HomeMy WebLinkAbout04/08/1974 Business Meeting 2.; APRIL 8, 1974 ...... _ The City Council met in session at 1:30 P.M. on this date in the Conference Room at Yakima City Hall. 1 !Councilmen present at the meeting were Assistant Mayor 'Wray Brown, Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich, Don Schussler and Bill Whitaker. Mayor Broad absent and excused. lAdministrative Assistant, Dick Zais, discussed the City's progress in its gasoline conservation program and the recent !guidelines established by the Federal Energy Commission concerning t he petroleum allocation and price regulation. In addition, the Council was advised that departments appear to be staying !within their budgets and accommodating restrictions on allocations as a result of the lower gasoline prices and gasoline conservation !measures initiated. 1 Police Chief Jack LaRue reviewed an evaluation report on the department's operations as they have been affected by the reduction of gasoline. The Chief noted that the department had only been able to save 15 per cent below the previous !year's gas consumption at the expense of curtailing police preventative patrols. He recommended to the Council that Ithe conservation program be restricted on police service to 10 per cent below the full requirement. The Council responded 'by agreeing that the Police Department should return to full ;operational service with conservation in mind effective immediately. C aptain Harvey Qualley reviewed the Police Annual Report, noting that crime in Yakima had been reduced 12 per cent over the previous year. Captain Erwin Metzer reported on the meeting he attended on Police Patrol Management in Seattle consisting of international and statewide representation. The topics discussed included the patrol management course, training police and the energy crisis. Police Chief Jack LaRue reviewed the financial assistance request from the Yakima Youth Center made by Director Geraldine IHatten. She stated that a decision would have to be made by April 16 to meet the funding deadline, since the City is the sponsoring agency for the program. Last year the City's match was $6,791. The center is requesting $25,000 this year. The Council ; agreed to review this request at the upcoming Council retreat Vi and requested that Law and Justice prepare a report on this iissue. 'At 3:00 P.M., the Council members moved into the Council 'Chambers for the balance of the meeting, Assistant Mayor Brown presiding, Councilmen Edmondson, Moore, Rich, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews !present on roll call. Mayor Broad absent and excused. The Invocation was given by Councilman Brown. It was noted that an additional statement should be entered in the minutes of the previous meeting of April 1, 1974, regarding Ordinance No. 1639, amending the Certificate of !Occupancy inspection requirement. This Ordinance will delete the requirement for a Certificate of Occupancy inspection on the sale of buildings when no change of occupancy occurs. 1 Mr. Paul George, Manager of Yakima Meadows, being present, spoke Ito the Council concerning a request made last year for City fire protection service to the Central Washington Fairgrounds. He noted APRIL 8, 1974 - - - - - that the fairgrounds is now given service by the City on a . second call basis, and stressed the need for fire protection service on a first call basis from the City. Mr. Walt Weeks, Secretary for the Turf Club, spoke regarding the previous request by the City for annexation of the fairgrounds before this fire protection service is granted. He referred to the Community benefits from the many activites held at the fairgrounds and requested that the City give consideration to fire protection service on a contractual basis. He further requested that the annexation policy be altered, if necessary, to , accommodate this request. Mr. Ellis Cummins, a member of the Fair Board, spoke in favor of this request in light of the fact that Fire Station No. 5 is now located so close to the fairgrounds. He also referred to the possibility of connecting the fire alert system at the fairgrounds with the main alarm headquarters. Fire Chief Matt Young indicated that he has been against providing fire service to the fairgrounds ' I/ without annexation since the citizens within the City limits pay for the City fire service and that exception should not be made for one private enterprise. He reported that the fairgrounds would have to be brought up to the City's minimum Fire Code standards in the event that fire protection service is granted, but noted an insurance savings through annexation. Mr. Weeks indicated that the Fair Board will work with the county regarding possible annexation of the fairgrounds. It was the consensus of the Council that the Fair Board approach the County Commissioners regarding the matter annexation. After due discussion, it was MOVED by Whitaker, seconded by Moore that this matter be referred to the City Manager and staff for .study and recommendation: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. Broad absent. Present also, and speaking to this matter were Mr. Frank Pierce, and Daryl Leonard. Referring to the proposed agreement with Union Pacific Railroad to improve the railroad grade crossing at Walnut Street, Director of Public Works, Dave Vargas, reviewed the provisions of the proposed agreement to include the costs to be covered by the City in the total amount of $28,358. He noted a total project cost of approximately $53,440. It was MOVED by Edmondson, seconded by Schussler that Resolution No. D-3108, authorizing the execution of said agreement with Union Pacific Railroad be passed: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll 'call. Broad absent. RESOLUTION NO. D-3108, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an agreement with Union Pacific Railroad Company for improvement of the railroad grade crossing at Walnut Street. City Attorney, Fred Andrews, explained the legal documents which have been prepared for execution whereby the City will purchase, under option agreements, 100 feet of frontage property on Yakima Avenue, east of the Miller Building. He explained that the City will then exchange this property for the Capitol I/ Theatre now owned by the Junior Amusement Company. Mr. Andrews indicated that the City will acquire property under these option agreements at approximately $230,000 with Federal Revenue Sharing monies. He further explained that through a lease , agreement, the Capitol Theatre will then be leased to the Junior Amusement Company for entertainment purposes. Mr. Andrews indicated that this is a straight across trade and that this method of acquisition provides certain tax benefits for the Junior Amusement Company. After due discussion, it was MOVED by Whitaker, seconded by Schussler that Resolution No. D-3109, accepting said Option assignments, be passed: Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. Broad absent. Present and speaking to this matter were Mr. Bill Hempstead, Frank Pierce, Russell Miller and Larry Robinson. It was noted that the Capitol Theatre will provide a public auditorium, but is not being acquired as a convention center facility. APRIL 8, 1974 RESOLUTION NO. D-3109, A RESOLUTION accepting from Gene P. Mayer purchaser's assignments of options to purchase real property. It was MOVED by Rich, seconded by Whitaker that Resolution No. D-3110, authorizing the execution of the agreement to exchange real estate with Junior Amusement Company for acquisition of the Capitol Theatre, be passed: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. Broad absent. RESOLUTION NO. D-3110, A RESOLUTION authorizing and directing the City Manager and City Clerk to execute an Agreement to Exchange Real Estate with Junior Amusement Co., a corporation. The City Treasurer having submitted the Investment Report for the month of March, 1974, it was MOVED by Schussler, seconded by Whitaker that the Report of the City Treasurer dated March 31, 1974, regarding the investments of the City of Yakima, be accepted and approved: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote. Broad absent. An Ordinance appropriating $3,800 within the Refuse Fund for the purchase of refuse bins and container dumping mechanisms, having been read by title only at the previous meeting, and being again read by title only at this meeting, it was MOVED by Edmondson, seconded by Moore that Ordinance No. 1647, providing for said appropriation, be passed: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. Broad absent. ORDINANCE NO. 1647, AN ORDINANCE appropriating the amount of $3,800 from unappropriated money in 471-Refuse Fund to Account 471.534.50.64 as a 1974 appropriation for 471-Refuse Fund. An Ordinance transferring and appropriating $16,683.64 from the Contingency Fund to the Southeast Yakima Community Center Fund to close the account, having been read by title only at the previous meeting, and being read again by title only at this meeting, it was MOVED by Whitaker, seconded by Rich that Ordinance No. 1648, providing for said transfer and appropriation, be passed: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. Broad absent. ORDINANCE NO. 1648, AN ORDINANCE transferring the amount of $16,683.64 from 195-Contingency Fund to 391-Southeast Yakima Community Center Fund and appropriating that amount to various accounts as 1974 appropriations for 391-Southeast Yakima Community Center Fund. An Ordinance transferring and appropriating $8,235 from the Cumulative Reserve Fund for Capital Improvement to the Central Business District Capital Improvement Fund to pay N. G. Jacobson and Associates, Consulting Engineers, for work on the Central Business District Parking Study, having been read by title only at the previous meeting, and being again read by title only at this meeting, it was MOVED by Edmondson, seconded by Whitaker that Ordinance No. 1649, providing for said transfer and appropriation, be passed: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1649, AN ORDINANCE transferring the amount of $8,253 from 392-Cumulative Reserve Fund for Capital Improvement to 321-Central Business District Capital Improvement Fund APRIL 8, 1974 and appropriating that amount as a 1974 appropriation for 321-Central Business District Capital Improvement Fund. Referring to the proposed Ordinance designating "A" Street as a westbound one-way street between 6th Street and Naches Avenue, Director of Public Works, Dave Vargas, explained that this area is now a two-way street and'that the parking will remain. Traffic Engineer, Bill Stark, indicated that this is proposed to eliminate much of the congestion in this area, while still allowing for the same amount of parking. It was MOVED by Moore, seconded by Edmondson that Ordinance No. 1650, providing for said designation, be passed: carried, Brown, Edmondson, Moore, Schussler and Whitaker voting aye on roll call; Rich not voting. I/ ORDINANCE NO. 1650, AN ORDINANCE relating to traffic control; designating a portion of East "A" Street as a one-way street; and amending Subsection 9.75.020 (a) of the City Of Yakima Municipal Code. It was MOVED by Whitaker, seconded by Rich that Ordinance No. 1651, amending Ordinance No. 1641 and correcting the legal description of property added to the Irrigation Maintenance Roll by that Ordinance, be passed: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1651, AN ORDINANCE amending Section 1 of Ordinance No. 1641, enacted April 1, 1974, and placing a parcel of real property in the City of Yakima on the Irrigation Maintenance Roll of Local Improvement District No. 793. It was MOVED by Schussler, seconded by 'Edmondson that Ordinance No. 1652, creating an irrigation maintenance district to serve Kern Addition in the City of Yakima, be passed: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting - aye on roll call. Broad absent. City Attorney Andrews explained that this will provide for service to an area on Lincoln Avenue which has been previously served by a separate system. He noted that approximately two years ago the residents of this area approached the City with a request for irrigation maintenance under the City's system. A Hearing is to be held in a few weeks on the assessment to cover maintenance costs in providing irrigation to this area. ORDINANCE NO. 1652, AN ORDINANCE accepting the conveyance to the City of an irrigation system serving Kern Addition to the City of Yakima; and accepting the transfer to the City of rights of the owners of property in Kern Addition to receive delivery of and distribute irrigation water to the property in Kern Addition; creating Irrigation Maintenance District No. 996; setting a public hearing to assess property within that Irrigation Maintenance District for costs incurred I/ to date and for maintenance for the current year; providing for the levy and collection of assessments; and declaring an emergency. Amendment to the Planned Development located at South 53rd Avenue and Tieton Drive, filed by Mr. Donald R. Wick, .D Construction Company; d. Amendment to the Planned Development located in the vicinity of the Englewood Avenue Reservoir, filed by Mr. Walter G. Mayer, Jr., Yakima Tennis Club, it was MOVED by Schussler, seconded by Rich that April 22, 1974, be the date set for Hearings on these requests: carried, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting , aye by voice vote. IA Damage Claim having been filed with the City Clerk on April i 3 , 1974, by Beulah Lyke, 602 North 2nd Street, in the amount of $150 for damages to a door in connection with a police ;raid, it was MOVED by Schussler, seconded by Rich that said .
