June 3, 1974
The City Council met in session on this date at 1:30 P.M. in
the Conference Room at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad, Wray
,Brown, Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich,
1Don Schussler and Bill Whitaker.
It was MOVED by Whitaker, seconded by Schussler that the Armored
Tank in Elks Park be removed: Schussler and Whitaker voting
, aye by voice vote; Broad, Brown, Edmondson, Moore and Rich voting
Inay by voice vote. Motion failed for want of a majority vote.
The Council requested that the City Manager report back the
'circumstances by which the tank was located in the park.
1 Mr, Tom Bostic appeared on behalf of the Housing Code Task Force
to support his letter of May 31, 1974. It was MOVED by Brown,
;seconded by Rich that legislation be prepared to repeal Sections
1 11.20.020 (b) , 11.20.030 (b) , and 11.20.040 (b) and (c) of the
!City of Yakima Municipal Code: carried, Broad, Brown, Moore,
;Rich and Whitaker voting aye by voice vote; Edmondson voting
inay by voice vote. Schussler abstaining. Mayor Broad explained
his vote in favor is due to the advice that the Task Force will
continue to work on the housing question and bring a final report
and recommendation to the Council no later than July 1, 1974.
At 3:00 P.M., the Council members moved into the Council Chambers

for the balance of the meeting, Mayor Broad presiding, Councilmen
!Brown, Edmondson, Moore, Rich, Schussler and Whitaker, City
Manager McMicken and City Attorney Andrews present on roll
'call.
The Invocation was given by Mayor Broad.
The minutes of the previous adjourned regular meeting of May
117 and May 24, 1974 and the regular meeting of May 27, 1974,
lhaving been duly certified accurate by two Councilmen, and
no one present wishing to have said minutes read publicly, Mayor
1Broad declared said minutes approved as recorded.
This being the time set for the Hearing on an amendment to the
Planned Development located in the vicinity of the Englewood
!Avenue Reservoir, filed by Mr. Walter G. Meyer, Jr., Yakima
Tennis Club, Principal Planner, Dick Hill, reviewed the objection
raised by Mrs. Barnsley, the owner of the single-family residence
ladjacent to this development. This objection is in reference
to the proposed access drive which is requested to be placed
at least 20 feet from her front door; Attorney James Lust,
representing the Barnsleys, restated their position in objecting
to a Planned Development Zone for this property. He indicated
that this area was previously residential and that the Barnsleys
raise no objection to a residential zone, but do object to
the traffic and noise which will be created by the type of activity
going into this Tennis Club development. He further noted
that the tennis courts will be located behind the Barnsley's
property with the access drive adjacent to their property and they
:feel that this location will hurt the value of their property.

Mr. Lust requested that the proposed development be denied
and that this area be continued as residential property. Mr.
Walter Meyer,yakima Tennis Club, noted that this request is
, 1 an amendment to an already existing Planned Development Zone.
The amendment moves the access road to provide entrance from
the north instead of the west. He further indicated that the
' Tennis Club has agreed to the stipulation that the access
road on the northern portion of the development be maintained at
least 20 feet from Mrs. Barnsley's residence. Mr. Meyer indicated
that the Tennis Club has an Offer to Purchase on this property.
He noted that there are plans for paving the already existing
'access road. Mr. Lust indicated that it is likely that traffic
will be entering and exiting from the development every hour.
I Dick Hill reported that there is adequate room to provide the
I driveway at the stipulated 20 feet. After due discussion, it

was MOVED by Schussler, seconded by Whitaker that Ordinance
No. 1667, granting modifications to this Planned Development
Zone, be passed: carried, Broad, Brown, Moore, Schussler
and Whitaker voting aye on roll call; Edmondson and Rich
voting nay on roll call. Also present and speaking to this
matter was Mr. Ron Barnsley.
ORDINANCE NO. 1667, An Ordinance granting modifications
to a Planned Development Zone for certain property situated
between North 40th Avenue and existing Yakima Tennis Club
facilities.
At this time, students from McClure School presented the
Council with two Proclamations in recognition of the City's
Bicentennial Celebration and purchase of two trolly cars. Also
presented to Councilman Wray Brown were a picture of early
trolly cars in Yakima and a trolly car mobile.
This being the time set for the Hearing on Petition No. 811,
filed by Samuel A. and Betty A. Gridley, requesting annexation
of property located on the west side of 24th Avenue, between
Nob Hill and Washington, Assistant Planner, Glenn Rice,
reviewed the Staff Report on this request dated May 16, 1974.
He indicated that this request involves approximately 9.5
acres along 24th Avenue and reported that the Gridleys desire
annexation in order to obtain the full range of City services.
Mr. Rice indicated that this request is in conformance with both
the Yakima County Comprehensive Plan and Yakima City General
Plan. He noted that the Planning Commission has heard this
request and recommends approval for annexation and an R-1,
Single Family Residential Zone for the following reasons:
1. The desire of the property owners to annex to the
City of Yakima.
2. The logical service area represented by this proposal.
3. The recommendation of the Yakima County Water and
Sewer Study, the Yakima County Comprehensive Plan, and
the Yakima City General Plan.
4. The need for and availability of the full range of
urban services afforded by annexation.
5. The position of the Yakima County Boundary Review Board
concerning this request.
6. The recommendation of the Yakima City Planning Commission
for annexation of this area and R-1 zoning.
It was MOVED by Schussler, seconded by Edmondson that Ordinance
No. 1668, annexing this property to the City, be passed:
carried, Broad, Brown, Edmondson, Moore, Rich, Schussler
and Whitaker voting aye on roll call.
ORDINANCE NO. 1668, An Ordinance annexing property to the
City of Yakima, and zoning said property.
City Manager McMicken reviewed City Manager Report No. 219
concerning Yakima Air Terminal-Land Acquisition Program
and recommended authorization for the following three contracts
in reference to the Airport Land Acquisition Program:
It was MOVED by Brown, seconded by Whitaker that Resolution
No. D-3137, authorizing the engagement of professional appraisal
services from the firm of Butler and Walls, be passed:
carried, Broad, Brown, Edmondson, Moore, Rich, Schussler
and Whitaker voting aye on roll call.
RESOLUTION NO. D-3137, A Resolution authorizing the City
Manager of the City of Yakima to engage professional real
estate appraisal services of Butler and Walls in connection
with the expansion of the Yakima Air Terminal.

It was MOVED by Schussler, seconded by Whitaker that Resolution
!No. D-3138, authorizing an agreement with the Washington State
!Highway Commission for negotiations and relocation services,
be passed: carried, Broad, Brown, Edmondson, Moore, Rich,
'Schussler and Whitaker voting aye on roll call.
!RESOLUTION NO. D-3138, A Resolution authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
an agreement with the Washington State Highway Commission
for services in connection with the expansion of the Yakima
;Air Terminal.
It was MOVED by Edmondson, seconded by Schussler that Resolution
'No. D-3139, authorizing the execution of a contract with Reid,
Middleton and Associates, Inc., for professional consulting
services, be passed: carried, Broad, Brown, Edmondson, Moore,
Rich, Schussler and Whitaker voting aye on roll call.
!RESOLUTION NO. D-3139, A Resolution authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
!a contract with Reid, Middleton and Associates, Inc., for professional
services in connection with the expansion of the Yakima Air
'Terminal.
City Manager McMicken referred to his Report No. 220 concerning
!Yakima Air Terminal-Parking Management. Director of Public
!Services, Jack Daniel, reviewed his attached report dated
May 21, 1974. He reviewed the bids received on the Airport
!Parking Lot Management from both Diamond Parking and APCOA, and
proposals received from each as outlined in the report. He
reported that the APCOA bid offered either a 5 or 10 year term
at a $90,000 guarantee for a 5 year term or $245,000 guarantee
for a 10 year term. The annual guarantee is $18,000. He reviewed
the Diamond Parking bid at approximately $22,000. Mr. Daniel
!reported that a proposal was compiled/by the Airport Manager,
!Jim Eakinc City operation of the parking lot with the use
of EEA personnel as Parking Attendants. Mr. Daniel recommended
that potential revenue projections appear to be best from a
iCity-run operation. Mr. Jewell L. Doherty of APCOA, being
'present, indicated that their bid attempts to guarantee the
'highest revenue to the City and that they are not specifically
limited to a 5 or 10 year contract term. Mr'. Morrgy Shore,
!Attorney, spoke in favor of the APCOA bid. Mr. Doherty indicated
that if the contract were for one year the annual guarantee
!would drop to approximately $15,000 and that if renewed the •
1$3,000 difference would be made up. Mr. Doherty further reviewed
Ithe procedure used by APCOA for meetings with the news media
to inform the public of the new parking lot management and
i procedures. After due discussion, it was MOVED by Whitaker,
seconded by Rich that the City negotiate a 5-year contract
for Yakima Air Terminal Parking Lot Management with APCOA:
l carried, Broad, Edmondson, Moore, Rich and Whitaker voting
!aye by voice vote; Brown and Schussler voting nay by voice
'vote. Councilmen Brown and Schussler indicated a desire to
contract for one year only. Also present and speaking to
this matter were Kathlyn McGuire and Don Emerick.

!Referring to the award of bids for the construction of the
I new City Shops, Director of Public Works, Dave Vargas, reviewed
the bid summary sheet, noting a budget overun of approximately
1$389,000. He explained that the staff is not yet ready to
' make a recommendation but would like another week to study the
! bids and come back with a recommendation. It was the consensus
of the Council that this matter be continued for one week
or until June 10, 1974. Also present and speaking to this
matter was Architect Bob Dawley.

City Manager McMicken reported on the bid received for the
Demolition and Disposal of the Chieftain Hotel, from Zimmerman
Construction Company in the amount of $24,806.25. He explained
the work left to be done and suggested the placement of an
8 foot fence around the property. It was the consensus of
the Council that this matter be continued for one week or
until June 10, 1974.
City Manager McMicken reported that no bids were received
for the sale of the City's surplus Fire Station and indicated
that Wagner Chevrolet would like to work on some type of
lease agreement for this property. There was discussion
by the Council regarding the possibility of tearing down
the old office space portion of the building and leasing
the remaining space to Wagner Chevrolet. It was the consensus
of the Council that the City work with Wagner Chevrolet on
a possible lease proposal.
City Manager McMicken reported that bids were received and
considered for the purchase of animal cages at the Humane
Society Shelter and that the low bid was received from the
H. C. Burns Company in the amount of $10,181.68. It was
MOVED by Whitaker, seconded by Brown that the bid be awarded
to H. C. Burns Company in the amount of $10,181.68: carried,
Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker
voting aye by voice vote.
It was MOVED by Whitaker, seconded by Rich that Resolution
No. D-3140, authorizing the execution of an agreement with
the City of Bellevue Washington for cooperative purchasing
of communication equipment, be passed: carried, Broad, Brown,
Edmondson, Moore, Rich, Schussler and Whitaker voting aye
on roll call. City Manager McMicken explained that this
will enable Bellevue to purchase communication equipment
under a contract between Yakima and the supplier of this
equipment.
RESOLUTION NO. D-3140, A Resolution authorizing and directing
the City Manager and City Clerk of the City of Yakima to
execute an agreement with the City of Bellevue for the cooperative
purchase of communications equipment.
An Ordinance transferring $10,000 from the Federal Shared
Revenue Fund to the General Fund and appropriating $10,169
within the General Fund to buy animal cages for the impoundment
of animals, having been read by title only at this meeting
was laid on the table for one week, or until June 10, 1974.
Petition No. 815, Notice of Intention to Commence Annexation
Proceedings, having been filed with the City Clerk on May
28, 1974, by Jesse M. Moore and others for property located
between 45th and 48th Avenues, south of Tieton Drive, it
was MOVED by Schussler, seconded by Whitaker that today be
set as the time for a meeting with the initiating parties
who signed the Notice of Intention to Commence Annexation
Proceedings dated May 23, 1974, those initiating parties
being Jesse M. Moore and others: carried, Broad, Brown,
Edmondson, Moore, Rich, Schussler and Whitaker voting aye
by voice vote. The petitioners being present and indicating
that they are willing to assume their share of the City's
existing indebtedness, it was duly MOVED, seconded and passed
that the annexation proposed by Petition No. 815 (Notice
of Intention to Commence Annexation Proceedings) be accepted
by the City of Yakima and that the area sought to be annexed
be required to assume the City's existing indebtedness, and
that a Notice of Intention to Annex be filed with the Yakima
County Boundary Review Board. The above MOTION was made
by Schussler, seconded by Brown and carried, Broad, Brown,
Edmondson, Moore, Rich, Schussler and Whitaker voting aye
by voice vote.

Damage Claims having been filed with the City Clerk on:
a. May 29, 1974, by Jesus Jimenez, 802 Naches Avenue,
in the amount of $100,000 for damages in connection
with a police incident;
b. May 31, 1974, by David Ramirez, 1507 Prasch Avenue,
in the amount of $1,081.54 for injuries in connection
with water discharged from a City street flusher;
c. May 31, 1974, by Hubert and Emily Griffin as an amended
claim in the amount of $50,000 for damages and injuries
in connection with a fall on the City sidewalk,
it was MOVED by Schussler, seconded by Whitaker that said
Damage Claims be referred to the City Manager and staff for
study and recommendation: carried, Broad, Brown, Edmondson,
Moore, Rich, Schussler and Whitaker voting aye by voice vote.
It was MOVED by Schussler, seconded by Whitaker that the regular
evening meeting of June 17, 1974 be the date set for a Hearing
on the proposed amendment to the Zoning Ordinance in reference
to Group Homes: carried, Broad, Brown, Edmondson, Moore,
Rich, Schussler and Whitaker voting aye by voice vote.
It was MOVED by Schussler, seconded by Whitaker that the regular
evening meeting of the City Council held on the third Monday
evening of each month be held from now on at television station
KYVE, Channel 47: )1■1111111111111111 Broad, Schussler and Whitaker
voting aye by voice vote; Brown, Edmondson, Moore and Rich
voting nay by voice vote. Motion lost for want of a majority
vote. It was then MOVED by Edmondson, seconded by Whitaker
that the City staff and a representative of the City Council
meet with station KYVE to discuss holding future meetings
at the station: carried, Broad, Brown, Edmondson, Moore,
Rich, Schussler and Whitaker voting aye by voice vote.
There being no further business to come before the Council,
it was MOVED by Moore, seconded by Rich that this meeting
be adjourned at 5:15 P.M., to Friday, June 7, 1974, at the
hour of 12:00 Noon, to then meet in the Flight Deck Restaurant:
carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and
Whitaker voting aye by voice vote.
