The City Council met in session at 1:30 P.M. on this date in
the Conference Room at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad, Wray
Brown, Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich,
Don Schussler and Bill Whitaker.
Councilmen reviewed the material prepared by the City in response
to the invitation by the Governor for budget input.
Councilmen then toured the Walnut Street Undercrossing Project,
Washington Park and Fire Station No. 5.
At 3:00 P.M., the Council members met in the Council Chambers
for the balance of the meeting, Mayor Broad presiding, Councilmen
Brown, Edmondson, Moore, Rich, Schussler and Whitaker, City
Manager McMicken and City Attorney Andrews present on roll
call.
The Invocation was given by Councilman Edmondson.
Mayor Broad noted a correction to be made'in the minutes of
the previous meeting, in reference to the number of signatures
received and required on the Referendum Petition to repeal
Ordinance No. 1615. The Clerk noted that the necessary corrections
would be made.
This being the time set for Hearing on the Confirmation of
the Irrigation Maintenance Assessment Roll for the year 1974,
Director of Public Works, Dave Vargas, explained that these irri-
gation assessments cover the cost of maintaining and operating
the City's irrigation system. He noted that the total amount
assessed includes salaries for six irrigation personnel, equipment, i
repairing of bad portions of the system and an amount toward
the City's new shop warehouse facilities. Mr. Vargas further
explained that these monies are not used for major replacement
of pipelines. and that any major replacement jobs would require
residents benefited to form a local L.I.D. He noted that the
assessment rates remained the same as last year, except
for three which have been reduced and the 19th Avenue District
which has been raised. Mr. Vargas stated that the City is
again being asked to participate in a voluntary alternate day
arrangement for use of irrigation water, explaining that the
Bureau of Reclamation is in favor of this practice as it will
help in areas which experience low pressure. Councilman Rich
suggested that the City explore the possibility of using FRS
funds for some major replacements needed, especially for new
pipelines in the old General System. Councilman Moore emphasized
the need for a citywide irrigation system, suggesting that
this possibility be considered further. Those present and

,areas noted would be looked into by City staff. It was MOVED
by Brown, seconded by Schussler that Ordinance No. 1632, confirming
the Irrigation Maintenance Assessment Roll for 1974, be passed:

Referring to the Lions Park Site Development Plan, City Manager
McMicken noted that the preliminary design on this project was
approved by the Council two weeks ago and indicated that the
final plans and cost estimate are now being recommended for
final approval by the Parks and Recreation Commission and the
Planning Commission. He noted the total cost estimate from
the consultant in the amount of $179,352. Referring to the
cost breakdown sheet dated March, 1974, he noted funds now available
in the amount of $134,325.64, leaving a total amount still
needed of $45,026.36. He recommended the continued use of FRS
funds on this project. Director of Parks and Recreation, Bill
Hutsinpiller, explained the high priority given to this project,
as it benefits from the Davis High School Complex nearby. Mr.
Dean Starr, Principal, being present, referred to the plans
for the new community gym, explaining that the school is looking
toward three home areas for parking on 7th Avenue which would
be located across from the new gym. He explained that 26
parking spaces are being lost. Councilman Schussler spoke
in favor of this project as it ties in with the Davis High School
Complex. Councilman Moore indicated a desire for more time
to consider this project. After due discussion, it was MOVED
by Whitaker, seconded by Schussler that the Council adopt the
Lions Park Plan and cost estimate as presented: carried, Broad,
Brown, Edmondson, Rich, Schussler and Whitaker voting aye by
voice vote; Moore voting nay by voice vote. Councilman Edmondson
requested that a spray pool be considered for Larson Park.
It was MOVED by Whitaker, seconded by Schussler that Resolution
No. D-3091, authorizing the engagement of ORB, Architects,
to design the construction work for the Lions Park Development,
be passed: carried, Broad, Brown, Edmondson, Rich, Schussler
and Whitaker voting aye on roll call; Moore voting nay on roll
call.
RESOLUTION NO. D-3091, A RESOLUTION, authorizing and directing
the Mayor and City Clerk of the City of Yakima to execute an
agreement with the ORB Architects,Planners, Engineers, for architec-
tural services for Lions Park development.
It was MOVED by Brown, seconded by Whitaker that Resolution
No. D-3092, authorizing the City to apply for state and federal
funding in connection with the Lions Park Project, be passed:
carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and
Whitaker voting aye on roll call.
RESOLUTION NO. D-3092, A RESOLUTION, authorizing application
for funding assistance for an outdoor recreation project to
the Interagency Committee for Outdoor Recreation as provided
by the Marine Recreation Land Act and the $40,000,000 Outdoor
Recreation Bond Issue of 1968.
City Manager McMicken referred to the proposed Wastewater Facilities
Planning Study, noting that this study would provide a plan
for the placement of sewage lines to benefit Yakima, Union Gap,
Terrace Heights Sewer District and Yakima County at an estimated
cost of $100,000. He referred to the Technical Committee which
will serve in an advisory capacity in connection with this study.
Director of Public Works, Dave Vargas, indicated that the study
will take approximately one year to complete. After due discussion,
it was MOVED by Schussler, seconded by Edmondson that Resolution
No. D-3093, authorizing the execution of an agreement with Union
Gap, Terrace Heights Sewer District and Yakima County to jointly
conduct this study, be passed: carried, Broad, Brown, Edmondson,
Moore, Schussler and Whitaker voting aye on roll call; Rich
voting nay on roll call.
RESOLUTION NO. D-3093, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
an agreement with the County of Yakima, the Town of Union Gap,
and the Terrace Heights Sewer District for a cooperative study
of sewage facilities.

It was MOVED by Whitaker, seconded by Brown that Resolution No.
1D -3094, authorizing the City to submit a pre - application for
funding by the Department of Ecology, be passed: carried, Broad,
!Brown, Edmondson, Moore, Schussler and Whitaker voting aye on
roll call; Rich voting nay on roll call. Mr. Vargas explained
that this application is for a 90o grant with a 10o Local share.

'RESOLUTION NO. D -3094, A RESOLUTION authorizing and directing
lthe City Manager and City Clerk of the City of Yakima to execute
and submit pre - application documents to the State of Washington,
!Department of Ecology, for a Wastewater Facility Planning Study.
IIt was MOVED by Moore, seconded by Rich that Resolution No.
ID3095, authorizing the renewal of the license for the Firearms
( Training Range at the Yakima Firing Center, be passed: carried,
Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker
'voting aye on roll call. City Manager McMicken explained that
!this renewal is for a five year period.
RESOLUTION NO. D -3095, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
an agreement with the Department of the Army for a license to
utilize a firing range at the Yakima Firing Center.
City Attorney Andrews reported that the following Damage Claims
have been investigated and are recommended for payment.
It was MOVED by Brown, seconded by Edmondson, that Resolution
No. D3096, authorizing payment of $60.00 to Stanley Joe Carlson,
for replacement of contact lenses damaged while on duty as a
Yakima Police Officer, be passed: carried, Broad, Brown, Edmondson,!
1Moore, Rich, Schussler and Whitaker voting aye on roll call.
RESOLUTION NO. D -3096, A RESOLUTION authorizing payment of a
claim for damages filed by Stanley Joe Carlson.
.It was MOVED by Edmondson, seconded by Rich that Resolution
No. D -3097, authorizing payment of $443.92 to the Yakima Hardware
Company for costs incurred in connection with the removal of
a transmission tower, be passed: carried, Broad, Brown, Edmondson,
Moore, Rich, Schussler and Whitaker voting aye on roll call.
RESOLUTION NO. D -3097, A RESOLUTION authorizing payment of a
claim for damages filed by Yakima Hardware Company.
The City Treasurer having submitted the Investment Report for
the month of February, 1974, it was MOVED by Schussler, seconded
by Brown that the Report of the City Treasurer dated February
28, 1974, regarding the investments of the City of Yakima be
accepted and approved: carried, Broad, Brown, Edmondson, Moore,
Rich, Schussler and Whitaker voting aye by voice vote.
City Manager McMicken reviewed City Manager Report No. 211,

concerning Sunday Bus Service, noting the recommendation from
Transit Manager, Bob Knight against Sunday service, as explained
in the report.
It was MOVED by Moore, seconded by Schussler that Ordinance
No. 1633, repealing Chapter 6.80. entitled "Unfair Housing Practices
of the City of Yakima.'Municipal. be passed: carried, Broad,
Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting
aye on roll call. City Attorney Andrews explained that this
1 ordinance concerns the activities of the Fair Housing Committee
which has handled no complaints for over a year and further ex-
1 plained that the functions of this committee are already handled
by the State.

MARCH 11, 1974
An Ordinance appropriating $6,630 from unappropriated money
in the Park and Recreation Fund to pay for professional services
in connection with the Comprehensive Park Plan, having been
read by title only at this meeting, was laid on the table for
one week or until March 18, 1974.
A letter having been received from Dick Parker, submitting his
resignation from the Parks and Recreation Commission, it was
MOVED by Schussler, seconded by Brown that receipt of this letter
be acknowledged and that Mr. Parker be commended for his services:
carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and
Whitaker voting aye by voice vote.
A report having been received from the Planning Commission recom-
mending the denial of a request for rezone filed by Earl C.
Grissom for property at 1101 Landon Avenue, it was MOVED by
Schussler, seconded by Rich that March 25, 1974 be the date
set for Hearing on this matter: carried, Broad, Brown, Edmondson,
Moore, Rich, Schussler and Whitaker voting aye by voice vote.
A report having been received from the Planning Commission on
the request for rezone filed by Glascam Builders, Inc., for
property at 2405 West Lincoln Avenue, it was MOVED by Schussler,
seconded by Rich that March 25, 1974 be the date set for Hearing
on this matter: carried, Broad, Brown, Edmondson, Moore, Rich,
Schussler and Whitaker voting aye by voice vote.
A Damage Claim having been filed by Mrs. Raymond E. Spratt,
303 North 1st Street, in the amount of $12.50, for injury incurred
while opening a door at City Hall, it was MOVED by Whitaker,
seconded by Rich that said Damage Claim be referred to the
City Manager and Staff for study and recommendation: carried,
Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker
voting aye by voice vote.
There being no further business to come before the Council,
it was MOVED by Rich, seconded by Moore that this meeting be
adjourned at 5:15 P.M., to Friday, March 15, 1974, at the hour
of 12:00 Noon, to then meet in the Flight Deck Restaurant:
