NOVEMBER 18, 1974
The City Council met in session on this date at 6:30 P.M. in the
Conference Room at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad, Wray
Brown, Betty L. Edmondson, Dick Jarms, W. K. "Pete" Moore
and Charles A. Rich.
City Manager McMicken reminded Council members of the meting
scheduled for Friday, November 22, 1974, with Bill Barber
(Organizational Consultant) to discuss management structure
and Team Building Day efforts.
Personnel Officer Marilyn Farnham, briefed the Council on the City's
response to the General Services Administration inquiry into the
City's Affirmative Action Plan and its conformance with the
Civil Rights Act. Highlighting the report, she noted three
major changes which the City would be incorporating in its
Affirmative Action Plan:
1. In the future, minority complements will be broken down by
individual departments, the determination of qualification
for various jobs will be based upon skill levels available
within the labor force residing within Yakima County as
opposed to the percentage of population previously utilized.
2. The G.S.A. has determined that many of our placement tests
are considered to be discriminatory by their standards
and therefore, will be undergoing a comprehensive review
to remove discriminatory elements.
3. Future contracts which the City bids must be designed to
encourage minority contractors, though in some cases, the
City might not always take the lowest bid, but instead, be
preferenced by minority contractors attempting to compete
in the community.
In considering this presentation, the Council agreed that the
City's Affirmative Action Program should be revamped in compliance
with G.S.A. standards. Councilman Rich questioned the applica-
bility of utilizing labor force statistics in the County unless
based upon permanent residency. The Personnel Officer will
make this determination.
City Manager McMicken reviewed some of the ongoing activities and
new ventures entered into by the Office of Community Develop-
ment, at the ICMA Fall meeting in Ellensburg. Mr. Dick Hempstead,
Director of O.C.D., described attempts by his office to rescind
the growth limitation in property tax, but noted no large tax
increase apparent for the future. Mr. Hempstead also noted
that the Government meeting with local officials in making
up the State Budget (Association of Washington Counties, Cities
of Vancouver, Cheney and Seattle) was a successful effort and
very helpful in preparation of the State Budget. In general,
any raising of tax ceilings presently in effect must be directed
by local government officials on a joint effort. City Manager
McMicken noted there was liability present to local jurisdictions
in the LEFF Act, resulting from higher retirement rates, 57 per-
cent of which is disability retirement and 12-15 percent is
non-service retirement. Consequently, the actuary soundness of this
Pension Fund is of concern to all local officials. Finally,
Mr. Hempstead noted that O.C.D. also proposed that a State
Charter Financial Housing Commission be established to aid low-
income housing of beneficiaries. Further progress on these efforts
will be communicated to the Council as they develop.

iAt 8:00 P.M., the Council members moved into the Council Chambers
for the balance of the meeting, Mayor Broad presiding, Councilmen
Brown, Edmondson, Jarms, Moore and Rich, City Manager McMicken
and City Attorney Andrews present on roll call. Councilman
1Schussler absent on roll call, having been excused at a previous
'meeting.
The Invocation was given by City Manager McMicken.
The minutes of the previous regular meeting of November 12,
1974, having been duly certified accurate by two Councilmen,
and no one present wishing to have said minutes read publicly,
Mayor Broad declared said Minutes approved as recorded.
This being the time set for the Hearing on the adoption of
A Comprehensive Parks and Recreation Plan, as an amendment
to the General Plan, Parks Director Bill Hutsinpiller referred
to the large Comprehensive Plan Document dated May 1, 1974,
as prepared by ORB Architects, and a smaller Summary document,
'containing a condensed explanation of the Comprehensive Plan.
He explained the purpose of the plan in qualifying the City
of Yakima for State and Federal matching funds. With the use
of an outline map, Mr. Hutsinpiller pointed out the divisions of
the comprehensive planning area as they are divided into communities
and neighborhoods. He explained that the communities identify
"larger areas that require larger community park facilities,
hereas the neighborhood park would serve the local neighborhood
heeds. He briefly reviewed the various considerations of the
Comprehensive Plan, to include existing parks, open spaces,
'evaluation of present needs, population trends and various
tables relating to community participation in the Parks and
Recreation system. Mr. Hutsinpiller explained that the Plan
be used to help develop future parks and evaluate the
present facilities in relation to existing need. It will also
serve as a guide in the acquisition of land for the development
l of future park sites. He explained that the State will use
this document for review of all City applications for Federal
funds. Council members discussed some changes which should be
hoted in the Plan to include a more specific description of
the proposed park site to be acquired at 40th and Englewood,
eleting reference to the need for a future school facility
on Community Number 1 and reference to the preservation of
agricultural lands in neighborhood areas 26 and 27. Dr. McGuinness,
Parks and Recreation Commissioh member, spoke in favor of the
Comprehensive Plan and suggested that top priorities might
exist adjacent to schools. After due discussion, it was MOVED
; by Brown, seconded by Rich that Resolution No. D-3215, adopting
the Comprehensive Parks and Recreation Plan, be passed: carried,

' RESOLUTION NO. D-3215, A RESOLUTION amending the "General Plan
for the City of Yakima" by adding as a supplement thereto a
Comprehensive Parks and Recreation System Plan", and repealing
?esolution No. 1442, adopted February 16, 1970.
It was MOVED by Rich, seconded by Jarms that Resolution No.
P-3216, authorizing the acceptance of a grant from the State
of Washington Department of EcOlogy,for the planning of waste

equal to the cost of living increase, is now raised to $18,000
with the same adjustments to be made. It was MOVED by Moore,
seconded by Brown that Resolution No. D -3217, authorizing the
execution of said contracts for the operation of the Central
Fire Alarm Headquarters, be passed: carried, Broad, Brown,
Edmondson, Jarms, Moore and Rich voting aye on roll call.

RESOLUTION NO. D -3217, A RESOLUTION authorizing the City Manager
and City Clerk of the City of Yakima to execute contracts for
the operation of the Central Fire Alarm Headquarters for the
years 1975 through 1977.
I/ City Manager McMicken reviewed City Manager Report No. 234,
entitled Conveyance of Cahalan Park to Town of Union Gap.
Councilman Edmondson referred to the earlier decision of the
Council to set a period of not less than ten years for the
continued use of the park by the City of Yakima and the sub-
sequent proposal from Union Gap for a term of three years.
She made reference to the fact that this park space is needed
by the City's Park and Recreation Department. After due discussion,
it was MOVED by Edmondson, seconded by Rich that the matter
of the transfer of Cahalan Park to the Town of Union Gap be
referred back to the Parks Commission for their recommendation
on the continued use of the park by the City of Yakima for
a period of not less than ten years: carried, Broad, Brown,
Edmondson, Jarms, Moore and Rich voting aye by voice vote.
Schussler absent.
It was MOVED by Brown, seconded by Edmondson that the Council
affirm their support of City sponsorship of the Yakima - Kittitas
Resource Conservation and Development Project: carried, Broad,
Brown, Edmondson, Jarms, Moore and Rich voting aye by voice
vote. Schussler absent.
Traffic Engineer Bill Stark reviewed the proposed timing of
traffic signals in the Central Business District, indicating
that they will be timed for a reduced speed of 27 miles per
hour. He reported that left turn green arrows will be eliminated
at the intersections of Walnut and First Street, First and
"B" Street, First and Lincoln, 3rd and Walnut, 5th and Walnut,
5th and "B" (where there is now a double turn), Lincoln and
3rd Street, and 7th and Yakima Avenues.
City Manager McMicken reported the recommendation of the Staff
for approval of the two Right -of -Way Use Permits for encroachments
of apple washing immersion devices owned by Sunquist Fruit
and Cold Storage. It was MOVED by Rich, seconded by Brown
that the requested Right -of -Way Use Permits for Sunquist Fruit
and Cold Storage at 302 and 316 North First Avenue and 38 North
I/ First Avenue, be approved: carried, Broad, Brown, Edmondson,
Jarms, Moore and Rich voting aye by voice vote. Schussler
absent.
City Manager McMicken reported that bids were received and
considered on November 14, 1974, for construction of L.I.D.
No. 998, Voelker Addition No. 1 Sanitary Sewer, and that one
bid only was received from DeBlasio Construction Company, Inc.,
in the amount of $13,697.25. City Engineer recommending that
the bid be awarded to DeBlasio Construction Company, Inc.,

it was MOVED by Rich, seconded by Edmondson that the bid be
awarded to DeBlasio Construction Company, Inc., in the amount
of $13,697.25 and that the City Manager be authorized to enter
into contract with said contractor upon the filing of the proper
bond and insurance: carried, Broad, Brown, Edmondson, Moore
and Rich voting aye by voice vote. Schussler absent.
An Ordinance appropriating $239,409.63 of Federal Shared Revenues
for transfer to the City Shop Fund, Library Fund and General
Fund, having been read by title only at this meeting was laid
on the table for one week or until November 25, 1974. City
Manager McMicken reviewed the Federal Shared Revenue Fund analysis
of appropriations dated November 18, 1974.
It was MOVED by Edmondson, seconded by Brown that Ordinance
No. 1724, regulating automobile rental businesses at the Yakima
Air Terminal, be passed: carried, Broad, Brown, Edmondson,
Jarms, Moore and Rich voting aye on roll call. Schussler absent.
ORDINANCE NO. 1724, AN ORDINANCE relating to licenses and business
regulations; prohibiting the operation of automobile rental
businesses at the Yakima Air Terminal without a license and
agreement with the City; specifying the license fee and form
of agreement; regulating operations of such license holders;
limiting the number of licenses to be issued; and amending
Sections 5.07.010 and 5.07.020 and enacting new Sections 5.07.015
and 5.07.025 all of the City of Yakima Municipal Code.
A report having been received from the Planning Commission
on the rezone request filed by Jack Teitenberg for property
located at 1708 and 1712 South 16th Avenue, it was MOVED by
Rich, seconded by Edmondson, that December 2, 1974, be the
date set for Hearing on this matter: carried, Broad, Brown,
Edmondson, Jarms, Moore and Rich voting aye by voice vote.
Schussler absent.
A report having been received from the Planning Commission
on the rehearing of a request for a rezone filed by Mr. Robert
Suver and Mr. Paul LaChance for property along Naches Avenue
and 6th Street between Yakima and Lincoln Avenues, it was MOVED
by Rich, seconded by Edmondson that December 2, 1974, be the
date set for Hearing on this matter: carried, Broad, Brown,
Edmondson, Jarms, Moore and Rich voting aye by voice vote.
Schussler absent.
A Damage Claim having been filed with the City Clerk on November
14, 1974, by John Huck, 409 Quince Street, in the amount of
$15,120 for damages in connection with a police incident, it
was MOVED by Rich, seconded by Edmondson that said Damage Claim
be referred to the City Manager and staff for study and recommendation:
carried, Broad, Brown, Edmondson, Jarms, Moore and Rich voting
aye by voice vote. Schussler absent.
There being no further business to come before the Council,
it was MOVED by Rich, seconded by Moore that this meeting be
adjourned at 9:30 P.M., to Wednesday, November 20, 1974, at
the hour of 4:30 P.M. to then meet in the Holiday Motor Inn:
