encumbrances, having been read by title only at a previous meeting, was brought before the Council for a second reading. ORDINANCE NO, 2682, AN ORDINANCE amending the 1983 Budget for the City of Yakima; appropriating the total amount of $260,408 from unappropriated balances to various accounts in various funds for expenditure during,the year. 1983. II/ *21. ORDINANCE AMENDING THE . 1983 BUDGET AND APPROPRIATING FUNDS -- STREET LIGHTS, STREET BUDGET AND VOLCANO LOAN INTEREST (FIRST READING) AN ORDINANCE amending the 1983 Budget of the. City of Yakima; appropriating the various amounts from unappropriated fund balances within various funds for expenditure during 1983, having been ready by title only at this meeting, was laid on the table for one week or until March 22, 1983. 22. OTHER BUSINESS Council member Doty addressed the vacancy- on the Community Programming Committee. It was MOVED by Doty, seconded by Beauchamp, to appoint Thuracial Fields-Wright to the Community Programming Committee to fill the vacancy created by Audrey Fetters. Unanimously carried by voice vote. Carmichael absent.
