The City Council met in session at 1:30 P.M. on this date in the
Conference Room at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad, Wray Brown,
Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich and Don Schuss-
ler.
City Manager McMicken commented briefly on the Park & Recreation Munici-
pal Budget Survey, noting that Yakima ranks third in lowest per capita
park expenditures and first in per capita development budget. Yakima
maintains the third lowest participation costs for 1973 and ranks
sixth in per capita expenditures for recreation. The data collected
in this report will be reviewed once again with the Council in the
work program reviews.
Referring to the budget, City Manager McMicken noted that for 1975,
the staff was proposing a new budget format that would incorporate Fore-
cast objectives into a streamlined budget document. The new format
would combine ongoing functions, objectives (Forecast '75), proposed
1975 budget in summary format and comparisons with 1973 expenditures
and 1974 budget levels. Councilman Don Schussler agreed with the
proposed format, but also recommended that a recap be made either
separate from or within the format to show the percentage change of
1975 proposed expenditures from 1974 and reasons for the difference.
The Council reviewed the Council Analysis of Service Levels and
Cost/ Benefit of Forecast '74 programs covered at Hidden Valley.
In reference to Animal Control, the Council was advised that the
Administrative Assistant will pursue with the Humane Society an
estimate of the expenses involved in building a new shelter.
In reference to housing, the City Manager commented that there may
be a lease subsidy sponsored by the Yakima Housing Authority whereby
substandard houses could be refurbished to minimum code with the
corresponding increase to pay for the improvements being absorbed
by the public agency. Councilman Edmondson inquired as to whether
or not the City was getting its money's worth in the entire Housing
Program. City Manager McMicken mentioned that the Housing Program
was in a transition stage and progress was difficult to analyze.
The Housing Code itself is under question; new federal programs
'support is planned for the first of 1975. City Manager McMicken
reiterated his previous recommendation that the City should wait
for federal action and funding to support housing efforts, rather than
embarking on an ambitious local program. Further comments and recommen-
dations affecting the Housing Program may be forthcoming from the
Housing Code Task Force.
The Council again considered the Management Compensation Outline Pro-
posal. Director of Management and Budget, Bob Hilsmann, mentioned
that Spokane has implemented a management benefits program in an
effort to avert the possibility of a management union. City Manager
McMicken mentioned that the outline program had been reviewed in
respective group meetings with mixed reaction from managers. Councilmen
Brown and Edmondson evidenced support for the proposal; Councilman
Schussler was in disagreement and remarked that he felt that the
, proposal was not a completely objective scheme.
At 3:00 P.M., the Council members moved into the Council Chambers
for the balance of the meeting, Mayor Broad presiding, Councilmen
Brown, Edmondson, Moore, Rich and Schussler, City Manager McMicken
and City Attorney Andrews present on roll call. Councilman Whitaker
having requested permission to be excused from this meeting, it
was MOVED by Brown, seconded by Schussler that Councilman Whitaker
be excused from this meeting: carried, Broad, Brown, Edmondson,
Moore, Rich and Schussler voting aye by voice vote.
The Invocation was given by City Attorney Andrews.

The minutes of the previous regular meeting of June 3, 1974,
having been duly certified accurate by two Councilmen, and no
one present wishing to have said minutes read publicly, Mayor
Broad declared said minutes approved as recorded.
This being the time set for the Hearing on Petition No. 810,
filed by City of Yakima and School District No. 7, requesting
vacation of portions of West Spruce Street, Assistant Planner
Glenn Rice, reviewed the Planning Staff Report on this subject
dated April 8, 1974. He noted that this request is for those
portions of West Spruce Street north of Lions Park between South
5th Avenue and vacated South 6th Avenue for purposes of expanding
and remodeling Lions Park. He further noted that this request
I/ has been submitted to affected City departments and no opposition
was received. Mr. Rice reported that the Planning Staff recommends
approval of this request subject to the following conditions:
1. All existing utility easements for the placement or main-
tenance of existing facilities either be maintained or moved
in accordance with City requirements and under the City Eng-
ineer's supervision.
2. No permanent structures be constructed or located in such a
manner within the vacated street right-of-way as to eliminate
or severely restrict the movement of public safety vehicles
into the adjacent building area.
City Attorney Andrews noted that the appropriate language for
maintaining the utility easementsneeds to be included in the
Ordinance providing for this vacation. It was MOVED by Schussler,
seconded by Moore that this Hearing be continued for one week, or
until June 17, 1974: carried, Broad, Brown, Edmondson, Moore,
Rich and Schussler voting aye by voice vote. Whitaker absent.
Mr. Dick Anderwald, Yakima County Planning Department, gave
a presentation on the proposed Yakima County Shoreline Master
Program. Included was a slide presentation which outlined the
steps involved in the development of the master program and
explained the types of shoreline environments included in the
proposed program. Following the slide presentation, Mr. Anderwald
reviewed the contents of the proposal as contained in the report
on this subject submitted for the Council's consideration dated
June, 1974. He reviewed the types of environments specified
for Yakima County shorelines and covered the steps completed in
the development of the program. He further reviewed the goals
of the program for Yakima County Shorelines, as outlined in
the report, including policy statements,shore line designations
and citizen participation in public hearings. He explained the
procedure for submitting this proposed Master Program for Yakima
County to the Department of Ecology by June 20 for review and
approval. After due discussion, it was MOVED by Schussler,
seconded by Brown that the City Manager be authorized to advise
the Department of Ecology that the City gives tentative approval
of the Yakima County Shoreline Master Program: carried, Broad,
Brown, Edmondson, Moore, Rich and Schussler voting aye by voice
vote. Whitaker absent. It was then MOVED by Schussler, seconded
by Edmondson that Dick Hill be named as the Local Administrator
of the Shoreline Management Act: carried, Broad, Brown, Edmondson,
Moore, Rich and Schussler voting aye by voice vote. Whitaker
absent.
Mr. John Kassebaum, Rt. 1, Box 1045, Moxee, being present, spoke
to the Council concerning a parking ticket received after placing
money in a defective meter which did not register the money correctly
and asked questions concerning the method to be followed in
reporting defective meters. Mr. Kassebaum was advised that
the City Manager will look into this matter and report back
to him.
City Manager McMicken referred the bid review for constructing
the new City Shops to Director of Public Works, Dave Vagas,
who presented a revised bid summary. The bid submitted by R.

C. Hedreen, Seattle, is in the amount of $1,989,000.80, which includes
those items noted on the bid summary. Mr. Vargas reported that
approximately $200,000 has been cut from the 1.98 million project,leav-
ing $200,000 for the City to finance toward the total project.
The City has negotiated with Hedreen, the low bidder, on a number
of items listed on the separate sheet outlining recommended deletions
for the City Shop Project. He noted that those items listed as
deletions from the basic bid total $106,365, the deletion of the
overhead crane totals $18,400 and other deletions, as listed, total
$64,318, making a grand total for deletions of $189,000.80. Mr.
Vargas further reported that the City proposes to receive $125,000
to help fund the project by selling the old shop site to the Transit
Division plus $75,000 to come from the Water -Sewer Fund. City Manager
McMicken covered a breakdown in the alternative sources of funding.
Architect Bob Dawley, being present, noted that the items suggested

for deletion are those that can go in at a future date. He indicated
that several sub - contractors are involved in the project and that
there is a time limit in connection with the pre -bid on the steel
building. It was MOVED by Moore, seconded by Edmondson that the
basic bid be awarded to R. C. Hedreen of Seattle: carried, Broad,
Brown, Edmondson, Moore, Rich and Schussler voting aye by voice
vote. Whitaker absent.
Refuse Superintendent, Glen Koelling, being present, gave a status
report on the newly implemented SHU -PAK Refuse Collection System,
which was put into effect on April 15, 1974. Mr. Koelling indicated
that the results of the new system have been good and has provided
for greater truck compaction, less trips to the landfill, savings
on repairs and maintenance and has resulted in the collection of
more refuse in less hours than under the old system.
City Manager McMicken referred to a letter received from N. G.. Jacobson
and Associates, outlining proposed revisions to the Downtown Redevelopment
Plan. These revisions include application for a E.D.A. grant,
revision of the L.I.D. assessments, an assessment
program for businesses, an estimate of operating revenues and expendi-
tures on parking meters and assistance with application for federal
funds. After due discussion, it was MOVED by Brown, seconded by
Rich that the City Manager be authorized to re- engage N. G. Jacobson
and Associates to make revised financial plans and assessment schedules
in connection with Downtown Redevelopment: carried, Broad, Brown,
Edmondson, Moore, Rich and Schussler voting aye by voice vote.
Whitaker absent.
It was MOVED by Schussler, seconded by Moore that Resolution No.
D -3141, authorizing payment of a damage claim in the amount of $63.53
to Yakima Tennis Club for reimbursement of a water billing, be passed:
carried, Broad, Brown, Edmondson, Moore, Rich and Schussler voting
aye on roll call. Whitaker absent.
RESOLUTION NO. D -3141, A RESOLUTION authorizing payment of $63.53
to Yakima Tennis Club in settlement of a claim for damages filed
against the City of Yakima.
It was MOVED by Brown, seconded by Schussler that Resolution No.

D -3142, authorizing payment of a damage claim in the amount of $47.63
to Harry B. Wilson for damages arising from a City sewer backup,
be passed: carried, Broad, Brown, Edmondson, Moore, Rich and Schussler
voting aye on roll call. Whitaker absent.
RESOLUTION NO. D -3142, A RESOLUTION authorizing payment of $47.63
to Harry B. Wilson in settlement of a claim for damages filed with
the City of Yakima.
City Manager McMicken referred to the Outside Utility request for
water service to the residence owned by Mr. Benton Dover along Peck's
Canyon Road. A water connection is available for an estimated con-
nection charge of $567.72 and Mr. Dover has expressed a willingness
to annex when feasible. It was MOVED by Schussler, seconded by
Edmondson that the request for outside water service to the Benton
Dover residence, be granted: carried, Broad, Brown, Edmondson,
Moore, Rich and Schussler voting aye by voice vote. Whitaker absent:

A report having been received from the City Engineer on the
completion of work and recommendation that the work be accepted
and final payment be made on the following:
a. Randall Park Pump Installation;
b. 1974 Water and Sewer Improvements, Schedule I;
c. L.I.D. No. 995, 44th Avenue and Others Street Improvement,
it was MOVED by Schussler, seconded by Brown that the reports
of the City Engineer dated June 3 and June 5, 1974, with respect
to the completion of work on Public Works contracts Randall
Park Pump Installation, 1974 Water and Sewer Improvements, Schedule
I, and L.I.D. No. 995, 44th Avenue and Others Pavings Improvement
District, be approved, the work be accepted and payment of the
final estimates as therein set forth is hereby authorized:
carried, Broad, Brown, Edmondson, Moore, Rich and Schussler
voting aye by voice vote. Whitaker absent.
The City Treasurer having submitted the Investment Report for
the month of May, 1974, it was MOVED by Schussler, seconded
by Edmondson that the Report of the City Treasurer dated May
31, 1974, regarding the investments of the City of Yakima, be
accepted and approved: carried, Broad, Brown, Edmondson, Moore,
Rich and Schussler voting aye by voice vote. Whitaker absent.
An Ordinance transferring $10,000 from the Federal Shared Revenue
Fund to the General Fund and appropriating $10,169 within the
General Fund to buy animal cages for impoundment of animals
at the Humane Shelter, having been read by title only at the
previous meeting and being again read by title only at this
meeting, it was MOVED by Schussler, seconded by Brown that Ordinance
No. 1669, providing for said transfer and appropriation, be
passed: carried, Broad, Brown, Edmondson, Moore, Rich and Schussler
voting aye on roll call. Whitaker absent.
ORDINANCE NO. 1669, AN ORDINANCE transferring the amount of
$10,000 from 199-Federal Shared Revenue Funds to 000-General
Fund; appropriating the amount of $10,169 from unappropriated
money in 000-General Fund to Account 011.539.30.64 therein as
a 1974 appropriation for 000-General Fund.
An Ordinance transferring and appropriating $25,000 to provide
a grant to School District No. 7 for financial support to KYVE-
TV, having been read by title only at this meeting, was laid
on the table for one week or until June 17, 1974. City Manager
McMicken referred to the two attached letters dated May 30,
1974, containing a breakdown of past and pending equipment purchases
to be made with this grant.
An Ordinance appropriating $13,000 within the Trolley Fund for
the acquisition of trolley cars from the City Bicentenial and
other sources, having been read by title only at this meeting,
was laid on the table for one week or until June 17, 1974.
It was MOVED by Schussler, seconded by Edmondson that Ordinance
No. 1670, deleting a portion of Madera Way from L.I.D. No. 995,
44th Avenue and Others Street Improvement, be passed: carried,
Broad, Brown, Edmondson, Moore, Rich and Schussler voting aye
on roll call. Whitaker absent. City Attorney Andrews indicated
that this is a formality in closing this L.I.D., since the property
owners requested that this portion be done under some other
contract, but it was not deleted from the original district.
ORDINANCE NO. 1670, AN ORDINANCE amending Section 1 of City of
Yakima Ordinance No. 1566, enacted September 17, 1973, entitled
"AN ORDINANCE providing for the improvement of certain streets
by grading, ballasting, surfacing with asphaltic concrete and
constructing concrete curbs and gutters, together with the
necessary drainage features; establishing a Local Improvement
District, providing for the method of payment thereof, and

creating a special fund"; and declaring an emergency.
It was MOVED by Rich, seconded by Brown that Ordinance No. 1671, amend-
ing the Housing Code to repeal certain provisions relating to inspections
and certificates of occupancy, be passed: carried, Broad, Brown, Moore
and Rich voting aye on roll call; Edmondson and Schussler voting nay on
roll call. Whitaker absent. Councilmen Edmondson and Schussler ex-
pressed a desire to retain the certificate of occupancy system for
rental property. Mayor Broad explained that his vote in favor is
based on the recommendation of the Housing Code Task Force, which is
to devise a workable program.
ORDINANCE NO. 1671, AN ORDINANCE relating to building regulations;
requiring building permits for certain work performed on building and
structures and requiring payment of building permit fees; requiring
inspections of buildings and structures and certain work performed there-
on; amending Sections 11.20.020, 11.20.030 and 11.20.040 of the City
of Yakima Municipal Code.
It was MOVED by Schussler, seconded by Edmondson that Ordinance
No. 1672, requiring right-of-way permits for private use of public
right-of-way, be passed: carried, Broad, Edmondson, Moore, Rich
and Schussler voting aye on roll call; Brown temporarily absent.
Whitaker absent. It was explained that those now holding such permits
will not have to make application and pay fees until those now in
effect expire.
ORDINANCE No. 1672, AN ORDINANCE relating to street and sidewalks;
prohibiting the use of public right-of-way for private purposes
without obtaining a permit therefor; providing for the application,
'issuance and revocation of such permit; providing a penalty for
violation; and enacting Chapter 8.20, "Right-of-Way Use Permits",
as a new chapter of the City of Yakima Municipal Code.
A report having been received from the Planning Commission on amending
the Zoning Code to add the M-4 Classification, Planned Industrial
Zone, it was MOVED by Schussler, seconded by Edmondson that June
24, 1974, be the date set for Hearing on this matter: carried,
Broad, Brown, Edmondson, Moore, Rich and Schussler voting aye by
voice vote. Whitaker absent.
'Petition No. 816, having been filed with the City Clerk on June
5, 1974, by Gene Souder and others, requesting improvement of property
by the construction of curbs, gutters and surfacing of a portion
of North 56th Avenue from Scenic Drive to approximately 540 feet
south, it was MOVED by Schussler, seconded by Edmondson that Petition
No. 816, for the creation of a Local Improvement District be referred
to the City Manager and Staff for study and recommendation: carried,
Broad, Brown, Edmondson, Moore, Rich and Schussler voting aye by
voice vote. Whitaker absent.
Damage Claims having been filed by Mrs. Albert Owens, 620 South
23rd Avenue in the amount of $4.15 for loss of refuse bags and by
Jack McEntire, 4401 W. Chestnut in the amount of $325 for damages
to his property in connection with work being done by a contractor
hired by the City, it was MOVED by Schussler, seconded by Edmondson
that said Damage Claims be referred to the City Manager and staff
for study and recommendation: carried, Broad, Brown, Edmondson,
Moore, Rich and Schussler voting aye by voice vote. Whitaker absent.
City Manager McMicken requested authorization to designate Jack
Larson as the City's official representative to the A.W.C. Conven-
tion in Seattle to report on Sister City activities at the Sister
City Workshop, June 11-14, 1974. His travel expense and fees amount
to $145. It was MOVED by Schussler, seconded by Brown that the
travel be approved and expenses paid: carried, Broad, Brown, Edmondson,
Moore, Rich and Schussler voting aye by voice vote. Whitaker absent.

City Manager McMicken requesting authorization for out-of-state
travel for Mayor Broad to travel to San Diego, California to attend
the U.S. Conference of Mayors Convention, June 22-26, 1974, it
was MOVED by Brown, seconded by Edmondson that said travel be approve
and expenses paid: carried, Broad, Brown, Edmondson, Moore, Rich
and Schussler voting aye by voice vote. Whitaker absent.
There being no further business to come before the Council, it
was MOVED by Moore, seconded by Rich that we do now adjourn at
the hour of 5:30 P.M.: carried, Broad, Brown, Edmondson, Moore,
Rich and Schussler voting aye by voice vote. Whitaker absent.
