HomeMy WebLinkAbout07/29/1974 Business Meeting and Adjourned Meeting 08/02/1974 1 94 JULY 29, 1974 The City Council met in session at 1:30 P.M. on this date in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Betty L. Edmondson, W.K. "Pete" Moore, Charles A. Rich, Don Schussler and Bill Whitaker. City Manager McMicken inquired as to the Council's position concerning the Wastewater Facilities Planning Study which would again be considered,on,this week's agenda. In response, Councilman' Schussler presented Council members with a letter reflecting his thoughts on the Wastewater Study in view of the Council's policy toward outside utility extensions and land use planning in our area. The thrust of his letter proposed that the City of Yakima and Yakima County agree.th_disgolve their existing Planning Commissions and instead form a Regional Planning Commission charged with preparing a Comprehensive Urban Growth Policy for adoption by jurisdictions in our area. Councilman Schussler indicated that a Regional Planning Commission should develop the policy and it should be adopted by the City before any changes are made in the City's existing annexation policy and before the Wastewater Facilities Plan is initiated. The Council discussed the matter among themselves and came to the consensus that the Facilities Plan should be executed in view of the political ramifications of Councilman Schussler's proposal. The Council, agreed, however, that Mr. Schussler's statement should accompany formal exectuion of the agreement. It was MOVED by Brown, seconded by Edmondson that the Council go into Executive Session to consider 1975 Union Negotiations and a summary of estimated revenues and expenditures for the last six months of 1974 and the 1975 year: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice Vote. At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Edmondson, Moore, Rich, Schussler, Whitaker and City Manager McMicken present on roll call. The Invocation was given by Councilman Brown. The minutes of the previous meetings having been read by the Council members and two errors noted, Mayor Broad indicated that after the corrections are made, the minutes will be at the next meeting. I This being the time set for the Hearing on Petition No. 814, filed by A. R. Webb and others, requesting vacation of a portion 1 of Stanley Assistant Planner, Glenn Rice, reviewed the Planning Staff Report and Planning Commission Minutes on this subject dated June 17, 1974 and July 2, 1974 respectively. The two petitioners are requesting vacation of the unimproved portion of Stanley Boulevard right-of-way which abuts their property. The proposed vacation T:rould square up their respective properties. Mr. Rice noted that this request has been submitted to affected City departments and agencies with no protest received. He reported the recommendation of the Planning Commission for approval of this request subject to the following conditions: 1. The City retain all public utility easement rights for the placement and maintenance of existing and future utilities in dimension satisfactory to the City Engineer. 2. Right-of-way be deeded to the City at the corner of West Chestnut and Stanley Boulevard to insure at least a 20 foot radius for future improvement of the intersection in dimensions satisfactory to the City Engineer. It was MOVED by Whitaker, seconded by Rich that Ordinance No. 1686, providing for said vacation, be passed: carried, Broad, 125 JULY 29, 1974 'Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting !aye on roll call. ORDINANCE NO. 1686, AN ORDINANCE providing for the vacation of a portion of public street in the City of Yakima, Washington. This being the time set for the Hearing on Petition No. 819, 'filed by St. Michael's Episcopal Church and the Young Men's 'Christian Associatiox'i, requesting vacation of air space above is portion of East Yakima Avenue, Assistant Planner, Glenn Rice, 'reviewed the Planning Staff Report dated July 15, 1974 and the 'Special Planning Commission Meeting Minutes on this subject. Mr. Rice reported that the request is for the vacation of air space over Yakima Avenue above the sidewalk and adjacent to 1 the south side of the YMCA building, for purposes of expanding the present Y.M.C.A. facilities, to include the construction of a new gymnasium and indoor running track. He related a question !expressed by some as to the future use by the City of this air !space if the new addition was destroyed or altered. Mr. Max ;Vincent, reported that a right-of-way use permit would not' be feasible and reviewed the problems associated with relocation Idue to lack of available space. Mr. Oliver Nelson, Manager of the YMCA, spoke to the matter of proposed window locations on the south side near the City's street lights. There was some question among Council members regarding possible action against the City due to the location of the street lights and !future use of this space by the City in the event the new structure was destroyed. City Manager McMicken indicated that appropriate ;amendments covering these questions could be included and passed !along with the proposed ordinance providing for the vacation. !After further discussion, it was MOVED by Whitaker, seconded by Rich that Ordinance No. 1687 be passed. It was then MOVED by Edmondson, seconded by Schussler that the following two amendment. !to the ordinance be adopted: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote.- ' 1. By the acceptance of this vacation, the Young Men's Christian Association of Yakima, present owner of the space to be vacated must waive and release any claim against the City of Yakima for light or light reflection that might arise because of the proximity of street lights 1 that might be installed near a structure to be placed in the vacated area. 2. In the event of demolition or other destruction of any structure placed in the vacated area, and in the further event of a sale or similar change of ownership after such demolition or other destruction rendering the vacated area no longer necessary for Young Men's Christian Association of Yakima use the vacated area shall thereupon revert to the City of Yakima. It was MOVED by Whitaker, seconded by Rich that Ordinance No. 1687, providing for said vacation be passed as ,amended: carried, !Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. , ORDINANCE NO. 1687, AN ORDINANCE providing for the vacation of .air space above a portion of East Yakima Avenue within the City of Yakima, Washington. 1 Mr. Ed Doran and Mr. Milton Shute, being present, spoke to the !Council regarding a problem along 16th Avenue caused by weeds and brush being blown onto residential properties located inside the City limits from a parcel of ground located outside the !City limits. Mayor Broad explained that the City had supplied i water and sewer service to this area with the stipulation that it was to be kept clean, but that this area is outside the City and under County jurisdiction. Mayor Broad indicated that he would pursue this matter with the County. . 1 125 JULY 29, 1974 ! Mrs. Helen Lawrence, 9 So. Naches Avenue, being present, spoke to the Council regarding the closure of the Eastgate Super Duper 'Store and indicated that this particular store is badly needed by residents in the area. Mayor Broad related that the law enforce-, iment officials have operated adequately to protect the rights of the people shopping at the store. Mr. Frank McCormick, 210 N. 7th Street, asked questions regarding the appointment of the Task Force Committee which is to study the over-all problem. Mayor Broad indicated that the Council had considered the names of persons submitted for appointment to this committee and had decided that equal representation be named from the East Yakima I section as well as the community at large. He noted that those 'being named have not yet been contacted or indicated a willingness to serve. Mayor Broad named the following persons as appointees to the Task Force Committee: Henry Beauchamp G. Hatten D. Goodman B.; Chandler S. Barnes M. Jackson P. Pleasant E. Brown Carter, Sr. J. Jefferson J. Lust R. Holbrook J. Goetz P. Nagle M. Schwab F. Fredericks D. Hinman C. Miller G. Velikanje N. Faller ■Mayor Broad indicated that this Committee would be meeting immediat- ely and would report back to the Council. City Manager McMicken referred to the matter tabled at the previous meeting regarding the proposed agreement with R. W. Beck & Associates ' for a Wastewater Facilities Plan'. It was MOVED by Brown,. seconded : by Edmondson that this matter be' taken off the table for reconsider-, ! ation: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler I and Whitaker voting aye by voice vote. Director Public ,Works, Dave Vargas, noted that an important part of the Study deals with the expansion of the three existing sewer systems which Imust be completed before the irrigation season is over and that at least two months are required to complete that Study. Councilman; Don Schussler reviewed his letter written to Council members and distributed on this date, expressing his concern for future land; I use considerations. He stated that the proposed Study may result ; in the City of Yakima sewering the areas in question without adequate agreement of sewerage needs or land use. His letter suggests that an agreement could be drawn up between the participating agencies granting a regional planning study, to include the question of annexation to the City. In regard to the questions of 1 annexation, Mr. Schussler expressed the view that future annexations will stop, while demands for City services increase. Mr. Schussler ' urged the Council to give adequate consideration to the objections and recommendations in his letter. Mr'. Dick Smith, Attorney representing the Terrace Heights Sewer District, reported that the districthas been working on a new sewer system and that all further-Ccimections have been cut down until the proposed study is completed. He noted that the study will include some land use recommendations as they relate to sewerage. He reviewed 1 the cost breakdown for the project, to include 90 percent funding by federal and state funds and the remaining 10 percent to be Ipaid by the City of Yakima, Yakima County, Union Gap and Terrace I Heights. Mr. Allen Bushley, Project Manager, noted that the ' Study will follow the guidelines established by the Environmental Protection Agency. He reported that the Study will include provisions for a Technical Advisory Committee and that the Study will provide alternatives for sewerage system layouts as well • as proposed financing. Mr. Russ Taylor, Department of Ecology, 1 emphasized that the infiltration inflow study must be completed during the irrigation season and urged the City to proceed with the project. After due discussion, it was MOVED by Brown, seconded by Edmondson that Resolution No. D-3160, authorizing the execution of this agreement with R. W. Beck & Associates for a Wastewater 27 JULY 29, 1974 ! Facilities Plan, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. It was then MOVED by Rich, seconded by Edmondson that the Council endorse the concepts for future regional planning contained in the letter from Councilman Schussler: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. RESOLUTION NO. D-3160, A RESOLUTION authorizing and directing the Director of Public Works of the City of Yakima to execute an agreement with R. W. Beck & Associates to prepare a Wastewater Facilities Plan. It was MOVED by Moore, seconded by Whitaker that Resolution No. D-3161 , authorizing the purchase of materials for emergency repair of the Rudkin Road Sewage Lift Station, without calling for bids, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. RESOLUTION NO. D-3161, A RESOLUTION declaring an emergency and authorizing and ratifying the purchase of materials without calling for bids. It was MOVED by Brown, seconded by Schussler that Resolution No. D-3162, authorizing the payment of $4.15 to Mrs. Albert Owens, for loss of garbage bags, be passed: carried, Broad, Brown, Edmondson, Moore, Rich,Schussler and Whitaker voting aye on roll call. RESOLUTION NO. D-3162, A RESOLUTION authorizing the payment of $4.15 to Mrs. Albert R. Owens in settlement of a Damage Claim. It was MOVED by Brown, seconded by Schussler that Resolution No. D-3163, authorizing the payment of $25.40 to Alan Bischoff, for damages in connection with an accident while on duty as a Yakima'Police Officer, be passed: carried, Broad, Brown, Edmondson Moore, Rich, Schussler and Whitaker voting aye on roll call. RESOLUTION NO. D-3163, A RESOLUTION authorizing payment of a claim for damages filed with the City by Alan Bischoff. A report having been received from the City Engineer on completion of L.I.D. NO. 995, 44th Avenue and Others Paving District, it was MOVED by Schussler, seconded by Brown that August 26, 1974, be the time fixed for Hearing on the Assessment Roll: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. An Ordinance appropriating $28,170 within the Street Fund for emergency street repair due to flood damage, having been read by title only at the previous meeting and being again read by title only at this meeting, it was MOVED by Schussler, seconded by Edmondson that Ordinance No. 1688, providing for said approp- riation, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1688, AN ORDINANCE appropriating the amount of $28,170 from anticipated unappropriated money in 141-Street Fund to Account 141.541.33.65 as a 1974 appropriation for 141- Street Fund. An Ordinance transferring and appropriating $1,500 for purposes of constructing a model of the City's Central Business District, having been read by title only at this meeting, was laid on the table for one week or until August 5, 1974. City Manager McMicken explained that this model will be used for information and study as the City progresses in downtown improvements. The funding will come from parking meter revenues which have been set aside for downtown renewal. 128 JULY 29-,- 1974 - - An Ordinance transferring and appropriating the amount of $ to pay for a State Audit and miscellaneous payments to the Yakima !Visitor's and Convention Bureau, having been read by title only at this meeting, was laid on the table for one week or until August ' 15, 1974. City Manager McMicken explained that the amount of $4,000 included in this appropriation will cover a two year State audit, ' when only one year was included in the 1974 budget. A Damage Claim having been filed with the City Clerk on July 23, 1974 by Gilbert D. Miley, 1402 Cornell Avenue, in the amount of i $ ! 5.00 for damages from a City sewer blockage, it was MOVED by Schussler, seconded by Moore that said damage claim be referred to the City Manager and staff for study and recommendation: carried ;Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting 1 aye by voice vote.
