DECEMBER 11, 1984
STUDY SESSION
The City Council met in session on this date at 2:00 p.m. in the Council
ChaMbers of City Hall, Yakima, Washington. Council members present were
Mayor Clarence Barnett, Henry Beauchamp, Lynn Buchanan, Lynn Carmichael,
Shirley Doty, Jerry Foy and Jack Sparling.
1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Council member Doty commented that the Joint Board will be meeting
this Friday and Council has not yet appointed a new representative
to that Board. She stated she would like to see this done today so
the City Council will be represented at the meeting. She pointed
out that a regular designee and an alternate should be appointed to
attend these meetings which are held on the fourth Friday of the
month. None of the Council members were available to attend the
meeting on Friday, therefore, no appointments were made at this
time.
Council member Carmichael indicated she has received a memo from
the City Clerk's Office stating two vacancies need to be filled on
the Community Programming Advisory Committee. She indicated this
committee requires an ethnic balance and there are not enough
applicants to draw from to fill the positions, therefore, the City
Clerk was requested to advertise for additional applicants.
2. COUNCIL CANDIDATE INTERVIEWS
Mayor Barnett announced the Council candidates would be
interviewed during this portion of the meeting, and Council
will meet in Executive Session to make their selection. It
was requested by Mayor Barnett that the record indicate
Council member Doty will not be participating in the
interviews or the selection of the new Council member.
Candidates present were Patricia Berndt, Mark Needham and
Felipe Posada. Each candidate stated their reason for
desiring to serve as a Council member and responded to
questions from various Council members. Following the
interviews, it was MOVED by Foy, seconded by Buchanan, to move
into Executive Session for the purpose of discussing the
selection of the prospective Council member. Unanimously
carried by voice vote. The meeting reconvened at 3:10 p.m.,
at which time Mayor Barnett announced deliberations would
continue at the close of the Council meeting.
BUSINESS MEETING
3. ROLL CALL
At 3:15 p.m., the Council members commenced the regular
meeting, Mayor Barnett presiding, Council members Beauchamp,
Buchanan, Carmichael, Doty, Foy and Sparling and City Manager
Zais and City Attorney Andrews present on roll call.
4. INVOCATION
The Invocation was given by Council member Beauchaup.
5. CONSENT AGENDA
Mayor Barnett referred to the Items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
Council member Sparling requested that Item No. 9 be added to
the Consent Agenda. It was the general consensus of the
Council that the addition of Item No. 9, as requested, be
made. The City Clerk then read the Consent Agenda items,
including resolutions and ordinances by title. It was MOVED
by Carmichael, seconded by Foy, that the Consent Agenda, as
read, be passed. Unanimously carried by roll call vote.

6. CURRENT STUDY SESSION ITEMS
None
7. APPROVAL OF MINUTES
The minutes of the November 6, 1984 Council meeting were
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.
8. AUDIENCE PARTICIPATION

A. Presentation of Annual Report by Yakima Housing Authority
Bill Burris, Manager of the Yakima Housing Authority, and
Robert Villbrandt, chairman of the Housing Authority Board,
were present to show a slide presentation of the 217 units
under their ownership and 192 units of Section 8 Housing which
serves the entire Yakima County, of which, nine are within the
City. Mr. Villbrandt expressed his appreciation for the
opportunity to share with Council that the Housing Authority
has been able to accomplish. It was pointed out that sane of
the farm worker housing units are located in Granger and
Toppenish. The residents are required to meet the income
guidelines and are given instruction on the care and
maintenance of the housing units, and are monitored
periodically for compliance.
*9. REPORT FROM DEPARTMENT OF ODMMUNITY AND ECONOMIC DEVELOPMENT
REGARDING STATUS OF EASTSIDE ANNEXATION
The report from the Fred Stouder, Acting Director of Community
and Economic Development dated December 12, 1984 regarding the
status of the Eastside Annexation was approved.
10. REPORT FROM THE DEPARTMENT OF FINANCE & BUDGET REGARDING GENERAL
LIABILITY INSURANCE BIDS FOR SERVICE
Council member Buchanan requested to be excused for appearance
of fairness. John Hanson, Director of Finance & Budget, gave
a brief introductory statement and indicated that Glen
Williams of Conover and Joel Pearson of Fred S. James were
present to address this issue. Glen Williams, Conover
Insurance, made a brief statement regarding their response to
the request for proposals (RFP's) and answered questions
related to the RFP's. Joel Pearson, Fred S. James, presented
Council with a list of advantages contained in the James'
program which he reviewed. There was discussion regarding the
James' proposal and the material presented to Council and haw
it differs from the Conover proposal. Mayor Barnett
temporarily yielded the gavel to Assistant Mayor Doty from

3:50 p.m. to 3:52 p.m. In response to Jerry Foy's question
relating to the RFP's and the comment about the commission and
broker's fees, City Manager Zais stated those should be
segregated. The fee for Conover is $27,000 and James is
$24,570. Following further discussion, it was MOVED by
Beauchamp, seconded by Foy, for discussion purposes, to accept
staff's recommendation. Council member Doty stated she was
curious as to whether or not the reluctance on the part of
Council was due to the fact that additional material has been
presented to Council today. Council member Sparling requested
that he be allowed to abstain from voting due to a possible
conflict of interest, stating he has conducted business with
James in the past and is currently conducting negotiations
with Conover for insurance coverage. City Attorney Andrews
indicated this fact does not preclude Council member Sparling
from voting on this issue if he so desires. Council member
Sparling requested that he be allowed to abstain from voting

on the issue just the same. It was MOVED by Foy, seconded by
Beauchamp, that Council member Sparling be allowed to withdraw
from voting on this issue. Unanimously carried by voice vote.
Buchanan and Sparling abstaining. The question was called for
a vote on the original motion. Carried by 3-2 roll call vote.
Barnett and Carmichael voting nay. Buchanan and Sparling
abstaining.
*11. REPORT FROM THE DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT
REGARDING STATUS OF THE URBAN AREA ZONING ORDINANCE
The report from the Department of Community and Economic
Development, regarding the status of the Urban Area Plan,
dated December 11, 1984, was approved.
*12. CONSIDERATION OF RESOLUTION AUTHORIZING THE SUBMISSION OF URBAN
HOMESTEADING GRANT APPLICATION
RESOLUTION NO. D-5056, A RESOLUTION authorizing and directing
the City Manager of the City of Yakima to file an application
with the United States Department of Housing and Urban
Development for participation in an Urban Homesteading
Program.
*13. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH
AREA AGENCY ON AGING RELATING TO TRANSPORTATION OF THE FIDERLY
RESOLUTION NO. D-5057, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to
execute an agreement with Yakima County and People for People
relating to transporting senior citizens.
*14. APPROVAL OF RIGHT-OF-WAY PERMITS:
a. Property Located at 311 East "D" Streets, requested by Don
Hollingbery
The report fran the Department of Canmunity & Econanic
Development regarding the right use permit requested by
Don Hollingbery for property located at 311 East "D" Street,
was accepted and approved.
b. Pr..- located at 402 South 3rd Street, ested b
Drummins and Drummins
The report from the Department of Community & Economic
Development regarding the right-of-way use permit requested by
Drummins and Drummins for property located at 402 South 3rd
Street, was accepted and approved.
*15. APPROVAL OF OUT-OF-STATE TRAVEL
The out-of-state travel for David Harris, Bruce Hines and Ron
Roberts, Fire Department, to attend "Fire Service
Organizational Theory," Advanced Incident Canmand," and
Interpersonal Dynamics in Fire Service Organizations," in
Emmitsburg, Maryland, March 24 to April 6, 1985 at a total
cost of $396, was approved.
*16. APPROVAL OF FINAL CONTRACT PAYMENT FOR THE WALNUT STREET
RESURFACING PROJECT
The report from. the Director of Engineering and Utilities
dated December 11, 1984, with respect to the completion of the
work on Walnut Street Resurfacing, performed by Mid-ColuMbia
Paving, was approved, the work accepted and payment of the
final estimates as therein set forth was authorized.
*17. CONSIDERATION OF AN ORDINANCE AMENDING THE 1984 BUDGET AND
APPROPRIATING FUNDS FOR COMMUNICATIONS EQUIPMENT (Second Reading)
An ordinance appropriating funds for communications equipment
having been read by title only at the previous meeting, was
brought before the Council for a second reading.

ORDINANCE NO. 2825, AN ORDINANCE amending the 1984 budget for
the City of Yakima; and making an appropriation in the
332 -Fire Capital Fund for expenditure during 1984.
*18. CONSIDERATION OF AN ORDINANCE AMENDING ORDINANCE NO. 2819 VACATING
ALLEY RIGHT -OF -WAY IN THE VICINITY OF NORTH 9TH AVENUE AND
SUMMITVIEW, AS REQUESTED BY JOHN NOEL, JR.
ORDINANCE NO. 2826, AN ORDINANCE amending City of Yakima
Ordinance No. 2819, enacted November 27, 1984, and entitled
"An Ordinance providing for the vacation of a public alley in
the City of Yakima, Washington," and declaring an emergency.
19. OTHER BUSINESS

20. EXECUTIVE SESSION RE: COLLECTIVE BARGAINING AND DISPOSITION OF
PROPERTY
It was MOVED by Foy, seconded by Beauchamp, to move into
Executive Session for the purpose of discussing collective
bargaining and - personnel. Unanimously carried by voice vote.
Buchanan temporarily absent. -
Following the completion of the Executive Session, it was
MOVED by Beauchamp, seconded by Carmichael, to appoint Pat
Berndt as Council member to replace Shirley Doty in District
No. 1. Unanimously carried by voice vote. Doty abstaining.
21. ADJOUREVENT
Mayor Barnett announced for the record that Council members
will be meeting for dinner with sane of the staff members and
their spouses and this is strictly a social gathering.
There being no further business to come before the Council, it
was MOVED by Buchanan, seconded by Carmichael, that this
meeting be adjourned at the hour of 5:15 p.m. Unanimously
carried by voice vote.
