HomeMy WebLinkAbout09/11/1984 Study Session 7rs SEPTEMBER 11, 1984 STUDY SESSION The City Council met in session on this date at 2:00 p.m. in the Council Chambers of City Hall, Yakima, Washington. Council members present were Mayor Clarence Barnett, Lynn Buchanan, Lynn Carmichael, Shirley Doty and Jack Sparling. Council member Henry Beauchamp absent. 1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER None 2. CONSIDERATION OF PROPOSAL CALLING FOR SPECIAL ELECTION TO INCREASE PUBLIC WORKS BID LIMIT Mr. Covell, Director of Engineering and Utilities, stated staff is requesting the bid limit be increased from S5,000 to $10,000 for Public Works Improvements, and $15,000 for improvement of water main construc- tion, an issue which would be placed on the November ballot for the vote of the people. He noted several projects which have been completed by contractors that could have been performed by staff, thus saving the City several thousand dollars. He indicated a more recent example is the Fruitvale Canal Plank Crossing in which 21/ , of the contract cost (approxinutely $2,000) could have been saved if the project had been handled by City crews. He stated the total cost of the project was S9,500 and believes the City should have the flexibility to utilize City crews where it has the ability to do so. After further discussion, it was MOVED by Buchanan, seconded by Carmichael, to move this item down to the Business portion of the meeting to become Item No. 7a. Unanimously carried by voice vote. Beauchamp absent. 3. EXECUTIVE SESSION It was MOVED by Carmichael, seconded by Buchanan, to move into Executive Session for the purpose of discussing collective bargaining and pending litigation. Unanimously carried by voice vote. Beauchamp absent. BUSINESS MEETING 4. ROLL CALL At 3:00 p.m., the Council members commenced the regular meeting, Mayor Barnett presiding, Council members Buchanan, Carmichael, Doty and Sparling and City Manager Zais and City Attorney Andrews present on roll call. Council member Beauchamp absent and excused. 5. INVOCATION The Pledge of Allegiance was led by Mayor Barnett. 6. CONSENT AGENDA Mayor Barnett referred to the Items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Council member Buchanan requested that Item No. 7a be placed on the Consent Agenda. Mayor Barnett requested that Item No. 9 be removed from the Consent Agenda to allow citizens the opportunity to protest the Ordinance. It was the general consensus of the Council that the addition of Item No. 7a and the deletion of Item No. 9, as requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Buchanan, seconded by Carmichael, that the Consent Agenda, as read be passed. Unanimously carried by roll call vote. Beauchamp absent. (Subsequent paragraphs preceded by an asterisk (*) indicate items on the Consent Agenda handled under one motion without, further discussion.) SEPTEMBER 11, 1984 7. CURRENT STUDY SESSION ITEMS a. Item No. 2 The staff recommendation to authorize preparation of legislation to provide for the submittal to the voters of the City of Yakima at the General Election, a proposition as to whether Article VI, Section 6(A) of the Yakima City Charter shall be repealed, was accepted. 8. AUDIENCE PARTICIPATION Mike Mallinger, 205 South 69th Avenue, appeared before Council requesting the number of home owners required to sign an Outside Utility Agreement be reduced from 75% to 60% assessed valuation in order to initiate a Local Improvement District. He indicated he has been unsuccessful in an attempt to achieve the 75/ required signatures, and he is under the impression that this figure has been set by Council policy. Therefore, he is requesting Council take some action to change , this for the benefit of the home owners in the area desiring to connect to City sewer service. City Attorney Andrews stated he is unsure if this is a figure determined by state law or a percentage figure that has been recommended by City staff. He indicated he would investigate the matter and report back to Council at a later date. Mr. Mallinger stated he had received his information from the Planning and Engineering Departments and added that since the Urban Area Plan is soon to be signed, perhaps Council could take some action to expedite the matter and change the 75% requirement factor as well. Council member Carmichael stated the Urban Area Plan has been in process for some time now, and the City has made sure the main trunk lines have been made available for the West Valley area residents wishing to connect to City sewer service. She indicated at this point the City has no jurisdiction in the area in which he resides, but indicated Council is willing to work with him and the neighbors desiring City sewer service. Leonard Sherry, 204 South 69th Avenue, stated he and Mr. Mallinger have been working with Rita Germunson of the Engineering Department since early spring and have been unable to come up with the 75% of required signatures. He indicated there are two developers that have the majority of property in this particular area and both are currently unwilling to sign the Local Improvement District petition due to the annexation clause. Council member Doty suggested they exclude the Yakima Avenue and Chestnut Avenue area and attempt to work with 67th Avenue area instead. Mr'. Sherry stated this configuration was not his idea, it had been presented in this manner by the Engineering staff. Mr. Mallinger reiterated that as long as the possibility remains that the home owners will be annexed into the City, they will not be able to obtain 75% of the signatures required for the L.I.D. until the figure is reduced to at least 60% of home owners involved. No action was taken by Council on this issue. 9. CONSIDERATION OF A RESOLUTION AUTHORIZING ABATEMENT OF CERTAIN WEEDY LOTS Mayor Barnett indicated he requested this item be removed from the Consent Agenda to allow citizens an opportunity to address the Resolution. Resolution No. D -5012 having been read by title only by the City Clerk, and no one present wishing to address the issue, it was MOVED by Carmichael, seconded by Buchanan, that the Resolution be passed. Unanimously carried by roll call vote. Beauchamp absent. RESOLUTION NO. D -5012, A RESOLUTION authorizing the Code Administration Manager to clear certain weedy lots. *10. CONSIDERATION OF A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH CENTRAL WASHINGTON HUMANE SOCIETY RESOLUTION NO. D -5013, A RESOLUTION authorizing the execution of an Animal Control Agreement with the Central Washington Humane Society. *11. APPROVAL OF FINAL CONTRACT PAYMENT FOR FRUJTVALE CANAL COVERS PROJECT The report from the Director of Engineering and Utilities dated September 4, 1984, with respect to the completion of the work on the Fruitvale Canal Covers, performed by Stephens and Sons Construction, was approved, the work accepted and payment of the final estimates as therein set forth was authorized. 37 , 5 SEPTEMBER,11 ' 1984 *12. SET DATE OF HEARING ON A MAJOR MODIFICATION TO AN EXISTING PLANNED DEVELOPMENT REQUESTED BY FIDDLESTICKS, FOR PROPERTY LOCATED AT 208 NORTH 16th AVENUE, FOR SEPTEMBER 25, 1984. September 25, 1984 was set as the date of hearing for consideration-Of a Major Modification to an Existing Planned Development located at 208 North 16th Avenue. *13. APPROVAL OF OUT-OF-STATE TRAVEL FOR ED CARROLL, FIRE CHIEF The out-of-state travel for Ed Carroll, Fire Chief, to attend the 1984 International Fire Chief's Conference in Los Angeles, CA, September 29th through.October 5, 1984 at a cost of $125, was approved. *14. CONSIDERATION OF AN ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION PLAN FOR CITY EMPLOYEES ORDINANCE NO. 2803, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective October 13, 1984; amending Sections 2.20.100• and 2.20.110 of the City of Yakima Municipal Code. 15. OTHER BUSINESS City Manager reminded Council that the Study Session would begin at 1:00 p.m. next week and the entire session will be devoted to interviewing the Council candidates. ADJOURMENT There being no further business to come before Council, it was MOVED by Buchanan, seconded by Carmichael, that this meeting be adjourned at the hour of 3:45 p.m. Unanimously carried by voice xiote.
