Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Betty L. Edmondson, Don Schussler and Bill Whitaker. There was a request from Councilmen Schussler and Edmondson for copies of the City Council Minutes to be given to Councilmen prior to the _ meeting on Monday. City Manager McMicken discussed, the matter of opening up a State Budget Process for input by local government officials prior to the planning meetings at the state level. It was suggested by Councilman Edmondson that the Council work with Staff on this matter. Councilman Schussler requested a City Staff examination of departmental effectiveness and assess objectives over a five -year period. At 2:30 P.M., Council members moved to the Council Chambers for a press conference. Betty L. Edmondson (incumbent), W.K. (Pete) Moore, and Charles A. Rich, having been duly elected to the office of Councilman for four year terms on November 6, 1973, and the Oath of Office having been administered to them by Superior Court Judge Howard Hettinger in the County Courthouse on this date, are now duly seated as Councilmen for the City of Yakima. At 3:00 P.M., Council members met in the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Edmondson, Moore, Rich, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by City Manager McMicken. JANUARY 14, 1974 _ . The minutes of the previous adjourned regular meeting of December 21, 1973, and the regular meeting of January 7, 1974, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. The next order of business was the election of a Mayor and Assistant Mayor for the next two years. Councilman Brown submitted in nomination the name of Bert Broad for Mayor and the nomination was seconded by Councilman Schussler. It was MOVED by Whitaker, seconded by Schussler that nominations be closed: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. Upon roll call, Councilman Bert Broad received the unanimous vote of the Council members: Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. Councilman Bert Broad having been elected Mayor for the next two year term, the Council meeting was turned over to him. Mayor Broad called for nominations for the position of Assistant Mayor. Councilman Edmondson submitted in nomination the name of Wray Brown for Assistant Mayor. The nomination was seconded by Councilman Whitaker. It was MOVED by Schussler, seconded by Whitaker that nominations be closed: carried, Broad, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. Upon roll call, Councilman Wray Brown received the unanimous vote of the Council members: Broad, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. This being the time set for the Hearing on L.I.D. No. 991, Haven Way Sanitary Sewer District, and there being no one present speaking against this matter, it was MOVED by Schussler, seconded by Whitaker that Ordinance No. 1608, confirming the assessment roll for L.I.D. No. 991, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1608, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 991 as created and established by Ordinance 1493 of the Ordinances of the City of Yakima. This being the time set for the Hearing on the adoption of an Airport Noise Impact Guideline as an amendment to the city's General Plan, Assistant Planner, John Haddix, reviewed the Planning Staff Report and Planning Commission Minutes on this subject dated August 27th and December 4, 1973, respectively. With the use of a map, he indicated the composite_ noise rating areas in this part of Yakima County as developed by the Federal Aviation Administration. He indicated that both the Farmer's Home Administration and Veteran's Administration are using these zone guidelines in decisions on insurance for home loans. He further reported that the Planning Staff recommends approval and adoption of the composite noise rating zones and that they be adopted as a Noise Impact Guideline for planning future land uses in the affected areas. City Attorney Andrews explained that the City would not be adopting a new zone but that this Guideline would be supplemental to the city's General Plan previously adopted. After due discussion, it was MOVED by Edmondson, seconded by Schussler that Resolution No. D-3054, providing for the adoption of said Noise Impact Guideline, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. RESOLUTION NO. D-3054, A RESOLUTION amending the "General Plan for the City of Yakima" by adding a supplement thereto a "Noise Impact Guideline" pertaining to land uses adjacent to the Yakima Air Terminal. This being the time set for the Hearing on Petition No. 800, filed by Orman E. Arnold and others, requesting vacation of King Street between Rock Avenue and Ledwich Avenue, Director of Community Development, Jay Otto, reviewed the Planning Staff Report and Planning Commission Minutes on this subject dated December 27, 1973, and January 8, 1974, respectively. He indicated this to be an island area within the City, noting that the request is for twenty-five unimproved feet of street right-of-way. Mr. Otto reported that no opposition to this request has been received from affected City departments and utility companies notified, and recommended approval of this vacation request subject to the following conditions: JANUARY 14, 1974 1. Easement rights for the placement and maintenance of existing and future utilities be maintained and deeded by Easement Deed to the City for the full 25 foot street right-of-way proposed for vacation. 2. In order to insure adequate future street right-of-way, it is further recommended that the petitioners be required to deed to Yakima County an additional 25 feet of right-of-way along the east side of Rock Avenue from King Street to Pierce Avenue. This would provide right-of-way adequate for a full width residential street similar to that recently completed along portions of Rock Avenue to the north. Mr. Otto indicated that the property owners are willing to give twenty feet and that a signed Easement Deed is ready for the vacated portion of Rock Avenue, but requested that this matter be held over to the next regular Council meeting for further consideration and information concerning Rock Avenue. It was MOVED by Edmondson, seconded by Rich that this Hearing be continued until the next regular Council meeting of January 21, 1974: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. Mr. Gene Gandy, 420 South 23rd Avenue, being present, spoke to the matter of fast traffic conditions in his neighborhood, requesting a 20 mile per hour speed limit in the area bounded by 16th on the east, 40th Avenue on the west, Nob Hill on the South and Summitview on the north. City Manager McMicken noted possible enforcement problems with a reduced speed limit in limited areas, being bordered by areas with higher speed limits. Mr. Gandy further requested that more 25- mile per hour speed limit signs be placed on 24th Avenue. Director of Public Works, Dave Vargas, indicated that the Staff will study the matter of the requested 20 mile per hour area and report back to the Council and that the Staff will provide for the requested additional 25 mile per hour signs on 24th Avenue. The matter of authorization to execute a contract with Blue Cross for insurance benefits for employees under the LEFF System, was referred to, having been continued from the last regular Council meeting. Mayor Broad indicated that the meeting of the Police Relief and Pension Board held on this date resulted in a recommendation for approval of the proposed medical coverage plan. This matter having been previously discussed at the last meeting, it was MOVED by Edmondson, seconded by Schussler that Resolution No. D-3055, author- izing the execution of said contract with Blue Cross, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. RESOLUTION NO. D-3055, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to acquire medical insurance coverage from Blue Cross, Washington-Alaska, Inc., for personnel within the Law Enforcement and Fire Fighter Pension System. City Manager McMicken briefly reviewed City Manager Report No. 203 regarding the Repeal of Health Licenses. He noted the attached Memo from City Attorney Andrews which gave reasons for the possible transfer to the Health District of the issuance of health permits for restaurants, retail meat, wholesale meat, milk trucks, and itinerant food businesses inasmuch as the Health District already performs the necessary health inspections for these businesses. After due discussion, it was MOVED by Whitaker, seconded by Brown that Resolution No D-3056, consenting to the administration of these permits and fees by the Yakima Health District, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. RESOLUTION NO. D-3056, A RESOLUTION consenting to the collection of health license and permit fees within the City of Yakima by the Yakima County Health District. 4 JANUARY 14, 1974 City Manager McMicken briefly reviewed City Manager Report No. 204 regarding the Disposition of Fire Station No. 1, along with the attached Planning Report, recommending that the building be retained and put to good use. Mr. Henry Beauchamp, Director of the Yakima Valley Opportun- ities Industrialization Center, being present, reviewed his letter of proposal dated January 11, 1974, in which he requested the use of Fire Station No. 1 as a location for carrying on the OIC program, explain- ing that the former location was burned out in the recent Chieftain Hotel fire. Mr. Beauchamp stated that the OIC organization would be willing to make necessary repairs to the building and also pay rent to the City. He further indicated that OIC would be using the whole building for their program. Eleanor Ficele, representing the Public Assistance Volunteer Services and the County's Emergency Task Force, requested the use of this building by the Emergency Task Force for carrying on assistance to migrant workers wishing to obtain housing and other services, noting that the Fire Station would provide a centralized 11 location. She indicated, however, that this organization would not be able to cover the renovation costs. Mr. Leo Seguel, Director for the County Voluntary Action Center, also indicated an interest in the use of this building to carry on this program, suggesting that a plan could possibly be worked out with OIC for use of part of the building. Mr. John Larson, being present, spoke in favor of the proposed use of this facility by the Opportunities Industrialization Center. Mayor Broad indicated an interest in saving this building to be used in some community service. Councilman Schussler opposed the use of this facility by volunteer agencies. Councilman Moore suggested that OIC be asked to give figures on the cost of renovation. There was discussion by the Councilmen of possible parking problems for surrounding businesses if volunteer agencies are located at this site. Councilman Edmondson suggested that an updated report be obtained from the Building Inspector on the present needed heating, electrical, and plumbing repairs. After due discussion, it was MOVED by Schussler, seconded by Edmondson that the City Manager be directed to obtain a formal appraisal on this building: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. It was then MOVED by Whitaker, seconded by Rich, that the City Staff be directed to work with OIC on a possible one or two-year lease for use of this building: Broad, Rich, and Whitaker voting aye on roll call; Brown, Edmondson, Moore and Schussler voting nay on roll call. The motion lost for want of a majority vote. City Manager McMicken referred to City Manager Report No. 190 dated September 20, 1973, regarding the Model Litter Control Act along with the attached report regarding Proposed Litter Control Program Elements. Administrative Assistant, Dick Zais, explained that the proposed local Ordinance incorporates the requirements of the 1970 State Model Litter Control Act and provides for an on-going program in Yakima. He reviewed the program as it has been handled thus far through the Fire Department and Police Department. Fire Chief Matt Young indicated that the proposed Ordinance will provide an enforcement tool. It was MOVED by Brown, seconded by Edmondson that Ordinance 1609, providing for local litter control, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1609, AN ORDINANCE relating to public safety and morals; defining terms; prohibiting the discharge of litter on public and private property and making exceptions to such prohibitions; requiring litter bags in vehicles and litter receptacles at certain public places; regulating the distribution of handbills; providing a penalty for violation; and enacting Chapter 6.86, "Litter Control", and its various sections as a new chapter and new section of the City of Yakima Municipal Code; and repealing Sections 6.04.255, 6.04.295 and 6.04.466 of the City of Yakima Municipal Code. City Manager McMicken referred to the request for outside sewer service to the residence owned by James W. Carter at 410 North 16th Avenue. The estimated connection charge for this property is $531.55 and an 8 inch sewer line is readily available along North 16th Avenue. The Planning Staff recommending approval of this request, it was MOVED by Schussler, seconded by Moore that the request of James W. Carter for outside utility service be granted: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. JANUARY 14, 1974 A-83 A report having been received from the City Engineer on the completion of L.I.D. No. 992, 1973 Street Paving District, it was MOVED by Schussler, seconded by Edmondson that February 11, 1974, be the date set for Hearing on the Assessment Roll: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. Referring to the proposed Ordinance adopting a classification and compensation plan for technical employees of the City, City Manager McMicken explained that the position of Engineering Aide I was not included in the previous pay plan Ordinance for 1974, indicating that a part time employee is being made full time and permanent. It was MOVED by Brown, seconded by Moore that Ordinance No. 1610, adopting said classification and compensation plan, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1610, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for certain City employees; amending Subsection 2.20.100 (c) of the City of Yakima Municipal Code; and declaring an emergency. City Manager McMicken indicated that the proposed Ordinance designating a change in the speed limit on a portion of West Yakima Avenue would effect a 25 mile per hour speed limit on Yakima Avenue between 16th and 36th Avenues noting that this portion is no longer on the Arterial Street Plan. It was MOVED by Schussler, seconded by Edmondson that Ordinance No. 1611, designating said change in the speed limit, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting. aye on roll call. ORDINANCE NO.'1611, AN ORDINANCE relating to traffic control; designat- ing a 30 mile per hour speed limit on a portion of West Yakima Avenue; and amending Subsection 9.75.010 (c) (9) of the City of Yakima Municipal Code. City Manager McMicken explained that the proposed Ordinance creating a City Shops Contruction Fund is for purposes of paying expenses in connection with the construction of the new City Shop Complex. It was MOVED by Edmondson, seconded by Schussler that Ordinance No. 1612, creating said fund and designating source of funds and expenditures, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1612, AN ORDINANCE relating to funds and accounts; creating a City Shop Construction Fund as a special fund and designating its purposes, sources of funding and means of expenditures therefrom; inacting chapter 3.97, "City Shop Construction Fund"; andl its various sections as a new chapter and new section of the City of Yakima Municipal Code; and declaring an emergency. Doctor Les Vierra, Yakima Valley College, reviewed the Letter of Intent for a Community Service Program under the Title I Grant. He explained this to be a joint effort to bring about more involvement by students in solving community problems. Dr. Vierra indicated that this program would be conducted at no cost to the City, with monies provided from Title I Grant in the total budget amount of $95,000. He further explained that this program would be a cooperative effort between the Southeast Community Center, Yakima Valley College and the City of Yakima. After due discussion, it was MOVED by Schussler, seconded by Brown, that the Mayor be authorized to sign the Letter of Intent dated December 27, 1973: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. A Damage Claim having been filed with the City Clerk on January 7, 1974, by Donald G. Also present was City Manager McMicken. There was general discussion by the Council on various subjects. No formal action was taken at this meeting. There being no further business to come before the Council, it was MOVED by Schussler, seconded by Whitaker that we do now adjourn at the hour of 1:30 P.M.: carried, Brown, Edmondson, Rich, Schussler and Whitaker voting aye by voice vote.
