HomeMy WebLinkAbout04/07/1975 Business Meeting 334 APRIL 7, 1975 The City Council met in session on this date at 1:30 P.M. in the Council Conference Room at Yakima City Hall. - 'Councilmen present at the meeting were Assistant Mayor Wray Brown, 'Betty L. Edmondson, W. K. "Pete" Moore, Don Schussler and Bill Simmons. Councilmen Mayor Bert Broad and Dick Jarms absent. ; City Manager McMicken discussed a letter from the Capitol Theatre ;Corporation which indicated that they were prepared to lease the facility as of .September 1, 1975 for $15,000 annually and recommend- ed that notice be given to Mercy Enterprises to that effect. City Manager McMicken recommended that a contract be prepared for CTC to undertake responsibility for booking activities and to cover pre-operating expenses. This would be accomplished by Mercy Enterprises remitting to CTC their income from the non-movie use of the theatre during the remainder of their lease and other CTC !funds would be generated by contributions, benefits, loans and performances. CTC will underwrite operating expenses for the ;theatre during the lease period and will utilize proceeds for 'promotion and general repairs. Repairs in excess of $1,000 must be authorized by the City. Upon consideration, the Council concluded that a contract agreement should be drawn. ;Council was apprised of City policies in posting speed limit signs on local streets, school crossings and signalized intersections. ;Principal Planner, Dick Hill, discussed several definitions relating Ito Group Homes, pointing out that these were an amended version of 'definitions previously considered by the Council. In addition, a proposed Ordinance regarding conditional property use was given consideration. _Upon reviewing these materials, the Council still I expressed the for-SOMe'further clarification and study prior to formal Hearing on theim4tter. ! The Council gave some reconsideration to some proposed Ordinances ;regulating ambulance service. Mr. Pat Cockrill, Attorney represent- ing ambulance businesses added one amendment to the Ordinance proposed to regulate service rates charge, asking that the Ordinance include a 60-day review period prior to rates becoming effective. However, should the Ambulance Service Advisory Committee declare that the rates are excessive, the rates would not be implemented. No further inquiries were made by the Council and the Ordinances will be considered at the regular session on April 14th. 1 At 3:00 P.M., the Council members moved into the Council Chambers 1 for the balance of the meeting, Assistant Mayor Brown presiding, Councilmen Edmondson, Moore, Schussler and Simmons, City Manager ;McMicken and City Attorney Andrews present on roll call. Councilman! Jarms having requested permission to be excused from this meeting, it was MOVED by Moore, seconded by Schussler that Councilman l Jarms be excused: carried, Brown, Edmondson, Moore, Schussler and Simmons voting aye by voice vote. Mayor Broad absent and lexcused. The Invocation was given by City Attorney Andrews. The minutes of the previous meeting of March 31, 1975, having been duly certified accurate by two Councilmen, and no one ;present wishing to have said minutes read publicly, Assistant 1 Mayor Brown declared said minutes approved as recorded. This being the time set for the Hearing on the Assessment Roll for L.I.D. No. 997, Voelker Addition No. 1 Domestic Water District, City Engineer Fritz Jaeger reported that no protests in writing or otherwise have been received on the final Assessment Roll and noted that the final roll is 15 percent below the Engineer's lestimate. There being no one present speaking for or against 1 this matter, it was MOVED by Schussler, seconded by Moore that 'Ordinance No. 1771, confirming said Assessment Roll, be passed: carried, Brown, Edmondson, Moore, Schussler and Simmons voting aye on roll call. Broad and Jarms absent. 335 APRIL 7, 1975 ORDINANCE NO. of said grant lallelntleNIEseinficralgedirisi roll ;covering Local Improvement District No. 997 as created and !established by Ordinance No. 1656 of the Ordinances of the City of Yakima. ;Ci 1City Manager McMicken explained the proposed grant agreement with Yakima County regarding a site for Special Projects for the Handicapped, noting that the requested property appraisal has now been completed. The report by Mr. Lemon supports the purchase price with a recommendation that an access road and utilities be provided was MOVED by Edmondson, seconded by Moore that Resolution No. D-3293, authorizing the execution Moore, Schussler and Simmons voting aye on roll call. Broad and Jarms absent. ;RESOLUTION NO. D-3293, A RESOLUTION authorizing a grant of $15,600 to Yakima County for the acquisition of property for Special Projects for the Handicapped, Inc. City Manager McMicken explained the proposed agreement conveying property to the Yakima Valley Museum and Historical Association for a museum addition. He explained that the Historical Association owns and maintains the building, but the City Parks Department maintains the Franklin Park grounds surrounding it. It was MOVED by Moore, seconded by Simmons that Resolution No. D- 3294, authorizing the execution of said agreement, be passed: carried, Brown, Edmondson, Moore, Schussler and Simmons voting aye on roll call. Broad and Jarms absent. The City Treasurer having submitted the Investment Report for the month of March, 1975, it was MOVED by Schussler, seconded by Edmondson that the report of the City Treasurer dated March 31, 1975, regarding the investments of the City of Yakima, be accepted and approved: carried, Brown, Edmondson, Moore, Schussler and Simmons voting aye by voice vote. Broad and Jarms absent. City Manager McMicken reported on the Outside Utility Request for the single-family property owned by Mr. Arnold E. Payne at 409 So. 49th Avenue, noting that a sewer connection is available at a charge of approximately $431. He noted that the parcel is not large enough for annexation at this time and will combine with other properties later for annexation. The standard Outside Utility Agreement has been signed. It was MOVED by Schussler, seconded by Simmons that the Outside Utility Request by Mr. Payne, be approved: carried, Brown, Edmondson, Moore, Schussler and Simmons voting aye by voice vote. Broad and Jarms absent. An Ordinance appropriating $2,401 within the Trolley Fund to pay shipping charges for trolley delivery, having been read by title only at the previous meeting and being again read by title only at this meeting, it was MOVED by Schussler, seconded by Simmons that Ordinance No. 1772, providing for said appropriation, be passed: carried, Brown, Edmondson, Moore, Schussler and Simmons voting aye on roll call. Broad and Jarms absent. ORDINANCE NO. 1772, AN ORDINANCE appropriating the amount of $2,401 from unappropriated money in 362-Trolley Fund to Account 362.546.23.65 as .a 1975 appropriation for 362-Trolley . -- Fund. - An Ordinance transferring $6,000 from the Contingency Fund to the Park and Recreation Fund and appropriating that amount for the Voluntary Action Center, having been read by title only at the previous meeting and being again read by title only at this meeting, it was MOVED by Edmondson, seconded by Moore that Ordinance No. 1773, providing for said transfer and appropriation, be passed: carried, Brown, Edmondson, Moore, 336 APRIL 7,— 1975 Schussler and Simmons voting aye on roll call. Broad and Jarms absent. 1ORDINANCE NO. 1773, AN ORDINANCE transferring the amount of $6,000 from 195-Contingency Fund to 131-Park and Recreation Fund and !appropriating that amount to Account 533.25.31. as a 1975 appropri- :ation for 131-Park and Recreation Fund. !Principal Planner Dick Hill reviewed the Hamilton Park No. , 3 Plat, noting that this has been before the Planning Commission for review of both the preliminary and final plat explaining that it involves the east half of property west of So. 24th Avenue and east of Hamilton Park No. 2 Addition. He noted that the staff recommends approval and all improvements are completed or have been bonded for. It was MOVED by Schussler, seconded by Edmondson that the Mayor be authorized to sign the Hamilton Park No. 13 'Plat: carried, Brown, Edmondson, Moore, Schussler and Simmons 'voting aye by voice vote. Broad and Jarms absent. Councilmen present at the meeting were Assistant Mayor Wray Brown, !Betty L. Edmondson, W. K. "Pete" Moore and Don Schussler. Council- men Mayor Broad, Jarms and Simmons absent. Council members held general discussion of various city matters. No Iformal action was taken at this meeting. There being no further business to come before the Council, it was MOVED by Schussler, seconded by Moore that we do now adjourn at the hour of 1:30 P.M.: carried, Brown, Edmondson, Moore and Schussler !voting aye by voice vote.
