' DECEMBER 20, 1983
STUDY SESSION
The City Council met in session on this date at 2:00 p.m. in the Council
Chambers of City Hall, Yakima, Washington. Council members present were
Mayor Lynn Carmichael, Clarence Barnett, Henry Beauchamp, Lynn Buchanan,
Shirley Doty, W.K. "Pete" Moore and Jack Sperling.
1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
None
2. STATUS REPORT REGARDING STREET RECONSTRUCTION REPAIR PROJECTS FOR
1983 AND 1984
Dennis Covell, Director of Engineering and Utilities, was
available to respond to the Council's questions regarding the
process of recycling asphalt and the resultant savings. There
was discussion regarding the advantages of recycling the
asphalt. It was MOVED by Moore, seconded by Barnett to move
this Item down as Item No. 7a to take action on the
reoonmendation. Discussion followed regarding the ratio of
the base gravel rock and the depth of the asphalt needed for
good construction of the street. The question was called for
a vote on the motion. Unanimously carried by voice vote.
3. REVIEW OF PARKS COMPREHENSIVE PLAN
Jodi Wroblewski, Recreation Superintendent, reviewed the can-
prehensive plan. She Commented that a policy guideline is
needed for the acquisition and disposition of park property.
She further stated that this plan recommends that the
acquisition of park property be referred to the Parks and
Recreation Commission prior to Council action. Ms. Wroblewski
responded to the Mayor's concerns regarding the recommendation
in the plan for additional recreational ball fields. Council
member Barnett inquired about the publication of the notice of
hearing on the Parks Plan and also questioned who received
copies of this Plan. Ms. Wroblewski indicated notice of the
public hearing will be processed through the newspaper and
Public Service Announcements with other electronic media. She
further commented that copies of the Plan are available and
will be mailed to associations who use the parks now. Council
member Buchanan requested a definition of the term "urban
shaping area", questioning if that was an error. Assistant
Director of Community and Economic Development Larry Wright
explained this is a draft document and any typing error will
be corrected prior to the hearing. It was MOVED by Barnett,
seconded by Buchanan to move this down to the Business portion
of the Council meeting. Carried by 6-1 voice vote. Moore
voting nay.
BUSINESS MEETING
4. ROLL CALL

At 3:00 p.m., the Council members canmenced the regular
meeting, Mayor Carmichael presiding, Council members Barnett,
Beauchdup, Buchanan, Doty, Moore and Sperling and City Manager
Zais and City Attorney Andrews present on roll call.
5. INVOCATION

The Invocation was given by City Manager Zais.
6. CONSENT AGENDA
Mayor Carmichael referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members -or citizens present.

Council member Doty requested that It No. 7a be added and
Items Nos. 8 and _23 be removed. Council member Moore
requested that Item No. 25 be removed from the Consent Agenda.
It was the general consensus of the Council that the addition
of Item No. 7a and the deletion of Its Nos. 8, 23 & 25, as
requested, be made. The City Clerk then read the Consent
Agenda items, including resolutions and ordinances by title.
It was MOVED by Beauchamp, seconded by Sperling that the
Consent Agenda, as read, be passed. Unanimously carried by
Toll call vote. .(Subsequent paragraphs preceded by an
asterisk (*) indicate items on the Consent Agenda handled
under one motion without further discussion.
II/ 7. CURRENT STUDY SESSION ITEMS
*a. Item No. 2
Report accepted and request to use any monies unspent from the
original authorization for consideration of other projects
listed in report dated 12/10/83 approved.
b. Item No. 3
Following discussion, it was MOVED by Moore, seconded by Doty
that the public hearing on the Parks Comprehensive Plan be set
for January 10, 1984. Unanimously carried by voice vote.
8. APPROVAL OF MINUTES
Council member Doty referred to the minutes of the December
2nd adjourned meeting, in the next to the last paragraph under
the Fire discussion, and requested the minutes to be corrected
to reflect that she mentioned that cities have a taxing
authority, rather than as stated that a tax be brought before
the people. Council member Doty referred to paragraph two
under Streets on the minutes for the December 5th meeting and
commented She thought staff mentioned the suggestion of
sending flyers to the neighborhoods; that she was the one who
mentioned the possibility of guest editorials. It was MOVED
by Doty, seconded by Buchanan that the minutes of the Council
meetings of November 29 and December 6, 1983 and the minutes
of December 2 and 5, 1983, as corrected, having been duly
certified accurate by two Council members, and no one present
wishing to have said minutes read publicly, be approved.
Unanimously carried by voice vote.
9. AUDIENCE PARTICIPATION
City Clerk Roberts read and presented a proclamation to the
City COuncil extending the City staff's best wishes for a
happy holiday season.
II/ *10. RIGHT-OF-WAY USE PERMIT FOR PROPERTY AT 301 E. ,YAKIMA AVENUE
The report by the Director of Community & Economic Development
regarding the application for a Right-of-Way Use Permit for
property requested by Joseph R. Morrier located at 301 East
Yakima Avenue, was accepted and approved.
*11. RESOLUTION AUTHORIZING ACCEPTANCE OF PROPOSAL FOR PUBLIC DEFENDER
SERVICES FOR 1984
RESOLUTION NO. D-4893, A RESOLUTION accepting the proposal of
Glen P. Warren, attorney at law, for public defender services
for the year 1984.
*12. RESOLUTION AUTHORIZING EXECUTION OF OFFICE RENTAL AGREEMENT FOR
CABLE COMMUNITY TV
RESOLUTION NO. D-4894, A RESOLUTION authorizing and directing
the City Manager and the City Clerk of the City of Yakima to
execute a lease agreement with the Yakima School District No.

*13. RESOLUTION AUTHORIZING EXTENSION OF INTER-FUND LOANS
RESOLUTION NO. D-4895, A RESOLUTION extending the date for re-
payment of various interfund loans.
*14. DISPOSITION OF DAMAGE CLAIMS
A. - 'RESOLUTION PAYMENT IN SETTLEMENT OF A DAMAGE CLAIM
SUBMITTED BY GLADYS MILLER
RESOLUTION NO. D-4896, A RESOLUTION authorizing the payment of
- $60.00 to Gladys Miller in settlement of a claim for damages
filed with the City of- Yakima.
B. RESOLUTION DENYING A DAMAGE CLAIM SUBMITTED BY NACE PATTERSON
RESOLUTION NO. D-4897, A RESOLUTION denying the claim of Nace
Patterson filed with the City of Yakima on December 7, 1983.
C. RESOLUTION DENYING A DAMAGE - CLAIM SUBMITTED BY VINEYARD
ENTERPRISES/MALCOM McKENZIE
RESOLUTION NO. D-4898, A RESOLUTION denying the claim of
Vineyard Enterprises filed with the City of Yakima on November
28, 1983.
*15. NOVEMBER BUDGET REPORT
The Revenue and Expenditure Report for November 1983 from the
Director of Finance & Budget, was accepted for filing.
*16. TREASURY REPORT FOR NOVEMBER 1983
The report from the Director of Finance and Budget dated
December 20, 1983, regarding the investments of the City of
- Yakima, was accepted and approved. - •
*17. APPROVAL OF AMENDED FINAL CONTRACT PAYMENT FOR SO. 48TH AVENUE
BRIDGE PROJECT
The report from the Director of Engineering and Utilities
dated December 20, 1983, with respect to the completion of the
- work on South 48th Avenue Bridge, performed by Lien-Ranger
Construction Co., was approved, the work accepted and payment
of the final estimates as therein set forth was authorized.
*18. OUT-OF-STATE TRAVEL FOR CAPTAIN WENTZ, POLICE DEPARTMENT
The out-of-state travel for Captain Anton Wentz, Detective
Division, to attend the 1984 FBI National Academy in Quantico,
Virginia, January 7-,March 24, 1984 at a cost of $700, was
approved.
*19. OUT-OF-STATE TRAVEL FOR DENNIS COVELL, DIRECTOR OF ENGINEEERING &'
UTILITIES
The out-of-state travel for Dennis Covell, Director of
Engineering and to attend a seminar sponsored by the
American Public Works Association in Sncwmass, Colorado, July
17-20, 1984, at a cost of $650, was approved.
*20. HEARING DATE SET FOR JANUARY 3, 1984 FOR A REZONE
January 3, 1984, was set as the date of hearing on the rezone
requested by Crescent' Convalescent Center, for property
located at 505 North 40th Avenue from R-1 to R-3.
*21. HEARING DATE SET FOR JANUARY 10, 1984 FOR A MAJOR MODIFICATION TO
PLANNED DEVELOPMENT
January 10, 1984 was set as the date of hearing for a Major
Modification an existing Planned Development request filed
by Anson Development Company for property located at 1715
South 3rd Avenue.

*22. ORDINANCE PERTAINING TO REGULATORY LICENSES
ORDINANCE NO. '2736, AN ORDINANCE relating to licenses and
business regulations; fixing license fees; amending Sections
and Subsections 5.11.030, 5.11.040(B), 5.11.050(B), 5.12.020,
5.18.020, 5.28.070, 5.30.020(A), 5.42.020, 5.46.030(A),
5.48.040, 5.48.080, 5.54.020, 5.62.030, 5.64.030, and
11.08.110 of the City of Yakima Municipal Code; and declaring
an emergency.

II/ Council member Doty expressed her concern regarding the
reclassification of the Department Assistant IV in the Housing
Services Center to Housing Loan Specialist, commenting that
this is a new item to the Council. She stated that in her
earlier discussion with Bob Weaver, Personnel Officer, she
learned that this pay range was set in a rather arbitrary
,fashion. She questioned if the City has to make up for all
those years at one time. Bob Weaver explained that when the
position was created, it was placed in the sane range as a
Department Assistant IV Simply because it was the closest
position the City had in comparison to the work that had to be
done. When staff began a review of the Department Assistant
system, staff found this is a unique position and it was not a
clerical position. He further commented there were two
different recommendations that were presented to the Civil
Service Ccmmission in November and December. Sheryl Smith,
Civil Service Secretary/Examiner, recommended at the November
3 Civil Service Commission meeting, a pay range of 10.5. At
that time, it was noted by the Union and Director of Community
& Econcmic Development that that range was low and there must
have been some factors overlooked in the reclassification
review. He stated that due to Mrs. Smith's pending leave of
absence, he talked to the individual and found some things
that changed the factoring formula. He commented he shares
Council member Doty's concerns, however, this is the first
time this position has had a formal review. Council member
Doty commented that in looking at the classification plan, she
agrees that the range of 10.5 is too low, but feels there are
other positions at the 12 and 12.5 range that are comparable
to this position. It was MOVED by Doty, seconded by Buchanan
to amend the ordinance, item 5, which provided for the
reclassification of the Department Assistant IV at the Housing
Services Center to Housing Loan Specialist, range 12, rather
than 13.0. Unanimously carried by voice vote. The question
was called for the vote on the Motion, as amended.
Unanimously carried by roll call vote.
II/ ORDINANCE NO. 2737, AN. ORDINANCE relating to City personnel;
adopting a classification and compensation plan for City
employees to be effective January 1, 1984; amending Section
2.20.100 and 2.20.110 of the City of Yakima Municipal Code.
*24. ORDINANCE IMPOSING REDUCTIONS IN WATER/SEWER UTILITY TAXES
ORDINANCE NO. 2738, AN ORDINANCE relating to public services
and utilities; imposing a water/sewer tax and refuse tax on
City-owned utilities and fixing the rates of tax; and amending
Sections 7.64.010 and 7.64.020 of the City of Yakima Municipal
ode.
25. ORDINANCE ADOPTING 1984 BUDGET
Ordinance No. 2739, having been read by title, it was MOVED by
Beauchamp, seconded by Buchanan that the ordinance be passed.
Council member Moore commented that he would vote against the
Motion to pass the ordinance because an equipment maintenance
fund has not been established and no provisions were made for
unfunded liabilities. He questioned if the interest from the

reserve fund created by the additional sales tax is being left
in that fund. City Manager Zais responded that the interest
earned in the FRS reserve, Which is an equivalent to the
$642,000 which would have been reserved from the additional
sales tax reserve, is being retained with those funds. He
further comMented that the Finance staff indicated there would
be a campTehensiVe report coming to the Council on unfunded
liabilities and financing alternatives. ' He stated that the
equipment rental fund is a part of that issue. Council member
Barnett expressed his concern about the rapid rise in
expenditures, as compared to the 1982 increase. Council
member Doty commented that during the budget wrap-up session,
she did ask Council if they would be interested in taking
_$100,000 out of the $646,000 reserve to begin some funding for
equipment replacement. Mayor Carmichael cammented that
Council does not have the total scope of the liability which
exists and was concerned that if $100,000 was reserved to
attempt to address unfunded liabilities, Council may have
thought the problem was taken care of for this year. Council
member Beauchamp pointed out that although money was not
specifically allocated for equipment replacement, it is
available in the Contingency Fund. The question was called
for a vote on the Motion. Carried by 6-1 roll call vote.
Moore voting nay.
ORDINANCE NO. 2739, AN ORDINANCE adopting a budget for the
City of Yakima, Washington, for the year 1984; and
appropriating funds for estimated expenditures.
*26. ORDINANCE AMENDING 1983 BUDGET, APPROPRIATING FUNDS IN THE URBAN
ARTERIAL BOARD AND PARKS FUND (First Reading)
An Ordinance appropriating funds in the Urban Arterial Board
and Parks Funds, .having been read by title only at this
meeting, was laid on the table for two weeks, or until January
3, 1984.
27. OTHER BUSINESS
Mayor Carmichael questioned if Council has any time conflicts
with the luncheon scheduled with the Utility Rate Advisory
Board members on January 17th.
