HomeMy WebLinkAbout05/13/1974 Business Meeting 65 MAY 13, 1974 The City Council met in session on this date at 1:30 P.M. in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich, Don Schussler and Bill Whitaker, Fire Marshall,Ed Lexa, briefed the Council on the application of the Fire Code to city hotels downtown. Mr. Lexa noted that the majority of hotels downtown are not in compliance with the Code and had been put on probationary status to achieve compliance in six months. As a consequence of this directive, several hotels have decided to close, including the ComMercial, Iowa, Longbranch and the Pacific. Director of Management and Budget, Bob Hilsmann, gave a brief status report on the city's progress in utilizing the services f Public Technology, Inc. The Council was advised that various PTI projects have been selected for review by the city Staff to determine their application in Yakima. These include: a) Public Facilities Locator; b)Fire Pumper Pressure regulator; c)Hot Spot Locator; d)Refuse vehicle routing; e) Vehicle replacement and equipment management, etc. The Council will e advised on further progress in these areas. City Manager McMicken discussed City Manager Bulletin No. 80 on Forecast 1 75 and inquired whether the Council had any questions and Comments concerning preparation of the 1975 Budget. Councilman Schussler recommended that the Council devote a Study Session for developing budget strategies and establishing guidelines. He recommended also'that a brief summary of past budget expenditures and comparisions be made for selected city departments. The Council concurred with the request for a Study Session on the 1975 Budget and will plan on using Forecast 1 74 in that discussion. Phil Johnson, Data Processing, gave a demonstration on the City's microfiche capabilities in regard to the miniturization of the irrigation assessments and billing records. At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Edmondson, Moore, Rich, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by Councilman Brown. The minutes of the previous regular Council meeting of May 16, 1974, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. This being the time set for the Hearing on an admendment to the Planned Development located at South 40th Avenue and West Nob Hill Boulevard, filed by Pik'4...Lee Glascam Builders, Inc., having been continued from the previous meeting of May 6, 1974, Principal Planner, Dick Hill, indicated that the proposed plan now complies with the following seven conditions: 1. That ten feet of right-of-way along 40th Avenue and five feet along 38th Avenue be deeded to the City. 2. That driveway widths be at least 24 feet. 3. That pools be fenced for safety. 4. That a continuous fence be provided along the property line that separates Nob Hill Lanes and the single family ! residential properties lying to the south of the project. 5. That a better pedestrian way be designed for the eight unit complex in the center of the project. 6. That refuse collection centers be indicated and sufficiently site screened. MAY 13,_19,74 7. That complete landscaping and irrigation plans be submitted ; before issuance of any building permits. It was MOVED by Whitaker, seconded by Rich that Ordinance No. 1662, modifying this Planned Development Zone, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1662, AN ORDINANCE granting modifications to a Planned Development Zone for certain property situated north Of Nob Hill Boulevard between 38th and 40th Avenues within the City of Yakima. This being the time set for the Hearing on the Irrigation Maintenance; Assessment Roll for Irrigation Maintenance District No. 996 Kern Addition, City Attorney Andrews explained that the assessment roll covers operation for 1972, 1973 and 1974. It was MOVED by Brown, seconded by Edmondson that Ordinance No. - 1663, confirming the Irrigation Assessment Roll or District No. 996, be passed: carried, Broad, Brown, Edmondson, , Moore, Rich; Schussler and Whitaker voting aye on roll call. Present and speaking to this matter was Mr. Jess Chisum. ORDINANCE NO. 1663, AN ORDINANCE confirming the Irrigation Maintenance 'Assessment'Roll of the City of Yakima for Irrigation Maintenance District No. 996 for the years 1972, 1973 and 1974, and levying irrigation maintenance assessments according to such roll; and declaring an emergency. This being the time set for the'Hearing on the proposed westerly connection for the "B" Street and Lincoln Avenue Couplet, Traffic Engineer, Bill Stark, reviewed his Memo on this subject dated March 25, 1974. Mr. Stark noted that the Staff has considered the 6th Avenue connection from Lincoln to "B" Street but recommends 'against utilizing'that connection for reasons outlined in his Memo. He reviewed the Phase II proposal, which would utilize a Pierce Avenue Connection between Lincoln Avenue and "B" Street to remove traffic congestion in this area, to include the following: 1. Extend one-way westbound on Avenue from 5th Avenue to Pierce Avenue, instal1 thee lanes and add parking along the south side. 2. Construct an island at Lincoln Avenue and Pierce Avenue forcing the two,eastbound Lincoln Avenue lanes to turn 1 right and the most southerly westbound lanes of Lincoln Avenue to turn left. 3. Remove parking on the west side of Pierce Avenue. between 1 Lincoln Avenue and "B" Street and install three one-way southbound lanes in this section. 4. Install a traffic island at "B" Street and Pierce Avenue. 111 5. Remove parking on both sides of "B" Street between Pierce ! Avenue and 6th Avenue. 6. Construct cul-de-sacs or close 7th Avenue and Folsom Avenue at Pierce Avenue. It was noted that Phase III, Alternates 2, and 3 would need to have review by the Planning Commission before a decision is ',reached on that phase. Those present and speaking against the 1implementation of Phase II were Mr. Bill Cahoon, Preston Shepherd, And George Pinnell. After due discussion, it was MOVED by Brown, 'seconded by Rich that this Hearing be continued for three weeks: Cartried Broad, Brown, Edmaridsou,Moore; Rich and Whitaker voting laye by voice votel_Schussier-Amting.;nay by. voice vote— Councilman 'SchusSler referred to the bad. traffic congestion.i.xl this area, ,suggestirfg a temporary arrangement for- safety.- (c7 May 13, 1974 This being the time set for the Hearing on the proposed two- way left turn lane, from "B" Street to "I" Street, Traffic Engineer, Bill Stark, reviewed the Traffic Engineering Report on this subject dated May 1, 1974, noting the increase in left turns into commercial businesses along North First Street and the added problem created by large trucks parking along the curbline, blocking the vision of those entering or exiting from North First Street. Mr. Stark reviewed the provisions for proposed Plan "A" which would remove parking from both sides of First Street from "B" Street to "I" Street and Plan "B" which would remove parking on the west side only. He noted that property owners with frontage along this street have shown 61% in favor of kaan "A" and 81% in favor of Plan "B". Mr. Stark reported that the staff recommends Plan "A", which would provide adequate lane widths and visibility from commercial driveways. He referred to the letters received from the Eagle Motel, which expressed opposition to any truck parking and the letter from Discount Fabrics which is opposed to removing parking from both sides. Those present and speaking against the removal of parking were Eileen Stanton, Al Rouse, Harley Eden, Dick Miller, Hal Lamb, Harry Nelson, Duane Radke, Mrs. Ortez, Mrs. Gasperetti, Dick Jarns, Dick Harris and Hattie Foley. Present and speaking for the removal of parking were Mr. Ash and Leon Burnside. After due discussion, it was MOVED by Whitaker, seconded by Brown that the City staff be directed to prepare legislation to eliminate truck parking from both sides of North First Street between "B" Street and "I" Street: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. Also present and speaking to this matter was Captain Metzer of the Police Department. Mr. Westburt C. Britt, 1605 Summitview, being present, referred to the traffic conditions existing at the northwest corner of 16th Avenue and Summitview, noting that cars have been going over the curb and striking the buildings located on that corner. It was noted by the Council that at this particular intersection there are commercial establishments on three corners and a grade school on the fourth. The City Manager will make a report on this matter. It was MOVED by Schussler, seconded by Moore that Resolution No. D-3127, authorizing the City to execute a Quit Claim Deed to Warren L. Barrett for acquiring title to certain property, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. City Attorney Andrews explained that a previous conveyance included Lot 1, except for the east 10 feet for an alleyway but that no alleyway exists on the east 10 feet of that lot and it needs to be clarified that this is not part of the alleyway. RESOLUTION NO. D-3127, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute and deliver a Quit Claim Deed to Warren L. Barrett and Marjorie J. Barrett, husband and wife. It was MOVED by Brown, seconded by Whitaker that Resolution No. D-3128, authorizing an amended lease agreement with Cecil and Sandra Beauchamp to cover the Flight Deck Restaurant facility at the Yakima Air Terminal, be passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. City Attorney Andrews explained that this amendment will facilitate a loan from the bank for financing Mr. Beauchamp's costs in connection with enlarging the Flight Deck Restaurant. RESOLUTION NO. D-3128, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Lease Agreement Modification with Cecil A. Beauchamp and Sandra M. Beauchamp covering Flight Deck Restaurant premises at the Yakima Air Terminal. City Manager McMicken indicated that the lease is being awarded 1 to the highest bidder. ! RESOLUTION NO. D-3129, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Lease Agreement with Darrell Barnhart covering a portion of the Chesterley Park Site. City Manager McMicken referred to the request for partial funding of a VHF Agricultural Weather Radio Station made to the Council at the meeting of April 22, 1974. Mr. McMicken advised that ; this would be an inappropriate use of FRS funds, but that this request could be considered in the 1975 Budget preparation. This request was further discussed as-a possibility for partial ! funding through the Department of Emergency Services, as the ! City contributes 31 percent to that program. Councilman Moore 1 indicated that this request will be discussed at the meeting 1 of the Department of Emergency Services this month. After due discussion, it was MOVED by Schussler, seconded by Brown that Mr. Dale Johnson be advised that the City has-considered and declined his request for financial assistance:- carried, I Broad, Brown, Moore, Rich, Schussler and Whitaker voting aye by voice vote. Councilman Edmondson not voting. City Manager McMicken referred to the Grant McDaniel Outside 1 Utility Request for property located at South 24th Avenue and 1 West Logan to Assistant Planner, Glenn Rice, who reviewed 1 the Planning Staff Report on this subject dated April 17, 1974. 1 He indicated that the request is for water and sewer service ' to two existing structures and a proposed four-plex unit along West Logan Avenue. He indicated that the residential development 1 conforms to both the Yakima City General Plan and the Yakima 1 County Comprehensive Plan. The estimated total cost for utility I service to the development is $1,116 The Planning staff - 1 - recommending approval of this request, it was MOVED by Moore, I seconded by Schussler that the outside utility'request of Mr. Grant McDaniel,be approved: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. , I City Manager McMicken referred to the outside utility'request for property at 1713 and 1715 Pleasant Avenue owned by Mr., 1 Gale E. Curtis, noting that Mr. Curtis has signed the standard outside utility agreement for sewer service. He indicated I that the City will prepare a 15-year reimbursement agreement for those connecting to the line over the next few years. It was MOVED by Whitaker, seconded by Rich that the request of Mr. Curtis for outside sewer service, be granted: carried, I Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. It was MOVED by Edmondson, seconded by Schussler that Ordinance 1 No. 1664, amending the Municipal Code to correct a clerical 1 error in connection with the penalty for violating. the City's . Damage Claims having been filed with the City Clerk on: a. May 6, 1974, by Walter L. Traub, 226 South 17th Avenue, for damages to personal property by a City Refuse Truck; b. May 6, 1974, by Carolyn H. Malone, in the amount of $100,000, for damages in connection with an arrest made by Yakima Police Officers; c. May 9, 1974, by Lucille Grothe, 4601 Englewood Avenue, in the amount of $57.33 for damages to her automobile by a City Refuse Truck; d. May 10, 1974, by Harry B. Wilson, 816 North 15th Avenue, in the amount of $47.63 for damages in connection with a City sewer backup, it was MOVED by Whitaker, seconded by Brown that said Damage Claims be referred to the City Manager and staff for study and recommendation: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. City Manager McMicken requesting authorization for out-of-state travel for Richard Haubrich and Marjorie Ward, Police Department, to travel to Portland, Oregon, to attend a Radio Dispatcher's School, May 13 -.15, 1974, it was MOVED by Whitaker, seconded by Rich that said travel be approved and expenses paid: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. There being no further business to come before the Council, it was MOVED by Rich, seconded by Moore that this meeting be adjourned at 5:20 P.M., to Friday, May 17, 1974, at the hour 12:00 Noon, to then meet in the Flight Deck Restaurant: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote.
