AUGUST 12, 1974
The City Council met in session on this date at 1:30 P.M. in the
Conference Room at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad, Wray Brown,
Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich, Don
Schussler and Bill Whitaker.
Councilman Brown gave a status report on the shipping of the trolleys,
which are expected to arrive in September.
The Mayor mentioned that the Human Rights Commission has set a
Hearing for August 31, 1974, and have a Task Force,
which would investigate the problems surrounding the closure of
the Super Duper Market.
City Attorney Andrews discussed two cases facing court action con-
cerning Group Homes. The first case concerns a Group Home for
children on West Yakima Avenue, wherein the Board of Adjustment
ruled that the occupants should not be permitted to live there. A
trial date has been set for September 24, 1974. A second case
concerns the Spring Acres Home for retarded children at 1412
West Chestnut. The surrounding property owners protested the
occupancy of the home, but the Board of Adjustment ruled in favor
of permitting such a use. The case will be heard in Superior Court
on a trial date yet to be set. Depending on the action taken by
the Court, the Council may be in a position to change legislation
governing the occupancy of such homes, however, specific de-
finitions will be required before any chancres can be effected.
Councilman Rich expressed concern that attention be given to
excluding possible discriminatory regulations against foster care
homes, which are different than other Group Homes. Some
assurance should be given rJQt to jeopardize this type of use.
Councilman Schussler felt that some consideration should be given
as to when conditional land use permits are granted, which would
distinguish between Boarding Houses, Fraternities, Sororities or
other types of Group Homes. Councilman Schussler favored licensing
them in R-3 or M Zones, but not in R-1 and R-2, Residential. This
may require an amendment to the Zoning Ordinance that would eliminate
present inconsistencies. Councilman Rich indicated he would like
to see separate categorical definitions for each type of "Group
Home." After discussion on these remarks, the Council agreed
that enacting legislation should be deferred until the cases before
the Court have been adjudicated. In the interim, Council consensus
was to ask Staff to prepare a separate definition for each type of
Group Home, for consideration after Court hearings.
At 3:00 P.M., the Council members moved into the Council
Chambers for the balance of the meeting, Mayor Broad presiding,
Councilmen Brown, Edmondson, Moore, Rich, Schussler and Whitaker,
City Manager McMicken and City Attorney Andrews present on roll
call.
The Invocation was given by City Manager McMicken.
The minutes of the previous meeting of August 5, 1974, having
been read by two Councilmen, Mayor Broad noted a correction
to be made and indicated the minutes would be signed at the
next regular meeting.
This being the time set for the Hearing on Petition No. 820,
filed by Jack Teitenberg and others, requesting vacation of
a portion of Pierce Street, City Manager McMicken referred to
the letter received from Mr. Teitenberg's Attorney, dated August
8, 1974, requesting a 90-day postponement to facilitate further
planning. It was MOVED by Whitaker, seconded by Schussler that
this Hearing be continued to November 11, 1974: carried, Broad,
Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting
aye by voice vote.

It was MOVED by Schussler, seconded by Brown that Resolution No.
D-3164, fixing September 9, 1974 as the date for Hearing on Petition ;
No. 823, for vacation of a portion of Garrett Street, be passed:

voting aye on roll call.
'RESOLUTION NO. D-3164, A RESOLUTION fixing the time and place
for Hearing on a Petition for the vacation of a portion of street
in the City of Yakima, Washington.
It was MOVED by Edmondson, seconded by Schussler that Resolution
1No. D-3165, authorizing the execution of an agreement with Yakima
lCounty for Emergency Employment Act Funds to hire three Irrigation
!Installers for City Parks, be passed: carried, Broad, Brown,
iEdmondson, Moore, Rich, Schussler and Whitaker voting aye on roll
call. City Manager McMicken explained that these are temporary Park
!personnel.
;RESOLUTION NO. D-3165, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
;an agreement with the County of Yakima for Emergency Employment
'Act Funds.
IReferring to the proposed agreement accepting a grant from Washington
IState for purposes of runway overlay and lighting at the Yakima
Air Terminal, City Manager McMicken reported that the City is now
ready to submit the project application. He reviewed the cost
!estimates for the project, noting the breakdown in federal, state
and local shares, and indicating that the City will pay approximately
$19,006. He further reported that the project is virtually completed.
It was MOVED by Whitaker, seconded by Rich that Resolution No.
1 D-3166, authorizing the execution of said agreement, be passed:
carried, Broad., Edmondson, Moore, Rich, Schussler and Whitaker
voting aye on roll call. Brown not voting.
RESOLUTION NO. D-3166, A RESOLUTION authorizing the City Manager
and City Clerk of the City of Yakima to execute an agreement with
the Washington State Economic Assistance Authority and Washington
1 State Aeronautics Commission for the acceptance of a grant for
runway overlay and lighting at the Yakima Air Terminal.

It was MOVED by Schussler, seconded by Brown that Resolution No.
1D-3167, revoking a permit held by Yakima City Creamery, Inc. for
la canopy constructed over the public alleyway be passed: carried,
'Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting
aye on roll call. City Manager McMicken explained that the Creamery
is no longer located at these premises and the obstruction should
be removed.
RESOLUTION NO. D-3167, A RESOLUTION revoking a permit previously
Igranted to Yakima City Creamery, Inc., to construct a canopy over
la public alleyway.
City Manager McMicken discussed the proposed agreement with APCOA
for management of the Yakima Air Terminal Parking Lot, as negotiated.;
,City Attorney Andrews reviewed the provisions found in the proposed
lagreement, to include rental compensation to the City, parking
;fees, '77. responsibilities of APCOA in connection with the management
• of the parking lot and responsibilities of the City in furnishing
!facilities, insurance requirements and signing,all as contained
in the proposed agreement. It was MOVED by Brown, seconded by
IMoore that Resolution No. D-3168, authorizing the execution of
said agreement with APCOA, be passed: carried, Broad, Brown,
;Edmondson, Moore, Rich and Whitaker voting aye on roll call;
Schussler voting nay on roll call.

RESOLUTION NO. D-3168, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to
execute an agreement with APCOA Division, ITT Consumer Services
Corporation, to operate and manage Air Terminal parking
facilities.
City Attorney Andrews covered the provisions of the Parking
Validation Agreement between the City and the Flight Deck
Restaurant, reviewing the validation schedule as found in
the agreement. He indicated that the proposed lease has
a five year term. It was MOVED by Brown, seconded by Whitaker
that Resolution No. D-3169, authorizing the execution of
said agreement with the Flight Deck Restaurant, be passed: carried,
Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker
voting aye on roll call.
RESOLUTION NO. D-3169, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to
execute a Parking Validation Agreement with Cecil A. Beauchamp
and Sandra M. Beauchamp, husband and wife, doing business
as Flight Deck Restaurant.
City Manager McMicken referred to City Manager Report No.
223 regarding the 911 Emergency Telephone Number, noting
the report and attached Memorandum for informational purposes
at this time. He recommended the endorsement of the proposal
for the 911 Emergency Number for consolidation of dispatching
emergency services. It was MOVED by Schussler, seconded
by Moore that the City endorse the 911 Steering Committee
and the proposal for the 911 Emergency Number and authorize
the City Manager to take the necessary steps to encourage
implementation of this number in this area: carried, Broad,
Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting
aye by voice vote. Administrative Assistant, Dick Zais,
Chairman for the 911 Steering Committee, indicated that
the alternate A, as described in his attached Memorandum,
appears to be the more desirable serving plan. He noted
a time projection of a approximately 1-1/2 years for implementa-
tion of this number by the Police and Sheriff Offices.
Referring to City Manager Report No. 225, Regulating Ambulance
Services, City Manager McMicken explained that the City has been
asked to limit the number of ambulance businesses operating
within the City limits on a competitive basis and referred
to the proposed ordinance restricting the number of licensed
ambulance services. Councilman Moore spoke in favor of
the proposal. Councilman Edmondson spoke to the matter
of ambulance rate increases, noting that the Council should
approve any rate increases. Mayor Broad questioned whether
there had been discussion on the control of rates. Councilman
Brown asked whether other cities approved rate changes and
spoke to the matter of controlling the rates,since the number of
businesses are being restricted. After due discussion,
it was the consensus of the Council that the staff research
the matter of approving rate changes and that a report be brought
back in a couple of weeks. Present and speaking to this
matter was Mr. Cliff McCargar, Yakima Ambulance.
City Manager McMicken indicated that Item No. 12 on the
Agenda, License Fees for Bowling Alleys, would be deferred
for two weeks.
Referring to the appeal by Autotronics Systems, Inc. of
the Planning Commission's denial of a request for water
and sewer connection to the Fill-Em-Fast Service Station,
1705 West Lincoln Avenue, Assistant Planner, John Haddix,
reviewed the background on this matter and past action taken
by the Planning Commission whereby the request was denied.

He reviewed the Staff's recommendation for denial, based on past
findings. The business was previously advised that a commercial
zoning would be in opposition to the City's General Plan.
Mr. Haddix indicated that the applicant desires a connection since
the utilities are located nearby and the connections are necessary
in meeting health and fire codes. City Manager McMicken questioned,
why the applicants had not annexed. Mr. Haddix indicated that
the Boundary Review Board would not let it come into the City
as an extension of an irregular boundary,noting that a larger
parcel is needed for annexation. If annexed, the property
would be zoned residential in accordance with the City's General
Plan. Councilman Schussler encouraged the Council to practice
and maintain its right to deny requests. After due discussion,
it was MOVED by Brown, seconded by Moore that the Outside Utility
request filed by Autotronics Systems, Inc., be denied: carried,
Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker
voting aye by voice vote.
City Manager McMicken referred to the request for Outside Sewer
Service to the residence owned by L. E. Prediletto, at 115
N. 56th Avenue and reported that an 8-inch sewer line along
56th Avenue is available to serve this property at an estimated
connection charge of $656.19. The applicants have agreed to
annex when feasible. It was MOVED by Whitaker, seconded by
Edmondson that the request for outside utility service by Mr.
and Mrs. Prediletto, be granted: carried, Broad, Brown, Edmondson,
Moore, Rich and Whitaker voting aye by voice vote. Schussler
abstaining.
City Manager McMicken reported that one bid only was received
and considered by the Bid Board on August 8, 1974 for L.I.D.
NO. 997, Voelker Addition No. 1, Domestic Water District.
The only bid received was from DeBlasio Construction Company,
Inc., in the amount of $17,998.58. The City Engineer recommending
that the contract be awarded to DeBlasio Construction Company,
it was MOVED by Schussler, seconded by Rich that the contract
be awarded to DeBlasio Construction Company, Inc., in the amount
of $17,998.58: carried, Broad, Brown, Edmondson, Moore, Rich,
Schussler and Whitaker voting aye by voice vote.
An Ordinance appropriating $76,000 for the Police Computerized
Micro-Film Record System and including $11,776 from the Contingency
Fund, having been read by title only at the previous meeting
and being again read by title only at this meeting, it was
MOVED by Edmondson, seconded by Schussler that Ordinance No.
1693, providing for said appropriation, be passed: carried,
Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker
voting aye on roll call.
ORDINANCE NO. 1693, AN ORDINANCE transferring the amount of
$11,776 from 195-Contingency Fund to 000-General Fund and appropria7
; ting the amount of $76,000 from available and anticipated un-
appropriated money in 000-General Fund to Account 031.521.20.64
as a 1974 appropriation for 000-General Fund.
A report having been received from the Planning Commission on
the Rezone Application filed by J. M. Perry Institute, requesting
rezone of property_at South 16th,and West Washington Avenues,
it was MOVED by Schussler„ seconded by Moore that August 26,
1974, be the date set for Hearing on this matter: carried,
Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker
Voting aye by voice vote.
AUGUST 12, 1974
City Manager McMicken referred to the off-agenda item regarding
the proposed resolution approving application of certain
provisions of the U.S. Housing Act, as amended,to the City
of Yakima. He noted that the application requesting financial
assistance for providing low-rent housing includes 25 units
for aged families. It was MOVED by Schussler, seconded by Brown
that Resolution No. D-3170, approving application of said
provisions, be passed: carried, Broad, Brown, Edmondson, Moore,
Rich, Schussler and Whitaker voting aye on roll call.
RESOLUTION NO. D-3170, A RESOLUTION approving application of the
provisions of Section 23 of the United States Housing Act of 1973,
as amended, to the City of Yakima.
Under New Business, Mayor Broad indicated that Mr. Jerry
Klinetobe has indicated a willingness to serve on.the Yakima
Housing Authority to fill the vacancy created by the resignation
of Oliver Nelson. It was MOVED by Whitaker, seconded by
Brown that Mr. Klinetobe be appointed to the Yakima Housing
Authority: carried, Broad, Brown, Edmondson, Moore, Rich,
Schussler and Whitaker voting aye by voice vote.
There being no further business to come before the Council,
it was MOVED by Rich, seconded by Moore that this meeting
be adjourned at 4:2.0 P.M., to Friday, August 16, 1974, at
the hour of 12:00 Noon, to then meet in the Flight Deck Restaurant:

The City Council met in session at 12:00 Noon on this date in the
Flight Deck Restaurant at the Yakima Air Terminal.
Councilmen present at the meeting were Mayor Bert Broad, Wray Brown
Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich, Don
Schussler and Bill Whitaker.
Council members held general discussion on various city matters.
No formal action was taken.
There being no further business to come before the Council, it was
MOVED by Rich, seconded by Moore that we do now adjourn at the hour
