The City Council met in session on this date at 1:30 P.M. in the
Conference Room at Yakima City Hall.
i Councilmen present at the meeting were Mayor Bert Broad, Wray
Brown, Betty L. Edmondson, W. K. "Pete" Moore, Don Schussler
and Bill Simmons.
The Council deliberated over several Community Development projects,
■ finally concurring on the following allocations for 1975:
1. Street lighting east of 1st Street - $26,000
2. Expansion of the recreational program in the
4. schools - $10,000.

Housing Resource Center - $50,000
Community Development Administration - $25,000.
5. Yakima Housing Authority Recycling Fund - $100,000.
6. Expansion of the Senior Citizen's Center - $23,000
(fitst year).
7. Southeast Community Center Recycling Project - $15,000.
8. Contingencies - $7,000
At 3:00 P.M., the Council members moved into the Council
;Chambers for the balance of the meeting, Mayor Broad presiding,
'Councilmen Brown, Edmondson, Moore, Schussler, Simmons and
!City Manager McMicken present on roll call. Councilman Jarms
l absent on roll call, having previously requested permission
to be excused.
The Invocation was given by Councilman Simmons.
! The minutes of the previous regular meeting of March, 24,
1975, having been duly certified accurate by two Councilmen,
and no one present wishing to have said minutes read publicly,
Mayor Broad declared said minutes approved as recorded.
This being the time set for the Hearing on the Rezone Application
filed by Hugh E. Davis, requesting rezone of property situated
at 1624 South 24th Avenue adjacent to KNDO and Bank of Yakima
i Proof Center, Principal Planner Dick Hill reviewed the Planning
i Staff Report and Planning Commission Minutes on this subject
I dated February 20 and March 4, 1975, respectively. Mr. Davis
requests a rezone from R-4, Suburban Residential Zone to
Planned Development Zone to accommodate construction of a
private tennis club facility, to include six outdoor courts,
I six indoor courts, two handball courts and related facilities.
1 Mr. Hill reported that access will be provided from South
24th by a proposed 50-foot street and indicated that each
1 property owner has dedicated 25 feet for street access to
i the site. The proposal includes 95 parking spaces. Mr.
Hill noted that the areas proposed for landscaping are sufficient
and the Planning Staff and Planning Commission recommend
approval, subject to the following three conditions:
1. That the detailed landscaping and irrigation plans
be submitted to and approved by the Office of
Environmental Planning.
2. That the developer initiate through the Public Works
Department an L.I.D. for sewer service.
3. That needed right-of-way for the east/west street
adjacent to the southern boundary of the site be
dedicated to the City.
Present and speaking to this matter was Mr. Hugh Davis.
It was MOVED by Brown, seconded by Schussler that Ordinance
No. 1768, accepting the recommendation of the Planning Commission
and rezoning said property, be passed: carried, Broad, Brown,
Edmondson, Moore, Schussler and Simmons voting aye on roll
call. Jarms absent.

So. 24th Avenue in the City of Yakima from R-4, Suburban Residential
Zone, to Planned Development Zone.
'Mr. Frank Bradley, Chairman of the Capitol Theatre Committee,
being present, spoke to the Council regarding his report dated
March 27, 1975 on the goals and proposals of the Capitol Theatre
Committee as regards the restoration and use of the Capitol
Theatre. He related that the report reflects the interests of
;this Committee and that a plan, program and staff have been
prepared in line with the proposal to begin leasing the facility
"effective Sept. 1, 1975. Mayor Broad indicated that the Council
!would need more time to consider this report and would report
back to Mr. Bradley in the near future. Councilman Schussler
"asked questions regarding the proposed leasing of the Theatre
by the Capitol Theatre Corporation as of September 1, 1975 and
their involvement in restoration activities. Mr. Bradley indicated
that leasing the facility provides the ability to underwrite
certain operations of the Theatre without financial risk to
the City and further indicated that the Corporation wishes to
be involved in restoration activities.
'Dolores Goodman, President of the National Association for the
!Advancement of Colored People, being present, read to Councilmen
a request for establishment of youth programs in Yakima to provide an
',education and emphasis on values for youth who will not be working
Ithis summer. She emphasized the merits of such a program in
'relation to preventing delinquency among youths in Yakima.
!Principal Planner Dick Hill related the first year projects
selected for. funding under the Community Development Block Grant
Program, as decided by Council members during the Study Session
at 1:30 P.M., which are as follows:
1. Street lighting east of 1st Street, to include $26,000
allocated the first year This would be a two-year program
related to crime prevention.
2. Expansion of the recreational program in the schools -
$10,000 earmarked.
3. Housing Resource Center - $50,000.
4, Community Development Administration - $25,000.
5. Yakima Housing Authority Recycling Fund, to include
rehabilitation of 25 units the first year and 75
units over the next two years - $100,000 earmarked.
6. Expansion of the Senior Citizens Center, to include site
acquisition at $23,000 the first year and actual constructiop
in the second year - $85,000 earmarked.
7. Southeast Community Center Recycling Project - $15,000
earmarked.
!Mr. Hill further reported that $7,000 was earmarked for Contingencies.
He noted the three project items which were not included specifically
to include Special Projects for the Handicapped, Capitol Theatre
IRestoration and the Home Base Preschool Program. Mayor Broad
'indicated that the Council has dropped the idea of funding
the Home Base Program. He noted that FRS monies are being
considered for funding Special Projects for the Handicapped.
:Councilman Schussler indicated he regrets the Council's decision
to not fund the Home Base Program, since he believes it to
b e a good program which has had good success and indicated
he would not prefer, at this time, to vote regarding the use
of FRS monies. Councilman Edmondson indicated her feelings
that the decision to not fund the Home Base Program was justified
,since it is an on-going educational program, Councilman Brown
indicated his favor of the Home Base Program and his willingness
to use FRS monies for Special Projects, if necessary. Councilman
!Moore agreed that Home Base should not be funded with City
monies, but felt Special Projects could be helped through FRS
Imo nies. Councilman Simmons expressed similar sentiments on
the Home Base Program and was in favor of the use of FRS monies
for Special Projects. It was MOVED by Moore, seconded by Edmondson
that Resolution No. D-3287, authorizing the execution of an

Application for funding through HUD, be passed: carried,
Broad, Brown, Edmondson, Moore, Schussler and Simmons voting
aye on roll call. Jarms absent.
RESOLUTION NO. D-3287, A RESOLUTION authorizing the City Manager
of the City of Yakima to file an application with the United
States Department of Housing and Urban Development for Federal
funding for a Community Development Program.
City Manager McMicken explained the proposed agreement with
Paddock and Hollingbery, Architects, for services in connection
with renovation of the Capitol Theatre. He explained that costs
will be paid through the Captiol Theatre Fund. It was MOVED
by Schussler, seconded by Moore that Resolution No. D-3288,
authorizing the execution of said agreement, be passed: carried,
Broad, Brown, Edmondson, Moore, Schussler and Simmons voting
aye on roll call. Jarms absent.
RESOLUTION NO. D-3288, A RESOLUTION authorizing and directing
the City Manager and the City Clerk of the City of Yakima
to execute an agreement with Paddock and Hollingbery, Architects,
for architectural services in connection with the renovation
of the Capitol Theatre.
City Manager McMicken requested authorization to give notice
to Junior Amusement Company for termination of their lease
which was entered into last July for use and operation of
the Capitol Theatre. He noted that Mr. Mercy requests an
extension on a month-to-month basis until September 1, 1975 and
requested a two month extension be included, with the lease
to terminate September 1, 1975. It was MOVED by Moore, seconded
by Brown that said lease agreement with Junior Amusement Company
be extended two months and terminated effective September
1, 1975: carried, Broad, Brown, Edmondson, Moore, Schussler
and Simmons voting aye by voice vote. Jarms absent.
City Manager McMicken referred to the proposed renewal of
an existing contract at the Yakima Air Terminal, which provides
for the operation of the Airport Lighting System at the part-time
tower. It was MOVED by Brown, seconded by Edmondson that
Resolution N. D-3289, authorizing the execution of said agreement
with the Federal Aviation Administration, be passed: carried,
Broad, Brown, Edmondson, Moore, Schussler and Simmons voting
aye on roll call. Jarms absent.
RESOLUTION NO. D-3289, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
an agreement with the Federal Aviation Administration relating
to the operation of the Yakima Air Terminal Lighting System.
City Manager McMicken explained a proposed lease agreement
with the Federal Aviation Administration for continued occupancy
of the Engine Generator Site at the Yakima Air Terminal.
It was MOVED by Brown, seconded by Moore that Resolution No.
D-3290, authorizing the execution of said agreement, be passed:
carried, Broad, Brown, Edmondson, Moore, Schussler and Simmons
voting aye on roll call. Jarms absent.
RESOLUTION NO. D-3290, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
an agreement with the Department of Transportation, Federal
Aviation Administration, for the occupancy of space at the
Yakima Air Terminal.
It was MOVED by Moore, seconded by Brown that Resolution No.
D-3291, authorizing the execution of an agreement with Yakima
Valley Transportation Company to lease facilities for housing
the trolley cars, be passed: carried, Broad, Brown, Edmondson,
Moore, Schussler and Simmons voting aye on roll call. Jarms
absent.

RESOLUTION NO. D-3291, A RESOLUTION authorizing and directing the
City Manager and City Clerk of the City of Yakima to execute an
agreement with Yakima Valley Transportation Company to lease real ,
properties to operate trolley cars.
! City Manager McMicken explained an off-Agenda item regarding a
temporary loan of $30,000 to the Parks and Recreation Fund to cover
a cash flow problem in that fund. It was MOVED by Edmondson, -
seconded by Moore that Resolution No. D-3292, authorizing said
temporary loan, be passed: carried, Broad, Brown, Edmondson,
Moore, Schussler and Simmons voting aye on roll call. Jarms
absent.
RESOLUTION NO. D-3292, A RESOLUTION authorizing a temporary
loan of $30,000 from 331-Parks and Recreation Capital Fund
to 131-Parks and Recreation Fund and providing for repayment.
It was MOVED by Edmondson, seconded by Simmons that Ordinance
No. 1769, creating a Human Relations Commission, be passed:
carried, Broad, Brown, Edmondson, Moore, Schussler and Simmons
voting aye on roll call. Jarms absent. Mr. Jay Spearman,
Chairman of the Human Relations Task Force, thanked the Council
for this effort and felt it to be a workable solution. Also
present and speaking in favor of this Ordinance was Dolores Goodman.
1 ORDINANCE NO. 1769, AN ORDINANCE relating to City Government
i Administration; creating a Human Relations Commission; providing
I for the appointment of members thereto and designating terms
of office and specifying the duties thereof; enacting Chapter
1.30 "Human Relations Commission", as a new Chapter of the
City of Yakima Municipal Code.
City Manager McMicken reported that persons in the area of
LaSalle Street have submitted a petition requesting that parking
be prohibited on the north side of LaSalle Street, since parking
on both sides during fairground events makes driving difficult.
He indicated that horse racing is now on at the fairgrounds
and such parking is presenting a problem. It was MOVED by
Edmondson, seconded by Simmons that Ordinance No. 1770, prohibiting
1 parking on the north side of LaSalle Street from 9th to 10th
Streets, be passed: carried, Broad, Brown, Edmondson, Moore,
Schussler and Simmons voting aye on roll call. Jarms absent.
ORDINANCE NO. 1770, AN ORDINANCE relating to traffic regulations;
prohibiting parking on certain streets; amending Section 9.50.500
of the City of Yakima Municipal Code; and declaring an emergency.
An Ordinance appropriating $2,401 within the Trolley Fund to pay
shipping charges for trolley delivery, having been read by title
only at this meeting, was laid on the table for one week or until
April 7, 1975. City Manager McMicken explained that this covers
the billings for trolley delivery and spare parts which were
delayed and carried over from the 1974 Budget.
An Ordinance transferring $6,000 from Contingency Fund to the
Park and Recreation Fund and appropriating that amount for the
Voluntary Action Center, having been read by title only at this
i meeting, was laid on the table for one week or until April 7, 1975.
City Manager McMicken explained that this is in line with the
$6,000 requested by VAC and approved by the Council.
A Damage Claim having been filed with the City Clerk on March
1 24, 1975, by John H. Stein, 904 So. 40th Avenue in the amount
of $19.14 for costs of a broken window, it was MOVED by Schussler,
seconded by Brown that said Damage Claim be referred to the
City Manager and Staff for study and recommendation: carried,
' Broad, Brown, Edmondson, Moore, Schussler and Simmons voting
aye by voice vote. Jarms absent.
i As a matter of record, it was noted that a petition was filed

with the City Clerk on March 25, 1975 by Yakima Valley Citizens

;Center.
!City Manager McMicken requesting authorization for out-of-
!state travel for Rex Burnham, Police Department, to travel
to Washington D.C. to attend a training program sponsored
by the U.S. Secret Service April 23 - 25, 1975 and for Lt.
;Bernie Kline, Police Dept., to travel to Anaheim, California
as a panelist on microfilm systems, April 8 - 10, 1975, it
was MOVED by Brown, seconded by Simmons that said travel

be approved and expenses paid: carried, Broad, Brown, Edmondson,
'Moore, Schussler and Simmons voting aye by voice vote.- Jarms
!absent.
;There being no further business to come before the Council,
it was MOVED by Moore, seconded by Schussler that this meeting

Council members held discussion of various city matters. No formal
action was taken at this meeting.
