STUDY SESSION
The City Council net in session on this date at 2:00 p.m. in the Council
Chambers of City Hall, Yakima, Washington. Council members present were
Mayor Clarence Barnett, Henry Beauchamp, Lynn Buchanan, Lynn Carmichael,
W. K. "Pete" Moore, and Jack Sparling. Council member Shirley Doty
absent and excused.
1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Barnett commented on the Association of Washington
Cities Convention, stating that past attendance was 400-500,
and this year it was close to 800 participants. He stated he
11/ felt special credit was due to Council member Carmichael for
the work she did in conjunction with the convention.
Council member Moore questioned what has happened with the
signalization at 1st Street and Yakima Avenue. Dennis Covell,
Director of Engineering and Utilities, stated they are waiting
for the controller to arrive for the project, which should be
anytime now.
Mayor Barnett requested to know when the next public meetings
for the Urban Area Plan are scheduled, and John Beer, Jr.,
Director of Community & Economic Development, stated the next
meetings are scheduled to be held on June 25th and 28th in the
County Courthouse, Room 420.
2. CONSIDERATION OF PROPOSED ALLOCATION OF UMTA FUNDING (Continued
from 6/5/84)
Council member Beauchamp stated he would like to see the
eit additicnal cinches purchased 'as had been previously discussed,
however, he questioned the need for enlarging the maintenance
facility. Council member Buchanan stated he has reservations
about the addition to the maintenance facility at $161 per
square foot when we have 24,000 square foot of garage that is
being used to store road equipment which should be stored
outside the facility. Bill Schultz, Transit Manager, stated
the idea is to allow for additional maintenance space, storage
of tires, welding, etc. He stated there is a lack of storage
space for parts for bus repair. City Manager Zais interjected
that over the past few years the use of the facility has
changed in that Traffic Engineering, Transit and most
recently, Parks & Recreation have relocated in the facility,
taking up much of the space that was previously used for
storage. In response to the question of why the road
equipment is being stored inside the facility, Fleet Manager,
Don Toney, explained that during the winter months the
hydraulic systems require inside storage to avoid damage to
these systems. After further discussion, it was MOVED by
II/ Buchanan, seconded by Carmichael, to move this item dawn on
the agenda to become Item No. 8a. Unanimously carried by
voice vote. Doty absent.
3. CONSIDERATION OF REQUEST FROM THE LEGAL DEPARTMENT FOR DISTRICT
COURT PROFESSIONAL SERVICES
City Attorney Andrews briefly reviewed a report that had been
submitted to Council approximately three weeks ago. City
Prosecutor, Robert Bounds, informed Council of the daily
schedule of the Legal Department and how the cases are
processed through the judicial system, stating they must be in
court every day from 1:30 p.m. to 3:00 p.m., and on occasion,
longer. In response to Council member Moore's question as to
the amount of money it costs the City to prosecute the cases,
City Manager Zais , explained it costs $104,000 annually to
prosecute the cases'. He stated filing fees and other expenses
amount to $201,000 and $50,000 for indigent defense. He
stated court cost reimbursement is $110,000. Revenues amount

to $100,000 in fines and $215,000 in forfeitures, so the City
is receiving income there. After further discussion, it was
MOVED by Moore, seconded by Carmichael to move this item down
on the agenda to become Item No. 8b. Unanimously carried by
voice vote. Doty absent.
4. EXECUTIVE SESSION RE: COLLECTIVE BARGAINING
It was MOVED by Moore, seconded by Sparling, to move into
Executive Session for the purpose of discussing collective
bargaining and pending litigation. Unanimously carried by
voice vote. Doty absent.
BUSINESS MEETING
5. ROLL CALL

At 3:00 p.m., the Council members commenced the regular
meeting, Mayor Barnett presiding, Council members Beauchamp,
Buchanan, Carmichael, Moore, Sparling and City Manager Zais
and City Attorney Andrews present on roll call. Council
member Doty absent and excused.
6. INVOCATION
The Invocation was given by City Attorney Andrews.
7. CONSENT AGENDA
Mayor Barnett referred to the Items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
Council member Moore requested that Items Nos. 11 and 13 be
added to the Consent Agenda. Council member Carmichael
requested that Item No. aD be added to the Consent Agenda. It
was the general consensus of the Council that the addition of
Items Nos. 8b, 11 and 12, as requested, be made. The City
Clerk then read the Consent Agenda items, including
resolutions and ordinances by title. It was MOVED by
Beauchamp, seconded by Carmichael, that the Consent Agenda, as
read, be passed. Unanimously carried by roll call vote. Doty
absent. (Subsequent paragraphs preceded by an asterisk (*)
indicate items on the Consent Agenda handled under one motion
without further discussion.)
8. CURRENT STUDY SESSION ITEMS
8a. CONSIDERATION OF PROPOSED ALLOCATION OF UMTA FUNDING
After further discussion regarding the transfer facility, it
was MOVED by Buchanan, seconded by Carmichael, to accept Phase
I and II for planning purposes. Carried by 4-2 voice vote.
Sparling and Moore voting nay. Doty absent.
*8b. CONSIDERATION OF REQUEST FOR LEGAL DEPARTMENT FOR DISTRICT
COURT PROFESSIONAL SERVICES
The report from the Legal Department, dated May 31, 1984,
regarding a request from the Legal Department to hire private
legal services, was approved.
9. AUDIENCE PARTICIPATION
None
10. HEARING ON MAJOR MODIFICATION TO AN EXISTING PLANNED DEVELOPMENT,
REQUESTED BY BAMBOO TERRACE
This being the time fixed for the hearing on a major
modification to the Bamboo T Planned Development, 54
West Nob Hill Blvd., Larry Wright, Assistant Director of

Community & Economic Development, stated the Planning
Commission had met and referred the issue back to City Council
for final disposition. He informed Council that the traffic
problem and the noise factor had previously been taken into
consideration by the Planning Commission when their original
decision had been made on this issue. Tom Culpepper, 5
Burning Tree Drive, the architect for the project, stated
everything possible would be done to resolve the problems
Council is presently concerned about at this time. Residents
of the neighborhood speaking in opposition to the project were
Vernon Cook, 1120 Rock Avenue, Louise Allision, 1114 Rock
Avenue, Victor Quigley, 1108 Rock Avenue and Wanda Streby of
1120 Rock Avenue. Their major complaints were unsightly
garbage, traffic congestion and the noise that would result
from having a live band in the lounge. Mr. Culpepper
reiterated the owner of the establishment, Kuie Wen, is most
willing to work with the neighbors, and do whatever is
required to minimize the traffic and noise level in the
neighborhood. Following further discussion and consideration
by Council, it was MOVED by Beauchamp, seconded by Carmichael,
to approve the recommendation of the Planning Commission.
Carried by 5-1 roll call vote. Barnett voting nay, stating he
had not been convinced that the traffic and noise problems had
been alleviated at this time. Doty absent.
*11. CONSIDERATION OF REQUEST FROM IRRIGATION DIVISION REGARDING
REALLOCATION OF MANPOWER AND UPGRADE OF POSITION
The report from the Department of Engineering and Utilities
regarding Irrigation Division Reallocation of Manpower, dated
June 19, 1984, was approved.
12. REPORT REGARDING CODE ENFORCEMENT MANAGEMENT (Continued from 6/5/84
and 5/22/84)
Lou Miller, President of Central Washington Homebuilders
Association, referred to a letter submitted previously to
Council, and stated he does not feel it is necessary for the
City to spend an additional $7,000 to give Council the same
information they have already obtained in the past. He added
he is not in favor of the fire inspections being placed under
the direction of the Fire Department. He spoke in support of
filling this position by promoting from within the department.
Bob Lewis, Cook-Lewis Construction, representing Yakima Valley
Construction Federation, stated he, too, is not. in favor of
placing the fire inspections under the direction of the Fire
Department. He stated the City currently has a person in an
acting capacity of the Code Manager position who did well on
the examinations for the position and does not feel there is a
need to search further. It was MOVED by Sparling, seconded by
More to defer action on this position until the pending law
suit is finally determined. Council member Buchanan stated it
seems we have been through this several years ago and feels we
should stand by the decision made at that time. Council
member Moore stated this motion does not contradict any action
taken in the past, rather, it simply defers further action at
this time. He stated it is tine we started trying to fill
positions from inside the department when possible. Council
member Beauchamp stated he sees no justification to delay the
selection, and the City Manager should be given an opportunity
to pursue a person to fill the position. Council member
Carmichael stated she would be voting against the motion as
she has not been shown any reason to delay. The question was
called for a vote on the motion. Failed by 3-3 voice vote.
Beauchamp, Buchanan and Carmichael voting nay. Doty absent.
13. REPORT ON AMBULANCE OaAMITTEE: PROPOSED ASSIGNMENT OUTLINE
The report from Tom Fieldstead, Deputy Fire Chief, dated June
13, 1984, outlining proposed committee assignments, was
approved.

*14. REPORT ON PROPOSED IMPLEMENTATION OF NO SMOKING REGULATIONS
The report from the Department of Community & Economic
Development, dated June 19, 1984, regarding the implementation
of no smoking regulations, was approved.
*15. RECONSIDERATION OF EXTENSION OF REAL ESTATE LISTING FOR CITY FIRE
TRAINING SITE PROPERTY
'The report from the Fire Department, dated June 19, 1984,
extending the real estate listing of the fire training site
property, was approved.
*16. APPROVAL OF OUT-OF-STATE TRAVEL:
a. The out-of-state travel for Ruth Felch, Housing Loan
II/
Specialist, to San Francisco, California, to attend a training
session, "Accounting for Block and Categorical Grants,
September 10-13, 1984, at a cost of $751, was approved.
b. The out-of-state travel for Dave Rhodes, Director of Public
hbrks, to attend a Train the Trainer Course, June 18-22, 1984,
in Emmitsburg, MD, at no cost to the City, was approved.
c. The out-of-state travel for Carl Wikman, Cable TV, to Denver,
CO, to attend the 1984 National Federation of Cable
Programmers Conference, July 19-21, 1984, at a cost of
$637.47, was approved.
*17. REPORTS FROM DEPARTMENT OF FINANCE & BUDGET:
a. Treasury report for May 1984
The report of the Director of Finance & Budget dated May 31,
1984, regarding the investments of the City of Yakima, was
accepted and approved.
b. May 1984 Budget Report
The May 1984 Budget Report was accepted and approved for
filing.
*18, SET DATE OF HEARINGS FOR JULY 10, 1984
a. Major Modification to an existing Planned Development,
requested by Mayer Corporation
July 10, 1984 was set as a date of hearing for a Major
Mbdification to an existing Planned Development, requested by
Mayer Corporation for property located in the 100 block of
North Naches Avenue.
b. Rezone request initiated by the Yakima Planning Commission
July 10, 1984 was set as the date of hearing for a rezone
II/
request initiated by the Planning Commission for property
located in the 900-1000 block of Naches Avenue, from R-3 to
M-1.
*19. CONSIDERATION OF AN ORDINANCE VACATING A PORTION OF EAST ARLINGTON
STREET, BETWEEN SOUTH FIRST STREET AND THE RAILROAD RIGHT-OF-WAY,
AS REQUESTED BY WEBB TRACDOR
ORDINANCE NO. 2778, AN ORDINANCE vacating a portion of East
Arlington Street in the City of Yakima, Washington.
*20. CONSIDERATION OF AN ORDINANCE REZONING PROPERTY LOCATED IN THE
VICINITY OF SOUTH NACHES AVENUE AND RAINIER STREET, AS REQUESTED BY
ASSOCIATED GROCERS
ORDINANCE NO. 2779, AN ORDINANCE accepting the recommendation
of the Planning Commission and rezoning property in the 900
Block of South Naches Avenue from R-3, Multiple-Family Zone to
M-1, Light Industrial Zone.

*21. CONSIDERATION OF AN ORDINANCE PROHIBITING PARKING ON SOUTH 40TH
AVENUE IN THE VICINITY OF MEADCW LANE TO WALNUT
ORDINANCE NO. 2780, AN ORDINANCE relating to traffic control;
prohibiting parking at all times on certain streets; and
amending Section 9.50.050 of the City of Yakima Municipal
Code.
*22. CONSIDERATION OF AN ORDINANCE AMENDING THE 1984 BUDGET (Second
Reading)
An Ordinance amending the 1984 Budget having been read by
title only at the previous meeting, was brought before the
Council for a second reading.
ORDINANCE NO. 2781, AN ORDINANCE amending the 1984 Budget for
the City of Yakima; and making an appropriation in the
477 - Domestic - Water Improvement Fund for expenditure during
1984.
*23. CONSIDERATION OF AN ORDINANCE AMENDING THE 1984 BUDGET (First
Reading)
An ordinance amending the 1984 Budget for the City of Yakima;
and making an appropriation in the 1962 G.O. Street Bond
Redemption Fund No. 281 having been read by title only at this
neeting, was laid on the table for one week or until June 26,
1984.
24. OTHER BUSINESS
City Manager Zais reported that Dennis Covell, Director of
Engineering & Utilities, had received a contract from the
Department of Ecology to accept their grant authorization for
the Irrigation Diversion Dam. He stated there is a desire to
expedite the signing of the contract as soon as possible and
encouraged Council to endorse the resolution presented today.
Resolution No. D-4965 having been read by title, it was MOVED
by Carmichael, seconded by Buchanan that the Resolution be
adopted. Unanimously carried by voice vote. Doty absent.
RESOLUTION NO. D-4965, A RESOLUTION authorizing the execution
of a contract with the State of Washington, Department of
Ecology, accepting a grant for irrigation diversion dam
rehabilitation.

Council member Buchanan reported that as a result of the
Association of Washington Cities Convention held in Yakima
last week, Council member Carmichael was re-elected to the
Board of the Association of Washington Cities, and she has the
opportunity to be elected as secretary of that Board. Council
member Buchanan indicated that in order for Council member
Carmichael to do so, Council would -have to be willing to
support her in that position and be willing to send her to the
National League of Cities Conference. He indicated Council
needs to make a decision whether or not they would be willing
to do this. Mayor Barnett indicated Council should support
the necessary travel in the event Council member Carmichael is
successful in this attempt. It was MOVED by Moore, seconded
by Sparling, that the Council support Council member
Carmichael for the position of secretary, with the
understanding that it would entail her travel to the National
Teague of Cities Conference, and ask the Mayor to draft a
letter to the Association of Washington Cities, representing
the entire Council, supporting her for this office. The
question was called for a vote on the motion. Unanimously
carried by voice vote. Doty absent.

Council member Sparling questioned the status of the Gleed
water project. City Manager Zais indicated it would be awhile
because Council authorized the engineering work to begin on
that project, and that, in itself, will take some time to
completed by CH2M-Hill.
City Manager Zais reported he had received a letter from Cecil
Collins, Director of Southeast Community Center, inviting
Council to meet at the Center on July 31st. It was the
general consensus of the Council that the Council members
would check their calendars and get back to the City Manager
with an answer as to whether or not they would be able to
attend a meeting on July 31, 1984.
