STUDY SESSION
The City Council net in session on this date at 2:00 p.m. in the Council
Chanters of City Hall, Yakima, Washington. Council members present were
Mayor Lynn Carmidhael, Clarence Barnett, Henry Beauchamp, Lynn Buchanan
and Shirley Doty. Council members W. K. "Pete" Moore and Jack Sperling
absent.
1. OPEN DISCUSSION FOR THE GOOD CF THE ORDER
Council member Doty informed Council she had attended a
meeting of the advocates of the mentally ill, wherein the
group expressed their appreciation of the supportive
relationship the Police Department has extended to then. She
stated the group's meeting will be November 10 at Yakima
Valley Memorial Hospital and informed staff the support group
encouraged Police Department members to attend.
Mayor Carmichael informed Council she had received a thank you
letter from Mrs. Henry Jackson expressing her appreciation of
Council's action at the September 6, 1983 meeting wherein the
Council passed Resolution No. D-4853, a resolution in
remembrance of Senator Henry Jackson.
Mayor Carmidhael informed Council she had received a request
from Mary Williams, Greenway Foundation, for Council
representation at the October 25, 1983 Bicycle Pathway
Dedication and questioned if any Council member would be able
to attend.
Mayor Carmichael referred to a letter Council members received
fran the Central Washington Home Builders Association
regarding the ordinance passed last week pertaining to street
cuts. Council member Barnett cam he had written a memo
to Council which will be included in next week's Council
packet.
2. PRESENTATION FIM THE COMMUNITY PROGRAMMING ADVISORY COMMITTEE
REGARDING COMMUNITY TV PLAN
Linda Dobbs, Chairperson of the Community Programming Advisory
Camnittee, provided an overview of the 1983 Yakima Comnunity
Television Plan, highlighting the major accomplishments and
future goals of the canmittee. Council member Barnett
requested clarification of the Cannunity Television's
operating expenses. Bruce Crest, Cable Communications
Coordinator, responded, informing Council staff has attempted
to use the reserve funds for purchasing equipaent. He
cannented it is their goal for 1984 to operate within the
revenue received from the cable operators. Council member
Beauchamp requested clarification of the Committee's 1984
goals. Bruce Crest stated the Committee hoped to provide an
access to a TV channel for the public and, therefore, give the
public a voice in the community. Council member Beauchamp
questioned if there were guidelines established for the
programmers once they have completed the necessary courses
involved. Bruce Crest responded affirmatively, informing
Council staff served in a facilitator capacity only and
encouraged the public to express their creativity in the
programming area. Council member Doty relayed a compliment
which was brought to her attention regarding the excellent
working relationships Which exists among the Committee, staff
and citizens. Referring to the 1984 Budget process, Council
matter Barnett requested Bruce Crest to separate capital
outlay expenses fran operating expenses. It was MOVED by
Buchanan, seconded by Doty to approve the 1983 Community
Television Plan, Committee report and recommendations with
Council's appreciation. Unanimously carried by voice vote.
Moore and Sparling absent. Craig Ackerson, McCaw Cablevision,
complimented staff and the Committee's accomplishments and
expressed his approval of the Council action taken today.

3. EXECUTIVE SESSION
It was MOVED by Barnett, seconded by Beauchamp to move into
Executive Session for the purpose of discussing collective
bargaining and current litigation. Unanimously carried by
voice vote. More and Sperling absent.
BUSINESS MEETING
4. ROLL CALL
At 3 :00 p.m., the Council members commenced the regular
meeting, Mayor Carmichael presiding, Council members Barnett,
Beaudlanp, Buchanan and Doty and City Manager Zais and City
Attorney Andrews present on roll call. Moore and Sparling
Absent and excused.
5. INVOCATION
The Invocation was given by City Manager Zais.
6. CONSENT AGENDA
Mayor Carmichael referred to the items placed on the Consent
Agenda, questioning Whether there were any additions or
deletions from either Council members or citizens present.
Council member Doty requested to add Item No. 11 to the
Consent Agenda, however, Council member Barnett indicated he
had a question on that item. The City Clerk then read the
Consent Agenda items, including resolutions and ordinances by
title. It was MOVED by Barnett, seconded by Doty that the
Consent Agenda, as read, be passed. Unanimously carried by
roll call vote. Moore and Sparling absent. Council member
Beaudiamp questioned if taxi cab deregulation was included in
Item No. 20. City Attorney Andrews responded negatively.
7. CURRENT STUDY SESSION ITEMS
None
*8. MINUTES -
The Council minutes of October 4, 1983 were approved, having
been duly certified accurate by two Council members and no one
present wishing to have said minutes read publicly.
9. AUDIENCE PARTICIPATION
Randy Brawn, 303 N. 61st Avenue, informed Council he was
present today representing local businessmen who are donating
$200 worth of fireworks for the Eisenhower High School's
Homecoming football game. He informed Council of an aerial
fireworks display which is being planned for half -time at the
football game and requested Council waive the $50 fireworks
fee the City now charges. He reiterated this was a non profit
effort in that he and local businessmen are donating their
money to provide the fireworks display. Council member
Beauchamp requested clarification of the proposed event. Mr.
Brawn responded to Council's questions. It was MOVED by
Barnett, seconded by Buchanan to waive the City's $50 fee for
the purchase of Eisenhower's fireworks display permit. City
Manager Zais demented if Council determined the fee should be
waived for future non-profit events, it would be appropriate
to amend the ordinance. It was the general consensus of the
Council to address amending the ordinance if the sane type of
request is repeated in the future. The question was called
for a vote on the motion. Unanimously carried by voice vote.
Moore and Sparling absent.
Mayor Carmichael informed Council Teri Norman, Community
Relations Director for Goodwill Industries, was present in the
audience, and informed Council Goodwill Industries is
celebrating their 30th Anniversary. Mayor Carmidzael
proclaimed October 9 -15, 1983 as Goodwill Industries Week in

the City of Yakima and presented the proclamation to Terry
Norman. Ms. Norman informed Council of the On House at
• Goodwill on Friday, Ocraber 21 fran 10:00 a.m. to 2:00 p.m.
and of the 3rd Annual Goodwill Halloween Costume Fashion Show
at 5:00 p.m. at the Towne Plaza. She expressed her
appreciation for the community support Goodwill Industries has
received.
10. REPORT ON DATA PROCESSING HARDWARE NEEDS (Continued fran 10/11/83)
Council member Barnett requested clarification of the proposed
purchase reduction of $4,700. Rick Pettyjohn, Informa-
tion - System Manager, responded to Council's questions.
Council, member Doty addressed the life expectancy of the
proposed equipment. Tarry Wittenberg, Assistant City Manager,
informed Council the equipment tends to become absolete due to
new technology rather than wear out. He commented computer
equipment may became old in three to five years, however the
proposed equipment would be compatible with an upgrade in the
Prime Computer line and, therefore, the City would be
utilizing the equipnent more than three years. Council member
Barnett questioned when the proposed computer equipment would
be paid off. Rick Pettyjohn responded, infoLning Council it
would be paid within approximately two and one-half years with
an annual savings of $31,404; Discussion followed regarding
the various funds Which were available to fund the purdhase of
the proposed computer equipment. It was MOVED by Doty,
seconded by Budhanan to accept staff's recommendation,
utilizing the amount budgeted for 1984 towards the purdhase
price, with payment for the remainder of the equipment to cane
from 1984 Federal Revenue Sharing funds. Unanimously carried
by voice vote. Moore and Sparling absent.
11. STATUS REPORT REGARDING YAKIMA AVENUE AND FIRST STREET LEFT TURN
SIGNAL EXPERIMENT
Mayor Carmichael requested clarification of staff's report
regarding the outcome of the signal experiment at the
intersection of First Street and Yakima Avenue. Hank Hein,
Supervising Traffic Engineer, expanded upon the responses
received from the various individuals staff contacted. He
commented the general responses received indicated the
intersection seems to be working wel4 there seems to be less
noise and more cars are able to get through the intersection,
although one individual had suggested installing an
eight-phase actuated signal at that intersection. Captain
Harvey Qualley reported on the collision history at that
intersection and informed Council since the initiation of the
experiment six weeks ago, there have been three accidents,
however, only one accident can be attributed to the revised
signal. He commented the Traffic Officers believe the revised
signal is working well. Mayor Carmichael addressed the number
of citizens who have called her expressing their concerns
regarding the revised signal and commented there were a number
of individuals Who were going through the red light when
making left turns and it seemed the police were ignoring this
practice. Council member Barnett indicated he had polled 27
people of which nine people indicated they liked the revised
signal, 16 did not like the change and two did not commit
themselves. He stated for this reason, he would like to see
the test period extended through the winter months.
Responding to Mayor Carmichael's. concerns, Captain Qualley
commented that once a vehicle enters the intersection on a
yellow light, they are allowed to complete the turn. City
Manager Zais relayed Council member Moore's opinion that
although he indicated he would like a decision made on this
iten, he could agree to an extended test period. He further
questioned the importance of signal synchronization on Yakima
Avenue. It was MOVED by Barnett, .seconded by Beauchamp to
extend the test period of the revised signal at First Street
and Yakima Avenue for an additional three months, to then have
it brought back to Council. Unanimously carried by voice
vote. Moore and Sparling absent.

*12. RESOLUTION OF INTENTION TO CREATE A LOCAL IMPROVEMENT DISTRICT FOR
SEVER SERVICE TO ZIER ROAD (Set date of hearing for November 22,
1983)
RESOLUTION NO. D-4870, A RESOLUTION of intention to create a
local improvement district.
*13. APPROVAL OF FINAL ODNTRACT PAYMENT FOR THE STREET AND AREA LIGHT
CONVERSION PROJECT -
The report from the Director of Engineering and Utilities
dated October 18, 1983, with respect to the completion of the
Inork on the Street and Area Light Conversion project,
performed by Power City Electric, was approved, the work
accepted' and payment of the final estimates as therein set
forth was authorized.
*14. APPROVAL OF FINAL ODNTRACT PAYMENT FOR 'CITY SHOPS PARTITION PROJECT
The report from the Director of Engineering and Utilities
dated October 18, 1983, with respect to the completion of the
work on the Portable Office Partitions project, performed by
Barclay Dean, Inc., was approved, the work accepted and
payment of the final estimates as therein set forth was
authorized.
*15. TREASURY REPORT FOR SEPTEMBER, 1983
The report from the Director of Finance and Budget dated
October 18, 1983, regarding the investments of the City of
Yakima, was accepted and approved.
*16. RESOLUTION APPROVING THE PRELIMINARY PLAT FOR GLEN PARK WEST, 51ST
AVENUE AND WEST CHESTNUT
RESOLUTION NO. D-4871, A RESOLUTION approving the plat of Glen
Park West, Phases 1, II and III.
*17. ORDINANCE REZONING PROPER!? AT 51ST AVENUE AND' WEST CHESTNUT, AS
REQUESTED BY PROFESSIONAL INVESTORS, INC.
ORDINANCE NO. 2723, AN ORDINANCE accepting the recommendation
of the Planning Commission and rezoning property located at
50th and 51st Avenues between and' Chestnut Avenues
from R-1, One-Family Zone to R-2, 'No-Family Zone.
*18. ORDINANCE AMENDING THE 1983 BUDGET FOR THE CITY CF YAKIMA (Second
Reading)
An. Ordinance making an appropriation in the General Fund
having been read - by title only at the previous meeting, les
brought before the for a second reading.
II/ ORDINANCE NO. 2724, AN ORDINANCE amending the 1983 Budget for
the City of Yakima; and making an appropriation in the General
Fund for expenditure during 1983.
*19. ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION PLAN FOR
' crri EMPLOYEES .
ORDINANCE NO. 2725, AN ORDINANCE relating to City personnel;
adopting a classification and compensation plan for City
employees to be effective November 19, 1983; amending Section
2.20.100 and 2.20.110 of the City of Yakima Municipal Code.
' *20. ORDINANCE AMENDING TITLE 5 OF THE YAKIMA MUNICIPAL ODDE, REPEALING
VARIOUS AND SECTIONS REGALING LICENSES AND BUSINESS
RBGULATIONS
ORDINANCE NO. 2726, AN ORDINANCE relating to licenses and
business regulations; and repealing Chapters 5.02, 5.16, 5.22,
5.34, 5.38, 5.44, 5.66, 5.74 and 5.86, all of the City of
Yakima Municipal Code.

21. OTHER BUSINESS
Council member Beauchamp requested clarification of Item No.
20, an ordinance amending Title 5 of the Yakima Municipal
Code. He expressed his opinion that he Was in apposition to
repealing the portion of the Municipal Code, Chapter 5.34,
Fortunetelling, as he felt, this type of business was against
the teachings of the Bible. City Attorney Andrews explained
the State had repealed the criminal provision against
Fortunetelling and, therefore, staff was recommending
reconsideration of the City's ordinance in an effort to keep
in line with State law. It was MOVED by Beauchdup, seconded
by Buchanan to bring this ordinance back for discussion by the
full Council. , ,Failed by 2-2 voice vote. Doty and Carmichael
voting nay. Barnett temporarily absent. More and Sparling
absent
Mayor Carmichael presented a Service Award to City Manager
Zais in recognition of eight years of service to the City of
Yakima.
Referring to the vacancy on the Yakima Center Advisory
Committee, it was MOVED by Buchanan, seconded by Barnett to
appoint John Rogers to the Yakima Center Advisory Committee,
replacing the vacancy created by Greg Tcdd. Unanimously
carried by voice vote. Moore and Sparling absent.
Council member Doty informed Council of the Conference of
Governments (COG) meeting, Wednesday night, October 19, in
Zillah at which time they will he presenting their budget.

Nicholas J. Ziegler to the Editor of the Herald-Republic
regarding code deficiencies at the Capitol Theatre 10/11/83;
letter from Linda Martin regarding parking problen by downtown

Assistant Secretary for Economic Development regarding
notification of denial of Jobs Act application 9/16/83;

It was MOVED by Buchanan, seconded by Doty to move into
Executive Session for the purpose of discussing collective
bargaining and then immediately adjourn the meeting.
Unanimously carried by voice vote. Moore and Sparling absent.
22. ADJOURNMENT
Following the completion of the Executive Session, the meeting
was adjourned at the hour of 4:40 p.m.
