JULY 8, 1974
The City Council met in session on this date at 1:30 P.M. in the
Conference Room at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad, Wray Brown,
Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich, and Don
Schussler.
It was MOVED by Brown, seconded by Edmondson that the Council go
into Executive Session for consideration of 1975 Union Negotiations:-
carried, Broad, Brown, Edmondson, Moore, Rich and Schussler voting
aye by voice vote. Whitaker absent.
Councilman Rich inquired about establishing a Park Patrol during
the summer months to control vandalism in the parks. City Manager
McMicken indicated that the Staff would look into this matter and
report back to the Council.
At 3:00 P.M., the Council members moved into the Council
Chambers for the balance of the meeting, Mayor Broad presiding,
Councilmen Brown, Edmondson, Moore, Rich and Schussler, City
Manager McMicken and City Attorney Andrews present on roll
call. Councilman Whitaker absent on roll call, having been
excused at a previous meeting.
The Invocation was given by Councilman Moore.
The minutes of the previous adjourned regular meeting of June
28, 1974, and the regular meeting of July 1, 1974, having
been duly certified accurate by two Councilmen, and no one
present wishing to have said minutes read publicly, Mayor
Broad declared said minutes approved as recorded.
City Manager McMicken referred to the APCOA contract proposal
for the Air Terminal Parking Lot Operation, noting the action
taken at the Council meeting of June 3, 1974, to proceed with
a five-year contract with APCOA. He indicated that the contract
is in the process of being negotiated, and cited three paragraphs
in particular to be negotiated which are found in the APCOA
proposal. Mr. McMicken further indicated that a sense of
direction would be in order on these particular items. He
referred to paragraph 2.0, Term of Agreement, as found in
the APCOA proposal and referred to the proposed option by
APCOA to renew or extend that agreement after the 5-year period.
He suggested that the contract should provide for the five-year
period, exclusive of the proposed option. In reference to
Paragraph 9.0, Suspension - Abatement of Compensation, City
Manager McMicken indicated that abatements are not found in
the other airport contracts, but noted no specific objections
to that provision. Referring to Paragraph 17,.Restaurant
Validation, Mr. McMicken suggested that the contract reflect
the agreement by APCOA to establish and recognize a validation
program between the restaurant operator and the City, excluding
the provisions further mentioned in that paragraph. Mr. Morris
Shore, Attorney representing APCOA, asked that this firm maintain
the right to discuss, review and possibly negotiate for a
new term after a period of five years. Mr. Cecil Beauchamp,
being present, referred to the City's original proposal for
a 50/50 split on the restaurant validation up to six hours.
He asked for a 90-day trial basis. Mr. Shore referred to
new language in the proposal prepared on this date and distributed
copies to the Councilmen at this time. It was the consensus of
the Council members that the City Manager further negotiate the
items in question in accordance with suggestions discussed at this
meeting.
Referring to the proposed agreement with Taggares Helicopter, Inc.,
City Manager McMicken noted that this concerns the lease of the
Baxter Building at the Yakima Air Terminal. City Attorney
Andrews explained the provisions of the Lease Agreement, indicating
a term of five years and a two year option by the lessee after
that term is completed. After that time it would be on a
year-to-year basis. The rental for five years is $400 per

month with the option to buy by the lessee. He noted that
the lessee intends to make several improvements to the property.
He further reviewed. the, conditions of future relocation subject
to new rental rates, as. provided for in the Lease. Mr. Andrews
suggested that the Resolution be amended to provide for reference. to
a supplemental agreement and effectiveness contingent upon FAA
certification. Also present and .speaking to this matter was
Mr. Richard Greiner. It was MOVED by Schussler, seconded by
Brown that this amendment. be included: carried, Broad, Brown,
Edmondson, Moore, Rich and Schussler voting aye by voice vote,
Whitaker absent. It was then MOVED by Schussler, seconded by
Brown that Resolution No. D-3152, providing for the execution
of said agreement with, Taggares Helicopters, Inc., be passed:
carried, Broad, Brown, Edmondson, Moore, Rich and Schussler voting
aye on roll call. Whitaker absent.
RESOLUTION NO. D-3152, A RESOLUTION authorizing the City Manager
and City Clerk of the City of Yakima to execute an agreement with
Taggares Helicopters, Inc., for the lease of property at the Yakima
Air Terminal.
Mr. Dick Bishop, president of Transportation, Planning and Engineering,
Inc., being present, spoke to the Council,regarding the Revised
Traffic Code, which has been drawn up in an effort to conform -
the City's Traffic Code with State laws and the R.C.W. He stated
that 150 copies will be published with an index, citing August
14, 1974, as the completion date. He reported on the several
reviews made by the Technical Advisory Committee, recommending
that the revised code be approved for legislation which would
repeal and replace Title 9 of the City's code. He noted specific
additions and changes found in the code appropriate for compliance
with State law. After due discussion, it was the consensus of
the Council that the copy of this revised traffic code be circulated:
among Council members for review and that legislation be brought
on at a later date.
City Manager McMicken discussed the need for a new Fire Training
Center; location, noting that the present one in Fire Station
No. 2 is nOt for the new equipment. Reviewing the Fire
Bond Issue Financial Statements, dated July 3, 1974,, Mr. McMicken
noted the net balance available of $58,359.80, and an estimated
training center cost of $100,000, leaving needed funding in the
amount of $41,640.20;. He,referred to the ten acres located on
10th Street which had been considered as a possible training •
•
site. He noted the City's assets in the old Fire Station No.
1 building and the ten acres on 10th Street, suggesting that the
balance be funded through FRS monies. Fire Chief, Matt Young,"
being present, reported that since construction costs continued
to rise the center should be built soon and explained that the
present training tower at Fire Station No. 2 is crowded and presents
a noise problem to the surrounding neighborhood. Fire Station
No. 5 is being considered as a good location for the center.
Councilmen Broad and Brown suggested that other funding sources
be investigated before the use of FRS funds. Councilman Edmondson
spoke in favor of FRS use of monies and Councilman Schussler
opposed the use of these,monies for this purpose. After due
discussion, it was the consensus of the Council that this matter
go back to the Manager for further study and recommendation.
City Manager McMicken referred to the memo dated July 5, 1974,
from Traffic Engineer, Bill Stark, regarding the proposed installation
of school crossing flashing lights. With a surplus of 1/2 cent
gas tax funds ,available, the report recommends that the flashing
lights be installed at those locations listed in the memo. Mr.
McMicken recommended that specifications be drawn and bids be
called for. It was the consensus of the Council that bids be
called for and that formal,action be brought back for the letting
1 of contracts on this project.
A report having been received from the City Engineer on the com-
! pletion of work and recommendation that the work be accepted
and final payment made on the Yakima Air Terminal Parking Lot

Project, it was MOVED by Schussler, seconded by Edmondson, that
the report of the City Engineer dated July 1, 1974, with respect
to the completion of the work on public works contract Air Terminal
Parking Lot Project, be approved, the work be accepted and payment
of the final estimate as therein set forth is hereby authorized:
carried, Broad, Brown, Edmondson, Moore, Rich and Schussler voting
aye by voice vote. Whitaker absent.
The City Treasurer having submitted the Investment Report for
the month of June 1974, it was MOVED by Schussler, seconded by
Edmondson that the Report of the City Treasurer dated June 30,
1974, regarding the investments of the City of Yakima, be accepted
and approved: carried, Broad, Brown, Edmondson, Moore, Rich
and Schussler voting aye by voice vote. Whitaker absent.
Referring to the proposed lease with Wagner Chevrolet for space
adjacent to the old Fire Station No. 1 building, City Manager
McMicken recommended that the 48 feet immediately south of the
fence be leased to Wagner Chevrolet, and that the old portion
of the building be torn down. Wagner Chevrolet will relocate
the fence and should the City terminate the lease the fence will
be replaced. He noted that the existing concrete floor would
be left in place. It was MOVED by Brown, seconded by Edmondson
that this recommendation by the City Manager be accepted: carried,
Broad, Brown, Edmondson, Moore, Rich and Schussler voting aye
by voice vote. Whitaker absent.
It was MOVED by Schussler, seconded by Brown that Ordinance No.
1681, amending the City's compensation plan and establishing
the pay for the position of Personnel Officer, be passed: Broad,
Brown, Edmondson, Moore, Rich and Schussler voting aye on roll
call. Whitaker absent.
ORDINANCE NO. 1681, AN ORDINANCE relating to City personnel;
adopting a classification and compensation plan for certain City
employees; amending Subsection 2.20.100 (a) of the City of
Yakima Municipal Code; and declaring an emergency.
A report having been received from the Planning Commission
on the Rezone Application filed by Noel Investment Company,
requesting rezone of property at 1008 South 3rd Avenue, it
was MOVED by Schussler, seconded by Rich that July 22, 1974,
be the date set for Hearing on this matter: carried, Broad,
Brown, Edmondson, Moore, Rich and Schussler voting aye by
voice vote. Whitaker absent.
A report having been received from the Planning Commission
on the Rezone Application filed by Yakima Federal Savings
and Loan Association, requesting the rezone of property
at 3906 Tieton Drive, it was MOVED by Schussler, seconded
by Brown that July 22, 1974 be the date set for Hearing
on this matter: carried, Broad, Brown, Edmondson, Moore,
Rich and Schussler voting aye by voice vote. Whitaker absent.
Petition No. 814, having been filed with the City Clerk
on May 22, 1974, by A. R. Webb and others, requesting vacation
of a portion of Stanley Boulevard, it was MOVED by Rich,
seconded by Schussler that Resolution No. D-3153, fixing
July 29, 1974, as the date for Hearing on this matter, be
passed: carried, Broad, Brown, Edmondson, Moore, Rich and
Schussler voting aye on roll call. Whitaker absent.
RESOLUTION NO. D-3153, A RESOLUTION fixing the time and
place for Hearing on a petition for vacation of a portion
of Stanley Boulevard within the City of Yakima.
A Damage Claim having been filed with the City Clerk on
July 2, 1974, by George E. Aldous, 914 South 35th Avenue,
in the amount of $15.00, for damages in connection with

the loss of three garbage cans, it was MOVED by Schussler,
seconded by Rich that said Damage Claim be referred to the
City Manager and staff for study and recommendation: carried,
Broad, Brown, Edmondson, Moore, Rich and Schussler voting
aye by voice vote. Whitaker absent.
Councilman Brown requesting permission to be excused from
the meeting of July 15, 1974, it was MOVED by Schussler,
seconded by Moore that Councilman Brown be excused on that
date: carried, Broad, Brown, Edmondson, Moore, Rich and
Schussler voting aye by voice vote. Whitaker absent.
There being no further business to come before the Council,
it was MOVED by Moore, seconded by Rich that this meeting
be adjourned at 5:30 P.M. to Friday, July 12, 1974, at the
hour of 12:00 Noon, to then meet in the Flight Deck Restaurant:

ADJOURNED REGULAR MEETING - FRIDAY, JULY 12, 1974
The City Council met in session at 12:00 Noon on this date in the
Flight Deck Restaurant at the Yakima Air Terminal.
Councilmen present at the meeting were Mayor Bert Broad, Wray Brown,
Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich and Don
Schussler. Councilman Whitaker absent.
The Council held general discussion on various city matters. No
formal action was taken.
There being no further business to come before the Council, it was
MOVED by Moore, seconded by Rich that we do now adjourn at the hour!
of 1:30 P.M.: carried, Broad, Brown, Edmondson, Moore, Rich and
Schussler voting aye by voice vote. Whitaker absent.
