The City Council met in session at 1:30 P.M. on this date in
the Council Chambers at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad, Wray
Brown, Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich
and Bill Whitaker.
At 1:30 P.M., the Council met for a Press Conference with the
news media.
Director of Public Services, Jack Daniel, gave a description of the,
proposed parking lot walkway canopy and entrance sign to the air-
port. The total cost for both was estimated at $9500. It was the
consensus of the Council that another alternative be considered
at less cost.
The Councilimominated several Task Force appointments to review
the Certificate of Occupancy permit system, which will be
released publicly at a -later date.
At 3:00 P.M., the Council members met in the Council Chambers
for the balance of the meeting, Mayor Broad presiding, Councilmen
Brown, Edmondson, Moore, Rich and Whitaker, City Manager
McMicken and City Attorney Andrews present on roll call.
Councilman Schussler having requested permission to be excused
from this meeting, it was MOVED by Brown, seconded by Edmondson
that Councilman Schussler be excused from this meeting:
carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker
voting aye by voice vote.
The Invocation was given by Councilman Rich.
The minutes of the previous adjourned regular meetings of
March 15 and March 22, 1974, and the regular meeting of March
25, 1974, having been duly certified accurate by two Councilmen,
and no one present wishing to have said minutes read publicly,
Mayor Broad declared said minutes approved as recorded.
This being the time set for the Hearing on the adoption of
the proposed Uniform Sign Code, City Manager McMicken briefly
reviewed City Manager Report #210 concerning the Proposed
Uniform Sign Code and explained that approximately twenty
businesses having signs would be classified as nonconforming
under the new code. Chief of Code Administration, Newell
Pock, indicated that letters were sent to each business found
to be nonconforming, informing them of the proposed changes
and this hearing. He explained the provisions of the proposed
Sign Code Ordinance, noting those types.of signs which would
be restricted. Mr. Pock showed slides to the Council of signs
in both residential and commercial districts, explaining why
each is either conforming or nonconforming under the provisions
of the new code. He noted that several of the signs were
beyond the required height and/or project out over the public
right-of-way. He explained that those businesses with nonconforming
signs would have a period of four years in which to remove
or replace the signs in conformance with the new requirements.
Mr. Pock further explained that the sign industries have
reviewed the proposed code and find it acceptable. He indicated
that the removal of signs advertising a business which no
longer exists at a given address provides a means for upgrading
the City. Those present and speaking to this matter and/or
asking questions were Mr. Hal Campbell, Joe Ibach and Lou
Bjorge. After due discussion, it was MOVED by Brown, seconded
by Whitaker that Ordinance No. 1638, adopting by reference
the 1973 edition of the Uniform Sign Code, be passed: carried,
Broad, Brown, Edmondson, Moore, Rich and Whitaker voting
aye on roll call. Schussler absent.
APRIL 1, 1974
ORDINANCE NO. 1638, AN ORDINANCE relating to building regulations,
adopting by reference the Uniform Sign Code, 1973 Edition,
copyright 1973 by the International Conference of Building
Officials; regulating direction and maintenance of advertising
signs, billboards and banners in the City of Yakima; requiring
a license for sign erectors; requiring the inspection of
signs and requiring permits therefore; providing penalties
for violation; enacting Chapter 11.08, "Sign Code ", as a
new chapter of the City of Yakima Municipal Code; and repealing
Chapter 5.06 of the City of Yakima Municipal Code.
It was MOVED by Whitaker, seconded by Brown, that Resolution
No. D -3102, a Resolution of intention to create a local improvement
district in accordance with Petition No. 794 filed by Mark
A. Kieth and others for the construction of water mains,
and setting April 22, 1974 as the date for Hearing on this matter,
be passed: carried, Broad, Brown, Edmondson, Moore, Rich
and Whitaker voting aye on roll call. Schussler absent.
RESOLUTION NO. D -3102, A RESOLUTION of intention to create
a local improvement district.
City Attorney Andrews reported that the following damage
claims have been investigated and are recommended for payment:
It was MOVED by Edmondson, seconded by Brown that Resolution
No. D -3103, authorizing payment of $250 to Robert M. Massong
for damages from a plugged sewer line, be passed: carried,
Broad, Brown, Edmondson, Moore, Rich and Whitaker voting
aye on roll call. Schussler absent.
RESOLUTION NO. D -3103, A RESOLUTION authorizing payment of
$250 to Robert M. Massong in settlement of a claim for damages
filed with the City of Yakima.
It was MOVED by Edmondson, seconded by Brown, that Resolution
No. D -3104, authorizing payment of $107.10 to Leo Menard
for damages from a plugged sewer line, be passed: carried,
Broad, Brown, Edmondson, Moore, Rich and Whitaker voting
aye on roll call. Schussler absent.
RESOLUTION NO. D -3104, A RESOLUTION authorizing payment of
$107.10 to Leo Menard in settlement of a claim for damages
filed with the City of Yakima.
Referring to the proposed agreement with the Department of
Highways to make preliminary estimates for Yakima Air Terminal
Land Acquisition, City Manager McMicken explained that this
agreement contains the same provisions as the previous letter
agreement, dated September 4, 1973, which is now being formalized.
I/ He indicated a cost estimate of $3,000 in connection with
estimates on 73 parcels. It was MOVED by Whitaker, seconded
by Rich that Resolution No. D -3105, authorizing the execution
of said agreement with the Department of Highways, be passed:
carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker
voting aye on roll call. Schussler absent.
RESOLUTION NO. D -3105, A RESOLUTION authorizing the Mayor
and City Clerk of the City of Yakima to execute an agreement
with the Washington State Department of Highways for services
in connection with the proposed expansion of the Yakima Air
Terminal.
A report having been received from the City Engineer on the
completion of work and recommending that said work be accepted
and final payment made on the 1973 Paving Improvement -
Schedule II - Milroy Park, it was MOVED by Brown, seconded
by Edmondson that the report of the City Engineer dated March
27, 1974, with respect to the completion of the work on the

Cameton and Company, City Manager McMicken reported that
!bids were received and considered by the bid board on March
22, 1974, for the Yakima Fire StatiOns No. 1 and No. 5 landscaping

The architect recommending that the bid be awarded to May Nursery
Company, who submitted the loWest and best. bid, it was MOVED
by Whitaker, seconded by Rich that the bid be awarded to May Nursery

Tax: carried, Broad, Brown, Edmondson, Mbore, Rich and Whitaker
voting aye by voice vote. Schussler absent.
City - Manager McMickew_ireferredvto theiregbe'St March
25, 1974, from the Yakima Softball Association for additional
! funding in the amount of $2,000 to engage a part time Director/Coor-:
dinator for the Slow-pitch Softball Association, This funding
1 would be channeled through the City's Parks and Recreation Depart-
1 ment. Mr. McMicken'briefly reviewed the 1974 budget for the
Parks and Recreation Department, indicating that it is not the
1 normal practice of the City to re-open the budget during the
1 year for such requests, but that this would be a worthwhile con-
1 sideration for next year's budget. Referring also to the request
1 for additional funding by the Southeast Yakima Community Center
1 on March 25, 1974, for funding in the amount of $2,000 to support
1 additional recreation programming at the Center, Mayor Broad
explained that the Youth Program carried on by Law Justice
Funding is no longer in operation and that some type of teen
program is needed in this area. After due discussion, it was
MOVED by Whitaker, seconded by Brown that the request from the
1 Yakima Softball Association and the Southeast Community Center
1 in the amount of $2,000 each, be denied: carried, Broad, Brown,
1 Edmondson, Moore, Rich and Whitaker voting aye by voice vote.

, 1 of Parks and Recreation, Bill Hutsinpillar.
Recreation Superintendent, Ron Abernathy, spoke to the Council
concerning the proposed application for,Federal Funds under the
Older Americans Act for an Outreach Worker to be based at the
Senior Citizens Center. He explained that this Outreach Worker
1 will work throughbut the community with isolated Senior Citizens,
providing friendship and help to those who are not able to take
1 full advantage of community services. It MOVED by Rich,
seconded by Edmondson that Resolution No. ID3106, authorizing
said application for funds be carried, Broad, Brown,
Edmondson, Moore,Rich and Whitaker !voting aye on roll call. Schussler
absent.
RESOLUTION NO. D-3106, A RESOLUTION authorizing the application
by the City of Yakima for a grant of funds under the Older American
Act of 1965 as amended.
Mr. Terry Schmalz, Attorney representing the Yakima Multiple Listing
Service, Yakima Board of Realtors, and the Yakima Home Builders
Association, reviewed his letter dated April 1,
1974, concerning the repeal.:of Ordinance No. 1615, which requires
1 a Certificate of Occupancy upon the,sale of a building or home,

He recommended the repeal of this ordinance and further requested
that the Council not reinstate Section H-301 (b) of Ordinance
No. 1507, which requires that a Certificate of Occupancy be issued
whenever there is a change in occupancy of a building. He noted
problems with the present Housing Code in relation to closing
real estate transactions, the duplication of inspection requirements
by other governmental agencies and the interpretations of the
housing code ordinance. Mr. Schmalz further recommended that
the Council appoint a Certificate of Occupancy Task Force. Mr.
Pat Nagle, Housing and Renewal Committee member, read a statement
to the Council in favor of the present housing code provisions,
noting that it provides a deterrent to deterioration of housing
within the community and requested the Council's support in
maintaining the present inspections. Chief of Code Administration,
Newell Pock, indicated that of all homes inspected since the
adoption of this Ordinance, only twenty-three certificate refusals
have been made and noted that those persons objecting to the
decision of the inspectors can appeal to the Housing Appeals
Board. Others present and speaking to this matter were Mr. Joe
Krieger, Bill Kinnear, Stan Haney, Joe Ibach, Jean Rich, Frank
Spencer, Galord Newby, Omer Gress, Ken Sampson, Jim Speidel,
Dick Miller, Mrs. Gaudette, Larry Robinson, Lloyd House, and
Bill Cahoon. City Attorney Andrews explained that the proposed
ordinance before the Council deletes the requirement for the Certi-_
ficate of Occupancy Inspection upon the sale of buildings, but
puts back the original language of the housing code adopted by
Ordinance No. 1507. Mayor Broad indicated that a Task Force will
be appointed to make recommendations regarding the Certificate
of Occupancy Inspections and clarifications to the City's present
housing code, which will be reported back to the Council within
60 days. He indicated that this Task Force will be made up of
a representative from the Multiple Listing Board, Board of Realtors,
Home Builders, Apartment Homes, and two from each of the four
sections of the community. After due discussion, it was MOVED
by Rich, seconded by Whitaker that Ordinance No. 1639, deleting
the requirement for a Certificate of Occupancy Inspection on
* the sale of buildings, be passed: carried, Broad, Brown, Edmondson,
Moore, Rich and Whitaker voting aye on roll call. Schussler
absent.
ORDINANCE NO. 1639, AN ORDINANCE relating to building regulations;
prohibiting the occupancy of buildings without obtaining a Certi-
ficate of Occupancy; amending Section 11.20 020 of the City of
Yakima Municipal Code; and declaring an emergency.
In accordance with an earlier recommendation found in City Manager
Report No. 191 for assessment of water mains of 8 inch size in
residential districts and 12 inch size in commercial and industrial
districts, it was MOVED by Whitaker, seconded by Edmondson that
Ordinance No. 1640, providing for said assessments, be passed:
carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting
aye on roll call. Schussler absent.
ORDINANCE NO. 1640, AN ORDINANCE relating to local improvement
districts; providing for approval of local improvement district
project plans, for supervision of work, and for determining construc-
tion costs to be borne by the City; amending Section 8.12.045
of the City of Yakima Municipal Code; and repealing City of Yakima
Resolution No. C-1051.
It was MOVED by Whitaker, seconded by Moore that Ordinance No. 1641
adding a parcel of real property to Irrigation Maintenance
District No. 793 be passed: carried, Broad, Brown, Edmondson,
Moore, Rich and Whitaker voting aye on roll call. Schussler
absent. City Attorney Andrews explained that the owner of
this property has been added to L.I.D. No. 793 by paying the
proportionate share of the cost of the improvements and this
Inadvertently omitted above: After due discussion, it was MOVED by
Rich, seconded by Whitaker that Ordinance No. 1639, deleting the
requirement for a Certificate of Occupancy inspection on the sale of
buildings where no change of occupants occurs, be passed: carried,
Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye on
roll call. Schussler absent.

ORDINANCE NO. 1641, AN ORDINANCE placing a parcel of real property
in the City of Yakima on the,Irrigation Role of
Local Improvement District No. 793.
An Ordinance appropriating the amount of $3,800 within the
Refuse Fund to purchase refuse bins and container dumping
mechanisms, having been read by title at this meeting,was
laid on the table for one week or until April 1, 1974. City
Manager McMicken noted that this matter had been discussed
at the previous meeting and City CounCU MeMbers
that legislation be prepared so that these purchases can be
made.
An Ordinance transferring and appropriating $16,683.64 from I/
the Contingency Fund to Southeast Yakima Community Center
Fund, to close account, having been read by title at this meeting,
was laid on the table for one week or until April 1, 1974.
City Manager McMicken referred to the report on the fund and
explained that this appropriation will close the account.
An Ordinance transferring $124,980 from Federal Shared Revenue
Fund to Parks and Recreation Fund and appropriating that amount
for 1974 expenditures from Parks and Recreation Fund for-Lions
Park Development and improvements to other - City parks, having
been read by title .at the previous meeting, and being read again
by title at this meeting, it was MOVED by Whiter, seconded
by Rich that Ordinance No. 1642 providing for said appropriation
be passed: carried, Broad; Brown, Edmondson, Moore, Rich
and Whitaker voting aye on roll call. Schussler absent.
ORDINANCE NO. 1642, AN ORDINANCE transferring the amount of
$16,683.64 from 195-Contingency Fund to,391-Southeast Yakima
Community Center Fund and appropriating that amount to various
accounts as 1974 .appropriations for 391-Southeast Yakima
Community Center Fund.
An Ordinance loaning the amount of $12,000 from Water-Sewer
Fund to Transit Fund and appropriating the total amount of
$42,000 within the Transit Fund, having been read by title
at the previous meeting, and being read again by title at this
meeting, it was MOVED by Edmondson, seconded by Brown that
Ordinance No. 1643 providing for said appropriation be passed:
carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker

ORDINANCE NO. 1643, AN ORDINANCE authorizing a temporary loan
of the amount of $12,000 from 473-Water-Sewer Fund to 462-Transit
Fund and providing for the repayment; appropriating the amount
of $42,000 from unappropriated money in 462-Transit Fund to
various accounts therein as 1974 appropriations for 462-Transit
Fund.
An Ordinance appropriating the.amount of $8,700 from unappropriated
money in the Park and Recreation Fund to pay for pickup trucks
and motorcycles to be purchased, having been read by title
only at the previous meeting, and being read again by title at
this meeting, it was MOVED by Brown, seconded by Edmondson
that Ordinance No. 1644 providing for said appropriation be

ORDINANCE NO, 1644, AN ORDINANCE appropriating the amount of
$8,700 from unappropriated .money in 131-Park and Recreation
Functto account 131.533.21.64 as a 1974 appropriation for
131-Park and Recreation Fund.
An.Ordinance transferring the'amount of $2,040 from the Contingency
Fund to the Police Department Training Fund and appropriating
that amount to pay costs for training police officers, having

seconded by Rich that Ordinance No. 1645 providing for said

An Ordinance appropriating $12,500 from unappropriated money
in the Trolley Fund to pay the purchase price and delivery
charges for trolley cars to be purchased, having been read
by title only at the previous meeting, and being read again
by title at this meeting, it was MOVED by Brown, seconded
by Edmondson that Ordinance 'No. 1646 providing for said appropri-
ation be passed; carried, Broad, Brown, Edmondson, Moore
Rich and Whitaker voting aye on roll call. Schussler absent.
ORDINANCE NO. 1645, AN ORDINANCE transferring the amount of
$2,040 from 195-Contingency Fund to 000-General Fund and appro-
priating that amount to Account 031.521.40.33 as a
1974 appropriation for 000-General Fund.
ORDINANCE NO. 1646, AN ORDINANCE appropriating the amount of
$12,500 from unappropriated money in 362-Trolley Fund to Account
362.546.23.64 as a 1974 appropriation for 362-Trolley Fund.
A Damage Claim having been filed by the Yakima County Fire
District No. 11, West Washington Avenue, for damages in connection
with the accident involving a county fire truck and a car, it
was MOVED by Whitaker, seconded by Rich that said damage claim
be referred to the City Manager: carried, Broad, Brown,
Edmondson, Moore, RiCh and Whitaker voting aye by voice vote.
Schussler absent.
City Manager McMicken referred to an off-the-agenda item, an
Ordinance transferring $8,235 from the Cumulative Reserve
Fund for Capital Improvement to the Central Business District
Capital Improvement Fund and appropriating that amount as a
1974 appropriation to pay for Consulting services for a
Central Business District Parking Study. This Ordinance
having been read by title at this meeting, was laid on the
table for one week or until April 1, 1974.
Another off-the-agenda item, the matter of authorizing
the application to the Department of Social and Health Services
of the State of Washington for grants for water supply system
construction, was brought on for discussion. City Manager
McMicken explained that three preliminary applications for grants
are being made, Powerhouse Road - 16' watermain, Front Street -
install 12" watermain, and Cherry Avenue Water Distribution
Main. After due discussion, it was MOVED by Brown, seconded
by Edmondson, that Resolution No. D-3107 authorizing the
application for said grants, be passed: carried, Broad,
Brown, Edmondson, Moore, Rich and Whitaker voting aye on
roll call. Schussler absent.
RESOLUTION NO. D-3107, A RESOLUTION authorizing the City Manager
of the City of Yakima to apply to the Department of Social and
Health Services of the State of Washington for grants for water
supply system construction.
City Manager McMicken referred to another off-the-agenda item,
a Resolution honoring Ms. Jayne Joseph of Ridgewood, New Jersey,
a distinguished visitor to the Yakima Valley, and naming her
and Honorary Citizen of the City of Yakima. He explained that
Ms. Joseph, a visitor in the City of Yakima and a friend of

Councilman Edmondson, is active in_the home and community of Ridge-
wood. It was MOVED by Edmondson, seconded by Brown-that Resolution,
No. D-3101 honoring a distinguished visitor to the Yakima Valley, ,
be passed: carried, Broad, Brown, Edmondson, Moore, Rich and
Whitaker voting aye on roll call. Schussler absent.

There being no further business to come before the Council, it was
MOVED by Moore, seconded by Rich that this meeting be adjourned
at 5:45 P.M., to Friday, April 5, 1974, at the hour of 12:00

The City Council met in session at 12:00 'Noon, on this date in the
Flight Deck Restaurant at the Yakima'Air Terminal.
Councilmen present at the meeting were Mayor Bert Broad, Wray Brown
Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich and Bill
Whitaker. Councilman Schussler absent.
The Council held general discussion on various city matters. No
formal action was taken at this meeting.
There being no further business to come before the Council, it was
MOVED by Rich, seconded by Moore that we do now adjourn at the hour
of 1:30 P.M.: carried, Broad; Brown, Edmondson, Moore, Rich and
Whitaker voting aye by voice vote. Schussler absent.
