HomeMy WebLinkAbout01/27/1975 Business Meeting 272 JANUARY 27, 1975 The City Council met in session at 1:30 P.M. on this date in the ;Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown,, ;Betty L. Edmondson, Dick Jarms, W. K. "Pete" Moore, Don Schussler and Bill Simmons. !City Attorney Andrews reviewed the case of "Autotronics" vs. City of ;Yakima concerning extension of outside utilities. Mr. Andrews noted that the Superior Court upheld the City's position and General Plan and ruled that the City had the right to deny extension. The Countyl Health District previously refused permitting installation of a !septic tank because of the availability of City service. In the judgment of the Court, the Health District is now required to issue a septic tank permit. Although the City has won the case, it may very likely be appealed. ;Fire Marshall, Ed Lexa, reviewed the 1973 Uniform Fire Code, explain- ing that the Code is inclusive of the Building and Mechanical Codes as they relate to State Fire Codes. In adopting the Code, the City has the right to require more atringent standards than the State ldoes; however, the Code must not be made any less lenient than the !State prescribes. City Manager McMicken suggested that prior to adopting the new Uniform Code, there should be an informational meeting called to apprise interested groups such as Industrial !Council, Chamber of Commerce and other related associations that H ave direct interest. Once their reaction to the proposed Code is Idetermined, the Council would set a public hearing for the proposed ladoption by Ordinance. Council concurred and directed that informa-, 'tional meetings be held and notices mailed to the appropriate l organizations. Regarding the 1975 Legislative Session, City Manager McMicken asked the Council what their desire was concerning keeping abreast of Iproposed legislation. Previous practice has been for the Council to Ichoose one or two bills to follow directly. Perhaps Councilmen may wish to link up with a State Representative by, personalities„: Igo directly to the representative assigned to'theappropriate leg- lislative committee. Mayor Broad indicated there was some question l as to the possibility of approaching representatives in this manner !under the new requirements for registering Lobbyists and such effort Iwould have to be low-key. Councilman Brown expressed the opinion that he expected the Association of Washington Cities to have much more clout and influence over proposed legislation and would be more directly representative of City interests this Session. City Manager McMicken reviewed major highlights of the Session thus far to include the following: . 1 1. Taxation and Revenue - measures include the following: i granting additional property or sales tax relief to elderly or low-income persons; modifying the 1.06 tax limit and reducing liquor taxation. 2. Land.Use Planning and other Planning Activities - three .S.Q.pra P PrPPosal$ on land use planning. 3. Public Employees Pensions - proposal for new public I employee pension sytem to include all State and local employees. 4. Public Transportation - several measures are proposed, including AWC measure to allow cities to fund transit systems through the use of 3/10 of one percent sales tax. Council will be kept abreast of further Legislative developments !through AWC Bulletins and the City Manager. The Council was apprised of a proposed advertising scheme for pedestrian benches to be placed at selected bus stops throughout the ; 1 City. Further discussion will be made on this at the Study Session i February 3, 1975. 1 273 JANUARY 27, 1975 At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen 'Brown, Edmondson, Jarms, Moore, Schussler and Simmons, City 1Manager McMicken, and City Attorney Andrews present on roll call. The Invocation was given by Councilman Edmondson. 1 1The minutes of the previous meetings of January 13, 1975, and January 20, 1975, having been duly certified accurate by two Councilmen, and no one present wishing to have said iminutes read publicly, Mayor Broad declared said minutes I/ happroved as recorded. This being the time set for the Hearing on the Rezone Application .filed by Jack Teitenberg for property situated at 1712 South 16th Avenue, Assistant Planner, Glenn Rice, reviewed the Staff Reports on this subject dated November 6 and December 1 24, 1974 and the Planning Commission Minutes dated January 17, 1975. Mr. Teitenberg, owner of the property along South 116th Avenue, requests a rezone from R-2, Two-Family Zone and R-4, Suburban Residence Zone to a commercial Planned ;Development Zone. With the use of a map, Mr. Rice cited the 1surrounding land use and zoning, to include R-4 to the west, 1development of the Armed Forces Reserve Center north of the site and to the south M-4, Planned Industrial Zone. The remainder of the property is zoned R-2. Mr. Teitenberg plans to construct a farm market center for the retail sale of farm products. The City's General Plan indicates this area for low density residential development and the Yakima Municipal Airport Noise Impact Zone designates this area with a Composite Noise Rating above 100. Mr. Rice reviewed the earlier action whereby a correction on the legal description required a rehearing by the Planning Commission, at which time the request was !recommended for approval. He indicated that it was the Staff's original recommendation to deny the request for reasons outlined on the Planning Staff Report dated November 6, 1974. Mr. Rice noted that the main parking lot would be hard surfaced, but the unloading area to the back of the property would be gravel and oil. Mr. Jack Teitenberg, being present, presented an artist's conception of the proposed greenhouse, noting that it would be a building constructed of vinyl materials. He stated that this type of development should not igenerate any more cars than the Perry Trade Development in a Commercial Zone. He reviewed his plans for establishing 1a farm market on the property starting in June and running 1through November. It was MOVED by Moore, seconded by Simmons that Ordinance No. 1746, accepting the recommendation of the Planning Commission and zoning said property, be passed: lcarried, Broad, Brown, Edmondson, Jarms, Moore, Schussler l and Simmons voting aye on roll call. ORDINANCE NO. 1746, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at 1712 !South 16th Avenue from R-2 and R-4 to Planned Development 1Zone. 1 City Manager McMicken requested authorization for the transfer of Federal Shared Revenue monies in the amount of $69,465 to the General Fund for purposes of funds for the Southeast 1Community Center Clinic, Data Processing and Special Projects for the Handicapped. These amounts have been budgeted and are in accordance with the Council's earlier Budget-decisions i regarding FRS Funds. He reviewed the Council's action to 'earmark $80,000 over a two year period for the Southeast Community Center Clinic, or $10,000 per quarter. It was 'MOVED by Schussler, seconded by Simmons that Resolution No. D-3257, authorizing the transfer of Federal Revenue Shared monies to the General Fund, be passed: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons !voting aye on roll call. 274 JANUARY 27, 1975 :RESOLUTION NO. D-3257, A RESOLUTION authorizing the transfer of $69,465 from 199-Federal Shared Revenue Fund to 000-General :Fund. City Manager McMicken explained the Regional Basic Law Enforcement School being conducted by the Washington State Criminal Justice !Training Commission operating through Yakima Valley College. The ;school provides an 11 week training course, for which a full !time coordinator is needed. The proposed contract provides for the services of Reid Follansbee, Yakima Police Officer, to act as the Training Coordinator with the City,to be reimbursed for his salary and fringe benefits. It was MOVED by Brown, !seconded by Jarms that Resolution No. D-3258, authorizing the ! execution of said contract with the Washington State Criminal ;Justice Training Commission, be passed: carried, Broad, Brown, ;Edmondson, Jarms, Moore, Schussler and Simmons voting aye on !roll call. ;RESOLUTION NO. D-3258, A RESOLUTION authorizing the City Manager and City Clerk to execute a contract with the Washington State ;Criminal Justice Training Commission for the services of a Yakima 1 Police Officer as Training Coordinator for a course in Basic !Law Enforcement. It was MOVED by Schussler, seconded by Moore that Resolution !No. D-3259, authorizing the payment of $25.73 to Charles Martin, for damages incurred from a sewage backup, be passed: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons ivoting aye on roll call. RESOLUTION NO. D-3259, A RESOLUTION authorizing payment of a claim for damages filed by Charles 0. Martin. City Manager McMicken reviewed City Manager Report No. 237 regarding Reorganization of City Departments. He explained the need for 'changes in City administration due to the loss of a Director of Public Services which will not be replaced. The City is ; presently recruiting for a Director of Community Development. He requested approval for the proposed division of the Admin- istration into six major departments, to include Police, Fire, ;Public Works,Community Development, Parks and Recreation and ;Management and Budget. He noted that an Ordinance would be !prepared to implement these changes, if Council approves. Mayor !Broad referred to the requirement for the City to indicate its ;cooperation in the Affirmative Action Program and noted that no specific reference was made for its Administration under !any certain department. He suggested it fall under the Management and Budget category. After further discussion, it was the Council's consensus that all Departments are involved in complying with the Affirmative Action Program and that the intent of.the proposed legislation is to provide for realignment of departments rather than specifying laws to be complied with by each department. It was MOVED by Moore, seconded by Edmondson that the appropriate legislation be prepared to implement this reorganization plan: .carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and 'Simmons voting aye by voice vote. 1 The City Treasurer having submitted the Investment Report for the month of December, 1974, it was MOVED by Schussler, seconded by Brown that the report of the City Treasurer dated December 31, 11974, regarding the investments of the City of Yakima, be !accepted and approved: carried, Broad, Brown, Edmondson, Jarms, !Moore, Schussler and Simmons voting aye by voice vote. City !Treasurer, Walt Chappel explained the Year End Report, noting that the City exceeded the Budget and brought in more on investments than anticipated. He reported that the General !Fund benefited in the amount of $137,000. Councilmen expressed !appreciation to Mr. Chappel for his work. 1 27 JANUARY 27, 1975 I It was MOVED by Edmondson, seconded by Jarms that Ordinance INo. 1747, designating the speed limit on South 48th Avenue from Nob Hill Boulevard to the south City limits and Ranch Rite IRoad to the south City limits, be passed: carried, Broad, Brown, Edmondson, Jarms, Moore and Simmons' voting aye on roll !call. Schussler temporarily absent. City Manager McMicken 'explained that the speed checks along So. 48th between Nob Hill land West Washington Avenue indicate that 85% of the motorists !drive 45 mph on this road and in light of the small amount of development it is felt the speed Limit should be reduced to 40 mph to be uniform with the County portion of this street, 'recently designated as 40 miles per hour. ' ORDINANCE NO. 1747, AN ORDINANCE relating to traffic control; !designating speed limits on certain City streets; amending Subsection 9.50.350 E of the City of Yakima Municipal Code and declaring an emergency. A Damage Claim having been filed with the City Clerk on January 23, 1975, by Mike A. Parker, 3409 West Nob Hill Boulevard, in the amount of $110.29 for damages from a sewer backup, it was MOVED by Moore, seconded by Brown that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting aye by voice vote. Mayor Broad reported that he would not be present at the Council luncheon meeting to be held Friday, January 31, 1975 at the Chalet Restaurant.
