HomeMy WebLinkAbout02/23/1982 Study Session 122 FEBRUARY 23, 1982 STUDY SESSION The City Council met in session on this date at 1:30 p.m. in the Council Chambers of City Hall, Yakima, Washington. Council members present were Mar Lynn Carmichael, Clarence Barnett, Lynn Buchanan, Shirley Doty and Jack Sparling. Council members Henry Beauchamp and W. K. "Pete" Moore absent. 1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Council member Barnett stated he felt it is important for Council members to attend the Ki-Yak/COG meeting in Toppenish regarding a forum on local oil/gas impacts in Yakima County on February 25, 1982 at noon. Council member Sparling requested reports on revenue for the City on a monthly basis. Assistant City Manager Wittenberg stated that the City Manager had planned to bring this information to Council on a quarterly basis. Council member Buchanan then suggested that Council be apprised about the revenue status following the receipt of the December sales tax money. There was discussion regarding the dike at the Wastewater Treatment Plant; Council member Barnett requested clarification on the suggested Corps of Engineer study under Section 205 and the removal of the gravel bar. 2. EXECUTIVE SESSION It was MOVED by Doty, seconded by Buchanan to move into Executive Session for the purpose of discussing pending and prospective litigation. Unanimously carried by voice vote. Beauchamp and Nbore absent. BUSINESS MEETING 3. ROLL CALL At 3:00 p.m., the Council members commenced the regular meeting, Mayor Carmichael presiding, Council members Barnett, Buchanan, Doty and Sparling and Assistant City Manager Wittenberg and City Attorney Andrews present on roll call. Council members Beauchamp and Moore absent and excused. 4. INVOCATION The Invocation was given by Council member Buchanan. 5. OONSENT AGENER Mayor Carmichael referred to the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Council member Doty II/ requested that Item No. 14 be added, however, Mayor Carmichael stated that Jay hbite, Yakima Herald-Republic wished to speak to that item. Mr. Mite indicated that he did not have any objections to having it placed on the Consent Agenda. Council member Doty requested that Items No. 16 and 20 be added, huNever, Council member Barnett stated he had a question on Item No. 20. Council member Barnett requested that Items No. 9 and 12 be removed from the Consent Agenda. It was the general consensus of the Council that the additions of Items No. 14 and 16 and the deletion of Items No. 9 and 12, as ' - requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Doty, seconded by Buchanan, that the Consent Agenda, as read, be passed. Unanimously carried by roll call FEBRUARY 23, 1982 123 vote. Beauchamp and Moore absent. (Subsequent paragraphs preceded by an asterisk (*) indicate items on the Consent Agenda handled under one motion without further discussion.) 6. CURRENT STUDY SESSION ITEMS None 7. APPEARANCE BY KEN SCHILLER OF COX CABLE OF YAKIMA Stating he has received complaints about the program, "Escapade", Council member Sparling asked Mr. Schiller about the policy of their station. He stated that at the time they were trying to obtain their franchise they had promised not to II/ bring in any bad movies. Mr. Schiller introduced Doug Brooks, Plant Manager, who explained there is a method to wipe out the audio and picture completely for that channel by having Cox come out and de-tune the converter, free of Charge. He stated that there is also available a keyed lock which can be purdhased. 8. AUDIENCE PARTICIPATION Ward Steiner, 3307 Castlevale, stated he works with a licensed broker representing the Hartford Deferred Compensation Plan. He compared some of the benefits management would have with Hartford Deferred Compensation that the ICMA program does not offer. Assistant City Manager Wittenberg interrupted Mr. Steiner to suggest that he speak with the appropriate staff members. Don Brule, 9 No. 65th Ave. expressed his objection to the program, "Escapade", being available on Cox Cable. He stated he is concerned that this programming is accessible to kids. Roland McLaughlin, Rt. 2, Box 643, stated that he also objects to the program, "Escapade". He stated that he has been advised there is nothing that can legally be done to prevent this from being aired. 9. REPORT ON STATE EXAMINER'S PRELIMINARY AUDIT OF CAPITOL THEATRE PROJECT AND CITY SHOPS PAVING PROJECT Referring to Exhibits A and B, Council member Barnett asked What the impact will be on the City if the Review Agencies do not accept the unresolved costs. Don Horan, Director of Finance & Budget, stated that he asked that question of the State Attorney General's Office and it was their feeling that we would not be penalized. It was MOVED by Barnett, seconded by Buchanan to approve the report. Unanimously carried by voice vote. Beauchamp and Moore absent. *10. SET DATE OF HEARING FOR 1981 GRANTEE PERFORMANCE REPORT FOR COMMUNITY DEVELOPMENT BLOCK GRANT Mardh 9 and 16, 1982 were set as the dates of hearing on the 1981 Grantee Performance Report. *11. AGREEMENT ACCEPTING COMMUNITY BLOCK GRANT FUNDS FROM THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT RESOLUTION NO. D-4622, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute an agreement accepting Community Development Block Grant No. B-8244C-53-0008 from the United States of America, Department of Housing and Urban Development. 12. CHANGE ORDER NO. 13, NASTEWATER TREATMENT PLANT CONSTRUCTION, CONTRACT NO. 5, SCHEDULE A Jon Wiese, Sanitary Engineer, responded to several questions asked by Council member Barnett regarding various items in the change order. Ines Rice, 4409 Arlington, expressed her displeasure about some of -these Changes; asking why the 12 FEBRUARY 23, 1982 contractor is not responsible for some of these costs. Following discussion, it was MOVED by Doty, seconded by Buchanan to approve Change Order No. 13 to Contract No. 5, Schedule A. *13. OUT OF STATE TRAVEL FOR WATER SUPERINTENDENT AND CITY MANAGER The out of state travel requests were approved for Frank Mabry, Water/Irrigation Superintendent to attend the Pacific Northwest Section of AWWA Annual Conference in Medford, Oregon, April 15 & 16, 1982, at a cost of $275 and for the City Manager to attend the Regional Spring Conference meeting of Oregon-Washington City Management Associations in Gleneden Beach, Oregon, March 30-April 2, 1982, at a cost of $170. *14. AWARD BID FOR CITY LEGAL ADVERTISING The staff recommendation to award the bid for the City's legal advertising to the single bidder, Yakima Herald-Republic, was accepted. 15. REPORT FROM COMMUNITY DEVELOPMENT RE STATUS OF FIRE MASTER PLAN STUDY Larry Wright, Acting Director of Community and Economic Development, gave a brief outline of the information contained in the material previously distributed to the Council. Council member Doty requested monthly status reports on this project. Following discussion, it was MOVED by Barnett, seconded by Doty to accept the report. Unanimously carried by voice vote. Beauchamp and Moore absent. *16. REPORT ON IMPLEMENTATION OF REVISED REFUSE REROUTING SYSTEM The report was accepted. 17. REPORT ON PROPOSED TRANSIT MARKETING PROGRAM AND CONSIDERATION OF STAFF SUPPORT Dan Neaton, Transit Manager, gave some background information on a marketing program which was approved by Council in 1980, of which only 4 of the 8 programs outlined were hmplemented. He stated he would like Council authorization to hire a temporary Marketing Specialist to be financed out of the Marketing Specialist Fund to initiate the four remaining programs; Fare Exchange Progran, Employer Subsidized Passes, "Getting Around" - Transit Makes the Difference, and Media Tradeouts. There was discussion concerning the fare box revenue receipts ratio to the operating expenses. In response to Council member Budhanan's question, Mr. Newton explained that staff is recut the hiring of the DA IV who used to be the secretary to the Public Works Director to do this work. He stated that she has taken some marketing programs and is familiar with the City and its transit system. Council members then asked questions about the media trade-outs and II/ canuented that this program was discontinued several years ago as being non-productive. Council member Barnett stated that before the funds are expended for these marketing programs, we should find out where we are in our revenues and expenditures. Council Timbers asked for comparison figures on the transit fares from some of the other jurisdictions, such as Spokane and Bremerton. Council member Sparling also asked for a background on the person staff was recommending to fill this position. It was MOVED by Sparling, seconded by Buchanan to table this for two weeks until staff has an opportunity to come back with further information, as requested. Unanimously carried by voice vote. Beauchamp and Moore absent. 18. REPORT ON WNSULTANT STUDY OF SLUDGE MANAGEMENT PLAN Dennis Bertek, Supervising Sanitary Engineer, reported that the consultant's recommendation indicates that on the short term, the City should negotiate with the County to get a favorable rate to spread the sludge at the landfill. He FEBRUARY 23, 1982 125 stated staff would continue to look at alternatives to put it on farm land, etc. for a long term plan. He reported that DOE was pleased with this report. Gary Gray, Gary Gray and Associates, commented that a firm, Entranco, helped with this report. He commented on the recommendations and alternatives given in the report; disposing of sludge in County landfill; set up completely separate sludge disposal site; or set up an agricultural utilization program. He recommended entering into an agreement with the County whereby the City uses the existing County landfill in Terrace Heights on an interim basis, if not a permanent basis. He suggested that Council read the report in full or consider a Council Committee. Following discussion, it was MOVED by Buchanan, seconded by Sparling to continue this it to the next Study Session. Unanimously carried by voice vote. Beauchamp and MOore absent. *19. ORDINANCE ZONING PROPERTY AT 56TH AVENUE AND TIETON DRIVE (TANCARA SUBDIVISION) ORDINANCE NO. 2600, AN ORDINANCE rezoning property within the TANCARA Subdivision at the intersection of 56th Avenue and Tieton Drive in the City of Yakima, Washington, from R-1, Single-Family Zone to Planned Development Zone. 20, ORDINANCE AMENDING CLASSIFICATION AND COMPENSATION PLAN (SEWER MAINTENANCE) Mayor Carmichael stated that there are a couple of Council members who need to leave shortly, which would leave the Council without a quorum. During the discussion on whether to continue this item to another meeting, Council member Buchanan excused himself. (Council member Buchanan absent after 5:15 p.m.) It was MOVED by Sperling, seconded by Barnett to continue this item for one week. Carried by 3-1 voice vote. Doty voting nay. Beauchamp, Buchanan and MOore absent. 21.
