September 15, 1975
The City Council met in session on this date at 6:30 P.M. in a class-
room at Station KYVE-TV.
'Councilmen present at the meeting were Mayor Bert Broad, Dick Jarms,
W. K. "Pete" Moore, Don Schussler and Dr. Bill Simmons.
'City Manager McMicken advised the Council that insurance adjusters
!would be in Yakima Thursday, September 18; 1975, to discuss the in- !
Isurance due on the Capitol Theatre fire loss. Council will be
!apprised as soon as the loss figures are known.
City Manager McMicken reminded Councilmen of the dedication for
;Lions Park to be held Friday, October 3, 1975.
!City Manager McMicken also explained that commencing November 15,
11975, demolition shotld be completed on the Sears lot.
1 Finally, Council was apprised that AWC had asked for an Attorney
;General's Opinion on the release of Motor Vehicle Excise Tax for
itransit purposes in 1976. City Manager McMicken observed that the
!City is budgeting on the premise that transit funds will be avail-
able in 1976.
Council members then viewed the KYVE-TV program on the Capitol Theatt
At 8:00 P.M., the Council members moved into the main television
!studio of KYVE-TV for the balance of the meeting, Mayor Broad
presiding, Councilmen Jarms, Moore, Schussler and Simmons, City
'Manager plcMicken and CityAttorney Andrews present on roll call.
!Councilmen Brown and E being absent on roll call, it was
MOVED by Moore, seconded by Simmons that they be excused from this
!meeting: carried, Jarms, Moore, Schussler and Simmons voting aye
by voice vote. -
The Invocation was given by Councilman Simmons.

been duly certified accurate by two Councilmen, andna One present
iwishing to have said minutes read publicly, Mayor Broad declared
I said minutes approved as recorded.
1 This being the time set for the Hearing on Petition No. 860, filed
by John Taylor and Joe Denman, requesting vacation of an unimproved
!portion of South 9th Street, Associate Planner Glenn Rice reviewed
the Planning Staff Report and Planning Commission Minutes on this
!subject dated August 25 and September 2, 1975, respectively. Mr.
!Rice explained the request involves an unused portion of right-
, lof-way north , let new Fire Station No. 5. He indicated that due
to the location of the fire station, South 9th Street will not
be extended to East Nob Hill Boulevard. Although the vacation will
not provide good access for two lots immediately north of the fire
istation, it was explained that this unimproved portion has not
been used for access, but the alley has, instead, been utilized
for access to these properties. No objections were received from
any concerned departments or utility companies and both the Planning
! Staff and Planning Commission recommend approval of this request.
It was MOVED by Simmons, seconded by Schussler that Ordinance No.
1837, providing for said vacation, be passed: carried, Broad,
!Jarms, Moore, Schussler and Simmons voting aye on roll call. Brown
and Edmondson absent.
ORDINANCE NO. 1831, AN ORDINANCE providing for the vacation of
is portion of public street in the City of Yakima, Washington.
Mr. Norman Stewart, 217 North 16th Avenue, being present, presented
ithe Council with a petition signed by several residents in the
area of N. 16th and Folsom Avenues, requesting the installation of an
!overhead amber flashing light, pedestrian warning signs and painted

icrossing. Due to the number of accidents occuring at this inter-
section, he requested that extraordinary safety measures be
established for this intersection and described for Councilmen
the conditions that presently exist, as detailed in the petition.
Mr. Stewart indicated he has talked with the City's Traffic
Department and they do not recommend such an installation.
Mr. Carl Kuehn, parent of a young girl recently injured at this
intersection, spoke to the Council describing the existing condi-
tions at this intersection and passed around pictures depicting
the appearance of the present pedestrian crosswalk. Mr. Kuehn
indicated that the crosswalk is not visible to drivers approaching
this intersection from the south. He explained that traffic
is heavy in this area and this intersection has had a high accident
rate. Councilman Schussler expressed concern over: placement
of a mid-block crosswalk, noting that most drivers would not
be expecting one at this location. Mr. Stewart requested that
!the pedestrian measures be similar to that recently installed
at 44th and Tieton. Councilman Simmons asked that a report
be brought back next week from the Traffic Engineer. After
'due discussion, it was MOVED by Schussler, seconded by Simmons
that this matter be referred to the City Manager for investigation
and report: carried, Broad, Jarms, Moore, Schussler and Simmons
voting aye by voice vote. Brown and Edmondson absent.
For the Council's information, Director of Community Development
Fred Stouder reported on the earmarking by HUD of $150,000 to
the City of Yakima for three percent Housing Rehabilitation
'Loans for Community Development Target Areas, to include Central,
'Northeast and Southeast Yakima. Mr. Stouder reported that the
'City has already received eight applications and is in hopes
of processing ten to twelve low-cost loans. He indicated that
the money is available directly from the government and the
!City is acting as agency for processing applications.
IThe City Treasurer having submitted the Investment Report for
the month of August, 1975, it was MOVED by Schussler, seconded
by Moore that the report of the City Treasurer dated August 31,
1975, regarding the investments of the City of Yakima, be accep-
ted and approved: carried, Broad, Jarms, Moore, Schussler and
,Simmons voting aye by voice vote. Brown and Edmondson absent.
!Associate Planner Glenn Rice reviewed the Right-of-Way Use
1 Permit request filed by the Corporation of the Catholic Bishop
of Yakima, for closure of the alley between 3rd and 4th Streets,
"B" Street to Lincoln. He explained that this was eariler submitted
as a request for a street vacation, but after study of the location
and adjacent areas, the vacation petition was recommended for
denial. He noted that there is a multiple use of the property
Iabutting this alley on both sides by St. Joseph's-Catholic Church,
!Church School and adjacent facilities and play area. It has
been found that a considerable amount of traffic uses this alley
and the applicant wishes to stop through traffic to provide
a safe play area for students of St. Joseph School. The power
company has requested that access be maintained to their main
lines and overhead cables. Mr. Vince Beaulaurier, Attorney
representing the Corporation of the Catholic Bishop, further
explained this request, explaining their request for permission
to install a gate across the south end of the alley and a re-
movable chain near the north end of the alley to prevent through
traffic. It was MOVED by Schussler, seconded by Simmons that
the request for a Right-of-Way Use Permit by the Corporation
of the Catholic Bishop, be granted: carried, Broad, Jarms,
Moore, Schussler and Simmons voting aye by voice vote. Brown
and Edmondson absent.
An Ordinance appropriating $1,237 within the Dangerous Building
Demolition and Repair Fund, having been read by title only at
the previous meeting and being again read by title only at this
meeting, it was MOVED by Moore, seconded by Jarms that Ordinance
No. 1838, providing for said appropriation, be passed: carried,
Broad, Jarms, Schussler and Simmons voting aye on roll call.

1ORDINANCE NO. 1838, AN ORDINANCE appropriating the amount of $1,237
from unappropriated money in 132-Dangerous Building Demolition
and Repair Fund to Account 538.20.42 as a 1975 appropriation for
I132-Dangerous Building Demolition and Repair Fund.
An Ordinance appropriating $4,280 within the Transit Fund to make
!final payment on City buses, fare boxes and spare wheels not com-
Ipleted in 1974, was laid on the table for one week or until
.September 22, 1975.

; City Attorney Andrews explained the earlier authorization for
'vacation of a portion of Swan Avenue, as requested by Frank Bacon
and Don McKinley of PDQ Foods. This authorization was granted
on the condition that-the City receive deeds for the additional
!needed right-of-way on abutting streets. The appropriate deeds
have now been received and final action can be taken. It was
iMOVED by Schussler, seconded by Simmons that Ordinance No. 1839,
,providing for said vacation, be passed: carried, Broad, Jarms,
Moore, Schussler and Simllions voting aye on roll call. Brown and

iORDINANCE NO. 1839, AN ORDINANCE providing for the vacation of
l a portion of public street in the City of Yakima, Washington.
It was MOVED by Schussler, seconded by Jarms that Ordinance No.
1840, amending chapter 1.30 of the Municipal Code and redefining
the duties of the Human Relations Commission, be passed: carried,
Broad, Jarms, Moore, Schussler and Simmons voting aye on roll
call. Brown and Edmondson absent. Human Relations Officer Susan
Boughton-Morin explained that this Ordinance also includes the
discrimination areas of marital status and handicap.
'ORDINANCE NO. 1840, AN ORDINANCE relating to City government adminis-
tration; specifying the duties of the Human Relations Commission
of the City of Yakima; amending Section 1.30.040 of the City of
'Yakima Municipal Code; and declaring an emergency.
l In accordance with the recommendation of the Human Relations Com-
mission, it was MOVED by Jarms, seconded by Simmons that Resolution
! No. D-3389, approving rules and regulations for investigating
'complaints against the City on matter involving discrimination
because of race, creed, color, national origin, age, sex, religion,
;marital status or handicap, be passed: carried, Broad, Jarms,
Moore, Schussler and Simmons voting aye on roll call. Brown and
IEdmondson absent. Human Relations Officer Susan Boughton-Morin
lexplained that these rules and regulations set down the procedures
I for issuing complaints against City departments or employees involving
those areas of discrimination stipulated,above. Mr. Larry Robinson
objected to the reference in the procedures for "any person feeling
agreived" to file a complaint and questioned what would be done
if a complaint is found to be spurious. He asked for a clear
ldefinition of discrimination and felt these procedures might bring
harassment, especially to the Police Department. Also present
and speaking to this matter was Mr. Jay Spearman.
'RESOLUTION NO. D-3389, A RESOLUTION approving rules and regulations
,adopted by the City of Yakima Human Relations Commission for investi-
gating complaints.

the adoption of a Comprehensive Sidewalk Plan as an amendment
Ito the General Plan for the City, it was MOVED by Schussler, seconded
by Jarms that October 6, 1975, be the date set for hearing on
this matter: carried, Broad, Jarms, Moore, Schussler and Simmons

IA report having been received from the Planning Commission on
the proposed Subdivision Ordinance for the City of Yakima, it
was MOVED by Schussler, seconded by Moore that October 6, 1975,

be the date set for hearing on this matter: carried, Broad, Jarms,
Moore, Schussler and Simmons voting aye by voice vote. Brown and
Edmondson absent. Councilman Jarms asked that the Council discuss
this proposal at a Study Session prior to October 6, 1975.
Petition 861, Notice of Intention to Commence Annexation Proceedings
having been filed with the City Clerk on September 11, 1975, by Mr.
and Mrs. Preston Brown and Debco Enterprises, Inc., requesting annexation
of property south of Tieton Drive between South 51st and 58th Avenues,
it was MOVED by Schussler, seconded by Jarms, that today be set as the
time for a meeting with the initiating parties who signed the Notice of
Intention to Commence Annexation Proceedings dated September 11, 1975,
those initiating parties being Mr. and Mrs. Preston Brown and Debco
Enterprises, Inc.: carried, Broad, Jarms, Moore, Schussler and Simmons
voting aye by voice vote. Brown and Edmondson absent. Mr. and Mrs.
Brown, being present, and indicating that they are willing to accept
their share of the City's existing indebtedness, it was duly MOVED,
seconded and passed that the annexation proposed by Petition No. 861
(Notice of Intention to Commence Annexation Proceedings) to be accepted
by the City of Yakima and that the area sought to be annexed be
required to assume the City's existing indebtedness, and that a Notice
of Intention to Annex be filed with the Yakima County Boundary Review
Board. The above MOTION was made by Schussler, seconded by Moore and
carried, Broad, Jarms, Moore, Schussler and Simmons voting aye by
voice vote. Brown and Edmondson absent.
City Attorney Andrews explained a correction in the legal description
of the Resolution of Intention to create an LID in the Cascade Vista
area, asking that the Council approve the new Resolution, which includes
one more lot. It was MOVED by Schussler, seconded by Moore that
Resolution No. D -3390, a Resolution of Intention to create a local
improvement district, be passed: carried, Broad, Jarms, Moore, Schussler
and Simmons voting aye on roll call. Brown and Edmondson absent.

City Manager McMicken requesting authorization for out -of -state travel
for Paul Page, Sewer Superintendent, to travel to LaGrande, Oregon,
to attend the Pacific Northwest Pollution Control Safety Committee
Meeting, September 18 -19, 1975, it was MOVED by Jarms, seconded by
Schussler that said travel be approved and expenses paid: carried,
Broad, Jarms, Moore, Schussler and Simmons voting aye by voice vote.
Brown and Edmondson absent.
There being no further business to come before_the Council, it was
MOVED by Simmons, seconded by Moore that we do no adjourn at the
hour of 9:30 P.M.: carried, Broad, Jarms, Moore, Schussler and Simmons
